There is no language in the resolution that discusses Board allowance for a two year conditional approval to satisfy conditions, therefore Section 4-101 H.1. is applicable to the application. This code section provides an applicant with one year from the date of approval to satisfy the conditions and have a Land Use Change Permit issued. It is the issuance of the Land Use Change Permit that permits th~ use . Staff had been in contact with your authorized representative to inform them of both the pending and actual expiration of the approval. The only response we received was that they would check into it. No further information was submitted to the County. The attached resolution does contain a condition that discusses 'two years' however that condition, shown below, states that the upon issuance the Land Use Change permit will be valid for a period of two years. The Land Use Change permit has never been issued. 3. The Land Use Change permit shall be valid for a period of two (2) years from the date ofissuance, whereupon the permit shall expire if a public water supply or private (well) water supply is not provided for the processing facility. If the Applicant determines that provision of an alternate water source is not feasible then a request shall be made to the Board of County Commissioners to continue the water hauling scenario. The Land Use Code does provide an Applicant the opportunity to request an extension of the expired approval upon showing of extenuating circumstances and that the extension is in the public benefit. Please see Section 4-1011.4. for details on requesting an extension of the approval. It is important to note that Mr. Sack's conditional land use permit for animal processing (USDA) has expired, therefore any inspection of the access by the Fire District would not be relative to use of the property for a USDA Approved Animal Processing Facility. The land use permit was approved with conditions. The conditions need to be met prior to closing that permit out. Check with your consultants with the land use permit on completing these conditions. There is a building permit BLC0-07-14-3288 issued that has expired for converting the building in question from a wood shop to a slaughter house. Requesting a renewal and providing a schedule to complete the work is required. I believe a final inspection from the fire district, state electrical inspector and the county is all that needs to be done with the structure. Please note that there could be correction notices associated with these inspections that may generate a punch list of items for the structure that will need to be completed. The septic permit SEPT-09-14-3401 has also expired. A letter or email requesting it be renewed is required. Once again, a schedule to complete the work should be included. The designer of the system needs to inspect the system prior to the system being backfilled and provide us with a letter approving the installation of the system. We will also do an inspection once the system is backfilled. When all three of the above permits are completed, we can close out the file on this project.
