(1973) Section 30-28-101 (10) (a) - (d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted A ri �3 1984 Section 2:20.49, the undersigned__ respectfully petitions the Board of County Commissioners of Garfield County, Colorado, to exempt by Resolution the division of % acre tract of land into tracts of approximately 2 ^� acres each, more or less, from the definitions of "subdivision" and subdivided land" as the terms are used and defined in C.R.S. Sketch map at a minimum scale of 1"=200' showing the legal description of the property, dimension and area of all lots or separate interests to be created, access to a public right-of-way, and any proposed easements for drainage, irrigation, access or utilities; B. Vicinity map at a minimum scale of 1"-2000' showing the general topographic and geographic relation of the proposed exemption to the surrounding area within two (2) miles, for which a copy of U.S.G.S. quadrangle map may be used. C. Copy of the deed showing ownership by the applicant, or a letter from the property owner(s) if other than the applicant; and D. Names and addresses of owners of record of land immediately adjoining and within 200 feet of the proposed exemption, mineral owners and lessees of mineral owners of record of the property to be exempted, and tenants of any structure proposed for conversion; and E. Evidence of the soil types and characteristics of each type; and F. Proof of legal and adequate source of domestic water for each lot created, method of sewage disposal, and letter of approval of fire protection plan from appropriate fire district; and G. If connection to a community or municipal water or sewer system is proposed, a letter from the governing body stating a willingness to serve; and H. Narrative explaining why exemption is being requested; and I. It shall be demonstrated that the parcel existed as described on January 1, 1973 or the parcel as it exists presently is one of not more than three parcels created from a larger parcel as it existed on January 1,• 1973. Due to the limited water supply, we would recommend, at least a 2,00• gallon cistern with at least a 2*' round or square opening in the top, to enable us t• lower a floating pump in the cistern for fire fighting purposes. The width of the proposed access road for the 5 proposed lots is 30' wide. Phis road would access off of County Road 323. The turning radius for the individual lot%is not information that we require. The driveways to each parcel will be placed individually and do not require County permitting since they will not directly access onto a County road. The source of water proposed to serve the parcels is Winn Spring which has an absolute water right for .0023 cubic feet of water per second and a conditional water right for .50 cubic feet of water per second. No water storage is proposed for this exemption. I have enclosed a copy of the application for the Schumann exemption. I hope this information will help answer any further questions you might have. I would appreciate a letter from you, for our records, noting your ability to serve this parcel and/or any concerns you have regarding it's fire protection. And the undersigned Referee having made such investigations as are necessary to determine whether or not the statements in the application are true and having become fully advised with respect to the subject matter of the application does hereby make the following determination and ruling as the Referee in this matter, to -wit: 1. The statements in the application are true. 2. The name of the structure is Winn Spring. 3. The name of the claimant and address is William B. Schumann; 327 Railroad; Rifle, Colorado. 4. The source of the water is a spring tributary to the Colorado River. 5. The spring is located in the SEQNEa of Section 36, T. 6 S., R. 95 W. of the 6th P.M. at a point whence the East Quarter Corner of said Section 36 bears S. 47°38'E. 1,558 feet. 6. On February ,15, 1973, in Case No. W-1271, the Water Referee for Water Division No. 5 awarded to Winn Spring, an absolute water right for 0.0023 cubic foot of water per second of time and a conditional water right for 0.50 cubic foot of water per second of time, to be used for domestic, livestock water and irrigation purposes, with appropriation date of December 31, 1920. The claimant was directed to file an application for biennial finding of reasonable diligence in the development of this conditional water right in June of 1974. This date was extended to June of 1976 by Order of the Court dated March 29, 1974. This Ruling of Referee was confirmed and made a Decree of the Court on April 26, 1973. 30": PAGE215 80CW239 7. During the intervening years, at timely intervals as required by Statute, the claimant has shown to the Court that reasonable diligence has been exercised in the development of this conditional water right, and the Court has ruled that it be continued in full force and effect. 8. On June 11, 1980, the claimant filed, in Water Court for Water Division No. 5, an application to make absolute a conditional water right, in which it is requested that the 0.50 cubic foot of water per second of time previously awarded conditionally to Winn Spring in Case No. W-1271, be made absolute and unconditional by reason of the completion of the appropriation and application of the water to beneficial use in accordance with the Decree. In support of this request it is stated by the claimant that a 4 foot diameter concrete casing 15 feet long has been installed at the spring and backfilled with 80 cubic yards of gravel. The claimant has installed 1500 feet of 12 inch diameter domestic pipeline and 2000 feet of 3 inch diameter irrigation pipeline. A 2 inch gasoline pump was used to pump the water; however, this pump is to be replaced with an electric pump. The water was first applied to beneficial use on September 15, 1979. The Referee does, therefore, conclude that the above entitled application should be granted and that 0.50 cubic foot of water per second of time, date of priority, December 31, 1920, decreed conditionally to Winn Spring for domestic, livestock water and irrigation, be made absolute and unconditional. It is accordingly ORDERED that this ruling shall be filed with the Water Clerk and shall become effective upon such filing, subject to Judicial review pursuant to Section 37-92-304 C.R.S. 1973. It is further ORDERED that a copy of this ruling shall be filed with the appropriate Division Engineer and the State Engineer. The source of the water is a spring tributary to the Colorado River. to -wit: 5. The spring is located in the SE4NE4 of Section 36, T. 6 S., R. 95 W. of the 6th P.M. at a point whence the East Quarter Corner of said Section 36 bears S. 47°38'E. 1,558 feet. 6. On February 15, 1973, in Case No. W-1271, the Water Referee for Water Division No. 5 awarded to Winn Spring, an absolute water right for 0.0023 cubic foot of water per second of time and a conditional water right for 0.50 cubic foot of water per second of time, to be used for domestic, livestock water and irrigation purposes, with appropriation date of December 31, 1920. The claimant was directed to file an application for biennial finding of reasonable diligence in the development of this conditional water right in June of 1974. This date was extended to June of 1976 by Order of the Col' dated March 29, 1974. This Ruling of Referee was confirmed and ma a Decree of the Court on April 26, 1973. - •-3? ►. 567 pcE215 80CW239 7. During the intervening years, at timely intervals as required by Statute, the claimant has shown to the Court that reasonable diligence has been exercised in the development of this conditional water right, and the Court has ruled that it be continued in full force and effect. 8. On June 11, 1980, the claimant filed, in Water Court for Water Division No. 5, an application to make absolute a conditional water right, in which it is requested that the 0.50 cubic foot of water per second of time previously awarded conditionally to Winn Spring in Case No. W-1271, be made absolute and unconditional by reason of the completion of the appropriation and application of the water to beneficial use in accordance with the Decree. In support of this request it is stated by the claimant that a 4 foot diameter concrete casing 15 feet long has been installed at the spring and backfilled with 80 cubic yards of gravel. The claimant has installed 1500 feet of 12 inch diameter domestic pipeline and 2000 feet of 3 inch diameter irrigation pipeline. A 2 inch gasoline pump was used to pump the water; however, this pump is to be replaced with an electric pump. The water was first applied to beneficial use on September 15, 1979. The Referee does, therefore, conclude that the above entitled application should be granted and that 0.50 cubic foot of water per second of time, date of priority, December 31, 1920, decreed conditionally to Winn Spring for domestic, livestock water and irrigation, be made absolute and unconditional. It is accordingly ORDERED that this ruling shall be filed with the Water Clerk and shall become effective upon such filing, subject to Judicial review pursuant to Section 37-92-304 C.R.S. 1973. It is further ORDERED that a copy of this ruling shall be filed with the appropriate Division Engineer and the State Engineer. The West Divide Water Conservancy District has a substitute water supply plan to replace out -of -priority diversions. The District has submitted a service area map to this office. The proposed subdivision is in area "A" where no problem exists with intervening water users not being able to access water carried in the Colorado River. We can recommend approval of this pro- posal subject to the following conditions: 1. The contract is currently between the applicant and the District. Provisions should be made to turn the contract over to the homeowners either as an association or individually. If the contract becomes the responsibility of an association, they should have the power to enforce individual compliance. 2. Lot purchasers should be made aware that use of the springs is sub- ject to payment of annual fees and other terms and conditions of the water allotment contracts. We recommend a covenant to this effect. 3. The contract restricts each lot to an irrigated area of lawn and garden equal to six thousand square feet. By execution of this application, Applicant hereby agrees to the following terms and conditions: 1. Water Rights: Applicant shall own water rights at the point of diversion herein, which will be supplemented by waters leased herein. 2. Quantity: Water in the quantity applied for by the applicant in the amount eet forth above shall be diverted at Applicant's point of diversion from the District's direct flow water rights and, when water is unavailable for diversion pursuant to administration by the Colorado State Engineer during periods when the beforementioned direct flow water right is not in priority, the District shall release for the use of applicant up to said quantity in acre-feet per year of storage water for the Applicant owned or controlled by the District. It is understood that any quantity allotted from direct flow, storage or otherwise, to the Applicant by the District pursuant to its direct flow water right will be limited by the priority of the District's decrees, and that any quantity allotted will only be provided so long as the Applicant fully complies with all of the terms and conditions of this contract. The District and the Applicant recognize that the District's decrees are in the name of the Colorado River Water Conservation District, and the agility of the District to allot a comparable direct flow decree to the Applicant may be dependent on the consent of the Colorado River Water Conservation District. In the event such consent is not forthcoming when the water is needed by the Applicant, the ?Applicant shall be responsible for obtaining other comparable direct flow water rights, and, in such event, the District shall release up to the above mentioned acre-feet per year of storage mater for the Applicant owned or controlled by the District during times when said water right is not in priority. At such time as the District does acquire the ability to allot its direct flow rights as herein provided, such allotment shall be • • made to the Applicant , as upon obtaining by the Applicant of a decree for change in point of diversion fps- said clirec.t flow right to this point of diversion, the District's obligation to deliver storage water as herein provided shall be reduced to accordingly. Such facilities or lands serviced wi11 be located entirely within the boundaries of the District. 4. Decrees tnd Deliver: Exchange releases made by the District out of storage trom Ruedi Reservoir or other works and facilities of the District or from other sources availab:Le to the District shall be delivered t:o the Applicant at the outlet works of said stogy 3qe facilities and release of water at such outlets shall constitute perfoemance of the Di strict'S total delivery obligation. - Deliver ✓ of water by the District from Ruedi Reservoir shall be subject: to the District's lease contract with the United States Hure au of Reclamation.. Releases from other facilities available to District shall be subject to the laws, rules and regulations governing releases therefrom.. Furthermore, the District hereby expressly reserves the right to store water and to make exchange releases fr.orn structures that may be built or controlled by the l:7istshiest in the feature, so long as t:he water service to the Applicant is not impaired by said action. Any quantity of Applicant's allocation not 'delivered to or used by Applicant by the end of eaeh water year (October 1) shall revert to the water supplies cf the District. Such reversion shall not entitle applicant t:o any refund of pa} rnent made for such water 5. Alternate Point: of Diversion: Requests for alternate points c,f diversion of the District '5 water rights or stc age water may be required in order to provide Applicant' the wager service contemplated hereunder. The District reserves the exclusive right to review and approve any conditions which may be attached to jiadi.cia1 approval of said alternate point of diversion as contemplated or necessary to serve Applicant's facilities or lands. Applicant acknowledges and agrees that it shall be solely responsible :for the procedures a .legal and engineering costs necessary for any changes in water a:ictht:s contemplated herein and further agreee to indemnify th'e Disstrect: from any costs or losses rebated thereto. Applicant is solely responsible for providing • 1 work's and facilities necessary to obtain divert the waters at said alternate point of diversion and deliver: them to Applicant's :intended beneficial use. Irrespective of the amount for water actually transferred t:o the Applicant's point of diversion, the Applicant shall make annual payments t.r: the District based upon the amount of water allotted under this agreement. 6. Annual a�, Payment: Ann sal payment: for the water service described herein shall be determined annually by the Board of. Directors of the District at :a per acre-foot rate. The initial annual payment shall be made, in fell, within thirty (30) days after the date of notice to the Applicant that the initial payment is due. Said notice will advise the Applicant, among other things, of the water delivery ye..n: to which the intitial payment shall apply and the price which i; :applicable to that: year. Annual payments for e.ach year thereafter shall be due and payable by the Applicant on or 'before each January. 1. If payment is not made within ten (10) days after t:he date of said written notice, Applicant shall at District's sole option nave no further richt, title or interest under this contract without further notice; and the allotment of water, as herein made, may be transferred, leased,, or otherwise disposed of at the discretion of the board of Directors of the District. In the event: water deliveries hereunder are made in cooperation 'with some other person, corporation, quasi -municipal entity, or gevei rr:m ft:al entity, said person, corporation, quasi --municipal entity or governmental entity i., hereby authorized to curtail water service to Applicant. . without liability to the District, or said other person or entity, in any respect at the sole opt:ion and request of the District. Said service may continue to be terni.nated as long as payments contemplated hereunder, together w.th all past due payments, are in arrears. 7. Said agreement may contain, but shall not be limited to, a provision within the terms of standard allotment contracts of t:he District; additional annual monetary consideration for extension of District delivery services and for additional admini.traeiorr;, operation and maintenance costs; or for other costs to the District which may arise through services made available t:o the Applicant.. 11. Chane of Use: The District reserves the exclusive right: to review, reapprove or disapprove any proposed change in use of the water allotted hereunder to the extent such change in use and/or change i:n land use would require approval of local cr state governmental authorities pursuant: to land use laws now cr hereafter in existence. 12. Use and £lace of ilse: Applicant: ac r es to use the water in the manner and on the property described in Exhibit A attached hereto or in any operation and maintenance agreement provided by Applicant:. The springs adjudicated in Water Court Case 80CW239 are very junior and would not be a reliable water supply. We believe five additional exempt wells would cause injury to vested water rights and could not offer any assurance that permits would be issued. It appears this property is located within the West Divide Water Conser- vancy District. Augmentation or exchange water should be available from the District.
