ISSUANCE OF THIS PERMIT DOES NOT CONFER A WATER RIGHT
CONDrTIONS OF APPROVAL
1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of the
permit does not assure the applicant that no injury will occur to another vested water right or preclude another
owner of a vested water right from seeking relief in a civil coun action.
2) The construction of this well shall be in compliance with the Water Well Construction and Pump Installation Rules
2 CCR 402-2, unless approval of a variance has been granted by the State Board of Examiners of Water Well
Construction and Pump Installation Contractors in accordance with Rule 17.
3) Approved pursuant to CRS 37-90-137(2) for the construction of a well appropriating ground water tributary to the
Colorado River as an alternate point of diversion to the Avalanche Canal and Siphon on the condition that the well
be operated only when a water allotment contract between the well owner and ll'!e West Divide Water Conservancy
District for the release of replacement water from Ruedi Reservoir is in effect, or under an approved plan for
augmentation.
4) The use of ground water from this well is limited to ordinary household purposes inside one (1) single family
dwelling and the irrigation of not more than one (1) acre of home gardens and lawns.
5) The maximum pumping rate shall not exceed 15 GPM.
6) The average annual of amount of ground water to be appropriated shall not exceed two (2) acre-feet.
7) A totalizing flow m&ter must be installed on this well and maintained in good working order. Permanent records of
all diversions mu•>! be maintained by the well owner (recorded at least annually) and submitted to the Division
Engineer upon request
8) The well shall be constructed not more than 200 feet from the location specified on this permit, and more than 600
feet from any existing well.
9) The owner shall mark the well in a conspicuous place with well permit number(s), name of the aquifer, and coun
case number(s) as appropriate. The owner shall take necessary means and precautions to preserve these

Subject: Building permit status at 6693 County Road 309, Parachute
Dear Ms. Wells:
It has come to my attention that the Single Family Dwelling Unit located at the above address has
not had an inspection within the last 180 days or has not had a final inspection and a Certificate of
Occupancy has not been issued by Garfield County.
A permit (#4755) for construction was issued on May 18, 1993. There have not been any
requests for inspections as of this date.
The UBC (Uniform Building Code) and other codes adopted by Garfield County require the
following:
1. Construction under a permit issued by this department must be commenced within 180
days of the date of issuance in order for the permit to remain valid.
2. Work authorized under the permit cannot be suspended or abandoned once begun, for a
period of more than 180 days if the permit is to remain valid.
3. The Uniform Building Code as adopted by Garfield County require the requesting of a
final inspection by the owner or contractor and completion of a final inspection by this
department prior to the occupancy of the building.
I am requesting and it is required that you contact this department regarding the status of this
project within fifteen (15) days of the date of this letter. Thank you for your cooperation and if

I received your letter regarding Permit 4 755 status dated 21 Dec 93 on Friday. My father
recently talked to Don Owens about the status of my building and we certainly would like to
meet with you soon.
From our side, we were unable to start construction last summer as planned because of
several problems: high cost estimates (twice the architects estimate) meant possible changes to
reduce the overall cost of the structure, the concrete subcontractor delayed 6 weeks because of
weather which in turn delayed my _specialty wall contractor at least until fall, and a possible
method change for the high north wall of the structure which the specialty contractor balked at
doing at the last minute. My father discussed these delays and problems twice about options
with Jim McMurray who assured him the department would work with and assist us through
the situation. Further, the death of my mother in May and my 12-16 hour workdays from June
until November kept me from being available and involved as I planned. The rammed earth
method is best done in good weather which means no work now until 1994. No work has been
started on the project to date, so no inspection has been requested. Mr. Owens noted no specific
problems to my father during his visit.
I will contact you to arrange a meeting at your convenience. Please let me know what
information and such you require to keep this permit on track and viable. Thank you for your
patience.

Dear Ms. Wells:
Regarding our earlier conversation today about your proposed home. Based
upon the application and the past correspondence regarding this project
between this department and you, I propose the following to clarify the
status of your permit.
If you begin construction of your home that is consistent with the plan
already approved by this department by June 1, 1994 you will be
considered to be in compliance with the building code. If construction has
not began by June 1, 1994 the permit will be considered to be expired
under provisions of Section 303 (d) of the Uniform Building Code. A new
permit application will be required, a plan review made and approved and
all fees paid prior to resuming construction.
As I explained earlier, this section of the code states that if construction
has not begun within 180 days of the issuance of a permit, the permit will
expire. Correspondence indicates that your have been given the
consideration of being maintained in a non expired status. The above
referenced code section also states that if work has been abandoned for
180 days after the project has started, the permit expires. If you are not
requesting inspections within a 180 day period you will need to
communicate in writing the status and progress on the project.

Dear Mr. Hougland:
Thank you for talking with me over the phone on May 25, 1994
about attempts Marion Wells has made to comply with your June 1,
1994 deadline to commence work on her home at the above
referenced address. As I explained, Marion had lined up Dave
Johnson to excavate on her property so that Cal Simmons could
pour her concrete foundation. Mr. Johnson contacted her this
week to advise her that he could not complete excavation by June
1. Ms. Wells contacted other contractors but was unable to
schedule excavation before June 1.
You kindly agreed to extend the deadline for Ms. Wells to
commence work up to and including July 1, 1994. In the event
that she runs into difficulty locating available contractors
again, we will contact you to advise you of the status before
July 1. As you know, the summer months are often very busy for
these contractors and she may have difficulty proceeding as
scheduled. Nevertheless, we hope to meet that deadline.
Thank you very much for your cooperation. Please feel free
to contact me if you wish to discuss this further.
