DESCRIPTION OF THE PROPOSAL Request for variance from Section 3.04.06(2), rear yard setback. Joseph R. and Phyllis Snoddy Lot 11, less the westerly 7 ft., Block 4, Western Hills Subdivision, located at 0547 County Rd. 130 in west Glenwood in the vicinity of the Glenwood Springs Mall. The site consists of a 7665 sq. ft. lot (105 ft. by 73 ft.). Existing drive off of County Rd. 130. R/L/UD North: R/L/UD East: R/L/UD South: C/L west: R/L/UD The applicant proposes to construct a 14.4 ft. x 19 ft. garage addition and combination storage area attached to the rear of the existing house and garage on the site. The applicant is requesting a variance from the rear yard setback of 25 ft. to allow for the proposed addition to be constructed with a rear yard setback of 5 ft. II. MAJOR ISSUES AND CONCERNS 1. In its present condition, the lot and existing buildings are pre-existing and non-conforming, in relationship to side yard setback, rear yard setback, and maximum lot coverage. The side yard setback on the eastern portion of the lot is presently 5 ft. where 10 ft. is required and the existing rear yard setback is 24 ft. The lot coverage including driveways and the proposed additions will be 45%, where 35% is the maximum allowed. 2. Any approval of the proposed variance should be in conjunction with the approval for the applicant of a variance from the maximum lot coverage requirements in Section 3.04.05 of the zoning Resolution. Proposed revisions to the zoning Resolution currently in the process of being implemented include a maximum lot coverage requirement of 45% for this zone district. 3. The applicant has represented that to the location of the house on the lot. the proposed variance is due extreme rear portion of the 4. The applicant is allowed, in accordance with Section 5.05.03(7), Supplemental Setback Regulations, to construct an accessory building in a required rear yard provided it is detached, maintains a 7 1/2 ft. rear yard setback, and that not more than 40% of the required rear yard area is covered. -I- r • • IV. SUGGESTED FINDINGS 1. 2. That proper publication and public notice was provided as required for the meeting before the zoning Board of Adjustment. That the variance granted is the m1n1mum necessary to alleviate such practical difficulties or undue hardship upon the owner of said property. 4. In its present condition, the lot and existing buildings are pre-existing and non-conforming, in relationship to side yard setback, rear yard setback, and maximum lot coverage. The side yard setback on the eastern portion of the lot is presently 5 ft. where 10 ft. is required and the existing rear yard setback is 24 ft, The lot coverage including driveways and the proposed additions will be 45%, where 35% is the maximum allowed. 2. Any approval of the proposed variance should be in conjunction with the approval for the applicant of a variance from the maximum lot coverage requirements in section 3.04.05 of the zoning Resolution.
