HomeMy WebLinkAbout2.0 Resolution 80-54STATE OF COLORADO County of Garfield l" At a.........SP.9,9i.a.1.........., ...meeting of the Board of County Commissioners for Garfield County, Colorado, Commissioner Chairman Commissioner Commissioner County Attorney when the forowins *J";;;:;;;;;;;;;;;;;;; '' ' crerk of the Board RESOLUTTON NO. 80.54 WHEREAS, Rifle Production Credit Association has petitionedthe Board of County Comm.i.tssioners of Garfield County, Colorado, for an exemption from th" aetinition of the terms "subdivision" and "subd.ivided 1and" under C.n.s. l-973, 30-28-101(10)(a)-(d), as amended, and the Subdivision Regulations of -Garfield County, Colorado, adopted January 2, 1979, Sections 2.02.21(d) and 3.02.01 for the divisionof a 474.50 acre tract described as follows: that parcel of Iand.as described in Document No. 290424 as filed in the office of theClerk and Recorder of Garfield County, Colorado into 2 tracts ofapproximately 3.0 and 421.50 acres eachT rncir€ or less, which proposeddivided tract is more particularly described as follows: Tract A: T]ne W 1/2 NW 1/4 Section 35, Township 7 South., R. 92 W.,6th Principal Merid.ian and also that portion of the SW L/4 SW L/4of Section 26, Township 7 5., R. 92 W., 6th P.M., lying Southerly and Westerly of County Road 331, containing 88 acres, more or 1ess, EXCEPT that portion thereof d.escribed as follows: Beginningat the Northwest Corner of Section 35, Tp. 7 S., R. 92 W. of the 6thPrincipal Meridian, thence N. 89 30'19" E. and along the Northerlyline of said Section 35, a distance of 1318.60 feet, to the N.E.corner of the NW 1/4 of the NW 1rl4 of said Section 35, a pipe withan aluminum cap properiy marked for the N.E. corner of the NW 1/4of the NW 1/4 of said Section 35, the True Point of Beginning; thenceN. 03 0Ir53" W. a distance of 32.76 feet, to a point of the Southerlyright-of-way line of County Road No. 331, a distance of 109.78 feet; thence N. 55 L9125" W. and. a1on9 the southerly right-of-way line ofsaid County Road No. 331, a distance of 61.06 feet; thence N. 7711'34" W. and along the Southerl-y right-of-way lj-ne of said. Countlz Road No. 331, a distance of 2L4.99 feet; thence S. 00 29'4L" E. adistance of 205.32 feet to a point on the Northerly boundary lineof said Section 35; said. point being a No. 5 rebar with a cap markedL.S. 10871; thence S. 00 29'41" 3. a distance of 249.0L feet; thenceN. 89 30119" 3., and paralleI to the Northerly line of the Nw 1/4of the NII 1/4 of said Section 35, a distance of 326.26 feet; thenceN. 00 29'41" W. 249.0L feet more or less to the Point of Aegj-nning.Containing 3.000 acres, more or Iess, The total property herein conveyed contains 85 acres, moreor less in the State of Colorado and County of Garfield; and WHEREAS, the Petitioner has demonstrated to the satj-sfactionof the Board of County Commissioners of Garfield County, Colorado,that the proposed division does not fa11 within the purposes ofPart 1, Article 28, Title 30, Colorado Revised Statutes 1973r &S amended, for the reason that the impact created is not large enoughto proceed through the subdivision review, and WHEREAS, the Petitioner has demonstrated to the satisfactionof the Board of County Commissioners of Garfield County, Colorad.o,that there is a reasonable probability of locating domestic wateron each of said tracts, that there is adequate ingress and egress to said tracts, that the location of septic tanks will be permitted by the Colorado Department of Health, that the requested divisionis not part of an existing or larger development and does not faIlwithin the general purposes and intent of the subdivision regulationsof the State of Colorado and the County of Garfield, and should, therefore, be exempted from the definition of the terms "subdivision"and "subdivided 1and" as set forth in C.R.S. 1973, 30-28-101(10) (a)-(d), as amended; NOW, THEREFORE, BE IT RESOLVED that the division of the above described tract rrArr from the above descri-bed 424.5 acre tract is hereby exempted from such definitions and said tract may be dividedinto tract "A", all as is more fu1Iy described above, and said dividedtract may be conveyed in the form of such smaller tracts withoutfurther compliance with the aforesaid subdivision statutes and regula-tions; provided, however, that this exemption j-s granted on the con-dition and with the express understanding and agreement of thePetitioner that no further exemptions be allowed on said tract rrArr and that a copy of the instrument or instruments of conveyance when recorded shalI be filed with this Resolution.
