COMPLIANCE WITH GARFIELD COUNTY ZONING RESOLUTION OF 1978
Project Description
Ursa Operating Company (Ursa) is submitting a Special Use Permit application for Garfield
County’s consideration. This permit is only for that portion of the temporary surface line that is
within the Battlement Mesa Planned Unit Development (PUD) starting at the eastern boundary of
Parcel 2407-053-07-001 in the SE ¼ of the NE ¼ of Section 7, Township 7 South, Range 95 West
of the 6th PM and ending at the tie-in point to the Tompkins Pipeline on parcel 2407-081-00-152
in the SE ¼ of the NE ¼ of Section 8, Township 7 South, Range 95 West.
The B&V Temporary Water Pipeline (Pipeline) will carry recycled water between the B&V Well
Pad and the Tompkins Water Pipeline. Approximately 6,220 feet of the pipeline is located inside
the PUD, with the remaining portion of the pipeline located outside the PUD. The pipeline will start
in the NW ¼ of the SW ¼ of Section 7, Township 7 South, Range 95 West of the 6 th PM and
continue in a northeasterly direction toward North Battlement Parkway (County Road (CO) 300N)
where the pipeline will cross the Colorado River and continue in an easterly direction along the
Parkway to the tie-in point with the Tompkins Water Pipeline next to East Battlement Parkway
(CO 300E) in the SE ¼ of the NE ¼ of Section 8, Township 7 South, Range 95 West of the 6 th
PM. The total length is approximately two miles.
The first 1,890 feet from the B&V Well Pad to the Colorado River will be 6-inch welded steel pipe.
The next approximately 3,400 feet from the Colorado River to just before the Battlement Mesa
Golf Course Club House will be constructed of dual 4-inch FlexFlow pipes. The next
approximately 710 feet will transition back to the 6-inch welded steel pipe until just east of the
Battlement Mesa Golf Course maintenance road where it will transition to a 10-inch DR7 welded
high density polyethylene (HDPE) pipe for the remaining 4,577.55 feet to the tie-in point with the
Tompkins Pipeline. Table 1 shows specific data about the Pipeline.

Ursa needs this temporary surface line to move water between the B&V Well Pad and other areas
of the Battlement Mesa Field for recycling and reuse during completions operations. This line will
enable Ursa to reduce disturbance to the community by removing up to 150 water transport trucks
per day totaling 1,050 trucks per week over the anticipated 90-day completion period. It also will
allow Ursa to use less fresh water throughout their process thus conserving water. The Pipeline
is planned to be in place for no more than three years.
The Pipeline will be laid on the surface within a temporary easement on the parcels shown in
Table 3. The pipeline will cross roads either by use of existing bores or culverts within the Garfield
County Road and Bridge Right-of-Way (ROW). Calculations are included in Appendix 9-102.C
showing the capacity of culverts to accommodate the pipeline and the intended drainage through
the culverts.
The Pipeline easements consist generally of a 25-foot temporary easement with a 50-foot
temporary easement for construction. The Pipeline is generally located adjacent to property lines
and county road ROWs, but is not within the road ROWs except where it crosses roads. In some
locations, the pipeline will follow the natural topography of the area.
Operations of the Pipeline will include 24-hour personnel to observe, monitor, and record all water
movement between the B&V Well Pads and the Tompkins Pipeline. There will always be at least
one person on the sending and receiving ends of the line during water transfer activities. The
constant supervision reduces the potential risk of leaks and failures from occurring without being
noticed in a timely manner. Every barrel of water that is sent is accounted for at both ends of the
line. Pressures are monitored constantly and any change in pressure will result in immediate
action to troubleshoot the cause of the pressure change. Prior to putting the water line into use,
Ursa will conduct fresh water pressure testing to ensure the integrity of the line. All lines are tested
to 100% of anticipated operating pressure or higher.
When the Pipeline is not in use, it will be completely drained to eliminate the potential for freezing
during winter months and inadvertent releases at other times. Containment vessels will be
installed at low points to capture any liquids that may be released during pipeline drainage
procedures.

Cribbing or sandbags will be installed to support the pipeline in areas where there are dips in the
topography to maintain straight-line elevation changes as much as possible. Gate valves will be
installed at along the Pipeline to control flow and to isolate portions of the Pipeline when
necessary.
Manufacturer’s specifications and installation data for the FlexFlow portion of the Pipeline are
included in Appendix 9-102.C. The DR7 HDPE section of the Pipeline will be fuse-welded using
a fully enclosed machine about the size of a Bobcat. The pipe is fed into one end of the machine
and heat fused when a joint is encountered. Once the joint has cooled, the pipe is fed out the
other end of the machine. There are no open flames or activities occurring outside the machine.
Fire watches are not required for HDPE fusing.
The pipeline will be held in place with the use of anchor restraints located along the pipeline route
at 500 foot intervals and at all corners and bends. Anchor restraints may be sand bags, dirt piles,
or other anchors deemed appropriate during installation.
5.03 Conditional and Special Uses
5.03(1) Utilities
Utilities adequate to provide water and sanitation service are not required for the proposed
Pipeline.
5.03(2) Street Improvements
Street improvements adequate to accommodate traffic volume generated by the proposed
Pipeline are not required. The primary purpose of the Pipeline is to minimize traffic impacts to the
area caused by trucks hauling water between well pad sites. After the Pipeline is constructed,

there will be no additional traffic volume associated with the proposed Pipeline, except as required
for maintenance of the Pipeline.
The pipeline will be laid on the surface. The pipeline will cross county roads in four locations
(Table 2). The pipeline will use culverts to cross roadways in three locations and will bore under
the road in one location. The preliminary pipeline route has been approved by Garfield County
Road & Bridge.

5.03(3) Impacts to Adjacent Land Uses
Impacts to adjacent uses of land will be minimal after the construction of the Pipeline is completed.
The pipeline will be laid along CR 300N within a temporary use and maintenance easement in
the Battlement Mesa PUD and along CR 300E within the Tompkins Pipeline Easement outside of
the road ROW. The Pipeline will be black in color and will follow the general topography of the
area taking advantage of existing vegetation to mitigate its visual impact.
The Pipeline will be in place for no longer than three years.
Construction will take approximately three weeks to complete. It will occur during daylight hours,
typically between 7:00 am and 6:00 pm. Ursa anticipates that construction will take place Monday
through Friday, but reserves the right to construct seven days a week to meet the construction
schedule. No access points or lighting will be required for the proposed Pipeline.
The Pipeline will be laid on the surface, so no excavating or trenching will be required. Should
intermittent disturbance occur, Ursa will reseed those disturbed areas in accordance with
easement agreements.
5.03.08 Industrial Performance Standards
5.03.08(1) Sound Volumes
Construction noise will not impact adjacent residents for an extended period. Ursa does not plan
to provide noise mitigation for this project as the construction is progressive and fast moving.
After construction, no significant sound impacts will be generated by the Pipeline. The occasional
pickup truck for maintenance and monitoring purposes will not impact surrounding operations and
properties beyond the impacts of the traffic noises from adjacent roads where the Pipeline runs.
Operation of the Pipeline will not exceed the Residential/Agricultural/Rural Zone Standards and
state standards.

No pumps associated with this pipeline will be located within the PUD. Diesel-powered pumps
will move water through the pipeline system. The pumps will be located outside the PUD on the
B&V Well Pad, Tompkins Well Pad, and the Monument Ridge B Well Pad. To mitigate against
any noise from the pumps, the well pads will be equipped with 32-foot high sound walls until the
pads enter into full production phase. The B&V Well Pad will have sound walls on four sides. The
Tompkins Well Pad has sound walls on east and west sides. The Monument Ridge B Well Pad
has sound walls on the north, south, and west sides.
Pumping will occur sporadically during the drilling and completion processes.
This proposed Pipeline will comply with state standards and COGCC Rules regarding noise
impacts as applicable.
5.03.08(2) Vibration Generated
There will be no vibrations generated to impact adjacent residents during construction or
operations of the Pipeline.
5.03.08(3) Emissions of Smoke and Particulate Matter
Adjacent lands will not be impacted by the generation of dust and smoke beyond those impacts
of traffic on the county roads next to the Pipeline ROW after the Pipeline is constructed. Ursa will
apply the appropriate level of controls to accommodate potential impacts via adherence to
CDPHE Air Quality regulations and the implementation of industry BMPs included in the
Stormwater Management Plan and Ursa’s dust control plan, if applicable.
While very little dust is expected during construction, fugitive dust will be controlled using water
or other dust suppressants.
5.03.08(4) Emissions of Heat, Glare, Radiation and Fumes
After construction, normal operation of the Pipeline will not result in heat, glare, radiation, and
fumes beyond the impacts of traffic on the county roads next to the Pipeline ROW.
5.03.08(5) Storage Area, Salvage Yard, Sanitary Landfill and Mineral Waste Disposal Areas
No storage areas, salvage yards, sanitary landfills, or mineral waste disposal areas are
associated with the proposed Pipeline. The standards regarding these uses do not apply to the
proposed Pipeline use.
5.03.08(6) Water Pollution
The proposed Pipeline falls within the Town of Parachute’s Watershed Protection Area. Ursa is
in the process of obtaining a Watershed Protection Permit from the Town of Parachute.
After testing, all water used for pressure testing will be hauled via truck to Ursa’s Wasatch Facility
for recycling or disposal or recycled at a completions site, as appropriate.
The potential for spills associated with the proposed pipeline are specific to the transport of fluids
in the water line(s) and the storage of liquids containing hydrocarbons in tanks. Typically, the
transport of fluids along the pipeline route does not require tank storage. In the event of a release

of fluids from the pipeline, Ursa will adhere to the details of their Spill Prevention and Management
Plan and Emergency Response Plan.
5.03.10 Approval of Conditional and Special Uses
5.03.10(1) Compliance
This application describes how Ursa will comply with the standards for pipelines as set forth by
the Garfield County Zoning Resolution of 1978 as amended, the Land Use and Development
Code (LUDC) for Pipeline Development Plans as amended, and the Battlement Mesa PUD
Guidelines as amended.
5.03.10(2) Conditions of Approval
Ursa will comply with Conditions of Approval that the Board of County Commissioners may
impose upon the proposed pipeline project.
5.03.11 Denial of Special Use
Denying this Special Use will allow up to 150 water truck trips per day totaling 1,050 truck trips
per week on county roads within Battlement Mesa to transport water between the B&V Well Pad
in Parachute and other facilities in Ursa’s Battlement Mesa Field operations area. This truck traffic
will increase the amount of traffic within Battlement Mesa. The pipeline is not incompatible with
the general uses of the area through which it runs.
9.03.01 Application
9.03.01(1) Supporting Information
All supporting information and plans are included in this application package.
Ursa will obtain utility permits and oversize/overweight load permits as required from Garfield
County Road and Bridge, prior to construction.
9.03.01(2) Vicinity Map
A Vicinity Map is included in Appendix 9-102.B. Site Plans for the Pipeline route are included in
Appendix 9-102.C. A Property Owners Map can be found in Appendix 9-102.E.1.
9.03.01(3) Letter to County Commissioners
This application package, in its entirety, serves as the letter to the County Commissioners
explaining in detail the nature and character of the Special Use requested.
9.03.04 Action by the County Commissioners
Ursa requests that the County Commissioners not refer this application to the County Planning
Commission for review and recommendation. Under Zoning Code of 1978, pipelines are reviewed
as a Conditional Use and approved by the Board of County Commissioners, while in the current
land use code, pipelines are generally approved by the Planning Director through Administrative
Review. This application is coming to the County Commissioners because pipelines are
considered a Special Use under the Battlement Mesa PUD Guidelines.

9.03.04(1) Public Notice
Ursa will place a public notice in the Rifle Citizen Telegram as required by the Zoning Code and
LUDC.
9.03.04(2) Public Notice by Mail
Ursa will provide public noticing as required by the Zoning Code and LUDC. The list of adjacent
property owners and mineral rights owners that will be notified is included in Appendix 9-102.F.
9.03.04(3) Property Posting
Ursa will post the property as outlined by the Zoning Code and LUDC.
9.07.04 Development Plan Submission
All requirements outlined in this section are addressed below in LUDC Section 9-102.
COMPLIANCE WITH BATTLEMENT MESA PUD GUIDELINES
The Battlement Mesa PUD Guidelines (Guidelines) allows the extraction and processing of
natural resources as a Special Use in all zone districts in the PUD. Pipelines are appurtenant
uses to the extraction of natural resources and have been historically reviewed and approved as
Special Uses by the Garfield County Community Development Department and Board of County
Commissioners. This application narrative describes how the pipeline is compatible with the uses
of the PUD which was originally developed to include extraction of natural resources as an integral
part of the PUD.

Adjacent property owner information was obtained January 16, 2017, from the Garfield County
Assessor’s website for the properties within 200 and 350 feet of the Pipeline route. A list and map
of adjacent property owners within 350 feet of the pipeline is included in Appendix 9-102.F. The
names and addresses will be confirmed prior to public notifications being sent out.
The Adjacent Property map also shows the approximate location of buildings and their uses within
350 feet of the proposed pipeline route. The distance between the improvements and the pipeline
are shown on the map.
A list of the mineral owners for the pipeline alignment within the Battlement Mesa PUD is included
in Appendix 9-102.F. Mineral owners were obtained through research by the Ursa Land
Department using the Garfield County Clerk and Recorder’s records database on January 17 and
18, 2017.

9-102.I Project Facilities
The tie-in point at the Tompkins Pipeline has a valve set as part of the location. No appurtenant
facilities or compression stations are planned for this Pipeline.
No pumps associated with this pipeline will be located within the PUD. Diesel-powered pumps
will move water through the pipeline system. The pumps will be located outside the PUD on the
B&V Well Pad, Tompkins Well Pad, and the Monument Ridge B Well Pad. To mitigate against
any noise from the pumps, the well pads will be equipped with 32-foot high sound walls until the
pads enter into full production phase. The B&V Well Pad will have sound walls on four sides. The
Tompkins Well Pad has sound walls on east and west sides. The Monument Ridge B Well Pad
has sound walls on the north, south, and west sides.
Pumping will occur sporadically during the drilling and completion processes.
9-102.J Construction Schedule
Construction will begin as soon as the land use permit is approved. Construction will last
approximately 3 weeks. Construction may begin on those portions of the pipeline located outside
the PUD prior to approval of this permit. Construction will occur during daylight hours, typically
between 7:00 am and 6:00 pm. Ursa anticipates that construction will take place Monday through
Friday, but reserves the right to construct seven days a week to meet the construction schedule.

9-102.K Sensitive Area Survey
WestWater Engineering (WestWater) prepared a Wildlife and Vegetation Impact Analysis for the
proposed project area dated January 2017. The report is in Appendix 9-102.K.
No special status plant species have been detected previously in the project area and no
threatened, endangered, or candidate plant species would be expected to be affected by the
project.
No threatened, endangered, or sensitive wildlife species listed in Garfield County are expected to
occur in the project area. No occupied raptor nests have been documented in the project area.
No nests would be removed by the project. The project will be located within elk and deer winter
concentration areas and mule deer severe winter range. Since there will be minimal Burning Rock
B2L2 LLC vegetation removal as part of this project, the effects of the project are likely to be
small. The project will not further fragment habitat.
During the analysis related to the construction and operation of the proposed land uses, Ursa has
performed an assessment of potential impacts to Waters of the US and compliance with Army
Corps of Engineers (ACOE) regulations. The results of the analysis indicate there will be no ACOE
impacts associated with the proposed project. Areas identified as Waters of the U.S. will be
protected by routing the pipeline around the area. Making sure that there are containment vessels
with secondary containment at any potential drain areas and release valves.
Ursa will follow the recommendations outlined in WestWater’s Protection of Wildlife Habitat Areas
report that is included in Appendix 99-102.K.
9-102.L Revegetation Plan
No excavation or trenching is anticipated for this pipeline. Should intermittent disturbance occur,
Ursa will reseed those disturbed areas in accordance with the easement agreements and in
accordance with Ursa’s Revegetation Plan that is part of their Reclamation Plan included in
Appendix 9-102.L. The Reclamation Plan includes a plant material list with application rates.
A revegetation security bond should not be required for this pipeline, because there is no
excavation or trenching required.
9-102.M Weed Management Plan
WestWater provided an Integrated Vegetation and Noxious Weed Management Plan for the
proposed Pipeline route, dated January 2017. Due to the time of year, no field survey was
completed for the report. Field surveys will be completed as part of Ursa’s normal weed
management plan activities in the area.
The noxious weed report encompasses a 30-meter area surrounding the proposed pipeline. In
the area along CR 300N, noxious weeds have been observed previously. Observations included
bull thistle, Canada thistle, chicory, common burdock, common mullein, curly dock,
houndstongue, musk thistle, and Russian knapweed.
In areas where soil disturbances have created growing conditions that favor non-native
vegetation, several unlisted nuisance weed species are present. These plants can negate
revegetation efforts and cause financial losses due to decreased seeding success and associated

costs of replanting. The presence of these plants creates increased competition for resources and
can negatively affect desirable native plant species. Plants in this category that may be present
in the project area include flixweed, kochia, Russian thistle, and tumble mustard.
Ursa will follow the recommendations outlined in WestWater’s Integrated Vegetation and Noxious
Weed Management Plan, located in Appendix 9-102.M.
9-102.N Emergency Response Plan
A copy of Ursa’s Emergency Response Plan (ERP) is included in Appendix 9-102.N. This includes
a Fire Protection Plan and a Spill Prevention and Management Plan. The documents and
descriptions included in this application taken as a whole make up the operating plan and
emergency response plan for the pipeline. The monitoring plan for the pipeline is not included in
the ERP, because the ERP documents the steps to take if an emergency occurs. A copy of Ursa’s
water transfer procedure from their Yater Pad to their Watson Ranch B Pad is included as a
sample procedure. Similar procedures will be written for the B&V Temporary Water Pipeline prior
to the pipeline being put into service.
Ursa will comply with provisions of their Spill Prevention and Management Plan as applicable to
pipelines. Ursa’s plan integrates all applicable state and federal regulations regarding spill
prevention, containment, and response into their regulatory, environmental, and health and safety
plans and programs.
A list of persons to be notified in an emergency is part of the plan, as well as other items outlined
in this section. Muster points will be determined at the preconstruction meeting with Ursa’s Health
and Safety manager. Generally, they will be located at the muster site for the closest well pad to
the active construction area. There is no site-specific plan for the Pipeline.
The potential for spills associated with the proposed pipeline are specific to the transport of fluids
in the water line(s) and the storage of liquids containing hydrocarbons in tanks. There will always
be at least one person at each end of the line during water transfer activities. The constant
supervision reduces the potential risk of leaks and failures from occurring without being noticed
in a timely manner. Every barrel of water that is sent through the Pipeline is accounted for at both
ends of the line. Pressures are monitored constantly. Any change in pressure will result in
immediate action to troubleshoot the cause of the pressure change. In the event of a release of
fluids from the pipeline, Ursa will adhere to the details of their Spill Prevention and Management
Plan and Emergency Response Plan.
Ursa will place emergency response markers indicating the pipeline operator, the water use, and
emergency contact information at road crossings.
9-102.O Traffic Impact
The traffic impacts during the three-week construction of this project will be minimal. No formal
traffic study was performed for this project. Construction vehicles will access the project site via
CR 215 from the I-70 Parachute interchange crossing the Colorado River and continuing onto
and along CR 300N to the project end location on CR 300E. Vehicle types and trip totals are
shown in Table 5 below.

Road closures are not anticipated at this time. Ursa will coordinate with Garfield County Road and
Bridge and the Battlement Mesa PUD on possible road closures. Temporary traffic controls such
as flaggers and signage will be used, if required. Ursa will submit traffic control plans to Road and
Bridge with Utility Permit applications.
After the Pipeline has been installed, up to 150 water truck trips per day totaling 1050 truck trips
per week will be eliminated from the PUD area during completions activities.
9-102.P Staging Areas
Potential staging areas are shown on Sheet 3 of the Site Plan. Equipment and materials used for
pipeline construction will be stored at the staging areas or along the pipeline during construction.
Pipe will be laid within the 50-foot construction easement during construction. Equipment may be
stored overnight within the construction easement.
9-102.Q Pressure Testing
The pipelines will be tested with fresh water prior to going into active service. Approximately 440
barrels (bbls) of water will be used. Ursa will pressure test the lines to 750 pounds per square
inch (psi). Anticipated operating pressure is 600 psi.
Water used for testing the Pipeline will be supplied by BMMD via a Water Service Agreement
between BMMD and Ursa. A copy of the Water Service Agreement is in Appendix 9-102.Q. After
testing, all water used for pressure testing will be hauled via truck to Ursa’s Wasatch Facility for
recycling or disposal or recycled at a completions site, as appropriate.
9-104 Review Criteria
9-104.A Located Along Perimeters
The Pipeline right-of-way is located along the perimeter of surface property ownership where
possible. The Pipeline route was determined based on the need to accommodate property
owners, mitigate visual and topographical impacts, work within previously disturbed areas, and
reduce the amount of new surface disturbance.
9-104.B Noise Abatement
All equipment used in the construction or operation of the Pipeline will comply with state standards
in regards to noise abatement as appropriate for the type of equipment or Pipeline. All power
sources will have either electric motors or muffled engines. Permanent facilities will comply with
noise abatement requirements. Construction noise will not impact adjacent residents for an

extended period. Ursa does not plan to provide noise mitigation during construction of this project
as the construction is progressive and fast moving.

9-104.C Visual Impact
During construction of the Pipeline, Ursa does not plan to provide visual mitigation for this project
as the construction is progressive and fast moving. The Pipeline route will be reclaimed if
necessary as soon as practical for optimal growing conditions.
The Pipeline is a temporary surface line. It will be laid along CR 300N within a temporary
easement in the Battlement Mesa PUD and along CR 300E within the Tompkins Pipeline
Easement outside of the road ROW. The Pipeline will be black in color and will follow the general
topography of the area taking advantage of existing vegetation to mitigate its visual impact.
9-104.D Access Points to Public Roads
All oversized or overweight vehicles will obtain permits prior to beginning work. Public roads that
will be used to access the project area include County Roads 300N and 300E. These roads are
classified as haul routes per the Road Map available on the Garfield County Road and Bridge
Department web page.
9-104.E Air Contaminant Emissions
All air emissions will be in compliance with provisions of the Colorado Air Pollution Prevention
and Control Act, Title 25, Article 7. Any required air quality permits will be submitted to the CDPHE
prior to construction, if applicable.
9-104.F Water Quality Control Standards
See Section 5.03.08(6) Water Pollution above.
9-104.G Reclamation Plan
No excavation or trenching is anticipated for this pipeline. Should intermittent disturbance occur,
Ursa will reseed those disturbed areas in accordance with the easement agreement. Any
revegetation that may be required after installation of the surface lines will be done in accordance
with Ursa’s Revegetation Plan that is part of their Reclamation Plan. The Revegetation Plan
includes a plant material list with application rates.

9-104.H Removal of Abandoned Pipeline
When the pipeline is no longer needed, and removed, Ursa will comply with the easement
agreement and their Reclamation and Weed Management Plans in effect at the time of removal.
The Pipeline will be removed from the 10-inch bore sleeve at the bore location by the Battlement
Mesa Golf Course. The sleeve will be left in place with both ends capped, for possible future use
by the golf course.
