Thank you.      From: Phil Vaughan [mailto:phil@pvcmi.com]   Sent: Saturday, November 01, 2014 6:21 PM  To: Kelly Cave; David Pesnichak  Cc: 'Ashlee Fechino (ashlee.fechino@wpxenergy.com)'; 'Lynn Cass (lynn.cass@wpxenergy.com)'  Subject: FW: Williams‐ TR 41‐35‐597 Communications Site    Kelly and Dave,    I hope that you are doing well today.    Dave Pesnichak, Ashlee Fechino and I conducted our pre‐application meeting for the WPX Energy Trail Ridge Employee  Housing Facility on 10/24/14.    I had noted in my table of contents for the project that mineral rights ownership would be researched for the property  leased from the Uphoff’s and the access road to the project starting at the end of BLM Road 1009A.  I have attached  existing conditions mapping for your information.    Dave indicated that he would clarify this issue with you.    As per a conversation last week with Dave Pesnichak, Dave asked me to email information to you regarding the past  decision from Carey Gagnon and Molly Orkild‐Larson to determine minerals rights ownership for lease areas that are  similar.    The TR 41‐35‐597 Communications Site was a Williams Production RMT Co. (WPX Energy predecessor)  2011 project  with a small lease area for a communications tower within Chevron, USA Inc, parcel 2137‐253‐00‐007.  This parcel is a  1,920.74 acre parcel. Resolution 2011‐58 is attached.    The attached 5/5/11 Table of Contents was utilized in our meetings with both Carey Gagnon and Molly Orkild‐Larson.    As per the attached 5/5/11 Table of Contents, page 2, “Tab 6‐ Listing of Adjacent Property Owners adjacent to or within  200’ of the subject property.  Include a listing of mineral interest owners of the lease area.”    The reasoning behind this decision by Carey Gagnon was that mineral rights ownership is needed only for the lease area  within these large parcels.  Preparing mineral rights ownership involves extensive cost and research. It was determined  by Carey Gagnon that researching mineral rights for the entire parent parcel is not warranted.  3   The same decision was arrived at by Carey Gagnon and Molly Orkild‐Larson for the WPX Energy Parachute Water  Management Facility.  The Parachute Water Management Facility is located on approximately 37.62 acres within a  383.78 acre tract.  The access road is located on 2 adjacent parcels owned by ExxonMobil Corporation totaling over 730  acres.      Please let me know if you have any questions and I look forward to your reply.    Sincerely,    Phil Vaughan  Phil Vaughan Construction Management, Inc.  1038 County Road 323  Rifle, CO 81650  970‐625‐5350    From: Phil Vaughan [mailto:phil@pvcmi.com] Sent: Wednesday, June 29, 2011 11:07 AM To: Carey Gagnon (cgagnon@garfield-county.com) Cc: Bryan Hotard (bryan.hotard@williams.com) Subject: Williams- TR 41-35-597 Communications Site   Carey,    Thanks for taking time to meet with Bryan Hotard and I on Monday.    As discussed, the attached power of attorney and letter of support are acceptable for our Garfield County Limited  Impact review permit application submittal.    A copy of the final lease agreement between Williams and Chevron will not be required by Garfield County to be  provided during the application process or prior to issuance of the land use permit.  Williams will be responsible for  verifying that the land use approval conforms with the agreement between Chevron and Williams.    Please let me know if any clarification is necessary regarding my meeting notes above.    Thanks again for your assistance and have a great afternoon.    Sincerely,    Phil Vaughan  Phil Vaughan Construction Management, Inc.  1038 County Road 323  Rifle, CO 81650  970‐625‐5350
