Uphoff Trust and Timothy James Uphoff WPX Energy RockY Mountain, LLC 2137-O12-00-001 The Site witl be approximately 1'5 acres on an overall tract of approximately 598.78 acres' The property is located approximately 30 miles north of the Town of Debeque and 5 miles south of the Rio Blanco County line, in Township 5 South, Range 97 West of the 6th P.M.; Section 1: STzNW/+ and the NW/+SW /+; Section 2: SYzNYz, NyzSEy4 and Lots 7 and 8; Section 3: SETaNE% and Lots 5, 6 and 7; County of Garfield. State of Colorado. The facility is accessed by BLM Road 1009A and Rio Blanco Road 5 and a% mile section of private roadway. The property is zoned Resource Lands Plateau EXISTING ZONING I. GENERAL PROJECT DESCRIPTION The Applicant is requesting a Limited lmpact Review for a 1.5 acre Major Temporary Employee Housing iacility and Storage area called Trail Ridge within a 598.78 acre partef . fne parcel-already has a graOed one acre area which will need to be expanded by about a half-acre to accommodate the housing and storage facilities. The facility is proposed in a very remote location with grazing and.oil and gas activities as the only nearby land uses. The Applicant has represented that the nearest hotels are an approximately 2.5 hour drive from the drilling rigs in this area. According to the Application, the Trail Ridge Employee Housing Facility is to consist of the following: A. 24 person, 6 unit side-by-side housing facility B. 10,000 gallon potable water skid C. On-site wastewater treatment system D. Diesel-fired electrical generator skid E. Refrigerator and Freezer skids F. Laydown yard and 60' wide x 125' long building for storage of drilling equipment, hydraulic f racturing equipment, pipe, excavation equipment, maintenance tools and snow-moving equipment. G. Gravel parking areas and circulation areas for employees and deliveries The traffic study as submitted states that the site will generate 2 vehicle trips per day (one round trip) for the Temporary Employee Housing Facility. The development of the site for the storage and temporary employee housing uses will require grading of an additional half acre. The total leased site is 1.5 acres within an overall approximately 598 acre property. The surrounding area is primarily native vegetation used for grazing and developed for oil and gas. There is limited residential or agricultural development in the surrounding area. The surrounding zoning is Resource Lands - Plateau with some public land nearby. III. PUBLIC COMMENTS AND REFFERAL AGENCY COMMENTS Public Notice was provided forthe Board's public hearing in accordance with the Garfield County Land Use and Development Code as amended. No public comments have been received at this time. Comments from referral agencies and County Departments are summarized below and attached as Exhibits' 1. Garfield County Consulting Engineer, Chris Hale, Mountain Cross Engineering: (See Exhibits 12)o The proposed water system provides water for potable use as well as fire sprinklers. The Applicant should address how the water storage will preserve fire sprinkler storage from domestic storage. 2.Gafield County Vegetation Manager: (See Exhibit 16) o Noted that the lntegrated Vegetation and Noxious Weed Management plan and proposed seed mixes are acceptable. . Requests that the Appticant calculate the area impacted by the Temporary Employee Housing component in order to determine if security is necessary. As permahent facilities, the road and storage areas should not be included in the calculation. o Any required security would be held by Garfield County until vegetation has been successf u lly reestablished. Garfield County Public Health: (See Exhibit 15) o Noted that the proposed vault-and-haul temporary wastewater system would produce approximately 1,800 gallons per day (24 people al75 gallons per day), which is very close to the 2,000 gallon threshold to install an Onsite Wastewater Treatments System (OWTS). Recommends that the rate be monitored to ensure it does not exceed 2,000 gallons per day. . Noted that a natural gas electric generator would create fewer emissions. . Recommended that any housing facility that is connected with the soil via a foundation be tested for radon. . Recommended that the operator keep the County informed as to the use of the facilities, Colorado Parks and Wildlife: (See Exhibit 10) . Noted that because this is a previously disturbed site, minimal if any impact is expected on wildlife. o Noted that the site is within an identified sage grouse production area. . Noted that the facility will use bear proof containers. . Noted that firearms and pets should be prohibited from the facility. Garfield County Oil and Gas Liaison: (See Exhibit 14) . Noted that the area is heavily developed by oil and gas. . Noted that the nearest residential property (EV Ranch) is more than a mile from the proposed facility. . Noted that impacts such as noise and traffic would not impact neighboring property owners.o Noted that the location seems appropriate for this type of facility. DeBeque Fire Protection District: (See Exhibit 1 1) . lndicated that the Applicant has met all requirements that the Fire Protection District has requested and that the District has no further comments. Garfield County Sheriff's Office: (Exhibit 13) . lndicated that the Sheriff's Office has no issues with the proposed facility. 3. 4. 5. 6. 7. g. STAFF COMMENTS AND ANALYSIS ln accordance with the Land Use and Development Code, the Applicant has provided detailed responses to the Submittal Requirements and applicable sections of Afticle 7, Divisions 1 , 2, and 3, including Section 7-1001 lndustrial Use Standards and Section 7- 705 Temporary Lmptoyee frousing Facilities, . Major Standards' The Application materials include an'lmpact Anatysii and related consultant reports, technical studies, and plans. 7-103: Zone District Reoulations The proposed use demonstrates general conformance with applicable Zone District provisions contained in the Land Usi and Development Code and in particular Article lll standards for the Resource Lands - Plateau zone district. 7-102: ComPrehensive Plan The Comprehensive plan 2030 designates the site as Resource Production / Natural. Excerpts irom the Land Use Description Section Chapter 2, Future Land Use, Section 8, Natural Resources and Section 9, Mineral Extraction are provided below. Chapter 2 - Land Use Designations Agriculture and grazing tand used primarily for oil, gas, oil shale, coal mining, giavet mining, iicluding support buitdings and facitities needed for the natural resource extraction industry, and other-business uses that can be adequately buffered from adjacent inco'mpatible uses. Also includes areas with significant environmental constraints such as upper plateaus, talus slopes, and .stelP slopes (over 20%). Private inholding mostty surrounded by public lands with limited Public access. Section 8 - Natural Resburces /ssues *The county maintains high air quality standards, however there may be , p?op"ntity for air pottutants to exist in the western part of the countY 10 Goals 1. Ensure that natural, scenic, ecological, and critical wildlife habitat resorJrces are protected and /or impacts mitigated. 4. Ensure the appropriate reclamation of land after extraction processes. Policies1. The County witlencourage and cooperate with the protection of criticat habitat inctuding state and federally protected, threatened, or endangered sPecies. Section 9 - Mineral Extraction Goals 2. Ensure that mineral extraction activities mitigate their effects on the natural environment, including air quality, water quality, wildlife habitat or i mportant visual resou rces. g. ln working with mineral extraction projects, the county will protect the public health, safety and welfare of its citizens. Policies 1. Garfietd County recognizes that surface and mineralowners have cerlain tegat rights and privileges, including the right to extract and develop these interests. Private property owners also have certain legat rights and priviteges, including the right to have the mineral estate devetoped in a reasonable manner and to have adverse impacts mitigated. The property rights of minerallessees must be balanced with the rights of private propefty owners and the general public. 2. Mineral resource extraction activities will protect critical wildlife habitat as identified by state and federal agencies. Development within these designations that cannot be designed, constructed and conducted so as to have a minimum adverse impact upon such habitat or these wildlife species shall be discouraged. S. Natural drainage patterns will be preserued or mitigated so the cumulative impact of mineral extraction activities will not cause storm drainage/floodwater patterns to exceed the capacity of natural or constructed drainage ways, or to subject other areas to increased flooding, erosion or sedimentation or result in pollution of streams, rivers or other natural bodies of water. 4. Facilities that are appurlenances to oil/ gas development activities (compressors, etc.) are considered appropriate in all land uses so long as they meet the respective mitigation requirements of the LUDC to maintain compatibility with surrounding land uses. t1 The location and design of the proposed facility is in general conformance with the Comprehensive Plan Policies subject to proper mitigation of impacts. 7-103: Compatibility The Application has also provided information indicating the character of the area and adjacent land uses. The request demonstrates general compatibility with adjoining uses thit are primarily oil and gas exploration/production and cattle grazing. According to the Garfield County Oil and Gas Liaison (Exhibit 14), "surrounding private lands are largely owned and operated by oiland gas companies. The nearest residence, on the EV Ranch, is more than a mile from the proposed facility and unlikely to be notably impacted by noise from the site if operated as proposed." 7-104: Source of Water The Temporary Employee Housing Facility is to be accommodated with stored potable water. The proposed 10,000 gallon water storage tank will provide approximately 5.55 days of supply. ln addition, the Applicant has represented that the operator will comply with the LUDC requirements outlined in Section 7-705(8). The Applicant has represented the following in regards to the water system. A 1O,0OO gatlon potabte water skid will be utilized for potable water. Please see Tab g- Site Plan for drawings of the potable water skid. The 10,000 gatlon suppty is adequate for a 24 person facility utilizing 75 gal/day/person (gpd/person) for total estimated usage of 1,800 gallons per day. D&P Water (Operator's License #8440) will be providing the potable water for the facitity. The source of the water is the Town of Meeker water plant. (PWS|D# CO-0252400). The Application was referred to the DeBeque Fire Protection District who indicated that all issues had been addressed by the Applicant. The proposed water storage has also been reviewed by the Garfield County Engineer who provided the following comments (See Exhibit 12). The water system provides water for potable use as well as for fire sprinklers. The water storage system does not seem to separate water for each use. The Appticant should address how the water storage will preserue fire sprinkler storage from domestic storage. The Applicant provided a response to the comments submitted by the Garfield County Engineer in Exhibit 17.|n this email, Phil Vaughan provided the following explanation of the fire protection system. The 10,000 gallon potable water storage unit is utilized only for potable water for the Trail Ridge Employee Housing Facility. 12 The 1,600 galton water storage system forfire suppres_si9n is located on the East side of unit 5 in the Mechanical Room. The ATCO Structures drawings are located in Tab 9- Site Plan. I have attached drawings AA01 and AA02 that notes Equipment List number 642 as the 1,600 gallon water tank' This 1,600 gallon water storage system for fire suppression is not connected to the 10,000 gat6n potabt6 waier storage unit, n9r is it connected to any other fixturets wniin the facility with the exception of the fire sprinklers. The 1,600 gallon fire water storage tank is filted from the exterior of the buitding via use of a 2-1/2" coupling' 7-105: Waste Water Svstems The Applicant has provided an engineered onsite. wastewater Treatment system towrsj design for ti-re facility. ln acJordance with LUDC for facilities which are to be onsite for greater than a cumulative of 1 year, the Applicant is proposing to install an OWTS to handle wastewater from the facility. ln addition, the Appticant has requested a waiver from the requirement to install an OWTS for up to 9 months after issuance of the Land Use Change permit to accommodate potentiaily inclement weather which could [revent installation of the OWTS along with installation of the Temporary Employee itousing facility. The Applicant has stated that they will comply with all standards as outlined in the LUDC. The Applicant has represented the fotlowing regarding waste water disposal. Please find attached the Alt Seruice Septic engineered design- a4"^! November 12, 2014 for the On-site Wastewater Treatment System (OWTS). ln the event that WPX Energy is unable to construct the OWTS in January/February 2015 prior to the opening of the Employee Housing Facility, wPx Energy requests a waiver of standard 7-705(c)(2)(e) "The facitity wilt not excee-d a cumulative of 1 year at the approved location, and" As noted in Tab 2- Proiect Overuiew, we are requesting tha.t the WPX Energy Trait Ridge Empioyee Housing Facility not have an expiration date. Vautt and haul of sewage would be-conducted at the site utilizing the 3- 1,500 galton sewage taiks for a total of 4,500 gallons of sewage storage. Detays of installation of the OWTS would be directly related to inclement weather that may delay construction. WpX Energy agrees to complete construction of the OWTS within I months after receipi of-the Gartietd county Land use Permit. L3 Staff suggests a condition of approval that the Applicant install the OWTS within 9 months i-ollowing issuance of the Land Use Change Permit of the Temporary Employee Housing and Storage facilitY. 7-106: Public Utilities Electric power will be provided by diesel powered generators, water will be hauled to the site and wastewater will be processed onsite using an OWTS for the proposed facilities. Due to the remote nature of tne facilities, connection to public utilities is not feasible. 7-107: Access & Roadways Access to the property is from Rio Blanco County Road 5, BLM Road 1009A and BLM Road 100g in aOdition to approximately % mile of private access road. Please see the below maps outlining the ownership of the roadways from the use to Rio Blanco County Road 5. ln addition, the Applicant has provided engineered drawings of the private roadways leading to ine property. The Applicant has provided the following statement regarding necesiary improvements to the private portion of the roadway. The drawings located in Tab 10- Grading & Drainage Plan have been prepared to-upgrade poftions of the existing % mile access road to "Semi-'Primitive" standards as per Garfietd County LUDC Table 7-107 Roadway Standards. The roadway will remain gravel surtaced. The Traffic lmpact Analysis conducted by Felsburg, Holt and Ullevig daied November 2014 makes the following conclusions' The results of the LOS anatyses show that traffic operations at the intersection of RBCR 5 and BLM 1009A witt not be negatively impacted by the devetopment of the WPX Energy Trait Ridge Employee Housing Facility. This intersection will operate at an LOS A during all peak hours for existing and total traffic scena'rios with the existing lane configuration. No auxiliary lanes are necessary to maintain acceptable LOS or to meet auxiliary lane requirements. . An estimated 24 workers wilt reside within the facility. Workers will be shuttled to the site, live, and work for extended periods of time. These traffic impacts are negligible. . lt is estimated, conseruatively, that there will be up to 34 round trips per month to the site after completion (approximately 1 trip per day). See the Traffic Worksheet in Appendix C for more information' o This amount of traffic is negligible and will not have significant impact on surrounding roadwaYs. This application was referred to both the BLM and Rio Blanco County for comment, but no comments were received. Review of the traffic study, however, state that "Felsburg Holt & Ullevig has prepared a basic traffic impact analysis for the proposed Employee Housing Facility... the facility will house an estimaled 24 employees." As a result, it does not appear that the traffic study considered the impacts of the storage facility. On May 28,2015 Phil Vaughan submitted a letter (See Exhibit 20) from Felsburg Holt and Ulllvig stating the following regarding the traffic impacts from the storage facility. Additional traffic trips on Rio Blanco County Road 5 are not anticipated to be generated by ihi" ute or on BLM Roads 1009 and 10094. The only roadway that wiit be affected is the % mile private access road. WPX Energy has indicated that during many weeks and months during the year, this storage area will have no trips. ln order to account for this type of use, a 1 trip p-er day increase in traffic for the storage use has been accounted for. As a result of this analysis, it is Staff's opinion that the traffic impacts from the proposed storage facility are negiigible and that the proposed improvements to the access roadway are appropriate. 18 7-108: Natural Hazards The Application provides significant information on natural hazards including information on soils, geology, and slopes associated with the site. The information supports a determination that the proposed use is not subject to significant natural hazard risks' The reports include results from radiation tests which indicate that radiation levels are very low and "indicative of normal background radiation'" A study was also conducted on potential contamination of water aquifer by water Resource Consultants, LLC. The study concludes that "The potential for aquifer contamination from the proposed employee facility is virtually non-existent'" 7-109: Fire Protection The Application includes the Emergency Respglt". Plan for the site. The Application was referred to the DeBeque Fire-protection District which indicated that all of their concerns have been addressed. See SectionT-104, Source of Water, above' 7-201 : Aqricultural Lands Minimal if any impact on agricultural land is anticipated. The property has been utilized for grazing and oil and gas development. There are no irrigation ditches located within the perimeter of the site' The facility will not be fenced with exception to the OWTS absorption field and the septic tanks. ln addition, per wPX policy, domestic animals will not be permitted on the site' 7-202: Wildlife Habitat Areas The Applicant has provided a wildlife habitat study completed byWestWater Engineering (dated October iO\+1. The study looks at impacts to the greater sage-grouse, riparian and aquatic species, raptors, American elk, mule deer, black bear, mountain lion' birds' small mammals and reptiles. The study notes that should the facility be maintained without animal attractions or harassment, irpr.t to the animals in the area should be minimal. The study also recommends adherence to the submitted lntegrated Vegetation and Noxious Weei M"nrg"*ent Plan in order to help reduce impacts to wildlife' The study notes that the subject site is not prime nesting or brooding habitat for the greater sage-grouse. However, the cPW comments (see Exhibit 10) note that the site is located within a greater sage-grouse production habitat. A fufther look into Gadield County,s Greater big" Crorr6 C-onservation Plan shows that the impact area is in fact outside the sage grouse suitable habitat arca' 19 No other threatened, endangered, proposed, candidate or other sensitive species were noted to occur in t-fre project"arer. i{o*.r"r, cheatgrass, a noxious weed was found on the site. The application was revieweJ by the OarfiltO,County Vegetation Manager who indicated that the weed management plan is acceptable. 7-203: Protection of Water Bodies The site location is not in close proximity of an active water body' The nearest water feature is located over r ,000 feet f rom the subject area. Due to this distance, impacts to water bodies are not anticiPated. The Applicant has included a stormwater Management Plan, Stormwater Discharge permit and Spill prevention Control and Countermeasure Plan (SPCC) as a part of the ffieater Sage Grous eled Suitable Habitat 20 Grading and Drainage Plan. These plans have been reviewed by referral agencies and appear to meet the requirements in the LUDC. 7-205 Environmental Qualitv The application includes an SPCC which has been reviewed by the referral agencies and appears to meet the requirements of the LUDC. Permits are required for the diesel generators. The Applicant provided evidence that the permits have been submitted. Except for the generators, the only other air emissions are expected from those typical of motor vehicles accessing the site. 7-206: Wildfire Hazards The DeBeque Fire Protection District reviewed the application and had no additional comments. The facility is not located within a "very high" wildland fire susceptibility designation according to the Community Wildfire Protection Plan. ln addition, no buildings will be constructed onsite with shake roofs. 7-207 Natural and Geologic Hazards See Section 7-108, above. 7-208: Reclamation The Applicant has included a reclamation plan that addresses re-vegetation and reclamation. However, it appears that the revegetation and reclamation calculation is only for the newly disturbed areas of the site. The LUDC states that reclamation security is required if the disturbed area outside that of the long-term functioning area of the site - in this case the storage and roadway improvements - is one acre or greater. The Applicant submitted a drawing from Sopris Engineering on May 28, 2015 (See Exhibit 20) indicating that the area outside the storage and roadway functions is 0.68 acres. Due to the small size of the impacted area, Staff does not recommend revegetation security. The form and content of the reclamation and revegetation plan has been reviewed by the Garfield County Vegetation Manager and has been found to be adequate. 7-301 : Compatible Design See Section 7-103, above. 21 7-302: Parkinq, and Loading Large areas of the site plan are available for parking, circulation, and loading activities' The Site plan specificaliy identifies the area between the proposed housing and storage facility for parking. The warehouse facility requires 3.75 spaces (1 space per 2,0o0 sq ft for ,,Warehorr""f and the Temporary Employee Housing Facility requires 14 (1 space p", ,oon1 for "Lodling") for a total of ll.lS spaces required' 29 parking spaces have been identified on the site Plan. ,-303' LandscaPinq As an industrial use, landscaping submittals and standards are not applicable to the Storage portion of the ProPosal. As Temporary Employee Housing is considered "Residential", Landscaping is applicable to this portion of tne proposal. Th? Residential Subdivisions The facility is located on a large tract of property in a remote area of Garfield County and is not within a platted subdivision. B. Setbacks The proposed facility is over 100 feet f rom the property lines and will meet the applicable setbacks. C. Concealinq and Screeninq The Applicant has requested a waiver from this standard. Due to the remote nature of the area, staff agrees that this request is appropriate. lt is Staff's opinion that the site is effectively screened by topography and geographical features' D. Storinq The materials to be stored on the site will be large industrial equipment that will not be transferred off the properly by any foreseeable nltural causes. ln addition, a 125'x 60' shelter is proposeo'to oe Constructed for the machinery to be stored in order to protect it from snow and wind. see the above discussion in section B regarding setbacks. E. lndustrialWastes The Applicant has stated that all hazardous wastes will be stored in conformance to the LUDC as well as state and Federal laws and regulations. F. Noise The Applicant contracted with Hankard Environmental who conducted a site specific study. The study concludes that the proposed facitity is expected to be within compliance with State Statute for noise. G. Ground Vibration The Applicant contracted with Hankard Environmental who conducted a site specific study. The study concludes that the proposed facility is expected to be within compliance with the LUDC for vibration. 23 H. Hours of Operation The Applicant has requested that this Temporary Employee Housing and Storage facility operate 24 hours per day, 7 days per week. Due to the nature of the activity and remote location, it is Staff's opinion that such a request is appropriate. l. lnterference, Nuisance. or Hazard No other nuisance or ground vibration hazards are anticipated based on type of use, existing operation and the remote location. The Applicant has indicated that all facilities will be painted a non-reflective neutral color which will minimize any glare or visual impacts. 7-705 TEMPORARY EMPLOYEE HOUSING FACILITIES. MAJOR A. Adequate Site Plan The Applicant has provided an adequate site plan which has been provided to the Sheriff's Office and DeBeque Fire Protection District. B. Water Systems ln addition to the discussion in Section 7-104, Source of Water, above, this section outlines the requirements for water systems associated with Temporary Employee Housing. The Applicant has indicated that consistent conformance with these standards will be maintained. 1. Water systems must comply with all applicable State and local laws and regulations. 2. All potable water systems must include a meter and the Operator must keep a record of the daily usage. 3. For sites to which potable water is hauled, Operators shall: a. Keep appropriate records, to be provided to the County upon request, to demonstrate that water supplied to a site is from an approved source and that wastewater is disposed at an approved facility. b. For water facilities not permitted by the CDPHE, the Operator must conduct monthly tests (or quarterly if an on-site disinfection system is installed) and maintain records of potable water samples specific for coli form. Any tests indicating coli form contamination must be disclosed to the County Public Health Department. c. Water systems facilities permitted by the CDPHE must obtain all necessary State permits or demonstrate that applications for any necessary permits have been submitted prior to a determination by the County that an application is complete. 24 d. Maintain compliance with State regulations at all times during oPeration. 4. ln no case shall unsafe water be used for drinking nor shall raw sewage or used water be discharged onto the ground surlace. C. Wastewater Systems See Section 7-105, above. The Applicant is requesting a waiver from Section 7-705(C)(2)(e) regarding the installation of a vault-and haul ty.G, for a period up to 9 months from the date of issuance of the Land Use change Permit. At this point, the Applicant is proposing. to instal an engineered owrs as ipecified in the apprication. This request is to provide the Appticant flexibility with the installation of tre owrs and allow for installation during favorable weather conditions. Staff agrees that the waiver request is acceptable' The standards as outlined in section 7-7\5(c)(2)(e) are as follows' 1. Wastewater systems musf comply with allapplicable State and locallaws and regulations. 2. wastewater may be disposed of using either an owTS or a vault-and- haul system. A vailt-and-haut system must demonstrate the following: a. year-round access is available and maintained for safe and regular access for sewage hauling vehicles; b. Trash and Food Storaqe The LUDC requires that "Major Facilities shall be maintained in a clean, safe, and sanitary condition, free of weeds and refuse. Any hazardous or noxious materials that must be stored on site for operational or security reasons must be managed in accordance with all applicable Federal, State, and local laws and regulations." The Applicant has indicated that they will comply with this standard. F. Fire Protection General Requirements The DeBeque Fire Protection District has reviewed this application and has indicated that they have no issues with the facilities as they are proposed. The Fire Districts review included provisions for providing alarm in the case of fire as well as fire suppression per fire codes. The Applicant has indicated that they will also comply with the requirement for carbon monoxide alarms. H. Notification of Site Development The LUDC requires the following: lf the County grants a Land Use Change Permit for a Major Temporary Employee Housing Facility, the Operator shall notify the County when site development begins. The Operator shall verify in writing, including submission of a Site Plan and photo documentation, that the site, water system, and sewage disposal system were designed, installed, and inspected in accordance with the Land Use Change Permit and comply with allapplicable regulations, permits, and conditions. Allwritten documentation and Site Plans verifying compliance must be stamped by a qualified professional engineer. The County also reserues the right to inspect a site, without notice, to assess compliance with County approvals. A determination of noncompliance with any Land Use Change Permit, or condition of approval thereof, is grounds for revocation or suspension of said permit. The Applicant has indicated that they will comply with this requirement. l. No Domestic Animals Allowed The Applicant has indicated that they will comply with this requirement. J. Reclamation and Revegetation Plan. See Section 7 -208, above 26 K. Expiration or Revocation of Land Use Change Permit The LUDC states the following: lJpon expiration of the Land lJse Change Permit, a Certificate of Occupancy shatt be nu1 and void. lJpon revocation of the Land Use Change Permit, a Certificate of Occupancy shall be revoked. The Applicant has indicated that they understand this requirement, although the Applicant is requesting that the Land Use Change Permit not have an expiration date. V. SUPPLEMENTAL AND ADDITIONAL STAFF ANALYSIS On May 11,2015, the Applicant submitted additional materials (See Exhibit 17) to address the comments submitted by Chris Hale (See Exhibit 12). On May 12,2015, the Applicant submitted additional materials (See Exhibit 18) to address the comments submitted by Morgan Hill (See Exhibit 15). On May 2A,2015, the Applicant submitted additional materials (See Exhibit 20) to address the Applicant's review of the draft staff report' V!. SUGGESTED FINDINGS 1. That proper public notice was provided as required for the hearing before the Board of County Commissioners. 2. The hearing before the Board of County Commissioners was extensive and complete, that ali perlinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. 3. That for the above stated and other reasons the proposed Land Use Change permit for the WpX Trail Ridge Temporary Employee Housing and Storage Facilityis in the best interest of the health, safety, convenience, order, prosperity and welfare of the citizens of Garfield CountY. 4. That with the adoption of conditions, the application is in general conformance with the 2030 Comprehensive Plan, as amended. S. That with the adoption of waivers for the Temporary Employee Housing Facility, Major, from Sections 7-705(CXZXe) - Wastewater Systems, 7-306 - Trail and Walkway Standards, 7-303 Landscaping Standards, the proposed facility meets the requirements of the Land Use and Development Code, as amended. 27 6. That with the adoption of waivers for the Storage Facility, from Section 7-1001(C) - Concealing and Screening, the proposed facility meets the requirements of the Land Use and Development Code, as amended. 7. That with the adoption of the Conditions of Approval the application has adequately met the requirements of the Garfield County Land Use and Development Code, as amended. VII. RECOMMENDATION The following recommended conditions of approval are provided for the Board of County Commissioners consideration. Conditions Prior to lssuance 1. The Applicant shall improve the access road as proposed to leet Section 7-107, ,,Semi-Primitive" standards prior to issuance of the Land Use Change Permit. The Applicant shall provide evidence that the roadway has been upgraded and meets the standards set forth in Section 7-107. This evidence shall be reviewed by the Galfield County Community Development Department and the County Contract Engineer. Other Conditions 2. That all representations made by the Applicant in the application shall be conditions of approval, unless specifically altered by the Board of County Commissioners. g. That the operation of the WPX Trail Ridge Temporary Employee Housing and Storage Facility shall be done in accordance with all applicable Federal, State, and local regulations governing the operation of this type of facility. 4. The facility shall maintain compliance with Storm Water Management Plan, Drainage and Grading Plans and Reclamation for the site. S. The Applicant shall control fugitive dust during the operation of the site. 6. The facility shall maintain compliance with Section 7-306 Lighting, with all lighting to be directed inward and doward toward the interior of the site. Facilities and storage tanks shall be painted a non-glare neutral color to lessen any visual impacts. 7. The Applicant shall comply with their Noxious Weed Management Plan including the best management Practices. 28 8. Within 9 months of the issuance of the Land Use Change Permit, the Applicant shall install an Onsite Wastewater Treatment System (OWTS) to serve the proposed facility. The installation of the System shall be in accordance with the design and specifications as outlined in the Application. g. All industrial wastes shall be stored in accordance with all State and Federal laws and regulations. 10. The facility is permitted to operate 7 days per week, 24 hours per day. 11. On Wednesday, November 5, 2014, CPW staff met with Phit Vaughan of Phit Vaughan Construction Management lnc., and Ashtee Fechinco of WPX to discuss the proposed Trait Ridge EmpLoyee Housing Facitity project. The proposed project is tocated in Section 3, T5S, Rg7 W, 6th pM., Garfield County, Cotorado. CPW reviewed the project to provide witdtife impact advice and recommendations so that Mr. Vaughan and Ms. Fechinco could incorporate discussion items and recommendations into the ptanning and construction of the project. CpW staff atso reviewed the fottowing documents prepared by WestWater Engineering:. lmpact Anolysis: Section 4-203-G (6); tntegroted Vegetation ond Noxious Weed Monagement Plan; and Section 7-202Wildlife Habitat Areas. r The proposed site tocation is within an area of existing disturbance; roads, pipelines, compressor stations, wett pads and other facitities. The housing facitity witt consist of 6 modutar units (buitt on skids) with each unit housing up to four emptoyees. lt is anticipated that there woutd be 21 oit fietd workers and four camp support staff for a totat of 25 peopte living at the site at one time. On site residence work schedute woutd consist of three weeks on and three weeks off. The proposed facility is a long term 24-person housing and storage facility. Proposed facility includes on-site wastewater treatment and also a laydown yard with a 60'wide x 125' long building for storage of equipment. My office is likely the most common receiver of citizen questions, concerns and complaints related to possible oil and gas activity impacts to Garfield County citizens. lt is with this in mind that I have reviewed the application. The proposed land use change will occur in northern Garfield County within the resource lands zone district that currently hosts significant existing oil and gas infrastructure. Surrounding private lands are largely owned and operated by oil and gas companies. The nearest residence, on the EV Ranch, is more than a mile from the proposed facility and unlikely to be notably impacted by noise from the site if operated as proposed ("Analysis of Noise from the Proposed WPX Trail Ridge Employee Housing Facility", Oct 2014, prepared by Hankard Environmental). As such, the site is relatively remote and daily operations are unlikely to impact surrounding neighbors, aside regular site access via public and private roads by WPX staff and contractors. According to the submitted traffic study primary access routes originate in Rio Blanco County and predicted impacts on traffic volumes within Garfield County are negligible. The application as presented seems appropriately located distant from neighboring homes and other potentially nonconforming uses that could othenryise yield nuisance issues for neighboring property owners. PVCM!Reply: The foundation system for the Employee Housing Facility consists of a "tie-down" system to ground anchors. Thus there will not be a foundation/basement that can accumulate radon. Please find attached the CDOH approved typical Foundation Plan incorporated into the application in Tab 9- Site Plan noting the foundation system. The Water storage system does not seem to separate water for each use. The Applicant should address how the water storage will preserve fire sprinkler storage from domestic storage." PVCMlreply: The 10,000 gallon potable water storage unit is utilized only for potable water for the Trail Ridge Employee Housing Facility. The 1,600 gallon water storage system for fire suppression is located on the East side of Unit 5 in the Mechanical Room. The ATCO Structures drawings are located in Tab 9- Site Plan. I have attached drawings AAoi. and AAO2 that notes Equipment List number 642 as the 1,600 gallon water tank. This 1,600 gallon water storage system for fire suppression is not connected to the 10,000 gallon potable water storage unit, nor is it connected to any other fixtures within the facility with the exception of the fire sprinklers. The 1,600 gallon fire water storage tank is filled from the exterior of the building via use of a 2-1.f2" coupling. Please contact me with further questions. Based on our discussions with you, this letter clarifies the traffic produced by the proposed storage area noted as "Laydown yard and 60' wide x 125' long building for storage of drilling equipment, hydraulic fracturing equipment, pipe, excavation equipment, maintenance tools and snow-moving equipment." Drilling equipment, hydraulic fracturing equipment, pipe, excavation equipment, maintenance tools and snow-moving equipment are all currently being utilized in the area, irrespective of the construction of this storage facility. Additional traffic trips on Rio Blanco County Road 5 are not anticipated to be generated by this use or on BLM Roads 1009 and 10094. The only roadway that will be affected is the Ta mile private access road. WPX Energy has indicated that during many weeks and months during the year, this storage area will have no trips. ln order to account for this type of use, a 1 trip per day increase in traffic for the storage use has been accounted for. Section 7-7O5 (J-61addresses the provision of a revegetation security for Temporary Employee Housing. This section does not specifically reflect the aforementioned change from Ll2 acre to 1 acre for the revegetation security that is in other sections ofthe Code. To be consistent with the amendment in the remainder of Code regarding this change, I recommend that we do not require a revegetation security for this permit application as it falls below the 1 acre threshold.
