L,ot B-9, Fairway Park at Aspen Glen Subdivision, Filing I Aspen Glen Subdivision (between Carbondale and Glenwood Springs on SH 82 1 ) I. DESCRIPTION OF TIIE PROPOSAL The owner of lot B-9 requests approval to reconfigure the platted building envelope on the lot. The illustration below depicts the originally approved building envelope in dashed lines and the proposed reconfigured envelope in a gray-hashed form. The reconhguration generally enlarges th" "nrllop"primarily on the east and north sides. The Applicant requests the enlargement to accommodate certain outdoor improvements including a swimming pool. II. STAFF COMMENTS / CONCERNS The subject lot is located in the 3/q acre zone district within Aspen Glen Planned Unit Development (PUD). As you will recall, when Filing I of the Aspen Glen PUD was approved,lots were platted with building envelopes as well as with setbacks setout in the PUD zoning. In most, if not all cases, / 2.44/ acres */- I t,-._'*.EPF**- \ h@,;.4wto/to;/e \ ^[ot E Amended Plat BOCC - 05/15/06 Page 2 the building envelopes were more restrictive than the setbacks in the zoning which is the case of Lot B-9. As such, the proposed expansion will not exceed the required setbacks. The Aspen Glen Homeowners Association has reviewed the change and has no issues with the proposal as stated in their leffer submitted with the Application. Note that portions of the lot are encumbered by the 100-year floodplain. However; as the site plan shows, none of the building envelope expansion gets any closer to the delineated floodplain than is presentlyplatted. Effectively, there is at least a 2O-foot buffer from the envelope of the floodplain. III. AUTHORITY Section 6:10 of the Subdivision regulations states that an amendment may be made to a recorded plat, if such amendment does not 1) increase the number of subdivision lots or dwelling units, or 2) result in the major relocation of a road or add new roads. This request will not result in either of the two aforementioned standards; however, all other applicable state and federal restrictions shall also be met. IV. STAFF RECOMMENDATION Staff recommends that the Board of County Commissioners approve this amended plat request with the following conditions: l.That all representations of the Applicant, either within the Application or stated at the meeting before the Board, shall be considered conditions of approval. Within 90 days of approval, the Amended Final Plat shall be reviewed (paper copy), then signed and dated (rnylar copy) by the County Surveyor, than signed and dated by the Chairman of the Board and recorded in the Clerk and Recorder's Office of Garfield County. The Amended Final Plat shall meet the minimum CRS standards for land survey plats, as required by Colorado state law, and approved by the County Surveyor and shall include, at a minimum, the information outlined in Section 5:22 of the Garfield County Subdivision Regulations.
