BEFORE THE BOARD OF COUNTY COMMISSIONERS OF
GARFIELD COUNTY, COLORADO
PETITION FOR EXEMPTION
Pursuant to the provisions of 12 Colo. Rev. Stat. §§
30-28-101 (10) (a) to -101 (10) (d) (1973) , as amended, and the
Subdivision Regulations, Garfield County, Colorado §§ 1.02.
17(d) and 3.02.01 (Sept. 1972), as amended, the undersigned
respectfully petition the Board of County Commissioners of
Garfield County, Colorado, to exempt by resolution the 0.015
acre parcel described in Exhibit "A" to this Petition from
the definitions of "subdivision" and "subdivided land" as the
terms are used in the foregoing statutes and regulations for
the reasons stated below.
1.0 Property Location. The two ownerships, more par-
ticularly described hereinafter, are located at or near the
Southerly territorial limits of the City of Glenwood Springs,
Garfield County, Colorado, fronting upon and Northeasterly of
the right-of-way of Colorado Highway No. 82.
2.0 Ownerships. The ownerships are:
2.1 Parcel A (Vittum). The 0.015 acre parcel,
described in Exhibit "A", is presently owned by Joseph W. Vittum,
and this parcel constitutes a part of the overall ownership of
Parcel B.
2.2 Parcel B (Glenwood Supply). This 0.521 acre

parcel, described in Exhibit "B", is presently owned by Joseph
W. Vittum, and this parcel is presently improved with improve-
ments and an asphalt paved yard for the business operations of
Glenwood Supply Company, a plumbing supply operation.
2.3 Parcel C (Schuster). This 0.52 acre parcel,
described in Exhibit "C", is presently owned by Raymond W.
Schuster, Beverly G. Schuster (husband and wife), and Edward
M. Schuster and Dorothy M. Schuster (husband and wife), and
improvements are being constructed thereon to compliment and
be a part of the operations of Glenwood Supply Company.
3.0 Purpose of Exemption. The purpose of the requested
exemption is to permit the integration of the improvements to
be constructed on Parcel C with the existing improvements con-
structed on Parcel B, and to further facilitate this improvement
integration by the creation and use of a common, party -wall be-
tween the two ownerships and the improvements thereon. To create
the common or party -wall, the approximate Northwesterly five feet
(5') of Parcel B must be conveyed to the owners of Parcel C
(Vittum to Schusters). The purpose of this exemption is to per-
mit this functional and economic use of the two continguous pro-
perties.
4.0 Zoning. All of the property which is involved in
this Petition is zoned "C / G -- COMMERCIAL / GENERAL" as defined
in the Zoning Resolution, Garfield County, Colorado § 3.09 (April

1975).
5.0 Water. All of the property which is involved in
this Petition is served by water from and through the system
of the City of Glenwood Springs, Colorado.
6.0 Sewage. All of the property which is involved in
this Petition is served by a septic tank system. The improve-
ments being constructed on Parcel C will not contain any toilet
facilities. Employees will have and continue to have adequate
and proper toilet facilities in the existing improvements on
Parcel B.
7.0 Ingress and Egress. All of the property which is
involved in this Petition is adequately served for purposes of
ingress and egress by Colorado State Highway No. 82 which abuts
and is contiguous to the property.
8.0 Planning Considerations. The requested division
is in accordance with the general purposes and intention of the
statutes of the State of Colorado and the subdivision regulations
of Garfield County, Colorado, and should, therefore, be exempted
from the definition of the terms "subdivision" and "subdivided
land" therein.

EXHIBIT "A" -- PARCEL A
A tract of land situated in the NW4SW4 of Section 22, T. 6 S.,
R. 89 W., 6th P.M., County of Garfield, State of Colorado, said
tract of land is more particularly described as follows:
Beginning at a point on the Northeasterly right-of-way line of
Colorado State Highway No. 82 whence the West Quarter -Corner of
said Section 22 bears: N. 69°10'00" W. 1060.57 feet; thence N.
50°51'00" E. 130.93 feet; thence S. 38°54'00" E. 5.62 feet; thence
S. 51°30'07" W. 129.63 feet, more or less to a point on the North-
easterly right-of-way line of said Highway; thence 4.34 feet along
the arc of a curve to the right, having a radius of 2735.10 feet,
the chord of which bears N. 56°26'26" W. 4.34 feet, more or less,
to the point of beginning.
The above described tract of land contains 0.015 acres of land,
more or less.
Parcel owned by Joseph W. Vittum to be conveyed to Raymond W.
Schuster and Beverly G. Schuster and Edward M. Schuster and
Dorothy B. Schuster.

EXHIBIT "B" -- PARCEL B
A tract of land situated in the NASA of Section 22, T. 6 S.,
R. 89 W., 6th P.M. described as beginning at a point on the North-
easterly right-of-way line of State Highway No. 82 as constructed
and in place under Department of Highways, State of Colorado, Pro-
ject S 0130(7) whence the West Quarter -Corner of said Section 22
bears: N. 69°10' W. 1060.57 feet; thence N. 50°51' E. 130.93
f et; thence S. 38°54' E. 230.70 feet; thence S. 50°40' W. 65.78
feet to the Northeasterly right-of-way line of said State Highway
No. 82; thence along the arc of a curve to the right having a
radius of 2735.00 feet a distance of 239.7 feet (the chord of this
arc bears N. 54°40' W. a distance of 239.6 feet), said arc being
along the Northeasterly right-of-way line of above State Highway
No. 82, to the point of beginning.
The foregoing parcel of land contains 0.521 acres of land, more
or less.
Parcel owned by Joseph W. Vittum, site of present Glenwood
Supply Company building.

EXHIBIT "C" -- PARCEL C
A parcel of land situated in the NW4SW4 of Section 22, T. 6 S.,
R. 89 W., 6th P.M., lying Northeasterly of the Northeasterly
right-of-way line of State Highway No. 82, said parcel of land
being more particularly described as follows:
Beginning at a point on the Northeasterly right-of-way line
of said Highway whence the West Quarter -Corner of said Section
22 bears: N. 71°59'45" W. 914.57 feet; thence N. 50°51'00" E.
166.40 feet; thence S. 38°54'00" E. 150.00 feet; thence S. 50°
51'00" W. 135.13 feet to a point on the Northeasterly right-of-
way line of said Highway; thence N. 50°36'00" W. 149.00 feet along
the Northeasterly right-of-way line of said Highway; thence N. 53°
50'30" W. 4.10 feet along the Northeasterly right-of-way line of
said Highway, to the point of beginning.
The foregoing parcel of land contains 0.52 acres of land, more
or less.
