Ursa Operating Company
Dear Glenn:
Thank you for your completeness review of Ursa Operating Company's (Ursa) Phase II Special
Use Permit Applications within the Battlement Mesa PUD. This letter serves Ursa's response to
your NTC letter dated June 29, 2017.
1. Application needs to provide documentation ensuring legal access to the site. This may
include reference to Surface Use Agreements or separate easements.
Response: Permanent legal access is granted by Battlement Mesa Land Investments
in the original Surface Use Agreement paragraphs 1 and 2 on page 2 along with the
Exhibits in the original SUA and the Third Amendment to the SUA which were included
in the original submittal.
2. Application needs to address consistency between the proposed use/site plan and the
Surface Use Agreement (including any exhibits and conditions/provisions).
Response: Paragraph 4 of the Third Amendment to the Surface Use Agreement
provides for use as a central water handling facility as illustrated in Exhibit B of the SUA.
The Site Plan is a proposed plan, but not a final plan as stated on Sheet 1 of 3 for Pad F.
The use of the site has not changed.
3. Letters from water and sanitation providers need to be dated.
Response: Copies of dated "Will Serve" letters from the Town of Silt and Western
Colorado Waste are included with this submittal.
4. Application needs to include an explanation on how the mineral rights were researched,
and should make reference to use of the Garfield County Clerk and Recorders records.

Response: Ursa's Land Department researched mineral rights by using records from
the Garfield County Clerk and Recorder's office.
5. The Geologic Hazards Report identifies slopes as an issue for the site. The report needs
to include site specific assessment and recommendations for the proposed water
storage facility. The recommendations should address cut and fill areas and any
limitations associated with those areas of the site plan.
Response: The Geologic Hazards Report has been updated to include site specific
information addressing the cut and fill areas and slopes for the proposed water storage
facility. Specific engineering recommendations for the site are included in the Drainage
Report which will be submitted at a later date.
6. The Traffic Study needs to address traffic estimates and impacts from the transportation
of the proposed 100 above grade storage tanks to the site during the construction
phase. The Road Assessment needs to specifically address the adequacy of the
roadway for transportation of the above grade, oversize storage tanks to the site.
Response: The Traffic Study has been revised to address traffic estimates and impacts
from transportation of the proposed 100 above grade storage tanks to the site. An
updated Road Assessment Report will be submitted at a later date.
7. The Traffic Study needs to address any special permits, safety provisions or traffic
control needed for hauling storage tanks to the site. The study needs to more clearly
identify the proposed haul route for accessing the site.
Response: The Traffic Study has been revised to address special permits, safety
provision and traffic control that may be required for hauling equipment and the drilling
rig to the site. The proposed haul route is described and shown with a blue line on the
maps included in the Study. A copy of the revised Traffic Study is included in this
submittal.
8. SPCC Plan needs to address the COGCC overall containment requirements specifically
for the water storage facility on Well Pad F and any operational provisions, equipment,
and safety standards that are applicable to the operation of the facility in the case of a
spill or leakage.
Response: The site specific SPCC Plan is a draft only and included in the original
submittal. A final copy will be forwarded to Garfield within six months after construction
of the facility, as specified by EPA rules for SPCC Plans. The draft plan addresses the
EPA and COGCC required containment requirements, equipment, and safety standards.
9. Relationship of the site to the Parachute Watershed Protection District needs to be
provided.
Response: Per conversation with the Town of Parachute, the BMC F Temporary Water
Storage is outside Parachute's Watershed Protection District boundary.

10. The LUMA comments and responses need to be included in the Application.
Response: The LUMA comments and Ursa's responses are included with this
submittal.
A recorded Statement of Authority for Ursa is included in this submittal.

Dear Glenn:
Thank you for your completeness review of Ursa Operating Company's (Ursa) Phase II Special
Use Permit Applications within the Battlement Mesa PUD. This letter provides the remainder of
the requested submittals in response to your NTC letter dated June 29, 2017.
1. Application needs to provide documentation ensuring legal access to the site. This may
include reference to Surface Use Agreements or separate easements.
Response: An additional recorded Temporary Right -of -Way Agreement for access
across Marl and Patricia Martin's property to the BMC F Water Storage Facility is
included with this submittal. The agreement expires after three years which is the
projected end of life of the Water Storage Facility.
6. The Traffic Study needs to address traffic estimates and impacts from the transportation
of the proposed 100 above grade storage tanks to the site during the construction
phase. The Road Assessment needs to specifically address the adequacy of the
roadway for transportation of the above grade, oversize storage tanks to the site.
Response: See the letter from SGM regarding Ursa Phase II Completeness Items
included with this submittal regarding the adequacy of the roadway for transporting the
above grade water storage tanks.
