On May 6, 2011 the Board of County Commissioners approved two final plats for Filing 9 and Filing 8,
Phase 2, a combined Improvements Agreement for the two filings and a Treasurer Deposit Agreement
for this area within the Elk Springs Subdivision. The platting of these areas required construction of
certain public improvement that were memorialized in an Improvements Agreement and collateralized
with a Treasurer Deposit Agreement.
The Applicant has adequately demonstrated completion of a portion of the required improvements with
submittal of a letter from a licensed engineer certifying to completion and cost as well as a letter
submitted from the contractor as to completion of improvements in accordance with approved plans
and specifications.
Staff recommends approval of the request and authorization for the Chairman to sign the
`Acknowledgement of Partial Satisfaction and Direction to the Treasurer Under Treasurer's Deposit
Agreement' for the release of $61,320.00 to an authorized representative of Elk Springs.

AND DIRECTION TO TREASURER UNDER
TREASURER'S DEPOSIT AGREEMENT
RECITALS
1. Elk Springs, LLC, a Colorado limited liability company ("Elk Springs"), entered
into a 2011 Garfield County Treasurer's Deposit Agreement with the Board of County
Commissioners of Garfield County, Colorado ("BOCC") and the Treasurer of Garfield County,
Colorado ("Treasurer") dated May 20, 2011 and recorded as Reception Number 802818 of the
Real Estate Records of the Garfield County Clerk and Recorder ("Deposit Agreement").
2. Elk Springs has presented certification to the BOCC from a licensed engineer that
construction of Improvements is final except for revegetation and in accordance with the
Improvements Agreement for Elk Springs Filings 9 and 8, Phase 2 between the BOCC and EIk
Springs, recorded as Reception Number 802817 ("IA").
ACKNOWLEDGMENT
NOW, THEREFORE, at the request of Elk Springs and in consideration of the premises
and the prior agreements contained in the Deposit Agreement and the IA, the BOCC hereby:
1. acknowledges satisfaction of the security requirements of the IA, except for revegetation;
2. authorizes disbursement of funds from the Elk Springs Filings 9 and 8, Phase 2
Improvements Treasurer's Account in the amount of $61,320.00, resulting in a remaining
balance of $500.00;
3. authorizes and directs the Treasurer to release the amount of $61,320.00 held in the
Treasurer's Account to an authorized representative of Elk Springs.

Dear Fred:
The purpose of this letter is to formally notify the Board of County Commissioners ("BOCC") of
the completion of all required work for Filings 9 and 8, Phase 2, Elk Springs Subdivision. On behalf of
Elk Springs, LLC, we request that the BOCC review the attached documentation and approve cancellation
and release of all but $500.00 (the estimated cost of revegetation) of the Garfield County Treasurer's
Deposit Agreement for Elk Springs Filings 9 and 8, Phase 2 Subdivision ("Improvements TDA") as the
same was recorded in the Garfield County real estate records on May 20, 2011 as Reception No. 802818.
The following documents are attached to this letter:
1. Letter dated November 30, 2011 from Schrnueser Gordon Meyer certifying completion of
the Filings 9 and 8, Phase 2 Public Improvements, containing the seal of Dean W. Gordon, P.E., together
with the original Engineering Cost Estimate for such subdivision improvements, and a stamped record
drawing of the completed improvements.
2. Letter dated November 22, 2011 from Sacred Ground Excavation, LLC, the contractor
for performance of the Filings 9 and 8, Phase 2 work, stating that the work was completed in accordance
with the plans and specifications.
3. Letter dated June 24, 2011 from HP Geotech, together with related field and lab reports,
confirming that they performed construction observation of the work and that the work was performed in
accordance with the plans and specifications.

4. Letter dated November 14, 2011, from Gary L. McElwee, Project Manager for Elk
Springs, confirming that the work was completed in accordance with the plans and specifications.
5. Letter dated December 12, 2011 from Gary L. McElwee, Project Manager for Elk
Springs, confirming that the necessary revegetation work for Filings 9 and 8, Phase 2 was performed in
accordance with the plans and specifications, together with invoices for the materials purchased to
complete the revegetation.
Based upon the attached information, construction of the Filings 9 and 8, Phase 2 public
improvements has been completed in accordance with the intent of the plans and specifications that were
reviewed and approved by the BOCC's representatives and referenced in Paragraph 2 of the Filings 9 and
8, Phase 2 Subdivision Improvements Agreement between the BOCC and the Elk Springs, LLC. Even
though the revegetation has been completed, we recognize that under the terms of the Subdivision
Improvements Agreement security for revegetation must remain in place until approval of the Garfield
County Vegetation Management Department. We are therefore requesting release of all of the security
except for $500.00 estimated as the cost of revegetation, and to that end, we have also enclosed with this
letter an Acknowledgement of Partial Satisfaction and Direction to Treasurer Under Treasurer's Deposit
Agreement which will authorize the requested release.

Certification of Public Improvements
Dear Larry:
At your request, I have reviewed the status of required public improvements for the above -referenced
project. Those improvements would generally consist of the construction of utilities and roadway
improvements within Filing 9, consistent with Final Plat submittals.
Attached hereto are letters from Sacred Ground Excavation, the contractor of record and Mr. Gary
McElwee, owner's representative, who provided project management during construction. Also attached
is a spreadsheet entitled "Elk Springs/Los Amigos Ranch, Exhibit B", the engineering cost estimate.
Finally is a record of the geotechnical observation of H -P Geotech.
Based on the attached documents and a final visual site inspection conducted by myself, to the best of
my knowledge, all required utility and roadway infrastructure improvements have been completed within
Filing 9 and appear to be constructed and installed in compliance with applicable construction documents.
I trust this is sufficient for your needs to document the completion of the necessary infrastructure for Filing
9.

elevations supplied by Schmueser, Gordon & Meyer. Al !pipe was bedded and backfilled with %" road
base and brought up in 1' lifts and compacted to 95% standard proctor density. Entry way road crossing
were brought up in 8" to 12" lifts (ail 3/" roadbase) and tested by a representative of H -P Geo -tech (all
results supplied to Gary McElwee directly). Erosion logs and natives were placed on finished grades.
The water line extension was done much in the same way as the sewer line. Specifications for size of
pipe and fittings were supplied by Schmueser, Gordon & Meyer (Dean Gordon). T's and fittings were all
mege-lugged to industry standards and was inspected the entire way by a representative of Red Canyon
Water and Sanitation(Scott or Alan Leslie). All pipe was installed level and was bedded and backfilled to
industry standards. All pipe and fittings were sanitized and monitored by a representative of Red Canyon
Water and San. All roaded areas of disturbance were compacted and brought back up in 12" lifts with %"
roadbase and compacted to 95% or better standard proctor density ( all testing done by H -P Geo -tech).
Telephone and electric were run at a depth of four feet with telephone placed one foot above the
electric. All were marked and bedded with %" roadbase and compacted to grade(also Inspected by a
representative of Holy Cross Energy }. Gas was run in its own trench at a depth of 3' and was backfilled
with bedding sand (installed and Inspected by Source Gas).
in conclusion, every effort and every step followed was with quality assurance to perform and provide a
safe and quality product. Pictures were also taken in various stages of each project and can be supplied
upon request.

Summary of Construction Observation and Testing, Kingbird Lane
Roadway Extension, Elk Springs, Garfield County, Colorado
Hepworth-Pawlak Geotechnical, Inc. performed construction observation and compaction
testing for the roadway extension and associated underground utility installation at the
subject site. This letter summarizes or observations and test results. The services were
performed in accordance with our agreement for construction observation and testing
services to Elk Springs, LLC, dated May 4, 2011.
Between May 6 and June 16, 2011 we performed part-time observation and compaction
testing of the utility trenches, roadway subgrade, and sub -base and base course placement
for the roadway extension. The trench backfill and roadway soils were tested and/or
observed to meet the minimum specified 95% standard Proctor density. The roadway
subgrade was stiff clay and stable under truck traffic and did not need a geo-grid material
to stabilize.
Our field and laboratory test results are being provided under separate cover. We will
forward these reports when they become available.

xtension, Sewer line and water line extension for commercial lot.
On the KingBird extension, after it was flagged we stripped and grubbed all topsoil which was 18" to
24" in some places. All soils were stockpiled to the north of Kingbird Lane and new 3" minus was
brought in to accommodate the loss of soils. New utilities were extended to the two new Tots, bedded
and backfilled with %" road base(except gas, bedding sand was used on ail gas as per Source Gas
request), and re -compacted to 95% standard proctor density or better. Some blasting was used in the
process to acquire suggested depths for all utilities. All trenches were brought back up in 8 "to 12" lifts,
and all was tested by a representative of H -P Geo -tech (all testing information was supplied to Gary
McElwee directly from H -P Geo -tech). The three inch minus material was then brought up in lifts of 6" to
8", compacted with large equipment and tested on every lift by H -P Geo-tec h to 95% or better
standard proctor density. Upon completion it was then chip and sealed by an independent contractor.
An water connections were sanitized, tested and monitored by a representative of Red Canyon Water
and Sanitation.
The Sewer line extension was completed in accordance with the plans and specifications supplied
by Schmueser, Gordon & Meyer. The tie-in with the existing sewer was a hand poured base using 3500
psi concrete supplied by Casey Concrete with pre -pour cast risers to bring it up to grade. Pipe was flow -
filled on the outside of risers and then attached to new sewer line. Sewer line was run to grade

Sacred Ground Construction had stripped topsoil from the
planned extension of Kingbird Lane in the Elk Springs
development and was excavating a utility trench at the time of
our site visit.

We observed that the subgrade on the extension of Kingbird
Lane appeared firm and dry and had been adequately stripped
of topsoil. The subgrade had been reportedly wheel rolled with
a dump truck prior to our visit and significant rutting was not
visible anywhere on the roadway. During our visit a 10 wheel
dump truck rolled across the roadway without significant
deflection. The subgrade appeared suitable for placement of
the roadway section materials.
The contractor was informed of our observations. The
contractor stated that he planned to place approximately 10" of
Class 2 base course on the subgrade and compact prior to
placing aggregate base course and asphalt chip seal pavement.
We recommended observing a proof roll of the pit run after
compaction and prior to placement of the aggregate base
course and compaction testing of the aggregate base course.
We also recommended testing the utility trench backfill for
compaction. The contractor stated he would contact us to
schedule a proof roll observation and compaction testing when
ready.

the afternoon to observe construction progress and perform
compaction testing if applicable. We observed that the 3"
aggregate base course had been placed for the raodway but
not yet compacted. It had been windrowed off the west side
where joint water/gas trench was to be excavated. Waterline
trench had been excavated in the cul-de-sac area. No backfill
was in progress and no areas were ready for testing.
Met with Breck Johnson with Sacred Ground and gave him my
contact information. He said he would be excavating for
water/gas trench the rest of the week and would call when he
had some backfill ready for compaction testing.

In my capacity as the Manager for Los Amigos Ranch LLC. /Elk
Springs LLC. I was involved and am aware of the construction of the
extension of Kingbird Road to install public infrastructure
improvements for two additional lots for filing 9.
I also was involved and am aware of the construction to install public
infrastructure improvements to the commercial property known as
filing 6A.
The contractor for the improvements on both locations was Sacred
Ground Excavation LLC. Breck Johnson owner.
This is to certify that the public utility systems and roadway
infrastructure facilities were installed in their entirety and were
installed in compliance with approved construction documents. All
systems hav been tested and are ready for their intended use.

Re -vegetation of Filings 9, 6A
To Whom it May Concern:
In my capacity as Manager for the Los Amigos Ranch LLC./Elk Springs LLC., I directed my ranch foreman
and supervised the re -vegetation of Filing 9 and Filing 6A.
This re -vegetation consisted of applying Mountain Brome grass seed to the perimeter of the new cul -d -
sac at the top of Kingbird Lane to accommodate two (2) additional lots.
In Filing 6A, two (2) trenches at different locations were dug to provide utilities to the lot.
Trench one (1) involved the re -vegetation of approximately 1.5 acres of disturbed pasture soil with a
seeding of Mountain Brome grass raked into the loose soil.
Trench two (2) running parallel to CR 114 and across the entrance to Elk Springs has four (4) erosion
waddles installed to control runoff along with a seeding of Low Grow Mountain Mix grass seed.
Six (6) existing pinion trees that were removed for the excavation were re -planted along with addition of
three (3) more pinions. A layer of bark chips was placed to protect and help with the germination of the
seeds.
I have enclosed the invoices from Rivendell Sod Farm (seed) and Mr. Russ Craig (trees) showing
expenses for this project.

1. Elk Springs, LLC, a Colorado limited liability company ("Elk Springs"), entered
into a 2011 Garfield County Treasurer's Deposit Agreement with the Board of County
Commissioners of Garfield County, Colorado ("BOCC") and the Treasurer of Garfield County,
Colorado ("Treasurer") dated May 20, 2011 and recorded as Reception Number 802818 of the
Real Estate Records of the Garfield County Clerk and Recorder ("Deposit Agreement").
2. Elk Springs has presented certification to the BOCC from a licensed engineer that
construction of Improvements is final except for revegetation and in accordance with the
Improvements Agreement for Elk Springs Filings 9 and 8, Phase 2 between the BOCC and Elk
Springs, recorded as Reception Number 802817 ("IA").
ACKNOWLEDGMENT
NOW, THEREFORE, at the request of Elk Springs and in consideration of the premises
and the prior agreements contained in the Deposit Agreement and the IA, the BOCC hereby:
1. acknowledges satisfaction of the security requirements of the IA, except for revegetation;
2. authorizes disbursement of funds from the Elk Springs Filings 9 and 8, Phase 2
Improvements Treasurer's Account in the amount of $61,320.00, resulting in a remaining
balance of $500.00;
3. authorizes and directs the Treasurer to release the amount of $61,320.00 held in the
Treasurer's Account to an authorized representative of Elk Springs.

On May 6, 2011 the Board of County Commissioners approved a final plat, Improvements Agreement
Treasurer Deposit Agreement for Filing 6A within the Elk Springs Subdivision. The creation of a ±4.6 -
acre parcel for commercial purposes and a ±6.9 -acres open space tract required certain improvements
that were memorialized in an Improvements Agreement and collateralized with a Treasurer Deposit
Agreement.
The Applicant has adequately demonstrated completion of a portion of the required improvements with
submittal of a letter from a licensed engineer certifying to completion and cost as well as a letter
submitted from the contractor as to completion of improvements in accordance with approved plans
and specifications.
Staff recommends approval of the request and authorization for the Chairman to sign the
`Acknowledgement of Partial Satisfaction and Direction to the Treasurer Under Treasurer's Deposit
Agreement for the release of $100,937.00 to an authorized representative of Elk Springs.

Dear Fred:
The purpose of this letter is to formally notify the Board of County Commissioners ("BOCC") of
the completion of all required work for Filing 6A, Elk Springs Subdivision. On behalf of Elk Springs,
LLC, we request that the BOCC review the attached documentation and approve cancellation and release
of all but $1,000.00 (the estimated cost of revegetation) of the Garfield County Treasurer's Deposit
Agreement for Elk Springs Filing 6A Subdivision ("Improvements TDA") as the same was recorded in
the Garfield County real estate records on May 20, 2011 as Reception No. 802813.
The following documents are attached to this letter:
1. Letter dated November 30, 2011 from Schmueser Gordon Meyer certifying completion of
the Filing 6A Public Improvements, containing the seal of Dean W. Gordon, P.E., together with the
original Engineering Cost Estimate for such subdivision improvements, and a stamped record drawing of
the completed improvements.
2. Letter dated November 22, 2011 from Sacred Ground Excavation, LLC, the contractor
for performance of the Filing 6A work, stating that the work was completed in accordance with the plans
and specifications.
3. Letter dated October 31, 2011 from HP Geotech confirming that they performed
construction observation of the work and that the work was performed in accordance with the plans and
specifications.

4. Letter dated November 14, 2011, from Gary L. McElwee, Project Manager for Elk
Springs, confirming that the work was completed in accordance with the plans and specifications.
5. Letter dated December 12, 2011 from Gary L. McElwee, Project Manager for Elk
Springs, confirming that the necessary revegetation work for Filing 6A was performed in accordance with
the plans and specifications, together with invoices for the materials purchased to complete the
revegetation.
Based upon the attached information, construction of the Filing 6A public improvements has been
completed in accordance with the intent of the plans and specifications that were reviewed and approved
by the BOCC's representatives and referenced in Paragraph 2 of the Filing 6A Subdivision Improvements
Agreement between the BOCC and the Elk Springs, LLC. Even though the revegetation has been
completed, we recognize that under the terms of the Subdivision Improvements Agreement security for
revegetation must remain in place until approval of the Garfield County Vegetation Management
Department. We are therefore requesting release of all of the security except for $1,000.00 estimated as
the cost of revegetation, and to that end, we have also enclosed with this letter an Acknowledgement of
Partial Satisfaction and Direction to Treasurer Under Treasurer's Deposit Agreement which will authorize
the requested release.

At your request, I have reviewed the status of required public improvements for the above -referenced
project. Those improvements would generally consist of the construction of utilities serving Filing 6A,
consistent with Final Plat submittals.
Attached hereto are letters from Sacred Ground Excavation, the contractor of record; H -P Geotech,
referencing compaction testing and site observation; and Mr. Gary McElwee, owner's representative, who
provided project management during construction. Also attached is a spreadsheet entitled "Elk
Springs/Los Amigos Ranch, Exhibit B", the engineering cost estimate.
Based on the attached documents and a final visual site inspection conducted by myself, to the best of
my knowledge, all required utility infrastructure improvements have been completed for Filing 6A and
appear to be constructed and installed in compliance with applicable construction documents.
I trust this is sufficient for your needs to document the completion of the necessary infrastructure for Filing
6A.

24" in some places. All soils were stockpiled to the north of Kingbird Lane and new 3" minus was
brought in to accommodate the foss of soils. New utilities were extended to the two new lots, bedded
and backfilled with 3" road base(except gas, bedding sand was used on all gas as per Source Gas
request), and re -compacted to 95% standard proctor density or better. Some blasting was used in the
process to acquire suggested depths for all utilities. Alf trenches were brought back up in 8 "to 12" lifts,
and all was tested by a representative of H -P Geo -tech (all testing information was supplied to Gary
McElwee directly from H -P Geo -tech). The three inch minus material was then brought up in lifts of 6" to
8", compacted with large equipment and tested on every lift by H -P Geo-tec h to 95% or better
standard proctor density. Upon completion it was then chip and sealed by an independent contractor.
All water connections were sanitized, tested and monitored by a representative of Red Canyon Water
and Sanitation.
The Sewer line extension was completed in accordance with the plans and specifications supplied
by Schmueser, Gordon & Meyer. The tie-in with the existing sewer was a hand poured base using 3500
psi concrete supplied by Casey Concrete with pre -pour cast risers to bring it up to grade. Pipe was flow -
filled on the outside of risers and then attached to new sewer line. Sewer line was run to grade
elevations supplied by Schmueser, Gordon & Meyer. Al I pipe was bedded and backfilled with %" road
base and brought up in 1' lifts and compacted to 95% standard proctor density. Entry way road crossing
were brought up in 8" to 12" lifts (all %" roadbase) and tested by a representative of H -P Geo -tech (ail
results supplied to Gary McElwee directly). Erosion logs and natives were placed on finished grades.
The water line extension was done much in the same way as the sewer line. Specifications for size of
pipe and fittings were supplied by Schmueser, Gordon & Meyer (Dean Gordon). T's and fittings were all
mege-lugged to industry standards and was inspected the entire way by a representative of Red Canyon
Water and Sanitation(Scott or Alan Leslie). All pipe was installed level and was bedded and backfilled to
industry standards. All pipe and fittings were sanitized and monitored by a representative of Red Canyon
Water and San. All roaded areas of disturbance were compacted and brought back up in 12" lifts with %"
roadbase and compacted to 95% or better standard proctor density ( all testing done by H -P Geo -tech).
Telephone and electric were run at a depth of four feet with telephone placed one foot above the
electric. All were marked and bedded with 1" roadbase and compacted to grade(also inspected by a
representative of Holy Cross Energy ). Gas was run in its own trench at a depth of 3' and was backfilled
with bedding sand (installed and inspected by Source Gas).
In conclusion, every effort and every step followed was with quality assurance to perform and provide a
safe and quality product. Pictures were also taken in various stages of each project and can be supplied
upon request.

Sumnnary of Compaction Testing, Access Drive Utility Trench Backfill to
Commercial Lot, Elk Springs Subdivision, Garfield County, Colorado
Hepworth-Pawlak Geotechnical, Inc. performed part time observation and compaction
testing of the trench backfill for utilities across the access drive to the proposed
commercial site at Elk Spring Subdivision. This letter summarizes or observations and
test results. The services were supplemental to our agreement for construction
observation and testing services to Elk Springs, LLC, dated May 4, 2011,
Between August 23 and October- 5, 2011 we performed part-time observation and
compaction testing of the utility trench backfill including roadway base course for the
trenches cut through the roadway. The backfill tested included sewerline trench,
waterline trench and the electric, phone, gas and phone line trench. The trench backfill
consisted of'/ inch aggregate base course. The trench backlit! and roadway surface base
course were tested to meet the minimum specified 95% standard Proctor density.
Our test results have been provided under separate cover.

Re -vegetation of Filings 9, 6A
To Whom it May Concern:
In my capacity as Manager for the Los Amigos Ranch LLC./Elk Springs LLC., I directed my ranch foreman
and supervised the re -vegetation of Filing 9 and Filing 6A.
This re -vegetation consisted of applying Mountain Brome grass seed to the perimeter of the new cul -d -
sac at the top of Kingbird Lane to accommodate two (2) additional lots.
In Filing 6A, two (2) trenches at different locations were dug to provide utilities to the lot.
Trench one (1) involved the re -vegetation of approximately 1.5 acres of disturbed pasture soil with a
seeding of Mountain Brome grass raked into the loose soil.
Trench two (2) running parallel to CR 114 and across the entrance to Elk Springs has four (4) erosion
waddles installed to control runoff along with a seeding of Low Grow Mountain Mix grass seed.
Six (6) existing pinion trees that were removed for the excavation were re -planted along with addition of
three (3) more pinions. A layer of bark chips was placed to protect and help with the germination of the
seeds.
I have enclosed the invoices from Rivendell Sod Farm (seed) and Mr. Russ Craig (trees) showing
expenses for this project.
