Followingthe Board's approval, this office will issue the Special Use permit io the applicant. lf theBoard's approval includes specific conditions of approval to be met, this office will not issuethe Official Special Use Permit certificate until the applicant has satisfied all conditions ofapproval. The Special Use Permit approval is not finalized until this office has issued theOfficial Special Use Permit certificate signed by the Chairman of the Board of CountyCommissioners.

GARFIELD COLTNTY (hereinafter COuNTli) and
(hereinafter APPLICANT) agree as follows:
1' APPLICANT has submined to coIrNTy an apprication for
(hereinafter, THE PROJECT).
2' APPLICANT understands and agrees that Garfield county Resolution No. gg-0g, as amended,establishes a fee schedule for each type of suMivision or land use review applications, and the guidetines for theadministration of the fee structwe.
3' APPLICANT and couNTY agree that because of the size, nature or scope of the proposedproject, it is not possible at this time to ascertain the full extent of ths costs involved in processing theapplication' APPLICANT agrees to make payment oith" Base Fee, established for the PROJECT, and tothereafter permit additional costs to be billei to APpLICANT. APPLICANT agrees to make additionalpayments upon notification by the cotrNTY when tbey arenecessary as costs are incurred.
4' The Base Fee shall be in addition to and exclusive of any cost for publication or cost of consultingservice determined necessary by the Board of county commissioners for the consideration of an appiication oradditional cotrNTY-$3{ time or expense not covered by the Base Fee. If actual recorded costs exceed theinitial Base Fee, qTlc-4ryT shall pay. additional billings to coLrNTy to reimburse the coI-INTy for theprocessing of the PROJECT mentioned above. T.his well shall be used in such a way as to cause no material injury to existing water rights. The issuance of the
permit does not assure the applicant tnat no jni_ury will o.ccur to airother vested water right or preclude another
owner of a vested water right from seeking relief in a civil court action'
The construction of this well shall be in compliance with the Water Well Construction Rules 2 CcR 402-2, unless
approval of a variance has been granted by the state Board of Examiners of water well construction and Pump
lnstallation Contractors in accordance with Rule 18.
Approved pursuant to cRs 37-92-602(3)(bxllxA) as the only well on a tract of land of 37 acres described as that
pbrtion ot ine rug %, sec. 11, Twp. z s'outti,'ing. 95 West, 6tn p.ut., Gar{ield county, more particularly described
on the attached exhibit A.
Approved for the use of an existing well, constructed as a monitoring and observation hole under file no. Ml-l-
28396.
The use of ground water from this well is limited to fire protection, orclinary household purposes inside up to 3
single famil/dwellings, the irrigation of not more than one (1) acre of home gardens and lawns and the watering
of domestic animals.
Tlre maximunr oumping rate shall not exceed 15 GPM.
The return flow from tl-re use of this well must be through an individual waste water disposal system of the
non-evaporative type where the water is returned to the same stream systenl in which the well is located'
This well shall be located not more than 2OO f'eet from the location specified on this permit.
This permit has been approved for a location of 1,850 feet from the east section line. You are hereby notified that
you have the right to appeal the issuance of this permit, by filing a written request with this office within sixty (60)
bays or the dat; of issuance, pursuant to the state Adrnirriitrative Procedures Act. (see section 244-1M through
