Smith , Commissioner Chairman Arnold L. Mackley Commissioner Elmer (Buckey) Arbaney , Commissioner Don DeFora , County Attorney Mildred Alsdorf , Clerk of the Board Chuck Deschenes , County Administrator when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 95-059 A RESOLUTION CONCERNED WITH THE APPROVAL OF A PRELIMINARY PLAN FOR SIERRA BLUFFS FILING #1 SUBDIVISION. WHEREAS, BARTON PORTER has filed an application with the Board of County Commissioners of Garfield County for approval of a Preliminary Plan for SIERRA BLUFFS FILING #1 Subdivision; WHEREAS, the Garfield County Planning Commission reviewed the Sierra Bluffs Filing #1 application and recommended approval to the Board of County Commissioners; WHEREAS, based on the material submitted by the applicant, the recommendation of the Planning Commission and the comments of the Garfield County Planning Department, this Board finds as follows: 1. That proper publication, public notice and posting was provided as required by law for the hearings before the Planning Commission and Board of County Commissioners. 2. That the hearings before the Planning Commission and Board of County Commissioners were extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that hearings. 3. That the Garfield County Planning Commission recommended approval of the Preliminary Plan. 4. That the proposed subdivision of land is in compliance with the recommendations set forth in the Comprehensive Plan for the unincorporated area of the County. 481784 B-949 P-411108/10/95 10:18A PG 2 OF 4 • S. That all data, surveys, analyses, studies, plans and designs as required by the State of Colorado and Garfield County have been submitted, reviewed, and found to meet all sound planning and engineering requirements of the Garfield County Subdivision Regulations. 6. That the proposed subdivision of land conforms to the Garfield County Zoning Resolution. 7. That for the above -stated and other reasons, the proposed subdivision is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. NOW, THEREFORE, BE IT RESOLVED that the Preliminary Plan of Sierra Bluffs Filing #1 Subdivision for what was known previously as Lot 10, Sierra Vista Subdivision in the unincorporated area of Garfield County, be approved with the following conditions: 1. That all representations of the applicant, either within the application or stated at the public hearings before the Planning Commission and the Board of County Commissioners shall be considered conditions of approval, unless stated otherwise by the Planning Commission and the Board of County Commissioners. 2. The Homeowner's Association shall be incorporated in accordance with Colorado Revised Statute requirements. The Homeowner's Association shall be responsible for well and road maintenance and snow removal. The articles of incorporation and restrictive covenants shall be reviewed by County Staff prior to the approval of a final plat. 3. The applicant shall prepare and submit a Subdivision Improvements Agreement (SIA} addressing all on-site improvements, prior to recording a Final Plat. 4. All new utilities shall be placed underground. 6. That all cut slopes created during construction shall be revegetated with native grasses using certified weed -free seed. The SIA shall include security for necessary revegetation. 7. The applicant shall pay $200 in school impact fees prior to approval of the final plat. 8. All roadways shall be designed and constructed m conformance with design standards set forth in the Subdivision Regulations and in place at the time of final plat. 9. Only one (1) dog will be allowed for each dwelling unit to protect adjacent agricultural uses. Kennels shall be required, and language ensuring compliance shall be enforced through the covenants. 10. No perimeter fencing shall be allowed, and fencing shall conform to DOW standards. 11. The following plat notes shall appear on the final plat: a. No open hearth solid fuel burning devices will be allowed within the Sierra Bluffs Filing #1; b. All dwelling units will be allowed an unrestricted number of natural-gas burning fireplaces or appliances. 481784 B-949 P-836 08/95 10:18A PG 3 OF 4 • c. All dwelling units will be allowed not more than one (1) new wood burning stove as defined by C.R.S. 25-7-401, et. seq. and the regulations promulgated thereunder. d. A site specific geotechnical report, prepared by a registered engineer licensed by the State of Colorado, is required for all structures, including sewage disposal systems, prior to the issuance of a building permit or an individual sewage disposal permit. e. Each lot will be restricted to a maximum of 7,260 sq. ft. of outside irrigation. f. Property owners in this subdivision will be required to participate in any road improvement district formed or pay road impact fees established in the future. 12. Prior to approval of a Final Plat, the applicant shall submit evidence, by a recorded easement, that access has been obtained through lot 15 of the Sierra Vista subdivision. 13. Weed control is the responsibility of the property owner. 14. Improvements of the Lot 15 access road and the road connecting it to C.R. 331 shall be included in the SIA. 15. The 25,000 gallon water storage tank will be shown as an easement, with access and maintenance easements for all water lines and the well, shown on the plat. 16. All deeds shall contain language prohibiting the further subdivision of any lot in the subdivision. 17. The recommendations of the Colorado State Forester wildfire prevention guidelines, specified by the pamphlet "Wildfire Protection in the Wildland Urban Interface" prepared by the Colorado State Forest Service (C.S.F.S. #143-691) shall be followed in the construction of all structures. The Architectural Committee will consider the guidelines in the most current wildfire publication by the Colorado State Forest Service when reviewing proposed structures. 18. The covenants shall include a limit of a maximum of 7,260 sq. ft. of outside irrigation on each lot. 19. The requirement for the looping of water system lines will not be required for this subdivision. Dated this 9th day of ATTEST: August , A.D. 19 95 .
