D. 19 82there were present: Eugene Drinkhouse , Commissioner Chairman Protem _ Larry Velasquez , Commissioner , Commissioner , County Attorney , Clerk of the Board when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 82-97 A RESOLUTION CONCERNED WITH THE APPROVAL OF A CONDITIONAL USE PERMIT APPLICATION BY COORS ENERGY COMPANY. WHEREAS, the Board of County Commissioners of Garfield County has received an application from Coors Energy Company for a conditional use permit for extraction of natural resources, specifically, two natural gas wells on the following described tract of land: NWS Section 1, Township 8 South, Range 98 West: Coors USA 1-1 LW and NWS Section 12, Township 8 South, Range 98 West: Coors USA 1-12 LW WHEREAS, the Board has considered the recommendation of the Garfield County Planning Director that a public hearing is not necessary upon the question of whether the above described conditional use permit should be granted or denied; and WHEREAS, the Board, on the basis of the said recommendation has made the following determinations of fact: 1. The proposed use is compatible with the uses existing and permitted in the district in which it is to be located, (provided Lhat certain hereinafter contained conditions be complied with.) NOW, THEREFORE BE IT RESOLVED by the Commissioners of Garfield County, Colorado that a conditional use permit be and hereby is authorized permitting the use of the above described tract of land for extraction of natural resources; specifically, two natural gas wells upon tic, following specific conditions: 1. That the use of the tract of land comply with all present and future regulations of Garfield County relating to extraction of natural resources in the zone district in which the property is now or may later be located; 2. That all proposals of the application shall be considered conditions of approval unlesz stated otherwise by the Board; 3. The applicant and driller shall notify the Road and Bridge Department and Assessor's Office prior to moving a drilling rig across county roads and bridges; 4. The three temporary trailers allowed for on-site employee housing during drilling operations shall be removed immediately upon completion of drilling activities; 5. The applicant shall provide on-going maintenance to County Road 200 and the Mesa County Roan Creek Road under the supervision of the respective County Road Supervisors, and on an as -needed basis; 6. The applicant shall return County Road 200 and the Mesa County Roan Creek Road to i_heiriginal conditions upon completion of drilling activities; The applicant shall provide two separate bonds totalling $75,000 for compliance with cond ions No. 5 and 6. A bond for $15,000 shall be made to Garfield County for any road improvement requirements. A $60,000 bond to Mesa County shall cover any road improvements to the Roan Creek Road. These bonds shall be kept on file at the Garfield County Planning Department office, and shall be submitted prior to issuance of a Conditional Use Permit. The bond shall cover both Well #USA 1-1 LW and #USA 1-12 LW. 8. The applicant shall provide the Garfield County Planning Dep- ment with a copy of their Bureau of Land Management access permit prior to issuance of t ei. con.itional use permit.
