RELATIONSHIP TO THE COMPREHENSIVE PLAN The eastern portion of the parcel is located in District A -New Castle Urban Area of Influence and the western portion in District C -Rural Areas with Minor Environmental Constraints as designated on the Garfield County Comprehensive Plan Management District Map. II. DESCRIPTION OF THE PROPOSAL A. Site Description: The parcel is located between the Colorado River and County ~oad 335. Request: The applicants are requesting several sign code variances: • Variance from Section 5.07.09 to allow for a free-standing sign in excess of the 20 foot maximum.in the NRIRD zone district. The applicants are proposing a 40' free-standing sign; • • Variance from Section 5.07.09(9) which only allows one (1) permitted sign per lot. The applicants are proposing a total of two (2) signs counting the price sign . • The applicants had also requested a variance to allow for a sign 10 feet within the25 foot setback from the County road. Section 5.07.09(2)requires that signs shall maintain a minimum setback of ten (10) feet from the street right-of-way line. Therefore, no Variance is needed for the applicant's proposal. A copy of the applicant's cover letter is attached on page l_, and a graphic portrayal of the placement and design of the signs submitted by the application are attached on pagesS-11 . Ill. MAJOR ISSUES AND CONCERNS 1. Standards for Review. Section 5.07.12 states that a variance from the strict application of the provisions of the sign code may be granted by the County Board of Adjustment, in accordance with the following guidelines: 1) It is the policy of the County to encourage aesthetically pleasing signs without substantial interference with the business to which the sign relates. 2) Projected signs should not substantially obscure any part of another sign related to another use. 3) Excessively large or tall signs should be avoided to prevent visual obstruction of the natural scenery within the County. 4) Variances should not be granted which would allow any business use an unfair advantage over any other business use. 5) Ifit is necessary or reasonable to grant a variance to the strict regulations ofthis chapter, the sign should be limited in sire, height and location in conformance with the propose of the sign. 2 2. Height Variance. The applicant is proposing a 40 foot primary sign, to be located at the southwest comer of the property, near the intersection of County Road 335 and the 1-70 access ramp. The site is partially obscured by the adjacent I-70 ramp, and the difference in grade between I-70 and the subject property is approximately 20 feet in relief change. In stairs opinion, the grade difference does warrant the applicant's request regarding a topographical justification for the height Variance. The final placement of the sign will have to conform to Section 5.07.07(4), as follows: "TheJe shall be no freestanding signs placed at the intersection of two (2) streets wit~"ihe triangillar area defined by a line extending from a point thirty (30) feet from the inter.section of curblines along one (1) street to a point thirty (30) feet from the intersection along the other curbline." 3. Variance 1o'Allow for more than One (I) Sign. Due to changes in the design criteria of Phillips Petroleum, a free standing sign is proposed instead of signs placed above each pump. In stairs opinion, this request does not violate the intent oftheSign Code, and should be granted. The Sign Code, at the time of its adoption, did not take into consideration design standards of individual corporations. 4. Sign Area. The applicants are proposing a sign area of approximately 252 square feet.for the primary sign. Staff feels this is excessive, and violates the following standard of review described in Section 5.07.12: 1) It is the policy of the County to encourage aesthetically pleasing signs without substantial interference with the business to which the sign relates. 5) Ifit is necessary or reasonable to grant a variance to the strict regulations of this chapter, the sign should be limited in size, height and location in conformance with the proposed sign. In stairs opinion, conformance to the 90 square feet requirement does not interfere with the business to which the sign relates. It is important to note that the Colorado River/I-70 Corridor bas been identified by Staff (Comprehensive Plan process) as an important visual corridor for residents and visitors to the area, and the excessive surface area of the proposed primary sign is not consistent with either this designation, or Section 5.07.12(1) and (5). Ill. SUGGESTED FINDINGS I. That the application for the requested Variances were found to be consistent with the requirements and standards of Section 5.07.12 (Variance) of the Garfield County Sign Code of 1978, as amended. 2. That proper publication and public notice was provided as required for the public hearing before the Zoning Board of Adjustment. 3. That the public hearing before the Zoning Board of Adjustment was extensive and complete, that all facts, matters and issues were submitted and that all interested parties were heard at the meeting. 3 IV. RECOMMENDATION Staff feels that the circumstances warrant the granting of the variances pertaining to height and number of signs, due to the topographic limitations of the site in relationship to the elevation ofl-70 adjacent to the property. We are asking for three things, #1 we address Sec. 507.09 maximum sign height. We wish to construct a sign just off the intersection that is 40ft tall. The reason for a special exception is that coming from the West the business is unseen also people pulling RV's and trucks need time to make a decision to exit, and finally if the sign is not 40ft tall the lowwer signs wili be unseen from 1-70 as they will be to close to the ground. Next we address Sec. 507.06.12 signs over gas pumps. Due to changes in gas station canopy construction and new images the major gas com- panies require, they don't want signs above the gas pumps or on the canopy. Their requirments have gone to free standing price signs with Phillips sheilds on top. We are asking for a varience to the location of this sign we wish to place this sign 10 ft inside the 25ft setback from the County Road. With this sign we also would like to address Sec. 507.07 only one sign per business. On top of Phillips price sign they require us to put a Phillips sheild. We feel the price sign by itself would be incomplete without something on it. A Sheild would complete this sign and conform to Phillips sign standards. RELATIQNSHIP TO THE COMPREHENSIVE PI.AN The eastern portion of the parcel is located in District A -New Castle Urban Area of Influence and the western portion in District C -Rural Areas with Minor Environmental Constraints as designated on the Garfield County Comprehensive Plan Management District Map. II. DESCRIPTION OF THE PROPOSAL A. Site Description· The parcel is located between the Colorado River and County Road 335. In July of 1992, the applicant was granted a PUD which allowed for 16 acres of RV spaces, 5 acres of commercial use, and 5 acres of open space. Specific commercial uses consist of2,400 square feet of commercial space which will house a convenience store, R.V. park offices and restroom facilities. Included in the commercial improvements are gasoline pumps. The RV park will consist of 59 spaces, each space with water, sewer, and electric hookups. A vicinity map is attached on page.2:._, and a site plan for the project is attached 1 • • on p~ge (p . B. Request: The applicants are requesting several sign code variances: • • • • Variance from Section 5.07.09 to allow for a free-standing sign in excess of the 20 foot maximum.in the NR/RD zone district. The applicants are proposing a 40' free-standing sign; Variance from Section 5.07.06(12) to allow for a free standing price sign, 0 \(_ as opposed to a sign placed over the gas pump; Variance from Section 5.07.09(9) which only allows one (1) permitted 0 \<' sign per lot. The applicants are proposing a total of two (2) signs " counting the price sign. Varia~ce from Section 5.07.09 which allows for 90 square feet of sign ~(\ ~ _,: area in the NR/RD Zone District. The applicant is proposing a primary 0 . sign with a face area of approximately 252 square feet, almost three (3) · times· the allowable sign area. The applicants had also requested a variance to allow for a sign 10 feet within the 25 fo~t ~tback _fr?m the County road. Section 5.07 .09(2),requir~ that signs O \<_ shall mamtam a mmunum setback often (10) feet from the street nght-of-way line. Therefore, no Variance is needed for the applicant's proposal. A copy of the applicant's cover letter is attached on page 1_, and a graphic portrayal of the placement and design of the signs submitted by the application are attached on pagesS-1\ . Ill. MAJOR ISSUES ANP CONCERNS 1. Standards for Review. Section 5.07.12 states that a variance from the strict application of the provisions of the sign code may be granted by the County Board of Adjustment, in accordance with the following guidelines: 1) It is the policy of the County to encourage aesthetically pleasing signs without substantial interference with the business to which the sign relates. 2) Projected signs should not substantially obscure any part of another sign related to another use. 3) Excessively large or tall signs should be avoided to prevent visual obstruction of the natural scenery within the County. 4) Variances should not be granted which would allow any business use an unfair advantage over any other business use. 5) If it is necessary or reasonable to grant a variance to the strict regulations of this chapter, the sign should be limited in size, height and location in conformance with the propose of the sign. 2 - - - - - - - - - - - - - - - - - - - - - ------------- - - - - - - - - - - - - - - - - - - - -• • 2. Height variance. The applicant is proposing a 40 foot primary sign, to be located at the southwest corner of the property, near the intersection of County Road 335 and the I-70 access ramp. The site is partially obscured by the adjacent I-70 ramp, and the difference in grade between I-70 and the subject property is approximately 20 feet in relief change. In stalT's opinion, the grade difference does warrant the applicant's request regarding a topographical justification for the height Variance. The final placement of the sign will have to conform to Section 5.07.07(4), as follows: "TheJe shall be no freestanding signs placed at the intersection of two (2) streets wit~"ihe triangular area defined by a line extending from a point thirty (30) feet from the intersection of curblines along one (1) street to a point thirty (30) feet from the intersection along the other curbline." 3. Variance to' Allow for more than One (1) Sign. Due to changes in the design criteria of ~hillips Petroleum, a free standing sign is proposed instead of signs placed above each pump. In stalT's opinion, this request does not violate the intent of the Sign Code, and should be granted. The Sign Code, at the time of its adoption, did not take into consideration design standards of individual corporations. . 4. Sign Area. The applicants are proposing a sign area of approximately 252 square feet for the primary sign. Staff feels this is excessive, and violates the following standard of review described in Section 5.07 .12: 1) It is the policy of the County to encourage aesthetically pleasing signs without substantial interference with the business to which the sign relates: 5) !fit is necessary or reasonable to grant a variance to the strict regulations of this chapter, the sign should be limited in size, height and location in conformance with the proposed sign. In stalT's opinion, conformance to the 90 square feet requirement does not interfere with the business to which the sign relates. It is important to note that the Colorado River/I-70 Corridor has been identified by Staff (Comprehensive Plan process) as an important visual corridor for residents and visitors to the area, and the excessive surface area of the proposed primary sign is not consistent with either this designation, or Section 5.07.12(1) and (5). Ill. SUGGESTED FINDINGS 1. That the application for the requested Variances were found to be consistent with the requirements and standards of Section 5.07.12 (Variance) of the Garfield County Sign Code of 1978, as amended. 2. That proper publication and public notice was provided as required for the public hearing before the Zoning Board of Adjustment. 3. That the public hearing before the Zoning Board of Adjustment was extensive and complete, that all facts, matters and issues were submitted and that all interested parties were heard at the meeting. 3 • • IV. RECOMMENDATION Staff feels that the circumstances warrant the granting of the variances pertaining to height and number of signs, due to the topographic limitations of the site in relationship to the elevation ofl-70 adjacent to the property. However, the sign area of the primary sign is excessive in stairs opinion, and the applicant should be required to conform to the 90 square feet requirement. 4 • • ! We are asking for three things, ffl we address Sec. 507.09 maximum sign height. We wish to construct a sign just off the intersection that is 40ft tall. The reason for a special exception is that coming from the West the business is unseen also people pulling RV's and trucks need time to make a decision to exit, and finally if the sign is not 40ft tall the lowfer signs will. be unseen from I-70 as they will be too close to the ground. Next we address Sec. 507.06.12 signs over gas pumps. Due to ch,anges in gas station canopy construction and new images the major gas com- panies require, they don't want signs above the gas pumps or on the canopy. Their requirments have gone to free standing price signs with Phillips s~ds on top. We are asking for a var~ce to the location of this sign,~ wish to place this sign 10 ft inside the 25ft setback from the County Road. With this sign we also would like to address Sec. 507.07 only one sign per business. On top of Phillips price sign they require us to put a Phillips s~ld. We feel the price sign by itself would be incomplete without something on it. A s~d would complete this sign and conform to Phillips sign standards. I do not have an objection to allowing them to have two signs on the property. I do have a problem with the height and square footage of the "location" sign. Visually for the valley corridor, for the residents of Apple Tree and Mountain Shadows and Riverbend, I am against a 40 ft. sign at the intersection of County Road 335 and the I-70 overpass. I will agree to a sign of 30 ft. Also, I think if the object is that the sign be seen from as far to the West as possible, that the applicant think about making the 30 ft. tall sign more on the horizontal. That is, the Phillips symbol and next to it would be stacked the word signs 'DIESEL", "RV PARK", and "STORE". However, I also firmly believe that the square footage of the sign, at 252 sq. ft. per side, is much too far over the allowable size. I think 90 sq. ft. per side would be adequate, especially since the sign will be 10 ft. taller than normally allowed. Although I realize that no variance is required for the gasoline price sign, the applicant might consider moving it either to the east or to the west of the building site where it seems there is plenty of room. All future developments of this lype shall develop a sign code for their proposed uses, which must receive approval from the County Commissioners and which shall be recorded at the time of PUD/Zone Change designation. (A. 82-66) Existing or Nonconforming Signs. Signs existi'ng at the time of the effective date of this Resolution and not in compliance herewith shall be regarded as nonconforming signs which may continue for a period of eight (8) years from the earliest effective date of the substantive provisions or limitations with which the signs do not comply, if the signs are properly repaired and maintained and in conformance with the other regulations of the county. At the end of such eight (8) year period, the signs shall be removed. Nonconforming signs which are structurally altered, relocated or replaced shall comply immediately with all provisions of this sign code. (A. 82-66; 82-90) Variance. A variance from the strict application of the provisions of this code may be granted by the County Board of Adjustment, in accordance with the following guidelines: (1) It is the policy of the county to encourage aesthetically pleasing signs without substantial interference with the business to which the sign relates. (2) Projecting signs should not substantially obscure any part of another sign relating to another use. (3) Excessively large or tall signs should be avoided to prevent visual obstruction of the natural scenery within the county. (4) Variances should not be granted which would allow any business use an unfair advertising advantage over any other business use. 80 • • Garfield County Sign Code 5.07.12 5.07.13 5.07.14 5.08 5.08.01 (5) If it is necessary or reasonable to grant a variance to the strict regulations of this chapter, the sign should be limited in size, height and location in conformance with the purpose of the sign. (A. 82-66) Violations and Penalties. Any person, firm or corporation violating any of the prov1s10ns of this code shall be guilty of a misdemeanor, and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this code is committed, continued or permitted, and upon conviction of any violation such persons shall be punishable by a fine of not more than one hundred dollars ($100.00) or by imprisonment for not more than ten (10) days or both such fine and imprisonment. (A. 82-66) Severability. To the extent that certain parts of this Resolution are found to be unconstitutional, it shall not affect the validity of the remaining sections of this sign code resolution. (A. 82-66) FISCAL IMPACT MITIGATION PROGRAM Statement of Purpose and Authority The Board of County Commissioners for the County of Garfield, State of Colorado (hereinafter the "Board"), supports private activities, including extraction of natural resources, which result in the diversification of the economic base for the County. Economic devel9pment increases the local tax base, provides increased employment opportunities and diversifies the local economy. Through zoning and. subdivision controls, the Board has attempted to require developers to pay a fair share of the public costs associated with development. Major Projects, because of their size, require that the Board set forth an express plan by which local government entities can deal with the impact of large scale development. Unless this is done, there may be an unacceptable deterioration in the quality of life for present and future residents of the County. The purpose of the fiscal impact mitigation program is to condition a land use permit to the sponsor of a Major Project so that the sponsor will participate, as necessary, in a mitigation plan to provide for the timely availability of adequate housing, community facilities and public services during the construction phase of a Major Project. In order to accomplish this, the Board has established a consistent review procedure by which the fiscal impacts on local governments in the impacted area can be determined. The program will be limited in time to that period between the start of construction and the time when construction is complete as specified in Section 5.08.07.10 herein. I do not have an objection to allowing them to have two signs on the property. I do have a problem with the height and square footage of the "location" sign. Visually for the valley corridor, for the residents of Apple Tree and Mountain Shadows and Riverbend, I am against a 40 ft. sign at the intersection of County Road 335 and the I-70 overpass. I will agree to a sign of 30 ft. Also, I think if the object is that the sign be seen from as far to the West as possible, that the applicant think about making the 30 ft. tall sign more on the horizontal. That is, the Phillips symbol and next to it would be stacked the word signs "DIESEL", "RV PARK", and "STORE". However, I also firmly believe that the square footage of the sign, at 252 sq. ft. per side, is much too far over the allowable size. I think 90 sq. ft. per side would be adequate, especially since the sign will be 10 ft. taller than normally allowed. Although I realize that no variance is required for the gasoline price sign, the applicant might consider moving it either to the east or to the west of the building site where it seems there is plenty of room. R90W. of the 6th P.M.; located at 7051 County Road 335, 1/2 mile east of the New Castle I-70 exit on County Road 335. The site consists of 38.335 acres. WelVISDS County Road 335 PUD I. RELATIONSHIP TO THE COMPREHENSIVE PLAN The eastern portion of the parcel is located in District A -New Castle Urban Area of Influence and the western portion in District C -Rural Areas with Minor Environmental Constraints as designated on the Garfield County Comprehensive Plan Management District Map. 11. DESCRIPTION OF THE PROPOSAL A. Site Description: The parcel is located between the Colorado River and County Road 335. Jn July of 1992, the applicant was granted a PUD which allowed for 16 acres of RV spaces, 5 acres of commercial use, and 5 acres of open space. Specific commercial uses consist of2,400 square feet of commercial space which will house a convenience store, R.V. park offices and restroom facilities. Included in the commercial improvements are gasoline pumps. The RV park will consist of 59 spaces, each space with water, sewer, and electric hookups. A vicinity map is attached on page.![,, and a site plan for the project is attached 1 • • on p~gelE_. B. Request: The applicants are requesting several sign code variances: • Variance from Section 5.07.09 to allow for a free-standing sign in excess of the 20 foot maximmn,in the NR/RD zone district. The applicants are proposing a 40' free-standing sign; • Varian~ from Section 5.07.06(12) to allow for a free standing price sign, as opposed to a sign placed over the gas pmnp;, • Variance from Section 5.07.09(9) which only allows one (1) permitted sign per lot. The applicants are proposing a total of two (2) signs counting the price sign. • Varianee from Section 5.07.09 which allows for 90 square feet of sign area in the NR/RD Zone District. The applicant is proposing a primary sign with a face area of approxiniately 252 square feet, almost three (3) times the allowable sign area. The applicants had also requested a variance to allow for a sign 10 feet within the 25 foot setback from the County road. Section 5.07.09(2) requires that signs shall maintain a minimum setback often (10) feel from the street right-of-way line. Therefore, no Variance is needed for the applicant's proposal. A copy of the applicant's cover letter is attached on page 1_, and a graphic portrayal oflhe placement and design of the signs submitted by the application are attached on pages&l\ . III. MAJOR ISSUES AND CONCERNS 1. Standards for Review. Section 5.07.12 states that a variance from the strict application of the provisions of the sign code may be granted by the County Board of Adjuslmenl, in accordance with the following guidelines: 1) It is the policy of the County to encourage aesthetically pleasing signs without substantial interference with the business to which the sign relates. 2) Projected signs should not substantially obscure any part of another sign related lo another use. 3) Excessively large or tall signs should be avoided to prevent visual obstruction of the natural scenery within the County. 4) Variances should not be granted which would allow any business use an unfair advantage over any other business use. 5) !fit is necessary or reasonable to grant a variance to the strict regulations of this chapter, the sign should be limited in size, height and location in conformance with the propose of the sign. 2 • • 2. Height variance. The applicant is proposing a 40 foot primary sign, to be located at the southwest corner of the property, near the intersection of County Road 335 and the I-70 access ramp. The site is partially obscured by the adjacent I-70 ramp, and the difference in grade between I-70 and the subject property is approximately 20 feet in relief change. In stairs opinion, the grade difference does warrant the applicant's request regarding a topographical justification for the height Variance. The final placement .of the sign will have to conform to Section 5.07.07(4), as follows: "1;hr~e sh~ll bepo freestanding signs ~laced at tl~e intersectio~ of tv:o (2) streets with the tnangular area defmed by a !me extendmg from a pomt thirty (30) feet from the internection of curblines along one (I) street to a point thirty (30) feet from the intersection along the other curbline." 3. variance lo' Allow for more than One (I) Sign. Due to changes in the design criteria of Phillips Petroleum, a free standing sign is proposed instead of signs placed above each pump. In stairs opinion, this request does not violate the intent of the Sign Code, and should be granted. TI1e Sign Code, at the time of its adoption, did not take into consideration design standards of individual corporations. 4. Sign Area. The applicants are proposing a sign area of approximately 252 square feet.for the primary sign. Staff feels this is excessive,'and violates the following standard of review described in Section 5.07.12: 1) It is the policy of the County to encourage aesthetically pleasing signs without substantial interference with the business to which the sign relates.'. 5) If it is necessary or reasonable to grant a variance to the strict regulations of this chapter, the sign should be limited in size, height and location in conformance with the proposed sign. In stairs opinion, conformance to the 90 square feet requirement does not interfere with the business to which the sign relates. It is important to note that the Colorado River/I-70 Corridor has been identified by Staff (Comprehensive Plan process) as an important visual corridor for residents and visitors to the area, and the excessive surface area of the proposed primary sign is not consistent with either this designation, or Section 5.07.12(1) and (5). III. SUGGESTED FINDINGS 1. That the application for the requested Variances were found to be consistent with the requirements and standards of Section 5.07.12 (Variance) of the Garfield County Sign Code of 1978, as amended. 2. That proper publication and public notice was provided as required for the public hearing before the Zoning Board of Adjustment. 3. That the public hearing before the Zoning Board of Adjustment was extensive and complete, that all facts, matters and issues were submitted and that all interested parties were heard at the meeting. 3 • • IV. RECOMMENDATION StalT feels that the circumstances warrant the granting of the variances pertaining to height and number of signs, due to the topographic limitations of the site in relationship to the elevation ofl-70 adjacent to the property. We are asking for three things, Ill we address Sec. 507.09 maximum sign height. We wish to construct a sign just off the intersection that is 40ft ta111 The reason for a special exception is that coming from the West the business is unseen also people pulling RV's and trucks need time to make a decision to exit, and finally if the sign is not 40ft tall the lowwer signs will ~e unseen from 1-70 as they will be to close to the ground. Next we address Sec. 507.06.12 signs over gas pumps. Due to changes in gas station canopy construction and new images the major gas com- panies require, they don't want signs above the gas pumps or on the canopy. Their requirments have gone to free standing price signs with Phillips sheilds on top. We are asking for a varience to the. location of this sign we wish to place this sign 10 ft inside the 25ft setback from the County Road. With this sign we also would like to address Sec. 507.07 only one sign per business. On top of Phillips price sign they require us to put a Phillips sheild. We feel the price sign by itself would be incomplete without something on it. We are asking for three things, #1 we address Sec. 507.09 maximum sign height. We wish to construct a sign just off the intersection that is 40ft tall. The reason for a special exception is that coming from the West the business is unseen also people pulling RV's and trucks need time to make a decision to exit, and finally if the sign is not 40ft tall the lowwer signs will be unseen from I-70 as they will be to close to the ground. Next we address Sec. 507.06.12 signs over gas pumps. Due to changes in gas station canopy construction and new images the major gas com- panies require, they don't want signs above the gas pumps or on the canopy. Their requirments have gone to free standing price signs with Phillips sheilds on top. We are asking for a varience to the location of this sign we wish to place this sign 10 ft inside the 25ft setback from the County Road. With this sign we also would like to address Sec. 507.07 only one sign per business. On top of Phillips price sign they require us to put a Phillips sheild. We feel the price sign by itself would be incomplete without something on it. A sheild would complete this sign and conform to Phillips sign standards.
