Holy Cross Energy I. DESCRIPTION OF THE PROPOSAL A. Request: The applicant is requesting a variance to the restriction of one sign per property. Section 5.07.07 (9) limits a lot to one permitted sign. Section 5.07.09 one free standing sign of 150 sq!. or one wall mounted sign of60 sq. ft .. See the enclosed application on pages 1:_-I 2-. The applicant's state that the purpose of the request is to allow their consumers, visitors and delivery personnel to find and safely exit the office/storage complex. The site presently has one free standing sign and two wall mounted signs. III. MAJOR ISSUES AND CONCERNS A. Section 9.05.03 of the Zoning Resolution (Variance -Action by the Board of Adjustment) states that the Board may authorize a variance to relieve hardship, provided: I. That the variance granted is the minimum necessary to alleviate such practical difficulties or undue hardship upon the owner of said property; 2. That such relief may be granted without substantial detriment to the public good and without substantially impairing the intent and purpose of the General Plan or this Resolution; 3. That the circumstances found to constitute a hardship were not cause by the applicant, are not due to or the result of general conditions in the district, and cannot be practically corrected; 4. That the concurring vote of four ( 4) members of the Board shall be necessary to decide in favor of the appellant . .,, I- In addition to the previously noted criteria for granting a variance, Section 5.07.12 in the sign code states the following: variance. A variance from the strict application of the provisions of this code may be granted by the County Board of Adjustment, in accordance with the following guidelines: (1) It is the policy of the county to encourage aesthetically pleasing signs without substantial interference with the business to which the sign relates. (2) Projecting signs should not substantially obscure any part of another sign relating to another use. (3) Excessively large or tall signs should be avoided to prevent visual obstruction of the natural scenery within the county. ( 4) Variances should not be granted which would allow any business use an unfair advertising advantage over any other business use. (5) Ifit is necessary or reasonable to grant a variance to the strict regulations of this chapter, the sign should be limited in size, height and location in conformance with the purpose of the sign. B. Zonini:: The Garfield County Sign Code was developed with the following intent statement: 5.07.01 Intmt. These regulations are established to safeguard the health, safety, morals, convenience, order and welfare of all residents of the County. It is the intent of these regulations to provide for the proper control of signs within the unincorporated areas of the County. It is recognized that signs are a necessary means of visual communication for the convenience of the public and also for the benefit of businesses. This code is intended to provide a reasonable balance between the right of the individual to identify his business, the right of the individual to utilize signs for other legitimate purposes, and the right of the public to be protected against visual discord and clutter resulting from the unrestricted proliferation of signs. This code is intended to aid in protecting the natural aesthetic character and scenic beauty of the area. It is further intended that the public be protected from signs that are structurally unsafe or obscure the vision of motorists or conflict with necessary traffic signs. Further, this code is intended to prevent --z_- - - - - - - - - - - - - - - - - - - - - - - - ------- - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - unnecessary or excessive competition between signs in the County. The principal reason for this statement was to provide a means of identifying a business location, without the clutter created by a large number of signs. B. Staff Comments: The applicant states that the principal reason for the signs is to identify the location of the company facilities. Staff contends that a larger sign at the entrance of the company complex would accomplish the identification of the site in a much more efficient manner than putting a number of signs up on the property that sits below the highway grade. The two existing signs on the buildings could have the content of the message changed without a variance The freestanding sign could be increased in size and height with a new sign permit. Having new wall mounted signs do not appear to serve any real purpose in terms of visibility of the site and would be setting a precedent for additional variance requests of a similar nature. IV. SUGGESTED FINDINGS I. That the application for Variance was found to be consistent with the requirements and standards of Section 9.05 of the Garfield County Zoning Resolution of 1978, as amended. 2. That proper publication and public notice was provided as required for the public hearing before the Zoning Board of Adjustment. 3. That the public hearing before the Zoning Board of Adjustment was extensive and complete, that all facts, matters and issues were submitted and that all interested parties were heard at the meeting. Tue site presently has one free standing sign and two wall mounted signs. III. MAJOR ISSUES AND CONCERNS A. Section 9.05.03 of the Zoning Resolution (Variance -Action by the Board of Adjustment) states that the Board may authorize a variance to relieve hardship, provided: I. That the variance granted is the minimwn necessary to alleviate such practical difficulties or undue hardship upon the owner of said property; 2. That such relief may be granted without substantial detriment to the public good and without substantially impairing the intent and purpose of the General Plan or this Resolution; 3. That the circwnstances found to constitute a hardship were not cause by the applicant, are not due to or the result of general conditions in the district, and cannot be practically corrected; 4. That the concurring vote of four (4) members of the Board shall be necessary to decide in favor of the appellant. ---I- In addition to the previously noted criteria for granting a variance, Section 5.07.12 in the sign code states the following: variance. A variance from the strict application of the provisions of this code may be granted by the County Board of Adjustment, in accordance with the following guidelines: (1) It is the policy of the county to encourage aesthetically pleasing signs without substantial interference with the business to which the sign relates. (2) Projecting signs should not substantially obscure any part of another sign relating to another use. (3) Excessively large or tall signs should be avoided to prevent visual obstruction of the natural scenery within the county. (4) Variances should not be granted which would allow any business use an unfair advertising advantage over any other business use. (5) Ifit is necessary or reasonable to grant a variance to the strict regulations of this chapter, the sign should be limited in size, height and location in conformance with the purpose of the sign. B. Zoninir The Garfield County Sign Code was developed with the following intent statement: 5.07.01 lntmll. These regulations are established to safeguard the health, safety, morals, convenience, order and welfare of all residents of the County. It is the intent of these regulations to provide for the proper control of signs within the unincorporated areas of the County. It is recognized that signs are a necessary means of visual communication for the convenience of the public and also for the benefit of businesses. This code is intended to provide a reasonable balance between the right of the individual to identify his business, the right of the individual to utilize signs for other legitimate purposes, and the right of the public to be protected against visual discord and clutter resulting from the unrestricted proliferation of signs. This code is intended to aid in protecting the natural aesthetic character and scenic beauty of the area. It is further intended that the public be protected from signs that are structurally unsafe or obscure the vision of motorists or conflict with necessary traffic signs. Further, this code is intended to prevent unnecessary or excessive competition between signs in the County. The principal reason for this statement was to provide a means of identifying a business location, without the clutter created by a large number of signs. B. Staff Comments: The applicant states that the principal reason for the signs is to identify the location of the company facilities. Staff contends that a larger sign at the entrance of the company complex would accomplish the identification of the site in a much more efficient manner than putting a number of signs up on the property that sits below the highway grade. The two existing signs on the buildings could have the content of the message changed without a variance The freestanding sign could be increased in size and height with a new sign permit. Having new wall mounted signs do not appear to serve any real purpose in terms of visibility of the site and would be setting a precedent for additional variance requests of a similar nature. IV. SUGGESTED FINDINGS 1. That the application for Variance was found to be consistent with the requirements and standards of Section 9.05 of the Garfield County Zoning Resolution of 1978, as amended. 2. That proper publication and public notice was provided as required for the public hearing before the Zoning Board of Adjustment. 3. That the public hearing before the Zoning Board of Adjustment was extensive and complete, that all facts, matters and issues were submitted and that all interested parties were heard at the meeting.
