I would like to hereby request a 3 month extension for an Exemption Plat
in the Peach Valley area (S1/2 NW1/4 of Section 33, Township 5 South, Range 91
West, of the 6th P.M., County of Garfield, State of Colorado) .
After talking to Sam Phelps, (the Garfield County Surveyor) I find that I did not
have enough surveying information to complete the plat I am working on.
This request would be very much appreciated.

In response to your request for comments regarding the proposed Zelenka
Subdivision Exemption along County Road 238 (Slaughter Gulch Road); I offer
the following statements for your scheduled December 4, 1995, public meeting.
The entire 80 -acre tract is surrounded by public lands administered by this
office. Current uses on the BLM include wildlife habitat, livestock grazing,
and dispersed recreation such as hunting.
1. Ownership of land adjacent to BLM-administered public land does not grant
the adjacent landowner(s) any special rights or privileges for the use of the
public lands.
2. The adjacent public land is currently permitted for livestock grazing.
The proponent should be aware of the location of property boundaries to ensure
no encroachment occurs on public land. I recommend the proponent construct
boundary fencing surrounding the proposed parcels to curtail any problems with
grazing livestock. Should fence construction be required along the boundary
of the private parcels, the fence standards should allow for easy passage by
big game. This office can provide additional information regarding fence
standards upon request.
3. Adjacent public land is open to hunting and other dispersed recreation
activities. The proponents should be aware that hunting and other recreation
uses are allowed on BLM-administered land.
4. Any roads, trails, paths, or utilities (water, electric, phone or
otherwise) crossing BLM would require right-of-way (ROW) permits from this
office. An environmental assessment report would be completed as a part of the
ROW permitting process.
5. The proposed subdivision lies within doer critical writer range.
Encroachment of homesites and people on big game winter ranges can have a
deleterious effect on game herd populations and health. Animals currently
wintering on the private lands will be displaced to adjoining public and
private lands. Habitat conditions on much of the big game winter range in
this area is considered unsatisfactory.
6. The issue of road use and maintenance along the County Road 238 (Slaughter
Gulch) must be addressed. This office supports continued public access to the
Slaughter Gulch area. I am concerned with road maintenance responsibilities
along the route given the possibility of increased vehicle use. Any fences
crossing the road must be maintained and closed during appropriate grazing
season(s) to help control livestock movements.

This letter is in response to your inquiry about the well
test conducted by Samuelson Pump Co. Inc. on October 17, 1995.
The test was conducted at 12 gpm for 7.5 hrs. and the water
level stabilized at 81'-0" indicating a total production greater
than 12 gpm. This well would supply enough water for three

1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of the
permit does not assure the applicant that no injury will occur to another vested water right or preclude another
owner of a vested water right from seeking relief in a civil court action.
2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless
approval of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump
Installation Contractors in accordance with Rule 18.
3) Approved pursuant to CRS 37-92-602(3)(b)(1I)(A) as the only well on a tract of land of 40 acres described as the
SE 1/4, NW 1/4, Sec. 33, Twp. 5 S., Rng. 91 W. of the 6th P.M., Garfield County.
4) Approved for the use of an existing well constructed on October 14, 1995, to a depth of 120 feet, following
submittal of monitoring hole notice MH -26740, acknowledged October 12, 1995.
5) The use of ground water from this well is limited to fire protection, ordinary household purposes inside up to 3
single family dwellings, the irrigation of not more than one acre of home gardens and lawns, and the watering of
domestic animals.
6) The maximum pumping rate shall not exceed 15 GPM.
7) The return flow from the use of the well must be through an individual waste water disposal system of the
non -evaporative type where the water is returned to the same stream system in which the well is located.
This well shall be located within 200 feet of the location specified on this permit 6
