AGREEMENT REGARDING
CERTIFICATE OF OCCUPANCY
WHEREAS, Matthew Van Portfliet, (hereinafte.r "Owner") has
applied for a Certificate of Occupancy for a house located at
2074 109 Road, Garfield County, Colorado under permit No. 5237,
issued August, 30, 1994 and,
WHEREAS, the following items have been determined to be
apparent defects or deficiencies with the application which
encumber the issuance of a Certificate of Occupancy until they
have been resolved pursuant to codes adopted by Garfield County
and approved by the Garfield County Chief Building Official:
Deficiency #1 -Back stairs and decks have not been completed.
Deficiency #2 -Guardrail has not been installed at entranceway
from the garage to the home.
Deficiency #3 -Soffit ventilation has not been installed.
WHEREAS, the Owner is willing to make certain assurances
and agreements relating to these identified code deficiencies and
on the basis of such assurances the County is willing to issue a
Certificate of Occupancy.
NOW, THEREFORE, it is agreed as follows:
A. The Owner agrees to do the following:
ACTION REQUIRED OF THE OWNER:
Deficiency No. 1.-Complete the rear deck and stairs according to
the approved plans, and following all relevant Building Code
Criteria for construction, guardrail spacing, and stairway rise
and run. Until this deck and the stairs have passed a final
inspection, access to this deck will be solidly blocked to
prevent access.
Deficiency No. 2 -P~operly install a guardrail at the stairway
from the garage to the hom~. Follow all applicable building codes.
Deficiency No. 3. -Properly add soffit vents to complete roof
structure ventilation system. Ensure that the net free
ventilating area is at least l/150th of the area of the space ventilated.

FURTHER ACTION REQUIRED OF THE OWNER:
The Owner will complete all work described herein and
request inspection of all work by the Garfield County
Building Department. All work shall be completed in
compliance with the stated provisions of the codes
currently adopted by Garfield County in a manner that
will enable approval of all work. All work,
inspections and approval of work shall be completed
within thirty (30) days of the date of signing of this
document.
B. In the event the Owner fails to perform as agreed on any
of the above, the County may revoke any permits which may
have been granted to the Owner. The County may require the
habitation and occupancy of the house cease immediately.
C. This agreement is binding upon the heirs, successors in
title, and assigns of the parties.
