This letter serves Ursa's response to your NTC letter dated June 29, 2017. 1. A statement of authority is need for Eric Schmela to act on behalf of Battlement Mesa Land Investments Parcel 1 LLC. Response: The Statement of Authority for Eric Schmela to act on behalf of Battlement Mesa Land Investments Parcel 1 LLC is included in this submittal. The recorded SOA will be forwarded to Garfield County as soon as Ursa receives it. Also included is a recorded Statement of Authority for Ursa Operating Company. 2. Letters from water and sanitation providers needed to be dated. Response: Copies of dated "Will Serve" letters from the Town of Silt and Western Colorado Waste are included with this submittal. 3. Application needs to confirm legal access to the site, by additional documentation or clarification if access is addressed in the Surface Use Agreements and amendments. Response: Legal access is granted in the original Surface Use Agreement paragraphs 1 and 2 on page 2 along with the Exhibits in the original SUA and the Third Amendment to the SUA which were included in the original submittal. 4. Mailing addresses for properties within 200 ft. need to be checked to correct some minor errors. Response: The mailing addresses have been reviewed and revised. One address is from the Assessor's website database. The other address is from returned mail showing a forwarding address. In the interest of making the best effort possible to notify all adjacent landowners, both addresses will be used. The revised list is included with this submittal. 5. Application needs to include an explanation on how the mineral rights were researched, and should make reference to use of the Garfield County Clerk and Recorders records. Response: Mineral rights were researched by Ursa's Land Department by using records from the Garfield County Clerk and Recorder's office. 6. The Geologic Hazards Report identifies slopes and corrosive soils as an issue for the site. The report needs to include site specific engineering recommendations for the proposed well pad. The report needs to address cut and fill areas, slope stability, and potential for impacts due to ground water. The report also needs to update sections on proximity to the flood. Response: The Geologic Hazards Report has been updated to include site specific information addressing the cut and fill areas, slope stability, corrosive soils, and potential for impacts due to ground water. The proximity to the flood plain information has been updated showing that this site is not within the Colorado River floodplain. Site specific engineering recommendations are detailed in the Geotechnical Report and Drainage Report which will be submitted at a later date. 7. Application needs to confirm that the noise study was conducted based on the relocated location of the well pad. Response: Data utilized for the sound study was compiled for the previous pad location. However, due to the very slight shift in the pad location (approximately 100'), the data and modelling are still applicable as any changes to dB levels would de minimis (less than 1 dB). See email from Justin Puggioni of Behrens and Associates with this submittal. 8. Per our telephone conference discussion, the Sound Study should be updated to ensure that all references to COGCC standards in various sections and tables are appropriate and accurate. Response: Per COGCC Series 800 Rules, sound levels for drilling activities are allowed up to the Light Industrial level. Completion activities sound levels are allowed up to the Industrial level. These two activities are short-lived. During the production phase of the well, Residential/Agricultural/Rural zone maximum noise levels will apply, per the SUA and COGCC Rules. See the revised Standards Analysis in this submittal. 9. Application needs to confirm and/or update the distances referenced in the various documents from the nearest residences, the church and daycare center. This information should confirm that the COGCC LUMA process is not applicable based on the updated distances. Response: The nearest building unit to the northwest of the well pad is 1,048 ft from the production equipment. Grace Bible Day Care and Church is 1,005 ft from the nearest MIPA-05-17-8552 Well Pad L, NTC Response Page 3 well or production equipment. See Location Drawing included with this submittal. The Impact Analysis has been updated. 10. Visual modelling of the proposed landscaping plan has been provided. The plan should include basic information on the proposed number of plantings and general locations. A plan view of the proposal would be most helpful. Response: This information will be supplied at a later date. 11. Relationship of the site to the Parachute Watershed Protection District needs to be provided. Response: Per conversation with the Town of Parachute, the BMC L Well Pad and Pipeline are inside Parachute's Watershed Protection District boundary. Ursa is in the process of obtaining a Watershed Permit. A copy of the application is included in this submittal. The Permit will be forwarded to Garfield County prior to obtaining final permits from the county. Project Description has been revised. 12. The LUMA comments and responses need to be included in the Application. Response: The LUMA comments and Ursa's responses are included with this submittal.
