PLJD. In this mle, the minimum rear yard setback is 20 feet The applicant's reqtrcst would
encloach l0 feet into that setback.
The Aspen Glen Design Review Committee (DRC) recommends the BOCC approve the proposed
building envelope. Althougb, the tett€r dd€d September 9,2W5 from the Asp€n Glen DRC states
'1he site plan submitted did not identify the bormdaries of the adjusted envelope..." This letter is
included in the application maf€rials. Staff would opine the DRC did not completely review a
complete site planto malce arecommendation of approval to the Board.
The applicant is prcposing a fireplace (open hearlh) rryhich is also a zoning violdion ofthe Asp€Nr
Glen PLID. Resolution y2456 states:
Air Quality

Glen with the uception offow (4) fireplaces permitted in tlrc clublwuse, as well
as allfireplaces ctrrently in place in uisting residences.

The applicant will need to be aware ofthe PLJD rquirements concerning fireplaces, wood burning
stoves, and gas buming stoves.
2. STATT' RECOMMENDATION
Staffis recomme,nding the Board of County Commissioners deny the applicants request to ame,nd
the building e,nvelope for lot IS-8 of Aspen Glenn PLJD Filing 2, based on the current undsrlying
zone requiring a 20 foot rear yard setback The applicants request will encroach into the rear yard
setback by apprcximately 10 feet In effec! the request is a zoning violation ofthe Aspen Glen PUD
setback standards for rea yards.
