The review consisted of determining the occupancy classifications, the type of construction, the location on the property, allowable floor area and height and number of stories. Conformity with with the occupancy requirements in Sections 303 through 312, the Type of Construction requirements in Chapter 6 and exiting requirements in Chapter 10 was also checked. A review for Compliance with Chapter 11, Accessibility, was not conducted because this is not new construction. Deficiencies were found and are tabulated below. - 1. The separation floor/ceiling between the stalls (U-3) and the apartment above (R-3) must be a :1 hour floor/ceiling assembly. 2. The separation wall between the retail (M) and the apartment (R-3) must be a 1 hour wall assembly. 3. Natural ventilation in the retail area must be increased to 1/20th of the floor area or mechanical ventilation provided. The occupant load for the retail area is 18 and the occupant load for the apartment is 4. These two areas are serviced by one exit. Section 1003.1 allows an exception if the occupant load is less than 10. An additional exit will need to be added, or alternatively, the county may allow the owner to limit the occupancy load in order to comply with Section 1003.1. 5. The first floor restroom needs to be handicap accessible, and allow the office on the ground Boor to be used for the handicapped retail sales. 2. Leave the Retail Store on the second floor for all other sales. 3. Post an occupancy sign in the Store "Not to exceed 4:. 4. That six (6) is the maximum occupancy of the three (3) bedroom apartment. 5, Ten is the maximum to qualify the common (single) entry to the store and apartment. 6. Mechanical Ventilation would be required for the Retail Store. I would need a drawing of the lower floor handicap toilet, and the new handicap Sales Store. Mr. Weitzenkorn is an adjacent landowner who is concerned about both the residential development, riding stable and retail activities occurring at Crystal Springs Ranch. It is my understanding that Ms. Weiss used to operate her retail tack shop in Carbondale, but that the shop is now located on the Ranch property. Also my client believes that her horse operations may include a "riding stable" as defined by the County regulations. The A/A/RD zone district regulations do not authorize a riding stable or a retail tack shop as a use by right. Specifically, section 3.02.01 states the uses by 'right in this district are agricultural uses, including a ranch, "and customary accessory uses including buildings for shelter or enclosure of persons, animals or property employed in any of the above uses, [and] retail establishment[s] for sale of goods processed from raw materials produced on the lot." The retail tack shop is not a shelter or enclosure, nor are the goods sold there processed from raw materials produced on the lot. The express allowance of only one type of retail establishment suggests other types of retail uses are not customary accessory uses, and therefore are not uses by right. Also, since Section 3.02.03 states a riding stable and other "agriculture -related businesses" are special uses, one would expect a retail outlet for riding equipment --which is produced elsewhere --is at best a special use. More correctly, the retail tack shop should be prohibited, as it does riot meet the definition of "agriculture -related business." Further, any riding stable would require a special use permit. I would appreciate your investigating whether Ms. Weiss is in compliance with the County zoning regulations. I would also appreciate a letter outlining the County's findings, and copies of any permits, resolutions of approval or other documents related to these uses.
