DESCRIPTION OF THE PROPOSAL Variance from Section 5.05.03(2) -Minimum Setback on a comer lot Paul Popish Lot 1 and B of Block 14 of the Townsite of Cooperton. The lot is 7825 square feet in size. Community water and individual sewage disposal system. Mesa Avenue R/L/UD A. Site Description: The subject property is a residential lot in the Cooperton townsite. The rear yard of applicant's property backs up to th.:o Colorado Rocky }~fountain School property, which is also a part of the old townsite. (See plat pg. • If..!') Mesa Avenue is on the east side of the property and is the only improved road to the lot in question. Sopris Avenue is on the north side of the property, but it is not physically in place. The right-of-way was platted as a part of the original townsite, but it is not physically in place at this time. There are no improvements on the property at this time. B. Request: The applicants are requesting a variance from therequired twenty-five foot (25') side yard setback on the side of the lot adjacent to a public right of way on a lot bordered by two streets. The proposed variance would locate the side of a proposed house 12 feet 4 inches from the lot line, which is a;;nt to the unimproved right-of-way of Sopris Avenue. (See site plan pg~ The application letter is attached on page t.f , -I· • • II. MAJOR ISSUES AND CONCERNS I. Zoning: The R/L/UD zone district has a minimum lot size of7500 sq. ft. and the lot in question is 7825 sq. ft. in size. The original lots were only 37.5 ft. wide, but Sopris Avenue was moved 12.5 ft north, to increase the subject lot and reduced the size of another lot on the opposite side of the street. This was all done through the amendment of the Cooperton Townsite plat at the request of the previous owners of the property. 2. Individual Sewage Disposal System (JSDS): It should be noted that an ISDS is allowed on a nonconforming lot provided there is no central sewer available to the lot and it can be demonstrated that the use of ISDS would not "result in a danger to health on the subject or adjacent lots." (Section 5.04.05, Garfield County Zoning Resolution) The property to the south of the subject property has an existing residence on it and staff does not know whether or not they use City water or have a well for their domestic water supply. If they are served by a well, the proposed lot will have to meet a 100 ft. separation requirement between leach field for the proposed ISDS and any wells in the area. If this cannot be met, the applicant will have to have an engineer design an ISDS to meet the State ISDS regulations. There are no variances allowed to the ISDS regulations. 3. Section 9.05.03 states that "by reason of exceptional narrowness, shallowness or shape of the specific piece of property at the time of enactment of this resolution or by reason of exceptional topographic conditions or other extraordinary and exceptional situation or condition of such piece of property," the Board may authorize a variance. In addition, the Board must also find that: A. That the variance granted is the minimum necessary to alleviate such practical difficulties or undue hardship upon the owner of said property; and B. That such relief may be granted without substantial detriment to the public good and without substantially impairing the intent and purpose of the General Plan or this Resolution; and C. That the circumstances found to constitute a hardship were not caused by the applicant, are not due to or the result of general conditions in the district, and cannot be practically corrected; and D. That the concurring vote of four (4) members of the Board shall be necessary to decide in favor of the applicant. 4. The applicant's lot is smaller than the adjoining lots, due to the way the original townsite was platted. If a variance is not approved, the building envelope for a house would be only 15 ft. wide. The original configuration of these lots would have left a 2.5 ft. wide building envelope, if the original owner had not amended the plat to create the larger lot. Since these lots were created prior to any type of zoning laws being implemented, the County is obligated to recognize the lots as legally created lots and make adjustments to the zoning requirements to allow for the use of the property. Given this circumstance, staff agrees that there is a hardship created due to the unusual configuration of the original townsite lots 2- • • and that granting the variance will not have any detrimental effect on any adjoining property, provided the applicant can place an ISD system on the property in conformance with the ISDS regulations. 5. Neighbors Cornmeals: Enclosed is a letter from Walter Roberts, expressing concerns about the legality of the lots as they are presently described. (See letter pg.I_-, III. SUGGESTED FINDINGS I. That the application for Variance was found to be consistent with the requirements and standards of Section 9.05 of the Garfield County Zoning Resolution of 1978, as amended. 2. That proper publication and public notice was provided as required for the public hearing before the Zoning Board of Adjustment. 3. That the public hearing before the Zoning Board of Adjustment was extensive and complete, that all facts, matters and issues were submitted and that all interested parties were heard at the meeting. IV. That the circumstances found to constitute a hardship were not caused by the applicant, are not due to or the result of general conditions in the district, and cannot be practically corrected; and D. The applicant's lot is smaller than the adjoining lots, due to the way the original townsite was platted. If a variance is not approved, the building envelope for a house would be only 15 ft. wide. Since these lots were created prior to any type of zoning laws being implemented, the County is obligated to recognize the lots as legally created lots and make adjustments to the zoning requirements to allow for the use of the property.
