Scott and the Joseph A. Scott 1979 Trust fl. LOCATION: A tract of land situated in Lot 2, Section 2, T6S, R89W, approximately 2.5 miles east of Glenwood Springs at 1555 No Name Lane, county Road 129. SITE DATA: The site consists of a 2.53 acre parcel. ACCESS: Existing drive off of No Name Lane, county Road 129. EXISTING ZONING: R/L/SD R/L/SD ADJACENT ZONING: I. RELATIONSHIP TO THE COMPREHENSIVE PLAN The site is located in District E, Rural Environmental Constraints as indicated Management District map. Areas with Severe-Moderate on the comprehensive Plan, II. DESCRIPTION OF THE PROPOSAL A. B. c. Site Description: The site consists of a long and narrow lot located between the county Road and No Name Creek. A large portion of the lot is embankment above the creek with the buildable portion of the site lying adjacent to the road. Project Descriftion: The applicant has constructed a six foot high fence w thin their required front yard setback. The fence is designed to provide security and privacy for existing and proposed improvements on the site. History: The applicant did apply for and receive conditional approval of the requested variance in September, 1986. Subsequent to that approval, the county Attorney's office advised that the variance application was not valid because the actual property owner, the Joseph A. Scott 1979 Trust fl had not made the variance request. Re-application and a new public hearing was determined to be necessary. III.MAJOR ISSUES AND CONCERNS l. section 5.05.03 (8) limits fences within a required front yard to 3 feet in height. 2. Hardships to development of the lot include both the narrowness of the lot and the exceptional topographic situation including No Name creek and its embankment. 3. Prior concerns regarding snow removal along the county road have been resolved to the mutual satisfaction of the property owner and the county Road and Bridge Department by widening and minor relocation of the roadway. -1- • • IV. SUGGESTED FINDINGS 1. That the application for variance was found to be consistent with the requirements and standards of Section 9.05 of the Garfield County zoning Resolution of 1978, as amended. 2. That proper publication and public notice wa provided as required for the public hearing before the zoning Board of Adjustment. 3. That the public hearing before the extensive and complete, that all submitted and that all interested hearing. V. The county Attorney's office has advised us that in order for an application to be valid it must be signed or authorized by the owner of the property under consideration. While your application was formally made by Joseph A. Scott, it has been established that the property is technically owned by the Joseph A. Scott 1979 Trust #1. An amended application form signed or authorized by the Trust must be submitted. Enclosed is a blank application form for your convenience. Because your application was not valid at the time of the public hearing, a new public hearing will also be necessary. Please complete and submit the application form, with the above mentioned corrections or authorizations, to the Garfield County Planning Department. An application for a zoning variance must be made to the Garfield County Planning Division. The complete application must be submitted at least 28 days prior to the Board of Adjustment meeting for which the request is scheduled. The fee for this application is $ 35. 00 and must accompany the application. 2. Once an application for a zoning variance is submitted, the Planning staff will review the request. If the application is complete, the Planning staff will schedule a public hearing with the Garfield County Board of Adjustment. 3. The following steps must be completed not more than 30 days nor less than 15 days prior to the scheduled hearing with the Board of Adjustment: a. A public notice must be published once in a newspaper of general circulation in that portion of the County in which the subject property is located at least fifteen (15) days prior to the date of the public hearing.
