Our client (Rocky Mountain Native Plants Company) has purchased Tracts 5, 6, 11, 12, 21, and 22 as shown on the Antlers Orchard Development Company's Plat #1, recorded in the office of the Clerk and Recorder, Garfield County, Colorado. Rocky Mountain Native Plants Company has made a substantial investment in the property, and would like to ensure the County of its intentions in the future to avoid any misunderstanding, as well as some form of written assurance regarding the allowed use interpretations within the A/R/RD zone district. The initial operation would be limited to "hoop houses," typical greenhouses and a small pre - manufactured office (building permit and associated background material attached).The purpose of the operation is the planting andharvesting of native plant material on the property to be used for wetlands mitigation and landscaping. The applicant does not intend on operating a commercial nursery operation. No plant material will be sold directly from the site. All plant material cultivated on the site will be removed and installed at potential job sites with no retail sales opportunity. The attached building permit is for a 12' x 40' pre -manufactured office building to house a telephone, office equipment and other material associated with the agricultural operation. At this time, plumbing facilities will be "roughed in", but the office will not be hooked up to a domestic water supply or Individual Sewage Disposal System (ISDS). The applicant will provide a portable toilet on site, and operated it in full compliance with applicable codes and requirements. It is the intent of the applicant to provide such water and sewer connections in the future, and a well permit and ISDS and plumbing permit application will follow when specific plans are finalized. I have spoken with Don Owens, Garfield County Chief Building Inspector, and he has confirmed that this approach is acceptable. The future operation would consist of a series of "hoop houses" and traditional green houses to promulgate native wetlands vegetation to be used in wetlands mitigation, landscaping, and riparian habitat improvements. Interpretation Section 2.02.015 of the Garfield County Zoning Resolution, 1984 as amended, reads as follows: Agriculture -Related Business: A business whose sole function is the provision of services or retail sales of products, agricultural in nature, as more fully defined under the definition of Agricultural Land. (A.81-145). Section 2.02.02 Garfield County Zoning Resolution, 1984 as amended, reads as follows: Agricultural Land: Any parcel of land presently being used for the primary purpose of obtaining a monetary profit by raising, harvesting and selling products of or by the feeding, breeding, management, and sale of or the products of livestock, poultry, fur -bearing animals, or honeybees, or for dairying and the sale of dairy products, or for any other agricultural or horticultural use of animal husbandry or any combination thereof Section 3.02.01 of the Garfield County Zoning Resolution, 1984 as amended, reads as follows: A/R/RD - Agricultural /Residential/Rural Density Uses, by Right: Agricultural including farms, garden, greenhouse, nursery, orchard„ ranch, small animal, farm for production of poultry, fish, fur -bearing or other small animals and customary accessory uses including buildings, for shelter or enclosure of persons, animals, or property employed in any of the above uses, retail establishment for sale of raw materials produced on the lot. The promulgation of native wetlands vegetation, either within a temporary or permanent structure, or outside of a structure on any lands zoned A/R/RD meets the definition of a use -by - right as described in the code, and requires no further land use approval other than required building permits for any structure not considered an "agricultural building", and thereby exempt from the requirement for a building permit. In addition, any office space associated with the agricultural business is allowed as a use -by -right, since it meets the definition of such use in the Zoning Resolution, as of the date of this letter. It is recognized that the proposed office use does require a building permit, and all documents required for a said permit are attached. Finally, employee dwellings units are allowed on the site as a use -by -right, assuming a legal and physically adequate water supply is available, that the structures meet required setbacks and lot coverage restrictions and a building permit is obtained. Finally, the number of structures, such as "hoop houses" and green houses, are only limited by the lot coverage restrictions and required setbacks, as well as the necessary well permits for Mr. Mark Bean June 8, 1998 Page 3 irrigation. If amendments occur to the A/R/RD zone district, the above-described uses in place and permitted at the time of the amendments would be considered "legally non -conforming and would be allowed to continue on the property until such uses cease.
