I. RELATIONSHIP TO THE COMPREHENSIVE PLAN
The subject property is located in District B -Rural Subdivision with Central
Water/Sewer as designated on the Garfield County Comprehensive Plan Management
Districts Map.
II. DESCRIPIION OF THE PROPOSAL

A. Site Description: The subject property is located within the Elk Creek
Subdivision and is currently vacant. The lot is 11 O' x 60', and is typical of lots
within the subdivision. The Elk Creek development was approved in 1965, prior
to the adoption of zoning or subdivision regulations by Garfield County. The
location of the lot is shown on page-3 -.
B. Requesl · The applicant is requesting a variance from the twenty-five (25) foot
rear yard ,setback to allow a nineteen (19) foot setback. The purpose of this
request is to allow the applicant sufficient developable area to place a 66' x 14'
single-wide mobile home on the lot (see application on pages ¥-1-5' ) .
MAJOR ISSUES AND CONCERNS

Section 3.11.06(2) requires a twenty-five (25) foot setback from the rear lot line.
The subject lot is elongated and relatively narrow (see the applicant's depiction
on page L). The depiction assumes the building envelope if the variance is
granted by the Board of Adjustment. The applicant's mobile home cannot be

placed on the property without violating the setbacks as described in Section
3.11.06(2) due to the narrowness of the parcel.
Section 9.05.03 of the Zoning Resolution (Variance -Action by the
Board of Adjustment) states that the Board may authorize a variance to
relieve hardship, provided:
A. That the variance granted is the minimum necessary to alleviate such
practical difficulties or undue hardship upon the owner of said property;
B. That such relief may be granted without substantial detriment to the
public good and without substantially impairing the intent and purpose
of the General Plan or this Resolution;
C. That the circumstances found to constitute a hardship were not cause by
the applicant, are not due to or the result of general conditions in the
district, and cannot be practically corrected;
D. That the concurring vote of four (4) members of the Board shall be
necessary to decide in favor of the appellant.
The Elk Creek Development was approved prior to any zoning regulations that
addressed building setbacks. This has resulted in the majority of structures
within the subdivision NOT meeting the above-cited setbacks. The Elk Creek
Homeowner's Association has approved the applicant's variance request, based
in part on the non-compliance of the majority of structures within the
subdivision.
Thisrequestisnecessitated by the unusual shape and size of the subject property.
The hardships are not caused by the applicant and cannot be practically
corrected.
IV. SUGGESTED FINDINGS

That the application for Variance was found to be consistent with the
requirements and standards of Section 9.05 of the Garfield County Zoning
Resolution of 1978, as amended.
That proper publication and public notice was provided as required for the
public hearing before the Zoning Board of Adjustment.
3. That the public heating before the Zoning Board of Adjustment was extensive
and complete, that all facts, matters and issues were submitted and that all
interested.parties were heard at the meeting.
RECOMMENDATION
APPROVAL, subject to the following conditions:
l. All required Building and I.S.D.S. permits shall be obtained.

Dear Mr. & Mrs. Orgill:

Due to circumstances beyond your control, we had to cancel the October 21, 1993 Board of
Adjustment hearing, due to the lack of a quorum. Without at least four members of the Board
present, a quorum cannot be established to take a legal action on a variance request.
Unfortunately, we only have five members available to establish a quorwn and only three of
them could be present.
As I noted previously, this is a requirement that you have no way of controlling. A new
hearing has been set for November 16th, 1993 at 7:00 p.m. for which the noticing requirements
will be the responsibility of this office. If this creates a hardship with a lending institution and
this letter does not answer all of their questions, feel free to have them call or write to me at
their convenience.
I apologire for any inconvenience and hope that the variance issue can be dealt with quickly.

I. RELATIONSHIP TO THE COMPREHENSIYE PLAN
The subject property is located in District B -Rural Subdivision with Central
Water/Sewer as designated on the Garfield County Comprehensive Plan Management
Districts Map.
II. DESCRIPTION OF THE PROPOSAL

Site Description: The subject property is located within the Elk Creek
Subdivision and is currently vacant. The lot is 11 O' x 60', and is typical oflots
within the subdivision. The Elk Creek development was approved in 1965, prior
to the adoption of zoning or subdivision regulations by Garfield County. The
location of the lot is shown on page-3-.
Request: The applicant is requesting a variance from the twenty-five (25) foot
rear yard ,setback to allow a nineteen (19) foot setback. The purpose of this
request is to allow the applicant sufficient developable area to place a 66' x 14'
single-wide mobile home on the lot (see application on pages l/'1--S"° ) .
III. MAJOR ISSUES AND CONCERNS

Section 3.11.06(2) requires a twenty-five (25) foot setback from the rear lot line.
The subject lot is elongated and relatively narrow (see the applicant's depiction
on page ..k__). The depiction assumes the building envelope if the variance is
granted by the Board of Adjustment. The applicant's mobile home cannot be

placed on the property without violating the setbacks as described in Section
3.11.06(2) due to the narrowness of the parcel.
Section 9.05.03 of the Zoning Resolution (Variance -Action by the
Board of Adjustment) states that the Board may authorize a variance to
relieve hardship, provided:
A. That the variance granted is the minimum necessary to alleviate such
practical difficulties or undue hardship upon the owner of said property;
B. That such relief may be granted without substantial detriment to the
public good and without substantially impairing the intent and purpose
of the General Plan or this Resolution;
C. That the circumstances found to constitute a hardship were not cause by
the applicant, are not due to or the result of general conditions in the
district, and cannot be practically corrected;
D. That the concurring vote of four (4) members of the Board shall be
necessary to decide in favor of the appellant.
The Elk Creek Development was approved prior to any zoning regulations that
addressed building setbacks. This has resulted in the majority of structures
within the subdivision NOT meeting the above-cited setbacks. The Elk Creek
Homeowner's Association has approved the applicant's variance request, based
in part on the non-compliance of the majority of structures within the
subdivision.

The hardships are not caused by the applicant and cannot be practically
corrected.
IV. SUGGESTED FINDINGS

I. That the application for Variance was found to be consistent with the
requirements and standards of Section 9.05 of the Garfield County Zoning
Resolution of 1978, as amended.
2. That proper publication and public notice was provided as required for the
public hearing before the Zoning Board of Adjustment.
3. That the public hearing before the Zoning Board of Adjustment was extensive
and complete, that all facts, matters and issues were submitted and that all
interested, parties were heard at the meeting.
RECOMMENDATION
APPROVAL, subject to the following conditions:

To whom it may concern:
We, the undersigned, in our capacity as elected directors of the Elk Creek Homeowner's
Association, have been asked to comment on a request for a setback variance for the above
described property. We do not claim to speak for any neighbor' ov resident in the
development, but as the entity responsible for the roads and water system in the development.
Since the Elk Creek Development was filed in June of 1965, and since at that time no
setbacks were required, many, if not most of the homes in the development do not comply
with the standards now in effect. we have no objection to a variance being gra'nted. We do
not believe that a variance, if granted, will adversely affect the association in any way.

hearing before the Zoning Board of Adjustment on October 21, 1993, at 3:30 p.m., in Suite 301,
Garfield County Courthouse, 109 8U1 Street, Glenwood Springs, Colorado. It is suggested you
or your authorized representative be in attendance.
A copy of U1e enclosed public notice should be submitted to the Glenwood Post or other
newspaper of general circulation for publication one time, al least, 15 days prior to the hearing.
You should contact the paper directly regarding obtaining the proof of publication and billing.

TAKE NOTICE that Lanea J. and Philip J. Orgill have applied to the Zoning Board of
Adjustment, Garfield County, State of Colorado, to grant a Variance in connection with the
following described properly situated in the County of Garfield, Slate of Colorado; to-wit:
