to purchase with James Mason being the purchaser.
In order to maintain an approximate 10zo grade on the
driveway, Mr. Mason wishes to move the buir;ing enverope
approximately 30 feet to the south. By doing this the Masoi,s
can avoid doing a switch back in the driveway rvhich u,oulcl

Creek project. ltte areas of ocnoern expressed by Mark upon requestingthe services of Schmueser Cordon Meyer was to address the need for the60" eMPrs provided for debris flow passage underneath the rcad servingthe subdivision.
rn our analysis, we have determined that the present drainage plan as
proposed by Johnson Kunkle Associates is adequate for both debris flovr
and normal- water flovl. However, rne have also determined that r,'e canmaintain the general crcncept of the drainage plan as proposed by John-
son Kunkle with the orception of providing the 60" CMP underneath theroad. The need for the 60" CMP as rnentioned earlier was to pass thedebris flow under the noad. we are proposirg, instead, to provide a24" culvert under the noad at the debris flow fan locations. hle intendto allow the debris flow to pass over the road for trto major reasons.the first beinq that the cost of the 60" cMp versus a 24" cMp is muchgreater; the secrcnd regards rnaintenance. rn naintaining a 60" cMp, itis our feeling that the debris flow uould lodge within the CMp and in-
tense labor rl,ould be required to clean one out. rf the dehris flow is
allowed to sross the road and, at the same time stops, it r,ould be nnrcheasier and cruicker to clean the road with a blade versus intense laborto clear the CMP of debris.
As you can see on the acc,ornpanying drainage map, urhrich is reproducedfrom the Johnson Kunkle map, vre are holdirg the same drainage pran as
Johnson Kunk1e, whereas the only chanqes are in the size of the culvert

Attorney nas adviseo thrs orfice ano the lluuding Officrar not to issue
any additional building permits in the itlitchell Creek Project, Filing wo.1. The reason for tnis oeterminatron is due to the fact that the
developer has not conpleted the agreed upon suodivisron inprovements and
there is no longer any vatrd security in place with the County to
guarantee the conpletion of the improvements.
Until security is in pJ-ace to guarantee the conpletion of the
inprovenents, the County will not issue any additional building permttsfor this develotrment. Mr. iEnton has been advised of this determination
and has indicated that he is trying to obtain the necessary security.

Dear Mark,
This letter is being sent at your request, to explain Mitchell Creek,
Ltd. position on thJmatter of the OrDel1's satellite dish in writing.
When we went through the subdivision process in Garfield County in
1981r w€ indicated on the plans that there would probably be
underground electrical service to the 22 southern lots on our
propeity. When it came time to install the electrical service, the
Cfenwooa Springs Electric System (goU Nastin) wanted to install
overhead servite, because of maintenance, and because all the
existing service in West Glenwood Springs was overhead. We discussed
this witfr at1 lot owners, with all people hotding contracts on lots
in the project, and with any prospective purchasers prior to actual
electrical service installation, and alI agreed. We have required
all secondary runs to be underground.
The electrical service was completed in December, 1984. The limited
partnership did not locate the pole that the electric company placed
to extend service, and there is no transformer on the pole. There
were already existing overhead electrical lines when Mrs. O'Dell
installed her satelli{e dish, and the electric company only installed
an extra pole for service to the subdivision.
We would suggest that Mrs. O'DeII speak to the Gtenwood Springs
Electric System, about the possibility that one of the two
transformerl located in the previously existing line (before Mitchell
Creek) is getting o}d, and therefore interferring with her satellite
reception.

Dear Steve,
Enclosed are copies of several letters concerning water run-off that
were sent to Garfield County in October and November. These letters
state our position on the Notice of Claim sent to Garfield County on
February 28, 1985.
The property claiming damage is presently vacant land, the propertv
owners are concerned that a prescriptive drainage easement will be
created, if run-off water continues to empty onto the property, and
may cause problems when the property is developed. The run-off from
Mitchell Creek PUD is supposed to go into the roadway ditch alongr
County Road 130. That ditch carries a lateral ditch to the subject
property, which means that no roadway ditch exists where Creekside
Court ( road from Mitchell Creek PUD ) enters County Road 130. There is
no place for the water to go but into the lateral and ont.o the subject
property. The subject property is also receiving run-off water from
adjacent developments (specifically Ponderosa) of greater magnitude
than from Mitchell Creek.

County Road 130 was plugged and therefore water was flowing out of the
ditchr we took immediate steps to eliminate the potential for
recurrence of this problem. We have sinc.ej:rsta.Ifgd a drainaqe
culvert under the road, as shown-oalb-elinal plat documents, which
wilt divert most of the water running down the road into the subject
ditch. We cleaned out the existing culvert that crossed County Road
130, that carries the lateral ditch to the subject property, deepened
the existing ditch as needed, revegetating the cut slopes, and this
Spring wiII place several small temporary straw dams to catch run-off
debris from unvegetated areas.

A meeting with the Garfield County Commissioners was held on November
5, 1984 to discuss this very problem. We sent eopies of our
engineer's anticipated flow rates for Mitchell Creek PUD to Mr.
Stoddard on November 21, 1984 along with a letter stating several
other problems involved in this matter.
We have authorized Stephen Connor, attorney to negotiate on our behalf
with Charles M. Stoddard an agreement that hopefully will alleviate
the subject property owners eoncerns about creation of a prescriptive
drainage easement. We will keep you informed as to our progress.

So long as my clients' land remains undeveloped, such increased ffow causes
no undue problem. Our concern is that if such increased flow is permitted to
continue you may acquire a prescriptive right to continue to flow water onto
their land. To accommodate yourconcerns, as well as to protect their rights,
my cJ-ients are willing to grant you a license to use their ditch for such
increased flow revocable at wi1l. This couid perhaps resolve your problem
as well as their rights, since if their ]and is developed, it may then be
possible to divert the water back onto Mitchell Creek or elsewhere without undue
difficulty or expense. However, it cannot be determined at this time what
may develop in the future and my clients' right to terminate any increased flow
onto their land for your development must be maintained.
If you are willing to consider working out a license that accommodates your
concerns as well as those of my clients, please 1et me know by Friday, Dec.

Louis Moda and his neighbor to the east this fall during a coup].e of
severe thunderstorms. we were not aware that Mr. Parkison had been

The MitchelI creek Project improvements were not fu1ly installed
at the time of these intense thunderstorms. We were in the process of
installing water and sewer iirr"=, shaping banks, final grading- and
planting, and we harl not instaffed the maj-or <irainage culvert' which
wilt carry the traditional run-off from the upper portion of The
Mitchell creek-Project to Mitchelt creek. The fact that no vegetation
had yet established, along with the existence of loose top soil in the
new roadway ditches combined with the excess run-off clogging the
culvert that crosses county Road 130, and forcing the draj naqe to flow
across the road. Debris also fi11ed the lateral ditch, where it runs
in front of these two homes causing the run-off to overflow the ditch
banks and deposit silt on the two yards'
When we were notified of the problem, we took temporary steps
immediately to eliminate trre potential for a recurrence of this
problem. A ditch was dug .".o=s the MitcheIl creek road (creekside
court) to temporarily divert water from the upper qllt of the project,
until a culvert is installed. This culveit wilt be permanently
installed this faIl. We also cleaned out the existing eulvert which
crosses county Road r30, and wiclened, ereaned and/or realigned !h-'
ditch where 1ipasses in front of the two residences' We witl finish
reshaping and'Llea1nq disturbed areas when we complete this work'

The final plat of l'litbhelI Creek Project Fil-ing No. I
indicates the l1mits of the tOO year floodplain for Mitchell
Creek. This limit does not correspond to the high water mark
as referred to in Section 5.07.01 of the County Subdivision
Regulations for set backs fiom the hiqh water marks of a live
stream.
The natural vegetation line, that is, the point at {vhieh
natural ground covei is able to exist, is considered the normal
high water mark for a live stream. Mitchel.I Creekts normal
wiatfr varies between 8 and 12 feet. Therefore the building
setbacks for a1I but a sma1l portion of Lot 4 would be 30 feet
or greater from the high water mark. Should the 15 foot setback
from the Westerly ]ot line of Lot 4 be modified to 20 feet, then
the County's requirement for a 30 foot stream setback could be
met.

We have received additional information concerning the City of Glenwood
Springs and the West Glenwood Water District which is supplied by the City.
The District is named as the supplier for the above named subdivisions.
The information provided includes a letter from the City Attorney dated
October 5, 1982 and a letter from the City Engineer dated September 5, L982.
The City clains ownership of the Glenwood Light and Water Conpany
System water rights adjudicated in 1907 in District Court Case No. 466.
These rights in Gttzzly and No Name Creeks are for a total of 20 cfs.
We believe these rights are sufficiently senior that they will be a reliable
supply. Information on the physical availability of water at the cityrs
proposed points of diversion is limited, however, the City Engineer indicates
these sources have been reliable to date.
The City Attorney indicates there is not currently a contract between
the City and the District, but that one may be forthcoming. The Engineerrs
letter indicates peak day denand in West Glenwood is estimated to be 3.09
nillion gallons per day. The attorneyrs letter indicates the proposed
agreement would be for ten years and would be for a maximum of four million
gallons per year. ltre believe the Attorney means four nillion gallons per day.
We can recommend approval of these proposals conditional upon the finaliza-
tion of the contract between the City and the District. We would further con-
dition this upon it being verified the contract is for four rnillion gallons
per day. We request a copy of the contract for our files once it is finalized.

functioning has expired. The City and the district are currently

Fire Mitigation Plan Addressing the Concerns of the Colorado State Forest
Ser vice !
John Dennison of the Colorado State Forest Service, after reviewing this
site, concluded that it would be impossibte to put a road connecting the
back seven tots to the front seven tots. He then suggested that a fire
box be installed at each fire hydrant so that residents of subdivision
could fight wild fires before the Glenwood Springs Fire Department reached
the site. At a meeting on August 20th with Fire Chief Zancanella we asked
him for his opinion on this idea of John Dennisonrs. He said he was
opposed to the idea because homeowners couLd get hurt due to a lack of
knowledgeoffirehy.drantoperation7andbecausethehomeownersmaynot
call the fire department until the fire was out of control.
Dollar Value of.58 Acres of Land be Paid to the Roaring Ftrrk School
District:
The Board of county commissioners in their recommendation stated that
the fee to be paid to the Roaring Fork School District should be either
the calculation used by the school district in their recommendation of ' 58
acres of land x the purchase price per acre of the property, or $200.00
per lot, whichever is greater. we are filing a final plat on 22 of the 29
lots, so the amounE to be paid with filing I is $3,92I.1-0. (This was
calculated using the purchase price value per acre x.58 acres x .7586 the
number of lots in filing one divided by the total * of lots' ) Or $200 x
22 = $4,400.00, so we will agree to pay the $41400'00r when the
commissioners decide that it should be paid.

15. Division of Water Resources Approval of Lega1 Water Supply:
We have been working diligently with the West Glenwood Water District,
the Division of Water Resources, and the City of Glenwood Springs to try
to reach some conclusion as to the probability of water flowing in West
Glenwood. To date, West Glenwood feels there's no problem at all, the
City of Glenwood Springs cannot figure out where the papers are to tell
them if they have water or not, and Division of Water Resources canrt
figure out why any of us want water anyhow. Actually, we feel that we are
being inserted by Garfield County between a rock and hard place. We do
not really know what more we can do to correct an exisEing problem that we
were in no way a part of creating and we ask that the Garfield County
planning @mmission and Board of County Commissioners not use us as a pawn
in a problem that is not ours.

Gtannel profiles are deepened and increased to handle
anticipated debris flow volumes. The grade of channels will
match existing grade wherever possible and is increased only

Roadside Ditches Should be Erosion Protected:
Iengths of roadside ditches are broken consistently by

water flow and volumes will be insignificant as far as erosion.
Ilowever, the 8t slopes do provide very positive drainage which
should eliminate any possibilities of saturation of road
sub-bases.
