Adjustment, Garfield County, State of Colorado, to grant a variance to the Garfield County Zoning
Resolution of 1978, as amended, in connection with the following described property situated in the

I. DESCRIPTION OF THE PROPOSAL
A. Request: The applicant is requesting a variance to the restriction of one sign per
property. Section 5.07.07 (9) limits a lot to one permitted sign. Section 5.07.09
one free standing sign of 150 sq!. or one wall mounted sign of60 sq. ft .. See the
enclosed application on pages 1:_-I 2-. The applicant's state that the purpose
of the request is to allow their consumers, visitors and delivery personnel to find and
safely exit the office/storage complex. The site presently has one free standing sign
and two wall mounted signs.
III. MAJOR ISSUES AND CONCERNS
A. Section 9.05.03 of the Zoning Resolution (Variance -Action by the Board of
Adjustment) states that the Board may authorize a variance to relieve hardship,
provided:
I. That the variance granted is the minimum necessary to alleviate such
practical difficulties or undue hardship upon the owner of said property;
2. That such relief may be granted without substantial detriment to the public
good and without substantially impairing the intent and purpose of the
General Plan or this Resolution;
3. That the circumstances found to constitute a hardship were not cause by the
applicant, are not due to or the result of general conditions in the district, and
cannot be practically corrected;
4. That the concurring vote of four ( 4) members of the Board shall be necessary
to decide in favor of the appellant .

In addition to the previously noted criteria for granting a variance, Section 5.07.12
in the sign code states the following:

A variance from the strict application of the provisions of this code may be granted
by the County Board of Adjustment, in accordance with the following guidelines:
(1) It is the policy of the county to encourage aesthetically pleasing signs without
substantial interference with the business to which the sign relates.
(2) Projecting signs should not substantially obscure any part of another sign
relating to another use.
(3) Excessively large or tall signs should be avoided to prevent visual obstruction
of the natural scenery within the county.
( 4) Variances should not be granted which would allow any business use an
unfair advertising advantage over any other business use.
(5) Ifit is necessary or reasonable to grant a variance to the strict regulations of
this chapter, the sign should be limited in size, height and location in conformance
with the purpose of the sign.
B. Zonini:: The Garfield County Sign Code was developed with the following intent
statement:
5.07.01 Intmt.
These regulations are established to safeguard the health, safety,
morals, convenience, order and welfare of all residents of the County.
It is the intent of these regulations to provide for the proper control of
signs within the unincorporated areas of the County. It is recognized
that signs are a necessary means of visual communication for the
convenience of the public and also for the benefit of businesses. This
code is intended to provide a reasonable balance between the right of
the individual to identify his business, the right of the individual to
utilize signs for other legitimate purposes, and the right of the public
to be protected against visual discord and clutter resulting from the
unrestricted proliferation of signs. This code is intended to aid in
protecting the natural aesthetic character and scenic beauty of the
area. It is further intended that the public be protected from signs that
are structurally unsafe or obscure the vision of motorists or conflict
with necessary traffic signs. Further, this code is intended to prevent

unnecessary or excessive competition between signs in the County.
The principal reason for this statement was to provide a means of identifying
a business location, without the clutter created by a large number of signs.
B. Staff Comments: The applicant states that the principal reason for the signs is to
identify the location of the company facilities. Staff contends that a larger sign at
the entrance of the company complex would accomplish the identification of the site
in a much more efficient manner than putting a number of signs up on the property
that sits below the highway grade. The two existing signs on the buildings could
have the content of the message changed without a variance The freestanding sign
could be increased in size and height with a new sign permit. Having new wall
mounted signs do not appear to serve any real purpose in terms of visibility of the
site and would be setting a precedent for additional variance requests of a similar
nature.
IV. SUGGESTED FINDINGS
I. That the application for Variance was found to be consistent with the requirements
and standards of Section 9.05 of the Garfield County Zoning Resolution of 1978, as
amended.
2. That proper publication and public notice was provided as required for the public
hearing before the Zoning Board of Adjustment.
3. That the public hearing before the Zoning Board of Adjustment was extensive and
complete, that all facts, matters and issues were submitted and that all interested
parties were heard at the meeting.
V. RECOMMENDATION

Holy Cross Electric Association, Inc., a/k/a Holy Cross Energy, wishes to amend its
Variance Application submitted to your office on May 29, 1998.
Please amend our application to reflect our request for a variance to Section 5.07.07(9)
concerning the number of permitted signs per lot, from one to three signs.
We would like to replace our existing freestanding sign with a new freestanding sign,
remove two existing wall mounted signs and install two new wall mounted signs at new
locations.
The requested signage is as follows:
1. A new freestanding sign at our entrance off Highway 82 replacing the
existing freestanding sign. The new double sided sign of approximately
29 square feet (2.5' x 11.5') will be installed perpendicular to Highway 82.

This Is a narrative explanation attached to the Variance Application to the Garfield
County Zoning Board of Adjustment. This narrative explanation refers directly to the
submittal requirements lettered A through Kon the Application.
The narrative explanation to the submittal requirements Is as follows:
A. A sketch map showing all Improvements on the site, building sizes, locations,
set backs, and access points Is attached as Exhibit A.
B. A vicinity map showing the general geographic location of the property Is
attached as Exhibits 8-1, 8-2, and 8-3.
C. A legal description of the site as shown by Deeds of ownership are provided by
copies of said Deeds attached as Exhibits C-1, C-2, and C-3.
D. A practical description of the site Is that the property Is located approximately
three miles south of Glenwood Springs on Highway 82, the address of which Is

Electric Association, Inc. to allow the Installation of one freestanding and four
wall mounted signs at Its headquarters/warehouse facility displaying Its
corporate name. The Association currently has one freestanding and two wall
mounted signs. The total number of signs, should this variance be approved
would be one freestanding and four wall mounted signs.
The site at 3799 Highway 82 Is 22 plus acres with 1,220 lineal feet of Highway
82 frontage lying below the grade of Highway 82. The location of the property
In relation to Its main access, provided from Highway 82, makes It particularly
difficult for consumers, visitors and delivery personnel to find and safely exit
Highway 82 without additional slgnage.
The Association will begin operating under an also known as (a/k/a) name of
Holy Cross Energy In mid-June. This name change provides the opportunity to
Improve our slgnage at 3799 Highway 82 while Installing signs with our new
name.
The proposed slgnage Includes:
1. A new freestanding sign at the entrance of Highway 82 replacing the
existing freestanding sign. The new double sided sign of approximately

I. DESCRJPTION OF THE PROPOSAL
A. Request: Tue applicant is requesting a variance to the restriction of one sign per
property. Section 5.07.07 (9) limits a lot to one permitted sign. Section 5.07.09
one free standing sign of 150 sq.ft. or one wall mounted sign of 60 sq. ft .. See the
enclosed application on pages ~ -I 2-. Tue applicant's state that the purpose
of the request is to allow their conswners, visitors and delivery personnel to find and
safely exit the office/storage complex. Tue site presently has one free standing sign
and two wall mounted signs.
III. MAJOR ISSUES AND CONCERNS
A. Section 9.05.03 of the Zoning Resolution (Variance -Action by the Board of
Adjustment) states that the Board may authorize a variance to relieve hardship,
provided:
I. That the variance granted is the minimwn necessary to alleviate such
practical difficulties or undue hardship upon the owner of said property;
2. That such relief may be granted without substantial detriment to the public
good and without substantially impairing the intent and purpose of the
General Plan or this Resolution;
3. That the circwnstances found to constitute a hardship were not cause by the
applicant, are not due to or the result of general conditions in the district, and
cannot be practically corrected;
4. That the concurring vote of four (4) members of the Board shall be necessary
to decide in favor of the appellant.

In addition to the previously noted criteria for granting a variance, Section 5.07.12
in the sign code states the following:
variance.
A variance from the strict application of the provisions of this code may be granted
by the County Board of Adjustment, in accordance with the following guidelines:
(1) It is the policy of the county to encourage aesthetically pleasing signs without
substantial interference with the business to which the sign relates.
(2) Projecting signs should not substantially obscure any part of another sign
relating to another use.
(3) Excessively large or tall signs should be avoided to prevent visual obstruction
of the natural scenery within the county.
(4) Variances should not be granted which would allow any business use an
unfair advertising advantage over any other business use.
(5) Ifit is necessary or reasonable to grant a variance to the strict regulations of
this chapter, the sign should be limited in size, height and location in conformance
with the purpose of the sign.
B. Zoninir The Garfield County Sign Code was developed with the following intent
statement:
5.07.01 lntmll.
These regulations are established to safeguard the health, safety,
morals, convenience, order and welfare of all residents of the County.
It is the intent of these regulations to provide for the proper control of
signs within the unincorporated areas of the County. It is recognized
that signs are a necessary means of visual communication for the
convenience of the public and also for the benefit of businesses. This
code is intended to provide a reasonable balance between the right of
the individual to identify his business, the right of the individual to
utilize signs for other legitimate purposes, and the right of the public
to be protected against visual discord and clutter resulting from the
unrestricted proliferation of signs. This code is intended to aid in
protecting the natural aesthetic character and scenic beauty of the
area. It is further intended that the public be protected from signs that
are structurally unsafe or obscure the vision of motorists or conflict
with necessary traffic signs. Further, this code is intended to prevent
unnecessary or excessive competition between signs in the County.
The principal reason for this statement was to provide a means of identifying
a business location, without the clutter created by a large number of signs.
B. Staff Comments: The applicant states that the principal reason for the signs is to
identify the location of the company facilities. Staff contends that a larger sign at
the entrance of the company complex would accomplish the identification of the site
in a much more efficient manner than putting a number of signs up on the property
that sits below the highway grade. The two existing signs on the buildings could
have the content of the message changed without a variance The freestanding sign
could be increased in size and height with a new sign permit. Having new wall
mounted signs do not appear to serve any real purpose in terms of visibility of the
site and would be setting a precedent for additional variance requests of a similar
nature.
IV. SUGGESTED FINDINGS
1. That the application for Variance was found to be consistent with the requirements
and standards of Section 9.05 of the Garfield County Zoning Resolution of 1978, as
amended.
2. That proper publication and public notice was provided as required for the public
hearing before the Zoning Board of Adjustment.
3. That the public hearing before the Zoning Board of Adjustment was extensive and
complete, that all facts, matters and issues were submitted and that all interested
parties were heard at the meeting.
V. RECOMMENDATION

Holy Cross Electric Association, Inc., a/k/a Holy Cross Energy, wishes to amend its

We would like to replace our existing freestanding sign with a new freestanding sign,
remove two existing wall mounted signs and install two new wall mounted signs at new
locations.
The requested signage is as follows:
1. A new freestanding sign at our entrance off Highway 82 replacing the
existing freestanding sign. The new double sided sign of approximately
29 square feet (2.5' x 11.5') will be installed perpendicular to Highway 82.

2. A wall mounted sign on the south side of the headquarters building with a
48" diameter logo and 16" high metal lettering. The logo will be internally lit.

County Zoning Board of Adjustment. This narrative explanation refers directly to the

The narrative explanation to the submittal requirements Is as follows:
A. A sketch map showing all Improvements on the site, building sizes, locations,
set backs, and access points Is attached as Exhibit A.
B. A vicinity map showing the general geographic location of the property Is
attached as Exhibits B· 1, 8·2, and 8·3.
C. A legal description of the site as shown by Deeds of ownership are provided by
copies of said Deeds attached as Exhibits C· 1, C·2, and C·3.
D. A practical description of the site Is that the property Is located approximately
three miles south of Glenwood Springs on Highway 82, the address of which Is
3799 Highway 82, Glenwood Springs, CO 81601.

H. A variance to the Garfield County Sign Code Is being requested by Holy Cross
Electric Association, Inc. to allow the Installation of one freestanding and four
wall mounted signs at Its headquarters/warehouse facility displaying Its
corporate name. The Association currently has one freestanding and two wall
mounted signs. The total number of signs, should this variance be approved
would be one freestanding and four wall mounted signs.
The site at 3799 Highway 82 Is 22 plus acres with 1,220 lineal feet of Highway
82 frontage lying below the grade of Highway 82. The location of the property
In relation to Its main access, provided from Highway 82, makes It particularly
difficult for consumers, visitors and delivery personnel to find and safely exit
Highway 82 without additional slgnage.
The Association will begin operating under an also known as (a/k/a) name of
Holy Cross Energy In mid-June. This name change provides the opportunity to
Improve our slgnage at 3799 Highway 82 while Installing signs with our new
name.
The proposed slgnage Includes:
1. A new freestanding sign at the entrance of Highway 82 replacing the
existing freestanding sign. The new double sided sign of approximately

PRQCEPURAL REQUIREMENTS·
1. Submit applications to the Garfield County Planning Department no later than the last Friday of the
month in order to be included on the following month's agenda. Regular meeting of the Zoning Board
of Adjustment scheduled on the fourth Monday of each month at 7:00 p.m ..
2. You will receive, from the Planning Department, a "Public Notice Form'' indicating the time and date
of your hearing.
3. Notice by publication (of the public notice form) shall be given once in a newspaper of general
circulation in that portion of the county in which the subject property is located, at least fifteen (15) days
prior to the date of the public hearing, and proof of publication shall be presented at the hearing by the
applicant. (section 9.05.04 (I).
