Dear Mr. & Mrs. Boat:
Please consider this letter to be official notification that on January 23, 1995, the Garfield
County Board of Adjustment approved your request for a variance from Section 3.02.06(1 )-
Minimum Setback, Front Yard to allow the completion of the proposed dwelling unit. The
proposed variance would place the west wall of the structure 24. 1 feet from the required 25'
setback.

Please find enclosed the proof of publication and billing from the Glenwood Post for
the variance request. Also enclosed are receipts of certified mall doted January 9,
1995 and return receipts from four of the five property owners. We have not
rece~ed the return receipt from Royal and Diane Warlnner. I spoke with Diane
Warlnner on Friday, January 20. She has not been able to get to the New Castle
post office to pick up her certified letter. She was going to try to go there on
Saturday the 21st. I have enclosed the receipt for the certified letter sent to her.

A. Site Description: The subject property is located within the Riverbend
Subdivision (Lot 4, Block 2, Amended Riverhead Subdivision, Filing #2), east
of the Town of New Castle. Improvements on the site include a initial
excavati~ fora foundation for a single-family home. A vicinity map is attached
on page_~. A "Foundation Location Survey" is s.#l:d on page~. and the
application for the variance is attached on pages
B. Request: The applicant is requesting a variance from the required twenty-five
(25) foot front yard setback front yard setback on the west side of the lot to
complete the proposed dwelling unit. The proposed variance would the place the
west wall of the structure 24.1 feet from the required setback (less then one foot
variance). The applicant has indicated that a minor survey error is the primary
reason for the request.
II. MAJOR ISSUES AND CONCERNS
A. Zoning: The front yard setback from an local street within the PUD zone
district is 25 feet from the lotline.

B. Section 9.05.03 slates that "by reason of exceptional narrowness, shallowness or
shape of the specific piece of property at the time of this resolution or by reason
of exceptional topographic conditions or other extraordinary and exceptional
situation or condition of such piece of property,'' the Board may authorize a
variance. In addition, the Board must also find that:
I. That the variance granted is the minimum necessary to alleviate such
practical difficulties or undue hardship upon the owner of said property;
and
2. That such relief may be granted without substantial detriment to the
public good and without substantially impairing the intent and purpose
of the General Plan or this Resolution; and
3. That the circumstances found to constitute a hardship was not caused by
the applicant, are not due to or the result of general conditions in the
district, and cannot be practically corrected; and
4. That the concurring vote of four ( 4) members of the Board shall be
necessary to decide in favor of the applicant.
C. The total encroachment into the front yard setback will be virtually
imperceptible by adjacent property owners. In addition, the lot in question is
quite steep, and the request will facilitate positive drainage around the
foundation, located initially to minimize total site disturbance.
IV. SUGGESTED FINDINGS
I. That the application for Variance was found to be consistent with the
requirements and standards of Section 9.05 of the Garfield County Zoning
Resolution of 1978, as amended.
2. That proper publication and public notice was provided as required for the
public hearing before the Zoning Board of Adjustment.
3. That the public hearing before the Zoning Board of Adjustment was extensive
and complete, that all facts, matters and issues were submitted and that all
interested parties were heard at the meeting.
V. RECOMMENDATION
APPROVAL of the proposed variance as requested.

This lot is quite steep which makes it dif.1:icult to establish and Mi'lintain ·--···-
positive drainage on the backside of the h:>use. In locating the house on the lot

for the foundation as far back into the hill as I felt I could and still "lilintain msitive
drainage for the remainder of the slope behind the house. I then used a survey
instrument to shoot the line between the two mints highlighted in yellow. (The mint
circled was oot located until later.) U!?ing these two points and olacinq footings as
far back in the excavation as p::>ssible it appeared that I would be beyond the 25' R.0.1~.
setback by approximately 2 feet. Hc:Mever, while stripping and trailering the foundation
concrete fornl\\Drk I located a third pin (Circled). At that time I resurveyed and
found the foundation to partially lie within the 25' setback. "lhile there was a
significant surveying error on my part, an additional 12" was oot available in an already
very extensive excavation and still provide and maintain positive drainage for the
finished product.

Dear Steve:
Your application for a Variance to the Garfield County Zoning Resolution of 1984, to allow
for an encroachment into the required front yard setback has been scheduled for a public
hearing before the Zoning Board of Adjustment on January 23rd, 1995, at 7:00 PM, in Suite
30 I, Garfield County Courthouse, 109 8th Street, Glenwood Springs, Colorado. His suggested
you or your authoriz.ed representative be in attendance.
The public notice must be submitted to the Glenwood Post or other newspaper of general
circulation for publication one time, at least, 15 days prior to the hearing. You are responsible
for contacting the paper directly regarding obtaining the proof of publication and billing. In
addition, copies of the public notice form will must be mailed by certified return-receipt to all
property owners within 200 feet of your property no less than five (5) days prior to the hearing.
The proof of publication from the newspaper, certificates of mailing and return-receipts from
the mailing must be submitted to the Planning Department prior to the public hearing.

PUBLIC NOTICE
TAKE NOTICE that RB HOMES, INC. have applied to the Zoning Board of Adjustment,
Garfield County, State of Colorado, to grant a Variance in connection with the following
described property situated in the County of Garfield, State of Colorado; to-wit:
Legal Description: Lot 4, Block 3, Amended Riverbend Subdivision Filing #2, according to
the plat recorded under Reception #299710 of the records of Garfield County, Clerk and
Recorders Office.
Practical Description: Located at 0364GlenEagle Circle, Riverbend Subdivision, New Castle.
Said Variance application is to allow a reduction in the required 25 foot front setback on the
above-described property.
All persons affected by the proposed Variance application are invited to appear and state their
views, protests or objections. If you can not appear personally at such hearing, then you are
urged to state your views by letter, particularly if you have objections to such Variance
application request, as the Zoning Board of Adjustment will give consideration to the
comments of surrounding property owners and others affected in deciding whether to grant or
deny the request for the Variance. This Variance application maybe reviewed at the office of
the Planning Department located at 109 8th Street, Suite 303, Garfield County Courthouse,
Glenwood Springs, Colorado, between the hoursof8:00 a.m. and 5:00 p.m., Monday through
Friday.
