Re: SB 35 Exemption Request
Dear Mr. Schuman:
This letter is in regard to the above referenced application which you
currently have pending with the Garfield County Planning Department and,
based on our records, has not received any final approval.
Additional submittals or conditions of approval remain to be satisfied
prior to any final approval of your application. These conditions are
outlined on your Resolution of Conditional Approval or in the minutes of
your meeting with the Board of County Commissioners and are available
through this office. Our staff is available to assist you in clarifying
what conditions remain to be completed.
The standard time limit of 120 days and your requested extensions to
satisfy these conditions, has expired. We request that you contact this
office within 30 days and indicate if you are still actively pursuing
approval of your proposal. If this is the case, further extensions can be
requested.
If you do not intend to pursue final approval or do not contact this
office within 30 days, it will be necessary for this office to begin
action to formally withdraw any approvals and close your file.
We encourage you to contact this office as soon as possible and look
forward to working with you in regard to this matter.

On May 6, 1985, the Board of County Commissioners heard and approved your
120 day extension request to meet the conditions of approval for your S.B.
35 exemption. All conditions need to be satisfied by September 9, 1985.
Enclosed is a list of the conditions of approval tor your information.

regarding the exemption or your conditions of approval.

SENATE BILL 35 EXEMPTION REQUEST OF W. B. SCHUMANN.
County Planner Cindy Houben reviewed the history of this exemption stating that
instead of the five smaller lots originally applied for, Mr. Schumann moved
lines on the plat so that this exemption concerns the creation of four new lots
on his parcel of land. The only opposing response in the original request was
from an adjacent landowner who did not want to see the area split into small
lots. The Division of Water Resources recommended Mr. Schumann obtain more
water from West Divide Water Conservancy District which he did. Ms. Houben
read the staff comments. Commissioner Drinkhouse made a motion that the Senate
Bill 35 Exemption request be approved with the following conditions:
1. Prior to final approval, the boundary line adjustment requirements of the
Garfield County Subdivision Regulations shall be submitted for the
existing lot.
2. Only 4 lots shall be created and that these 4 lots shall be in compliance
with all Garfield County Exemption and Zoning Regulations.
3. That approval of the proposed sources of water supply be obtained from
the Division of Water Resources prior to final approval.
4. That a plat be submitted to the Department of Development and recorded in
the Clerk and Recorder's office. This plat shall include:
a. Written legal description for each lot including all access, utility
and maintenance easements (access road, water line, spring, ditch,
etc )
b. A signature block for the Board of County Couuuissioners and the
County Surveyor.
c. The plat shall read "Schumann Exemption" and make reference to the
Resolution number approving the exemption.
d. A plat note shall read no further exemptions shall be allowed on
parcels created by this exemption.
5. Prior to final approval, a centrally located 2,000 gallon cistern shall
be installed with a minimum of a 2 1/2 foot round or square opening on
the top as per the Parachute Rural Fire Departments"s suggestion.
6. The applicant shall deed a portion of the existing water rights to the
spring or water rights obtained from the West Divide Water Conservancy
District to each lot.
7. $600.00 shall be submitted to the Department of Development, prior to
final approval for the school impact fee.
8. The applicant has 120 days to meet all conditions.
9. No further exemptions shall be granted on the parcels created by this
exemption.
Commissioner Cerise seconded the motion; carried.
In regards to the change in PUD for the Rifle Golf Course, the coumissioners
directed reapplication.
With prior approval, Chairman Velasquez signed the Mitchell Creek Subdivision
Improvement agreement.
County Attorney Earl Rhodes presented the amended letter on county letterhead
from the Department of Corrections supporting the area selection for state
correction facility near Rifle provided there is not opposition and there is an
election required.
Commissioner Cerise made a motion that the Chairman be authorized to sign
Resolution No. 84-223 concerning an intergovernmental agreement for county
workers' compensation pool. Commissioner Drinkhouse seconded the motion;
carried.
Upon the request of County Attorney Earl Rhodes and after a discussion with the
Department of Development, Couuuissioner Cerise made a motion that the Chairman
be authorized to sign the amendment to the Chipperfield Subdivision Improvement
Agreement. Commissioner Drinkhouse seconded the motion; carried.

request for a 90 day extension to meet the Conditions of Approval of your
S.B. 35 exemption. This means that all Conditions must be met no later
