APPLICANT: Jan Girodo dba. A-1 Traffic Control and Barricade LOCATION: Located in the NEt SW} of Section 22, T6S, RB9W of the 6th P.M.; located at 1280 C.R. 154 on a county island within the City of Glenwood Springs. SITE DATA: Approximately 6250 square feet WATER/SEWER: City of Glenwood Springs ACCESS: Existing driveways EXISTING ZONING: CG (Commercial General) I. RELATIONSHIP TO THE COMPREHENSIVE PLAN The subject property is located in District A - Glenwood Springs Urban Area of Influence as designated on the Garfield County Comprehensive Plan Management District's Map. II. DESCRIPTION OF THE PROPOSAL A. Site Description: The subject property is located on the south side of Grand Avenue in South Glenwood. It is a triangular shaped parcel, a portion owned by the applicant and the remainder leased from the DRG&W railroad. The property is graded level on a bench approximately five (5) feet above the Grand Avenue grade. Currently the entire property is in use with sign storage and two (2) mobile homes (see site plan). B. Reguest: The applicant is requesting a Variance from Section 5.05.03(8) to allow the construction of an eight (8) foot high wooden fence in the required front yard along the entire length of the Grand Avenue frontage. The Variance from Section 3.07.06(1-3) is to allow the use of the required setback areas, which must be "unobstructed from the ground upward," to be used for storage area of signs, barricades, etc. and the construction of a small office/storage building. C. Background: The situation at A-1 Barricade was brought to staff's attention by a complaint from a nearby landowner. The complaint centered around the negative visual impact of the property. In staff's review of the complaint, it was determined that there were two (2) types of zoning violations; the use of a required setback area for storage and the use of mobile homes. Since notified, the applicant has stated that the mobile homes will be removed. In order to rectify the setback issue, the applicants have requested a Variance. • • III. MAJOR ISSUES AND CONCERNS 1. Section 5.05.03(8) allows fences of up to three (3) feet in height in the required front yard. The major reason for this regulation is to provide visibility for vehicles entering and exiting the property and preserve sight distance. The applicants property is elevated above and setback approximately 30 feet from the roadway surface. This provides ample opportunity for a vehicle to fully egress the property and still have adequate visibility. The applicants are proposing to construct an eight (8)foot high wooden fence across the front of the property for screening and security purposes. The rear property line is partially fenced with sheet metal roofing material. The west end, abutting the cemetery, is fenced with chain link. 2. Due to space constraints, the applicant is requesting a waiver from Section 3.07.06(1-3) for storage and the construction of an office. The proposed office/storage building would be constructed at the north end of the parcel in the approximate location of the existing trailer. The building would extend from front to rear for a zero (0) foot front and rear setback. Since the area would be fenced, no detrimental impacts from the building would be experienced. 3. The County Road and Bridge Department has been on-site and has stated no objections to the request. 4. The City of Glenwood Springs has reviewed the application and has no objections. 5. Section 9.05.03 of the Zoning Resolution (Variance - Action by the Board of Adjustment) states that the Board may authorize a variance to relieve hardship, provided: A. That the variance granted is the minimum necessary to alleviate such practical difficulties or undue hardship upon the owner of said property; B. That such relief may be granted without substantial detriment to the public good and without substantially impairing the intent and purpose of the General Plan or this Resolution; C. That the circumstances found to constitute a hardship were not cause by the applicant, are not due to or the result of general conditions in the district, and cannot be practically corrected; D. That the concurring vote of four (4) members of the Board shall be necessary to decide in favor of the appellant. 6. These Variances are necessitated by the unusual shape and size of the subject property. The hardships are not caused by the applicant and cannot be practically corrected. IV. SUGGESTED FINDINGS 1. That the application for Variance was found to be consistent with the requirements and standards of Section 9.05 of the Garfield County Zoning Resolution of 1978, as amended. 2. That proper publication and public notice was provided as required for the public hearing before the Zoning Board of Adjustment. • 1,17 ib •• • • • 3. That the public hearing before the Zoning Board of Adjustment was extensive and complete, that all facts, matters and issues were submitted and that all interested parties were heard at the meeting. V. RECOMMENDATION APPROVAL, subject to the following conditions: 1. The applicants shall construct an eight (8) foot high wooden fence along the entire frontage of the site. The bottom two (2) feet may be constructed of chain link to allow for adequate circulation. 2. The rear yard shall be fenced entirely with fencing in accordance with Section 5.05.03(8). 3. All fencing shall be completed within 90 days of the date of approval of the Variance. 4. II. DESCRIPTION OF THE PROPOSAL A. Site Description: The subject property is located on the south side of Grand Avenue in South Glenwood. It is a triangular shaped parcel, a portion owned by the applicant and the remainder leased from the DRG&W railroad. The property is graded level on a bench approximately five (5) feet above the Grand Avenue grade. Currently the entire property is in use with sign storage and two (2) mobile homes (see site plan). B. Request: The applicant is requesting a Variance from Section 5.05.03(B) to allow the construction of an eight (8) foot high wooden fence in the required front yard along the entire length of the Grand Avenue frontage. The Variance from Section 3.07.06(1-3) is to allow the use of the required setback areas, which must be "unobstructed from the ground upward," to be used for storage area of signs, barricades, etc. and the construction of a small office/storage building. C. Background: The situation at A-1 Barricade was brought to staff's attention by a complaint from a nearby landowner. The complaint centered around the negative visual impact of the property. In staff's review of the complaint, it was determined that there were two (2) types of zoning violations; the use of a required setback area for storage and the use of mobile homes. Since notified, the applicant has stated that the mobile homes will be removed. In order to rectify the setback issue, the applicants have requested a Variance. • • III. MAJOR ISSUES AND CONCERNS 1. Section 5.05.03(8) allows fences of up to three (3) feet in height in the required front yard. The major reason for this regulation is to provide visibility for vehicles entering and exiting the property and preserve sight distance. The applicants property is elevated above and setback approximately 30 feet from the roadway surface. This provides ample opportunity for a vehicle to fully egress the property and still have adequate visibility. The applicants are proposing to construct an eight (8)foot high wooden fence across the front of the property for screening and security purposes. The rear property line is partially fenced with sheet metal roofing material. The west end, abutting the cemetery, is fenced with chain link. 2. Due to space constraints, the applicant is requesting a waiver from Section 3.07.06(1-3) for storage and the construction of an office. The proposed office/storage building would be constructed at the north end of the parcel in the approximate location of the existing trailer. The building would extend from front to rear for a zero (0) foot front and rear setback. Since the area would be fenced, no detrimental impacts from the building would be experienced. 3. The County Road and Bridge Department has been on-site and has stated no objections to the request. 4. The City of Glenwood Springs has reviewed the application and has no objections. 5. Section 9.05.03 of the Zoning Resolution (Variance - Action by the Board of Adjustment) states that the Board may authorize a variance to relieve hardship, provided: A. That the variance granted is the minimum necessary to alleviate such practical difficulties or undue hardship upon the owner of said property; B. That such relief may be granted without substantial detriment to the public good and without substantially impairing the intent and purpose of the General Plan or this Resolution; C. That the circumstances found to constitute a hardship were not cause by the applicant, are not due to or the result of general conditions in the district, and cannot be practically corrected; D. That the concurring vote of four (4) members of the Board shall be necessary to decide in favor of the appellant. 6. These Variances are necessitated by the unusual shape and size of the subject property. The hardships are not caused by the applicant and cannot be practically corrected. IV. SUGGESTED FINDINGS 1. That .the application for Variance was found to be consistent with the requirements and standards of Section 9.05 of the Garfield County Zoning Resolution of 1978, as amended. 2. RELATIONSHIP TO THE COMPREHENSIVE PLAN The subject property is located in District A - Glenwood Springs Urban Area of Influence as designated on the Garfield County Comprehensive Plan Management District's Map. II. DESCRIPTION OF THE PROPOSAL A. Site Description: The subject property is located on the south side of Grand Avenue in South Glenwood. It is a triangular shaped parcel, a portion owned by the applicant and the remainder leased from the DRG&W railroad. The property is graded level on a bench approximately five (5) feet above the Grand Avenue grade. Currently the entire property is in use with sign storage and two (2) mobile homes (see site plan). B. Request: The applicant is requesting a Variance from Section 5.05.03(8) to allow the construction of an eight (8) foot high wooden fence in the required front yard along the entire length of the Grand Avenue frontage. The Variance from Section 3.07.06(1-3) is to allow the use of the required setback areas, which must be "unobstructed from the ground upward," to be used for storage area of signs, barricades, etc. and the construction of a small office/storage building. C. Background: The situation at A-1 Barricade was brought to staff's attention by a complaint from a nearby landowner. The complaint centered around the negative visual impact of the property. In staff's review of the complaint, it was determined that there were two (2) types of zoning violations; the use of a required setback area for storage and the use of mobile homes. Since notified, the applicant has stated that the mobile homes will be removed. In order to rectify the setback issue, the applicants have requested a Variance. • III. MAJOR ISSUES AND CONCERNS 1. Section 5.05.03(8) allows fences of up to three (3) feet in height in the required front yard. The major reason for this regulation is to provide visibility for vehicles entering and exiting the property and preserve sight distance. The applicants property is elevated above and setback approximately 30 feet from the roadway surface. This provides ample opportunity for a vehicle to fully egress the property and still have adequate visibility. The applicants are proposing to construct an eight (8)foot high wooden fence across the front of the property for screening and security purposes. The rear property line is partially fenced with sheet metal roofing material. The west end, abutting the cemetery, is fenced with chain link. 2. Due to space constraints, the applicant is requesting a waiver from Section 3.07.06(1-3) for storage and the construction of an office. The proposed office/storage building would be constructed at the north end of the parcel in the approximate location of the existing trailer. The building would extend from front to rear for a zero (0) foot front and rear setback. Since the area would be fenced, no detrimental impacts from the building would be experienced. 3. The County Road and Bridge Department has been on-site and has stated no objections to the request. 4. The City of Glenwood Springs has reviewed the application and has no objections. 5. Section 9.05.03 of the Zoning Resolution (Variance - Action by the Board of Adjustment) states that the Board may authorize a variance to relieve hardship, provided: A. That the variance granted is the minimum necessary to alleviate such practical difficulties or undue hardship upon the owner of said property; B. That such relief may be granted without substantial detriment to the public good and without substantially impairing the intent and purpose of the General Plan or this Resolution; C. That the circumstances found to constitute a hardship were not cause by the applicant, are not due to or the result of general conditions in the district, and cannot be practically corrected; D. That the concurring vote of four (4) members of the Board shall be necessary to decide in favor of the appellant. 6. These Variances are necessitated by the unusual shape and size of the subject property. The hardships are not caused by the applicant and cannot be practically corrected. IV. ,.SUGGESTED FINDINGS 1. That the application for Variance was found to be consistent with the requirements and standards of Section 9.05 of the Garfield County Zoning Resolution of 1978, as amended. 2. That proper publication and public notice was provided as required for the public hearing before the Zoning Board of Adjustment. • • 3. That the public hearing before the Zoning Board of Adjustment was extensive and complete, that all facts, matters and issues were submitted and that all interested parties were heard at the meeting. Box 1034 Glenwood Springs, CO 81602 RE: 1280 C.R. 154 Dear Jan: It has been brought to our attention by a resident of Glenwood Park that there may be zoning violations on your property. Purported zoning violations include storage problems, "visual pollution", setback violations, lack of screening and non -permitted uses of the property. In response to these allegations, we sent a person from our office to view your facility. His concerns were two -fold. The first concern was in regard to the use of the mobile home and travel trailer as office/storage buildings. The C/G zone district does not permit the use of mobile homes for storage or office purposes. The only structures that are permitted are those that conform with U.B.C. (Uniform Building Code) standards. Since these two (2) units were not installed with the benefit of a permit, they are in conflict with the Zoning Resolution and must be removed. I have enclosed that section of the Zoning Resolution addressing the C/G zone. The other concern raised by our enforcement person is in regards to the use of the setback area or yard. According to the definition in Section 2.02.54 of the Zoning Resolution (see enclosed), the yard is defined as that open space which is to remain unobstructed from the, ground up. Technically, this would require that the yards be reserved as vacant space for a distance of 25 feet from the front lot line, 10 feet from the side lot line and 7.5 feet from the rear lot line. I might add, in response to the complaint, that screening is not automatically required, but may be required at the discretion of the Board of County Commissioners. In other words, I can not require you to screen or landscape, only the Commissioners can make this determination. Our main objection to the current use is the visual impact from our residential property directly across the Roaring Fork River. Because of the nature of the land use we see numerous fluorescent orange signs, cones, and barricades, several small storage buildings, small trailers, vehicles and two mobile homes. All this results in a disastrous appearance, visual pollution at its worst. This is a classic example of the need for strict enforcement of setback and screening code requirements. The property is being used as office, warehouse storage, vehicle storage, open storage, fabrication and repair of traffic control and barricade devices and perhaps residential. The devices are for rent.or use by the company in its conduct of business, 1 understand that the property is zoned C/G, Commercial/General. Even without knowledge of street classification or right-of-way width along Grand Avenue or County Road 154, I can say that all building locations are grossly in violation of code setbacks as are probably some items being stored. It fact it appears that some storage may be occurring on public right of way. In Amendments to the Code it appears that "storage" is a "Special Use". I would be surprised if the County Commissioners would allow such use as is taking place and therefore doubt that a special use permit has been issued.
