American Mr. Barton Porter 2571 County Road 314 New Castle, Colorado 81647 RE: Overhead Service, Lot 10, Filing 1, Sierra Bluffs Subdivision Dear Mr. Porter: We have completed a design and cost estimate for providing electric service to the above mentioned project. Our facilities will be installedas shown on the attached sketch. Holy Cross Electric estimates that the cost of construction will be as follows: Total estimated cost of overhead construction $7,500.00 Construction deposit (refundable) required before beginning work on the project $7,500.00 Less prepayment received (7,500.00) Additional payment required - 0 The above figures are only estimates. After the job has been completed, the actual cost of construction will be determined. Your construction deposit will be adjusted to reflect the actual cost by making a refund or further assessment.. Execution of this document constitutes agreement to pay any further assessment in a timely manner. Adjusted construction deposits are available for refund over a ten year period as specified by Holy Cross Electric's Line Extension Policy. The following conditions are hereby noted: 1. The undersigned agrees that if a ground frost condition exists at the time of power facility installation, Holy Cross Electric will provide the option of installing said facilities or deferring the installation until a later date when no frost is present in the ground. Should the undersigned decide to proceed with the installation notwithstanding frost conditions, such installation will be done with the actual additional frost charges incurred by Holy Cross Electric to be billed to and paid by the undersigned. These charges are in addition to any previous extension charges, and are not recoverable. Such charges will include, but not be limited to, large equipment required for trenching, hauling away spoils, hauling in backfill material, and extra labor charges. Such charges are due and payable within 30 days after billing. Should the decision be made to defer installation until there is no frost in the ground, rescheduling of installation will be done commensurate with other installation jobs that had been previously deferred. Notification of the approximate date of installation will be given by Holy Cross Electric as soon as practicable after frost conditions have ceased. 2. There is no provision in our estirnate for revegetation. Revegetation, if required, must be provided by parties other than Holy Cross Electric. 3. Secondary voltage available will be 120/240, single-phase. - 4. Secondary facilities shall be installed in accordance with National Electrical Code and Holy Cross Electric specifications. All meter locations must be approved. Any service over 200 amps or 240 volts must have prior written approval from Holy Cross Electric. 5. It shall be the consumer's responsibility to protect their electric equipment from temporary over voltage or under voltage situations resulting from causes beyond the control of Holy Cross Electric. 6. The above mentioned cost estimate does not include connect fees or meter deposits, if required. Arrangements for payment of these items and for scheduling the actual meter installation should be made through the local Holy Cross Electric office. Mr. Barton Porter February 13, 1996 Page Two 7. We attempt to complete all projects in a timely manner. However, highest priority is given to maintaining service to our existing consumers. This fact, along with inevitable construction delays, will not allow us to guarantee a project completion date. 8. All Holy Cross Electric rules and regulations will be followed. When Holy Cross Electric is in receipt of all necessary executed easements, other permits, if required, a completed "Request For Load Information" form and the signed original of this letter agreement (below), the job can be scheduled for construction.
