Grantor and Grantee are herein collectively referred to as "Parties." Grantee shall not construct any temporary or permanent improvements on the Lands not otherwise permitted by this Easement. In the event Grantee constructs temporary or permanent improvements on the Lands that are not permitted by this Easement, Grantor may remove them without Grantee's consent but at Grantee's sole expense, which expense Grantor may seek from Grantee. 4. Damages. Grantee shall reasonably protect the Easement Area and the adjacent lands of Grantor from damage caused in whole or in part by acts or omissions of Grantee, its employees, agents, contractors, subcontractors, assigns, lessees, licensees and agents. If by reason of Grantee's operations, there is damage to personal property located on the Lands or there is damage to the surface of the Lands by Grantee that is not associated with reasonable and normal operations and access as contemplated in this Easement, such as damage to structures, fences, culverts, water lines, sewer lines and/or electrical lines, such damage shall be promptly repaired or otherwise remedied by Grantee or Grantee shall promptly pay Grantor an amount reasonably adequate to remedy such damage. 5. Termination of Rights. This Easement and all rights, duties and obligations of the Parties granted herein will terminate automatically if and when Grantee ceases to utilize this Easement for a period of twenty-four (24) consecutive months, or at any time upon written notification of termination by Grantee. 6. Reservation by Grantor. Grantor hereby reserves the right to use the Easement Area and to grant further easement interests in the Lands to other grantees so long as such interests and uses are not inconsistent with and do not unreasonably interfere with the exercise by Grantee of its rights hereunder. 7. No Warranty. Grantor makes no warranty of title in entering into this Easement; provided, however, if it is determined that Grantor does not have the right to authorize grantee to use the lands affected by this Easement for the purposes set forth herein, then Grantee's sole remedy shall be to recover from Grantor those payments made by Grantee for the rights which Grantor did not have the right to grant to Grantee. 8. Maintenance. Grantee shall at all times keep the Easement Area safe and in good order, free of noxious weeds, litter and debris.
