Box 791 Glenwood Springs, CO 80306 RE: Zurcher ADU(GAPA-04-16 8444) Dear Glenn: I am writing to you on behalf of my client, Antonia Zurcher, to explain that the BLM Right of Way grant provided to her as reflected in the documents I previously provided to you is the only and the best "easement" that can be provided to a private property owner from the BLM to confirm access over and use of the federal lands in question. The Right of Way grant from the BLM authorizes Ms. Zurcher to use the "public land" for the driveway that has been in a place, as we have discussed, for many years, at least since the original farm house was constructed on the property. The federal laws and regulations governing the granting of these kinds of rights of use do not allow a conveyance in fee or a permanent easement to be granted. Rather the grant of use, in this case in the form of a Right of Way grant, is for a specified term. The Federal Land Policy and Management Act of 1976, as amended (FLPMA), is the federal law governing the BLM's authority and ability, among other things, to grant rights of way over federal lands. FLPMA requires a right of way grant be limited to "a reasonable term in light of all circumstances concerning the project." The grant of the right of way must also specify whether it is or is not renewable and the terms and conditions applicable to the renewal. See FLPMA, Section 504 (43 U.S.C. 1764). As per the BLM Manual governing terms and conditions applicable to FLPMA grants: "[t]he term of each grant shall be specific and is primarily dependent upon a reasonable period needed to accomplish the purpose of the authorization" and "no term should exceed 30 years" except for certain specific instances that are not applicable to this situation, such as grants to governments for highways and roads, reciprocal grants, and where lands are being transferred out of federal ownership. The holder shall contact the Authorized Officer (AO) at least 180 days prior to the non- emergency anticipated start of any surface disturbing activities. It is the holder's responsibility to comply with all applicable Federal, State, and local laws and regulations existing or hereafter enacted or promulgated. The BLM will determine if any surveys or inventories are required. As necessary, the holder shall demonstrate compliance in writing, i.e., with surveys and inventories completed by qualified individuals, with the following laws including, but not limited to, the Endangered Species Act (if potential habitat is determined to be present), the National Historic Preservation Act, and the Native American Graves Protection and Repatriation Act. Evaluations and inventories can be completed by BLM, or by the holder in order to meet the holder's schedule and subject to approval by the AO. Inventories may be time sensitive and may require US Fish and Wildlife Service concurrence, therefore this process could take longer than 60 days to complete. 2. Cultural Resources - Education/Discovery Stipulations. E. Pursuant to 43 CFR 10.4(g) the holder of this authorization or its contractor must notify the AO, by telephone, with written confirmation, immediately upon the discovery of human remains, funerary items, sacred objects, or objects of cultural patrimony. Further, pursuant to 43 CFR 10.4(c) and (d), the holder must stop activities in the vicinity of the discovery and protect it for 30 days or until notified to proceed by the AO. F. The operator or its contractor is responsible for informing all persons who are associated with the project operations that they will be subject to prosecution for knowingly disturbing historic or archaeological sites, or for collecting artifacts. If historic or archaeological materials are uncovered during any project or construction activity, the operator must stop work in the area of the discovery that might further disturb such materials, and immediately contact the AO. Within five working days the AO will inform the operator as to the mitigation measures the operator will likely have to undertake before the site can be used (assuming in place preservation is not necessary). G. The holder shall notify the AO at least 180 days prior to non -emergency activities that would cause surface disturbance in the lease, ROW, or TUP. The BLM will determine if a cultural resource inventory, treatment, or mitigation is required. H. A "Notice to Proceed" stipulation shall be required for any non -emergency activities as defined above that would cause surface disturbance on the lease, ROW, or TUP. Any request for a "Notice to Proceed" should be made to the AO, who shall review the proposed action for consistency with resource management concerns such as wildlife, big game winter range, paleontology, threatened and endangered species, and cultural resource protection. Additional measures may be required to protect these resources. 3. Paleontological Resources — Discovery Stipulations. Page I 1 8. Prior to termination of the lease, the holder shall contact the authorized officer to arrange a joint inspection of the lease. This inspection will be held to agree to an acceptable termination and rehabilitation plan as necessary. This plan shall include, but is not limited to, removal of facilities, drainage structures, or surface material, recontouring, topsoiling, and seeding. The authorized officer must approve the plan in writing prior to the holder's commencement of any termination activities. 9. The holder shall be responsible for weed control within the limits of the ROW. The holder is responsible for consultation with the authorized officer and/or local authorities for acceptable weed control methods (within limits imposed in the grant stipulations) including pesticides/herbicides approved for use on BLM land. Use of pesticides/herbicides shall comply with the applicable Federal and state laws. Pesticides/herbicides shall be used only in accordance with their registered uses and within limitations imposed by the Secretary of the Interior. Prior to the use of pesticides/herbicides, the holder shall obtain from the authorized officer written approval of the applicant's plan showing the type and quantity of material to be used, pest(s) to be controlled, method of application, location of storage and disposal of containers, and any other information deemed necessary by the authorized officer. The plan should be submitted no later than March 1 of any calendar year to cover the proposed activities for the next growing season. Emergency use of pesticides/herbicides shall be approved in writing by the authorized officer prior to such use. 10. As directed by the authorized officer, all road segments shall be winterized by providing a well -drained roadway by water barring, maintaining drainage, and any additional measures necessary to minimize erosion and other damage to the roadway or the surrounding public lands. 11. The holder shall seed all disturbed areas with the seed mixture(s) listed below. The seed mixture(s) shall be planted in the amounts specified in pounds of pure live seed (PLS) per acre. There shall be no primary of secondary noxious weed seed in the seed mixture. Seed shall be tested and the viability testing of seed shall be done in accordance with State law(s) and within 12 months prior to purchase. Commercial seed shall be either certified or registered seed. The seed mixture container shall be tagged in accordance with State law(s) and available for inspection by the authorized officer. Fire Prevention and Control Stipulations 1. The Holder shall indemnify the United States for any and all injury, loss or damage to life or property, including fire suppression costs, the United States may suffer as a result of losses, claims, demands or judgments caused by Holder's use or occupancy of public lands under this grant or permit. 2. Holder shall maintain the lease in a safe, usable condition. Page 13 F. The duty to provide information upon request of BLM and/or its counsel concerning the construction, monitoring, inspection, maintenance and/or repairs of any of Holder's facilities located at or adjacent to a fire. We have filed the Form 299 application with the BLM for a right of way over the BLM lands and I am told by the person at the BLM handling the application, Monte Senor, that there should not be any issue with receiving an approval, only that it takes time. Currently I am out of my office, on vacation with my family in Montana, but I will be back in the office tomorrow, Wednesday, 8/2/2017, and was hoping you might have some time to talk about this. Zurcher ADU Application Update — Existing Site Access Conditions 4110 243 County Road, (aka Elk Creek Road), New Castle CO, Garfield County Dear Mr. Smith, Per Garfield County's Planning Department request, an onsite review of the existing access conditions is also required in addition to my site review letter, dated July 13, 2016 along with any non-compliant issues and recommendations. My site review of the existing access conditions conducted on July 28. The access drive between the County Road and the proposed new ADU access drive is approximately 200 feet in length. The asphaltic pavement surface varies from 9.0' to 11.5' in width and appears to be in good condition. The shoulders consist of an unimproved hard surface native ground a minimum of 1.5' wide. The driveway comes off the edge of the County road with an approximate downward grade of 13.4% transitioning down to 12.0% in a distance of 28 feet and then flattens to a grade of approximately 7% at the new ADU access. Surface drainage along this stretch of existing driveway appears to be a non -issue. Two trees, one on each side of the drive way, near the county road intersection, do impact a drivers visibility of traffic he approaches the County road. Traffic from a single family residence along with the proposed ADU typically generates 20 vehicles or Tess per day and would fall in the Primitive/Drive category column of Table 7-107 Roadway standards. Based on my site visit, the existing drive way complies with the minimum requirements stated in this column with the exception of where the driveway grade exceeds 12% over a distance of 28 feet as shown in the attached sketch and indicated in red in the following chart. However, I do highly recommend removal of any trees or brush along the County Road ROW within 50 feet from the drive way centerline for improved visibility. Project Engineer 923 Cooper Avenue, Ste. 201 1 Glenwood Springs, CO 81601 1 970.945.5252 1 www.bu-inc.com Policy 01-14 Waivers for Roads and Demonstration of Compliance March 3, 2014 Section 7-107, Access and Roadways, of the Garfield County Land Use and Development Code (LUDC) requires all roads to be designed to provide for "adequate and safe access" and reviewed by the designated County Engineer. The LUDC defines "road" as "a County road, State highway, public road, street or alley, or private thoroughfare which affords primary access to abutting property, excluding a driveway accessing a single property." The LUDC defines "private road" as "a right-of-way constructed, established, owned, and maintained by a private party for access exclusively to private property." Many of the roads in Garfield County are private roads in that they are gated and do not serve the general public and they pre-existed the design currently required by the County's Road Standards as defined in Table 7-107. The LUDC allows for the waiver of specific standards provided that the following criteria have been met: 1) an alternative design achieves the intent of the subject standard to the same or better degree and 2) the proposed alternative will impose no greater impacts on adjacent properties than would occur through compliance with the specific standard (Section 4-118). In applications that include roads that do not meet current County road standards as outlined in Table 7- 107, the County has asked that Applicants request a waiver of Section 7-107.F, Design Standards, and include in the Application submittal sufficient information, prepared by a professional qualified in the specific discipline, to demonstrate that they meet the criteria outlined in Section 4-118 for granting a waiver. In doing so, the application must include: A Statement of Adequacy - The evaluation of the existing roadway and waiver will need to include a clear statement that finds that the road will be adequate for the proposed use. This statement must be signed by a professional engineer qualified in traffic engineering and licensed by the State of Colorado. To support this evaluation, the following information will be required to be provided: o Geometry of the road — A description of how the private road does/does not meet the design standards in Table 7-107. This should include a chart that compares the private road design to those standards in Table 7-107, as well as a map that shows the existing road design and highlights those areas that deviate from the standards. A narrative may also be helpful in describing the characteristics of the road as they compare to Table 7- 107 design standards. Unless available, this is not intended to imply construction -level drawings. 1 1 P a g e o Safety/Structural Issues — A description of obvious safety and/or structural issues observed and a statement about how these issues will be addressed. o Maintenance — A description of how the road is and/or will be maintained. This should be supported with the submittal of any existing or proposed maintenance agreements for the road sections. o Travel Demand — An accurate count of the existing peak travel demand as well as the Average Daily Traffic on the road. This should also include the types of vehicles that currently use the road as well as the additional amount and type of traffic that the proposed use will generate through all phases of its development. Other Evidence of Compliance. In addition, Sections 7-107.A, B, C, D, and E are required to be addressed, which includes documentation about legal access. It is my understanding that the County is requiring code compliance verification for the proposed ADU's driveway access and drainage. The site plan shows the ADU's proposed 2 -car garage to be serviced with a short 12' wide gravel driveway and turn around area. Our analysis, utilizing "AutoTURN" software, indicates that the proposed turnaround is adequate for two garage parked passenger vehicles to successfully back out from the garage and then drive out forward from the garage turnaround. The proposed culvert crossing under the turnaround area will convey intercepted surface runoff away from the garage area toward an existing drainage swale east of the turnaround. To the best of my knowledge the above referenced site plan complies with the driveway design standards referenced in "Table 7-107: Roadway Standards" in the Garfield County Code. Given that this well has been an actively used well with no issues and we completed a water quality test back in 2012 when Toni purchased the property with the a the national test laboratories, Ltd. and everything came back ok (see attached test from 2012) im hoping we can somehow move forward with our permit with the condition that we will get you everything as soon as the Colorado dept of health completes it. I would be happy to sign something that says we will bring the well up to the necessary standards if there are any negative results from the water quality test.
