I. Description of the Proposal: The applicant has requested a variance to the
side yard setback requirement of 10 feet, so that a t:w::l car garage can be built
an the south side of the house. The front 10 feet of the proposed garage would
be closer than 10 feet to the side yard property line. The structure would be
within approxinately 6 feet of the side yard property line at the closest point.
(See attached drawing. )
II. Major Issues and CCincems:
A. Previous HistoE¥: The Western Hills Subdivision was recorded in 1958
prior to any subdivision or zoning regulations being in effect in Garfield
County. The applicant has stated that similar variances were granted in the
sane area. Staff has not been able to detennine what these variances were,
but fran a visual inspection of the neighborhood, it a~s that there are
other garages well within the setbacks required.
B. Staff Carmants:
1. The applicant's lot is an unusual configuration in that it does
not have a rectangular shape. The sarewhat "pie" shape of the lot
along with a limited depth and width is an exceptional situation.
2. There are t:w::l other possible solutions to the problem , neither
of Wiich is any better than the other;
a. Move the garage back in an offset position to meet the side
yard requirements. This would result in a need for a variance
to the rear yard setback requirement of 25 feet.
b. It appears that at one time, there was a single car garage as
a part of the existing house. This is now a living area. To put the
garage back to the original location and add a section an to that area
could resolve the problem with setbacks, but this would be putting a
hardship an the applicant. Records do not indicate the irrprovements
were made by the applicant.
III. Findings:
1. That, due to the exceptional shape of the lot, an undue hardship is created.
2. That the variance requested is the minimum necessary to alleviate the hardship.
3. That the variance granted will not detrimentally affect the general public,
incllrling surrounding property CMners.

~ARFIELD COUNTY SIGN CODE~
Special Exception Application Instructions
l. An application for a special exception must be made_to the Garfield
County Planning Division. The complete application must be submitted
at least 28 days prior to the Board of Adjustment meeting for which
the request is scheduled. The fee for this application is $25.00 and
must accompany the application.
2. Once an application for a special exception is submitted, the Planning
staff will review the request. If the application is complete, the
Planning staff will schedule a public hearing with the Garfield County
Board of Adjustment.
3. The following steps must be completed not more than 30 days nor less
than 15 days prior to the scheduled hearing with the Board of
Adjustment:
a. A public notice must be published once in a newspaper of
general circulation in that portion of the County in which the
subject property is located at least fifteen (15) days prior to
the date of the public hearing. The Planning Division will
provide the Public Notice form which must be .verified and signed
by a Planning staff member before it is submitted to the
newspaper. The Proof of Publication, which will be sent to you
by the newspaper along with your bill, must be submitted at the
Public Hearing.
b. Copies of the Public Notice form must be sent by Certified
Return Receipt Mail to all owners of all property within two
hundred (200) feet of the subject property at least fifteen (15)
days prior to the Public Hearing. The return receipts showing
receipt of notice shall be presented at the Public Hearing by .the
applicant, unless the applicant is able to otherwise show
evidence of adequate notice to such owners.
c. The property for which the special exception is requested
must be posted with a sign provided by the Planning Division at
least 15 days prior to the scheduled hearing date with the Board
of Adjustment.
IMPORTANT: Publication in the newspaper, the certified return
receipt mailings, and posting of the property are the sole
responsibility of the applicant.

4. Map showing all improvements (present and proposed)
on the property including location of proposed sign
amd distances from right-of-ways and all
pertinent information related to the special exception
request.
5. USGS topographic map showing the location of the proposed
property in relation to the nearest town.

appear and state their views, protests or objections. If you cannot
appear personally at such meeting, then you are urged to state your views
by letter, particularly if you have objections to such Special Exception·.
