GENERAL PROJECT DESCRIPTION The appl icant is requesting a permit for an Accessory Dwelling Unit (ADU) on a 38.71 acre parcel located within the Rural zone district. As the property is over 4 acres, the ADU would be limited to 3000 square feet and would be required to meet all building code requirements. The property owner intends to replace an existing ADU that is not permitted with a new larger ADU. It is understood that the unit would be served by an individual well. The applicant will need to demonst rate adequate legal water (a well permit and augmentation plan, if applicable). A 4-hour pump test and water quality test are required, but may be done as a condition of approval (however, please submit any supporting information available). A review of the Division of Water Recourses records show that the well on the property may be only legally able to serve one dwelling unit. If this is the case, the well will need to b e re-permitted through the Division of Water Resources to legally serve 2 dwelling units. Regarding septic, it is understood that the existing Agricultural Exempt unit that is to be converted to an ADU already has its own septic system, which is to remain in place. The applicant will need to provide the Septic permit as well as an explanation as to the number of bedrooms the system built to serve and the number of bedrooms the unit will serve in the future. The property is shown to have an Aspen Valley land Trust (AVLT) Conservation Easement as well as bordered by Canyon Creek. The AVLT easement will need to be delineated on the site plan and the proposed building area will need to be outside the easement area or within an AVLT designated building area. The building area will also need to be designated farther than 35 feet from typical and ordinary high water mark. In addition, the topography of the property will need to be shown on the site plan in order to demonstrate that 1) the proposed building area does not have slopes exceeding 20% and 2) the building area has positive drainage. Demonstration of conformance to Section 7-107 and specifically Table 7-107, Roadway Design Standards, needs to be provided. Please respond to each of the items in the Roadway Design Standards Table (7-107) to show compliance with these parameters (ROW width, Lane width, Shoulder width, etc.). Note: most driveways fall into the Primitive/ Driveway category, however it appears that this driveway is shared with other properties, please identify which Average Daily Trip (ADT) category this access road may fall within with each dwelling unit accessing this driveway counting as 9.57 ADT. Please respond to the Standards as identified in Article 7: Standards, Division 1, 2 and 3 and for ADUs, Section 7-701 . These are the standards by which the application will be determined to be approved, approved with conditions or denied. A short response to these items ensures that 1) the applicant has read and understands the standards upon which a determination will be based, and 2) allows the applicant and staff to work through any possible issues early on in the application process. Upon review of Garfield County GIS, no geologic hazards have been identified on the property. 11. Bruce and Dayle Robinson() / Date: October 20, 2016 \ll/' We are owners of a property located at 1548 County Road 137, Glenwood Springs, Colorado consisting of approximately 39.5 acres, of which all but approximately 5 acres has been placed in a conservation easement with Aspen Valley Land Trust. We acquired our property jus~pver 20 years ago in June, 1996. The subject property includes our personal residence, a barn and a small log cabin. The log cabin has been the source of housing for the last 20 years for individuals who assist us from time to time with ranch chores. It is our desire to convert the cabin into an ADU and construct a small addition to the existing structure to enhance the living conditions for future tenants. The cabin has approximately 670 square feet of living space and a contemplated addition of approximately 300-350 square feet of living space with an attached new porch is planned. An architect has not yet been commissioned to develop the exact plans for the addition but will be done during the winter of 2016-17. We would like to have the ADU and building permit process finalized by May, 2016 to allow for a June, 2017 construction start. The site of all of the improvements on the property is situated outside of the boundaries of the conservation easement. Our house and cabin are serviced by one well which has provided a very sufficient water supply to both house and cabin over the 20 years we have lived here. Over the 20 years we have lived here, we have had to replace the pump only once and there have never been any issues with the supply or quality of water to house or cabin. The house and cabin have separate septic systems, the cabin's septic tank being a 750 gallon tank, sewage disposal permit# 1848 dated 11-21-90 and installed by Gibbeus Construction and inspected by Don Owens. There have been no issues with the operation of the septic system during the time we have owned the property, and it is routinely pumped every 2-3 years. I am happy to furnish you with soils reports (classification of soils, physical properties of soils, chemical properties of soils and soil features) wildlife habitat and rangeland productivity provided to us in 1996 upon our purchase of the property by the U.S. Department of Agriculture NRCS . Our property is zoned Rural. An ADU is permitted as an Administrative Land Use Change in this district. As demonstrated in the site plan, the location of the ADU will comply to all height restrictions and all setbacks, including the required 35 feet setback from the Ordinary High Water Mark. 7-102. The land use change is in general conformance with the Garfield County Comp Plan and complies with any intergovernmental agreements. 7-103. The land is compatible with adjacent land uses as well as the AVLT conservation easement agreements. (letter from AVLT is attached) 7-104. The property is supplied drinking water via a well/ permit included in the package. The property also has access to water rights via the Williams Canal Co. for irrigation purposes. 7-105. The ranch does not have a central water system nor a public sewer system. We utilize a well for our water and a septic system for our wastewater. Well permit and septic permit attached. 7-106. The property has the use of public utilities including electricity and phone. The ADU is served by electric and phone service. 7-107. There is a single shared chip and seal roadway that serves our property and my neighbor's property (Jim and Lisa Craig) and would be classified as a semi-primitive driveway and meets the requirements of this section. (serves 4 homes). The continuation of the shared driveway onto my property is flat, asphalted, approx. 200 feet long and would be classified as primitive/driveway serving 2 homes. This driveway meets the requirements of a primitive/driveway in this section of the code. 7-108. The property has no known natural or geologic hazards. 7-109. Adequate fire protection has been provided for this type of property. Division 2-General Resource Protection Standards: 7-201. The ADU will not impact the agricultural uses for this property. 7-202. The ADU will not impact the wildlife habitat areas for this property. 7-203. The high water setbacks for the ADU and property meets the requirements as defined in this standard . 7-204. The property has natural positive drainage and storm run-off. (see topo maps). This site does not require any treatment of storm water or ground water run-off. 7-205. The ADU does not affect the air quality or water quality of the property. 7-206. The ADU is not located in an area that is designated as a severe wildfire Hazard Area and the dwelling does not increase the likelihood of a wildfire. 7-207. The ADU is not located in an area designated as having natural or geologic hazards. 7-208. The ADU ls an existing structure and no reclamation is considered necessary. Division 3-Site Planning and Development Standards: 7-301. The ADU was constructed approximately 25 years ago and is properly designed to integrate well into the existing structures on the ranch. A contemplated renovation to the ADU to enlarge and improve it will add to the compatibility of the design with existing structures. 7-302. This property is for residential use and meets the requirements for ample off-street parking for residents of the ADU . 7-303. This property has grass front, side and backyard with trees to either side. This permit would be exempt from the landscaping standards of this section. 7-304. The lighting requirements of this standard are met for the ADU. 7-305. There is ample snow storage around the ADU to handle this section of the standard. 7-306. This is a residential property and this standard does not apply, although many walking trails exist on this property. Division 7-Additlonal Standards for Residential Uses: 7-701. The subject property consists of 39.158 acres and the ADU does not exceed the 3,000 square foot maximum. We will comply with all the applicable building codes and the ADU entrance has always been and will continue to be a separate entrance from the main living structure. 7-702. At this time no home office or business use is contemplated for this ADU . 7-703. This is a residential property, so any requirements regarding a manufactured home park does not apply. 7-704. Adjacent land use : All neighboring properties are residential acreage properties with some agricultural usage 2. Site features: The property has sloping topography and intersected on the westerly side by County Road 137 (Canyon Creek Road) and steep hillside above the county road. The property is bordered to the north and south by neighboring properties that contain residences. The property is bordered to the east by Canyon Creek. The vegetative cover is mainly grasses, cottonwoods and scrub oak native vegetation. There is no evidence of high ground water and the climate is very moderate with elevation that averages 6000 feet. 3. Soll characteristics: Soils report included in application 4. Geology and Hazard: No unusual geologic characteristics or hazards known. 5. Groundwater and Aquifer Recharge Areas: Buildings have existed on the property for 25 years and no incidence of any issues with ground water runoff or waste disposal have ever occurred. Excellent well at less than 100 feet depth with good recovery as indicated in the attached report by Aqua Tee, test performed in November, 2016. 6. Environmental Impacts: Existing structure on property requesting ADU designation. As such, there will be no impact on the flora and fauna. CLAY as a soil separate consists of mineral soil particles that are less than 0.002 millimeter in diaaeter. In this report, the estimated Qoist bulk density of each major soil horizon is expressed in grams per cubic centimeter of soil aaterial that is less than 2 millioeters in diameter. Bulk density data are used to compute shrink-s"ell potential, available water capacity, total pore space, and other soil properties. The aoist bulk density of a soil indicates the pore space available for water and roots. A bulk density of more than 1.6 can restrict water storage and root penetration. Koist bulk density is influenced by texture, kind of clay, content of organic aatter, and soil structure. PERMEABILITY refers to the ability of a soil to transmit water or air. The estimates indicate the rate of doMnward movement of water when the soil is saturated. They are based on soil characteristics observed in the field, particularly structure, porosity, and texture. Permeability is considered in the design of soil drainage systeas, septic tank absorption fields, and construction where the rate of water movement under saturated conditions affects behavior. AVAILABLE WATER CAPACITY refers to the quantity of water that the soil is capable of storing far use by plants. The capacity for water storage is given in inches of water per inch of soil for each major soil layer. The capacity varies, depending on soil properties that affect the retention of water and the depth of the root zone. The most i~portant properties are the content of organic matter, soil texture, bulk density, and soil structure.
