QLl J 0 mob,;1HuU .r C) 1 ;s3 lJ pX 04 11 t s GARFIELD COUNTY BUILDING AND PLANNING AGREEMENT REGARDING CERTIFICATE OF OCCUPANCY WHEREAS, Sharon Martin (hereinafter "Owner ") has applied for a Certificate of Occupancy for a house located 0201 D.J. road near Rulison, Garfield County, Colorado and, WHEREAS, the following items have been determined to be apparent defects or deficiencies with the application which prohibits the issuance of a Certificate of Occupancy until they have been resolved pursuant to codes adopted by Garfield County and approved by the Garfield County Chief Building Official: 1.The finished siding has not been installed on the house as of this date. and, WHEREAS, the Owner is willing to make certain assurances and agreements relating to these identified code deficiencies and on the basis of such assurances the County is willing to issue a Certificate of Occupancy. NOW, THEREFORE, it is agreed as follows: A. The Owner agrees to do the following: Deficiency No. 1. The Owner will install or cause to be installed exterior siding or t e complete house. 091\' 1 ACTION REQUIRED OF THE OWNER: The Owner will complete all work described herein and request inspection of all work by the Garfield County Building Department. All work shall be completed in compliance with the stated provisions of the codes currently adopted by Garfield County in a manner that will enable approval of all work. All work, inspections and approval of work shall be completed within thirty (30) days of the date of signing of this document. B. In the event the Owner fails to perform as agreed on any of the above, the County may revoke any permits which may have been granted to the Owner. Subjects: (1) Need to complete agreement for the issuance of a Certificate of Occupancy for your manufactured home if siding is complete. 2) Suspected failure to comply with 1988 Uniform Building Code Regulations as adopted by Garfield County by building, constructing, using and/or occupying an illegal dwelling unit constructed in the garage on the property located at 0201 D -J Road, Rullison, Colorado in Garfield County. Dear Sharon, ITEM #1 - As part of our routine followup, I visited your home to determine if the siding on the home had been completed according to the terms of the agreement signed by you on July 13, 1994, It appears that the siding is complete, so we would like to issue a Certificate of Occupancy for the manufactured home. I also need to obtain the Building Permit record card to retain in our files, ITEM #2 - During this inspection on 7/17/95, I observed what appeared to be a habitable dwelling unit inside the garage located on your property. Visible in the interior of this garage were (1) A bathroom with sink, toilet and shower. (2) Kitchen facilities- stove, refrigerator, sink,ti' - ,p table, counter tops and cabinets. (3) A bed, chairs, carpet, and an interior that has been drywalled. Lights and receptacles were also observed. It would appear that this unit may be in violation of Garfield County zoning and building regulations for the following reasons; 1. Your property is only allowed one residence. 2. An additional dwelling unit requires obtaining a special use permit. We do not find any record of a Special Use Permit in your name. 3. According to information on the County Assessors Office record card, in June of 1993 the Garage in poor condition - Renters destroyed interior, nothing but a shell." It would appear that work has been done since that time. We do not find any record of a permit for this work. If any electrical work was performed in this structure, an electrical permit is required. 4. All dwelling units have structural, health and sanitation concerns that must be addressed. Based on my cursory inspection, it does not appear that this structure meets basic requirements for a dwelling unit. At that time, we can determine the facts in the case and determine what actions may be needed. Here are some of the items we may need; 1) We would need verification that the electric in the garage has successfully passed a final electrical inspection, and that it was done with a permit. 2) Verification that a second habitable dwelling is permitted on your property. 3) Verification that a building Permit was obtained for all work in the garage. The 1988 Uniform Building Code, as adopted by Garfield County specifies in Sec. 301.(a).. "No building or structure regulated by this code shall be erected, constructed, enlarged, altered, repaired, moved, improved, removed, converted or demolished unless a separate permit for each building or structure has first been obtained from the Building Official." If the above items (1 -3) are not verifiable, then changes will have to be made to bring thesituationintocompliancewithallapplicableGarfieldCountyRegulations.
