HomeMy WebLinkAbout3.0 Director's Decision 03.15.2017March 15, 2017 Garfield County Community Development Department Ursa Operating Company LLC 792 Buckhorn Drive Rifle, CO 81650 ATTN: Cari Mascioli RE: Ursa Minor Modification — Wasatch Bench Brynildson Water Storage Facility (SUAA-03-17-8523) Dear Cari: This correspondence is being provided to you as the authorized representative for the Ursa Operating Company LLC, application for a Minor Modification to a Special Use Permit for the Ursa Wasatch Bench — Brynildson Water Storage Facility. The facility was approved by Resolution 2007-59 and the request is associated with additional facilities required by the CDPHE to meet air quality requirements. The facility is located approximately 5 miles southeast of Rifle off of County Road 315. It is located on property known by Assessor's Parcel No. 2179-191-00-511. The file number for the Minor Modification Application is SUAA-03-17-8523. Pre -application meetings with the Applicant provided direction to process the request as a minor modification and provided direction on the submittals requirements. Pursuant to the Minor Modification process contained in Section 4-106 (B)(1)(a) of the Land Use and Development Code, a Director's Decision is hereby issued approving the Minor Modification to allow two additional tanks, a desander and a skim tank as required to meet CDPHE Air Quality requirements and a loadout area as shown on the amended site plan attached as Exhibit "A". The Director's Decision is issued with a finding that the Application meets the Minor Modification Criteria in Section 4-106 (C) and subject to the following conditions: 108 Eighth Street, Suite 401 Glenwood Springs, Colorado 81601 (970) 945-8212 1. All conditions of approval contained in Resolution No. 2007-59 shall remain in effect. 2. As represented in the Application, the containment will be modified to accommodate the additional tanks and the Applicant's SPCC Plans for spill prevention and containment shall be updated as required by the COGCC. An amended Special Use Permit will also be issued pursuant to this Director's Decision Letter.
