request of Stephen & Debra Collins for a hearing before
the Board of Adjustment.

I. Description of the Proposal:
Request for a variance from Section 3.04.
06 {l){b), of the Garfield County Zoning
Resolution, minimum front yard setback.

more practically described as a parcel
located in the Cedar Crest Subdivision
in West Glenwood at the intersection of
169b Road and Cardinal Lane.

The applicant has requested a variance from the front yard setback
requirement of 25 feet. Due to the fact that the proposed lot is
bordered on two sides, Section 5.05.03 (2) of the County Zoning
Resolution, the front yard setback has to be observed along the
yards adjacent to the streets. As a result, the pie shaped lot
has a relatively small building area, when the 10 foot side yard
requirement is also observed.
II. Major Issues and Concerns:
1. The proposed garage is 20 ft. by 20 ft. and would abut right
up to the property line. This is below and away from the actual
driving surface of 169b Road. The improvement survey notes water
valve boxes very close to the area proposed for the garage, which
indicates that there are water lines in the area. The water lines
are located along the east property line, approximately 7 feet from
the east wall of the proposed garage, according to the Glenwood
Springs water treatment plant operator. In any event, precautions
should be taken to avoid any hillside sluffing that would weaken
the road surface or water lines.

III. Findings:
1. That due to the exceptional shape of the lot an undue
hardship is created.
2. That the variance requested is at the minimum necessary
to alleviate the hardship.
3. That the variance granted will not detrimentally affect
the general public, including surrounding property owners.
IV. Recommendations:
Approval, provided the applicant builds the garage in a
manner that will not result in the weakening of the adjacent
hillside and may require retaining walls on the north and

I. HOME WAS PURCHASED NOT CONSTRUCTED
II. LOT DESIGN
A. Pie shaped lot which is contiguous to Ptarmigan
Lane on north and cardinal Lane on west and
southern tip. Because of shape of lot, the 25
foot set back requirements from both streets
makes an inordinate amount of the lot
unavailable for a garage site.
Approximately 6,800 sq. ft. of the lot (48.9%
of the total of approximately 13,900 square
feet) is restricted by set back.
Comparatively, for a square lot of the same
area restricted on two sides by set back
requirements, approximately 5,275 square feet
(37.9% of total square footage) would be
restricted.
B. Present location of the driveway and natural
topography of the lot make the requested
placement of the building the only practical
alternative.
III. ALTERNATE SITE
The only area a garage could be placed without a set
back variance would be directly in front of home on
the south side. This is not a practical alternative
because:
A. Home is a solar designed home and placement of
building in front would invalidate the benefits
of the homes' southern exposure.
B. Because of the rise in elevation between street
and alternate site, street visibility would be
impaired by embankments. This would create a
hazard when backing a car onto the street from
the alternate site.
IV. AESTHETIC EFFECT
A. Distance between Ptarmigan Lane and property
line is about 15 feet, therefore placement of
building near property line would not crowd the
roadway or impair vision.
B. Drop in elevation between roadway and ground
level of proposed building is about 8 1/2 feet.
c. Roof line of proposed building would be lower
than the roof line of the house.
