The ADU will have a living area of 750sqft thus within the 1,500sqft maximum. The building site area is 27,387 sqft thus meeting the minimum lot size for an ADU. There were permits issued for both the addition built in 2001 and the Septic System which was engineered for it. The attached copies of the permits issued for 55 Mesa Ave demonstrate that the soils are appropriate for an addition on the property. The SWA water distribution network is the association who manages our neighborhood's tap access into the Town of Carbondale water. Currently, our home is on a City tap. However, there is a moratorium on additional water being supplied outside of city limits. There are no existing water taps available and there is not an option to add EQR to our existing tap. We have a legal well which is located on the property which we propose to use for our water source. The rights to this well are written in a decree on our deed. The current well has permit number 303994, which was issued by the Office of the State Engineer, Colorado Division of Water Resources. There will be a water test to determine adequate volume and quality of the water produced from the existing well on the property. Upon approval of this Land Use Application, with the exception of the Water Supply Plan, I will have the volume and quality of the well water tested. In a letter addressed to you and your wife dated April 15, 2002, from Kim Schlagel, County Planner, she instructed you to submit a 24" x 36" plat of the approved amendments to our office so that our C0Ul1ty Surveyor could verify location accuracy. To the best of my knowledge, the requested information has never been submitted. Technically, this process should have all been completed within 120 days of the BOCC approval. We are requesting a copy of the plat for review within the next 15 days or this approval will be null and void. Once the County Surveyor approves the amended plat for location accuracy, a mylar will then need to be drawn up, submitted to the Planning Office where we will submit to the County Surveyor for final review and signature and then set up on an agenda for the BOCC to sign. The mylar will be taken to the Clerk's Office for recording after the BOCC signs. A recording fee will need to be paid at that time as well. Secondly, no further building inspections will occur on your remodel until this issue is resolved. Please note that your last inspection on bui1ding permit number 8202 for remodel work at 55 Mesa Avenue was performed on November 5, 2002. A building permit is good for 180 days. Each time an inspection is performed and signed off it is extended another 180 days . Since your last inspection was done on November 5th the six months time period expired on May 5th. The Chief Building Official has agreed to extend your building permit for one month to complete the amended plat process. Your immediate attention in this matter is appreciated. In the online research it was suggested that we look in Schedule B of our Title Insurance to see if anyone has laid claim to these rights previous. After looking at the documents no entity has laid claim to the subsurface miTieral rights. We also called the title company to see if there was any information about the rights in their files and they were unable to find any conveyance of mineral right ownership. My deed search, as well as the record of mineral rights, with assistance by the Garfield County Clerk's office, did not find any record of Mineral Rights Ownership. I feel I have done my due diligence in the matter of locating the mineral rights owners. The zoning is Residential Urban requiring a minimum lot size of 15,000 square feet to qualify for an ADU (twice them minimum lot size required in the zone district). The ADU is limited in size to 1,500 square feet of finished floor area. Application will require all owners to sign the application for this proposed use. One person may be designated as the contact person authorized to act on behalf of the other owners. This will require a letter of authorization signed by all of the owners. A single family residence currently exists on the site which is served by public water from the Town of Carbondale. The Applicant proposes to provide water to the ADU via an existing well on the property due to the fact that the Town is not granting additional water to out-of-town properties. The Applicant will need to provide a "will not serve" letter from the Town otherwise the LUDC requires hook-up to a public supply if the site is within 400 feet of a public water supply. If the Town will not supply water then a valid well permit must be submitted demonstrating the legal allowance for use of the well. An OWTS manages wastewater on the site currently. The Applicant proposes to utilize excess capacity for the OWTS to serve the proposed one bedroom ADU. Adequate information will need to be provided, including existing permits, to demonstrate the ability to use the existing system. I IP age The Rockford Ditch runs through the site at the rear property line. The Applicant should contact the Ditch Company and obtain a letter regarding their review of whether the proposal will cause impact to the ditch. 1. A separate entrance to the Accessory Dwelling Unit is required.
