APPLICANT: Bob Scarrow LOCATION: A parcel located in the NW 1/4 and the W 1/2 NE 1/4 Section 28, T6S, R89W SITE DATA: The site consists of 218 acres WATER: Private Central System SEWER: Private Central System ACCESS: Private access off of County Road 127 EXISTING ZONING: R/L/SD ADJACENT ZONING: R/L/SD, A/R/RD, and O/S I. RELATIONSHIP TO THE COMPREHENSIVE PLAN The proposed lots are located in District F, Rural Areas with Severe Environmental Constraints, as designated on the Comprehensive Plan, Management Districts Map. II. DESCRIPTION OF THE PROPOSAL A. Site Description: The site is located in a rural area with land uses including single family residences, and open space. Significant slopes are found on the site and a small stream runs through proposed Lot 1. B. Project Description: The applicant proposes to divide the site into 3 lots approximately 3.01, 9.74, and 205.25 acres in size. The proposed lots will be served by a central water system (115,000 GPD, 2,000 gallons storage) and a central septic system designed for 10 dwelling units, currently serving 2. C. History: Numerous smaller parcels have been created out of the present parcel, however no splits since 1973 have been recorded. III.MAJOR ISSUES AND CONCERNS 1. Soils information on the site indicates severe limitations to development based on slopes, stones in the soil, and depth to rock. 2. Verbal comments from adjacent property owners served by the central water system have indicated problems with water pressure and concern whether the system is capable of handling additional dwelling units. 3. The applicant's submittals have established a legal source of water (.177 cfs) for the subdivision. The adequacy of the system to serve additional dwelling units is dependent on the number of units presently served and should be determined prior to any final approval. • • 4. No records of any inspections or issuance of permits for the existing septic system were found in Garfield County Sanitation Department Records. Confirmation from the designing engineer should be submitted establishing the ability of the system to handle additional dwelling units. 5. The lot configuration proposed by the applicant appears to result in the creation of an additional 2 lots less than 35 acres in size due to adjacent property boundaries. Clarification and correction of the legal descriptions of the proposed lots to eliminate this situation should be accomplished. IV. SUGGESTED FINDINGS 1. The proper posting and public notice was provided as required for the meeting before the Board of County Commissioners. 2. That the meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. 3. That for the above stated and other reasons, the proposed exemption is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. V. RECOMMENDATION APPROVAL, with the following conditions: 1. That the following plat notes be included on the recorded Exemption Plat: A) Each lot may be subject to engineered foundations due to soils limitations. B) Each lot shall be required to submit a detailed soils study with the building permit application to determine if engineered foundations will be required. 2. That easements for water and sewer lines be shown on the Exemption Plat. 3. That the applicant shall submit a statement, or other acceptable documentation from the designing engineer, that the existing central septic system is designed to handle the proposed additional dwelling units. /4' 4. That the applicant shall establish the adequacy of the water system to service additional dwelling units. This shall be based Ac- on the number of units currently served, system capacities and acceptable standards of usage. Ai 5. That School Impact fees in the amount of $200 per lot be paid for the creation of two new lots. 6. All representations of the applicant, either within the application or stated at the hearing before the Board of County Commissioners, shall be considered conditions of approval. 7.
