Pursuant to C. R. S.L973, 30-28-101, and the subdivisionregulations of Garfield County, Colorado, the undersigned RifIeProduction Credit Association respectfully petitions the Board ofCounty Commissioners of Garfield County, Colorado, to exempt by
re so lut ion the division of one tract of land containingapproximately 160 acres into two tracts of approximately 157acres, and one of approximately 3 acres.
The property to be severed is described as follows:
A tract of land located in the SW r-4 of Section 26,
and in the WLNW,4 of Section 35, Tp. 7 5., R. 92 W.,6th P.!1., more fully described as follows:
Beginning at the Northwest Corner of Section 35, Tp.7 S., R. 92 W. of the 6th Principal lvleridian, thenceN. 89 30r19" E. and along the Northerly line of saidSection 35, a distance of 13I8.60 feet, to the N. E.corner of the NW L/4 of the NW L/4 of said Section 35,a pipe with an aluminum cap properly marked for theN.E. corner of the NW l/4 of the NW L/4 of said Section35, the True Point of Beginning; thence N. 03 01'53"W. a distance of 32.76 feet, to a point on theSoutherly right-of-way line of County Road No. 331;thence N.37 14 | 37 " W. and along the Souther1yright-of-way line of said County Road No. 331, adistance of 109.78 feet; thence N. 55 L9,25' W. andalong the Southerly right-of-way line of said County

2. On April 20, L979, your

92 W., 6th P.M., plus that portion of the SW k of Section 26
tying Southerly and Westerly of County Road 331, minus the 3.00
acre tract described above. Your petitioner has now contracted
to sell the remaining portion of the Sw \ of Section 26, but
desires to retain title to the 3.00 acre property described
above. The 3.00 acre parcel described above is located Southerly
and Westerly of the County Road, and as indicated, the remaining
portion of the SW k of Section 26 is located Northerly and
Easterly of the County Road.
3. In support of this petition, the petitioner also submits
a map drawn to scale showing proposed lot subdivision and access
and a vic init,y ffidp, and fee in the amount of $50.
4. Domestic water for the property described above is
obtained from a well located Northerly of County Road 331. This
well has been in existence for some time, and when your
petitioner sells the remainder of the SW h, it intends to retain
an easement for the use of this well, together with sufficient
water rights from the well to provide for domestic use. The
property has been served for some time with a septic tank, and is
currently being served with natural gas and electricity.
