He stated that the barn "does not appear to adversely affect sight distance. I believe the County maintains the road. However, I am concerned that the barn would be demolished if the road were widened in the future". B. Garfield County Road & Rricjge Dept • Commented that this road does not lie under their jurisdiction. A letter dated 7/12/99 was received from a concerned neighbor who is opposed to the : 11,c variance (see page e)). Steve Hacket, the Garfield County Code Enforcement Officer, investigated the use of the building on 7/15/99. The only items he observed being stored were a horse trailer, truck, and tractor. 111. MAJOR ISSUES AND CONCERNS A. Zoning: A setback is the minimum dimension of a required yard (section 2.02.48). A yard is the open space on a lot unobstructed from the ground upward (section 2.02.54). A front lot line is the boundary of a lot dividing it from the adjacent street (section 2.02.34-1). It was explained to the applicant (via phone on 6/23/99) that the bam would not be allowed to be used for storage of any equipment or vehicles that are not employed for the purposes of agriculture. It was further explained that if the building was used as a garage a building permit would be required. B. Variance Criteria: Section 9.05.03 of the Zoning Resolution sets forth the criteria upon which a variance may be granted. The applicant states "I am requesting this variance due to the exceptional topographic conditions of this property, the drainages, and the steepness, all which makes it a hardship to me". The site is about 27 acres and while it does have steep terrain, there are other level areas on which to build a barn. Since this site was formerly platted for eleven (11) lots it could be argued that at least ten (10) other building sites exist. Any hardship would be a self-imposed one. Furthermore, the variance requested must be the minimum necessary. There is also a possibility of locating the barn further to the west so that the encroachment into the setback is not so substantial. Approval of this variance may cause the widening of State Highway 325 to be more cumbersome in the future. The zoning code, which requires setbacks, applies to all Garfield County residents equally. If the Board makes a practice of approving variances on any criteria except strictly what is provided by code, dangerous precedents are created. IV. $11GGESTED FINDINGS 1. That the application for Variance was found to be inconsistent with the requirements and standards of Section 9.05 of the Garfield County Zoning Resolution of 1978, as amended. 2. Hackett: This is my written statement for your review, which indicates the time frame for the moving of the barn. For now 1 am doing my best. I have removed 3 huge pick up loads of' Deer feed and wildlife habitat. I will burn it as soon as it is safe to Do so. 1 have spoken with an excavator Dave Johnson Construction for a price on leveling and the proper drainage, fill and new gravel for the additional drive area. 1 spoke with my original builder Rick Kuester to give me another bid to form & build a new concrete slab 28 x 28. He is presently too busy to even give me a bid. 1 spoke with another builder Mr. Wilson; he can not get to me until the first of the year. Spoke with a house mover 13i11 Bailey Movers from Clifton, Co. to possibly move the barn. He made no time commitment as yet. He would try and fit me in some where. But the cost to move the barn is over $2500.00 + He also offered $ 2500 for the building, I already paid $12,900 for. And so it goes. This mover will have to remove more natural landscape, as he moves the building. 1 then called Webb Crane Co. out of Glenwood. They could possibly lift the barn over the vegetation. Mr. Tom Saunders father passed away in Florida and Tom could not get back with me until after the 12th for his price and timing. I do hope this progress report is presently adequate. This was an honest error, is definitely a hardship and a terrible expense. So be it. A sorry taxpayer.
