In order to understand the scope of the work intended under a permit application and
expedite the issuance of a permit it is important that complete information be
provided. Adequate and complete information will prevent delays in the plan review
process. Reviewing a plan and the discovery that required information has not been
provided by the applicant may result in the delay of the permit issuance and in
proceeding with building construction. The owner or contractor may be required to
provide this information before the plan review may proceed. This causes delays
because other plans that are in line for review may be given attention before the new
information may be reviewed after it has been provided to the Building Department.
Please review this document to determine if you have enough information to
design your project and provide adequate information to facilitate a plan
review. If you do not, it may be helpful to obtain a book titled "Dwelling
construction under the Uniform Building Code. This book is available to you
through this department at our cost. Also, please consider using a design
professional for assistance in your design and a construction professional for
construction of your project.
To provide for a more understandable plan in order to determine compliance with the
building, plumbing and mechanical codes, applicants are requested to review the
following check list prior to and during design. Applicants are required to indicate
appropriately and to submit completed check list at time of application for a permit:

This report is regarding the structure on your property, which is
approximately one mile up the Three Mile Creek Road.
The following is a list of items from the Uniform Building Code
with which your structure does not comply. I cannot guarantee
that this list is complete but I believe it covers the majority of
the glaring discrepancies.
1. Need kitchen with kitchen sink. UBC Section 1205(b)
2. Need bathroom with toilet, lavatory, and a bath or shower with
hot and cold running water. UBC Section 1205(b)
3. Need smoke detector(s). UBC Section 1210(a)
4. Stairs should be 8" maximum rise 9" minimum run. Need
code approved handrail (not pass " sphere). UBC Sections
3306(c). and 3306(j).
5. Need guardrail around top of stairs. UBC Section 1711
6. Need fire protection between garage and living area - 5/8"

The above assumes all of the structure below the top of the logs
was existing before alterations began. UBC Section 104 would then
say the pre-existing structure need not exactly conform to current
UBC requirements.

The requirements for running water and toilet facilities may be
appealed to the County Commissioners. 1 understand that they have
allowed systems with septic tanks only, to be installed for a
minimal use cabin. The owner would pump the septic tank when
necessary. Also, one could add a leach field at a ater d..e.
You might be able to stretch this and ask that a vaul•. ivy be
approved.

BOARD OF HEALTH - GRANGE COMPOSTING TOILET AND PUMPABLE VAULT
Commissioner Smith made a motion that the Board adjourn and the Board
of Health convene. Commissioner Arbaney seconded the motion; carried.
Mike Watts, Zoning Enforcement Officer, and the applicant, Jon Grange,
discussed the composting system on Mr. Grange's property, and the
electrical system proposed to run it and heat it. The vault will not
be in place until spring but it will not be needed until then. All
issues will be settled before he uses the site. Commissioner Smith
made a motion that the Board authorize a permit for no less than 1 year
for Jon Grange to install a composting toilet and the 750 -gallon to
1000 -gallon pumpable vault as part of his sanitary sewer system.
Commissioner Arbaney seconded the motion; carried.
EXECUTIVE SESSION - NCIG SPECIAL USE PERMIT LEGAL ADVICE
After discussion with Don regarding necessary legal advice,
Commissioner Smith made a motion that the Board go into Executive
Session to discuss the legal authority of the Board regarding the NCIG
permit. Commissioner Arbaney seconded the motion; carried.
Commissioner Smith made a motion that the Board come out of Executive
Session and reconvene as the Board of County Commissioners.
Commissioner Arbaney seconded the motion; carried.
NCIG SPECIAL USE PERMIT
Don presented a draft of a resolution addressing the issues discussed
in the NCIG Public Hearing and discussed the road standards from the
mine site to Riverbend Subdivision. He stated that case law does not
allow the Board to require the applicant to construct roads, put in
utilities or generally improve areas off the site of the development
unless the criteria is precise which is not the case for Garfield
County roads. Consequently, the applicant cannot be required to build
the road from the mine site to the subdivision to a standard to which
they do not agree. He recommended language requiring only what the
applicant has volunteered to do to the road which is chip and seal;
that the language only require the road to be according to standards
-recommended by the applicant's engineer; and, that the applicant's
engineer submit his plan to the Road & Bridge Supervisor prior to the
work being done so the Board can then decide if the County should do
any sub -grade improvements before chip and seal.
Commissioner Arbaney made a motion that the Chairman be authorized to
sign Resolution No. 91-091 concerning the approval of an application
for a Special Use Permit by NCIG Financial, Inc. consistent with the
first draft provided by the Planning staff together with the changes
discussed during the course of deliberation. Commissioner Smith
seconded the motion; carried.
EXECUTIVE SESSION - BATTLEMENT RESERVOIR ROAD, COUNTY ROAD 318 AND THE
UNION OIL TAX CASE
Commissioner Arbaney made a motion that the Board go into Executive
Session to discuss the Battlement Reservoir Road, County Road 318 and
the Union Oil tax case. Commissioner Smith seconded the motion;
carried. Commissioner Smith made a motion that the Board come out of
Executive Session and reconvene as the Board of County Commissioners.
Commissioner Arbaney seconded the motion; carried.
