TYPE OF APPLICATION: Amendment to an approved Land Use Change Permit -Major Temporary Employee Housing I. GENERAL PROJECT DESCRIPTION Applicants seek to amend approvals granted by the Board of County Commissioners for a Major Temporary Employee Housing Facility known as the Trail Ridge Employee Housing Facility approved by Resolution 2015-30 and extended by Resolution 2016-42. A Special Use Permit was issued February 6, 2017 and recorded with Reception No. 888801. A Certificate of Occupancy was issued for the facility by the Building Department on March 27, 2017. The Applicant is seeking to amend the condition of approval #8 in Resolution 2015-30 and the Land Use Change Permit that provides the following regarding installation of an Onsite Wastewater Treatment System (OWTS) for the facility: 8. Within 9 months of the issuance of the Land Use Change Permit, the Applicant shall install an Onsite Wastewater Treatment System (OWTS) to serve the proposed facility. SUBMITIAL REQUIREMENTS As the request will modify the conditions of approval as issued by the Board of County Commissioners, the application must be considered a Substantial Modification. The Director shall determine the contents of the application submission requirements for a Substantial Modification. The following information shall be submitted as part of this application: A. General Application Materials a . Deed; b . Owner Authorization; c. Copy of approval Resolution(s), certificates of occupancy, and septic permits d. Copy of approved Land Use Change Permit e . Property owner name and mailing address with 200 feet and a map showing these adjacent properties; f. List of names and mailing addresses of mineral owners of the subject parcel; g. Project Narrative, including why the request is being made, proposed amended language for condition, and any other relevant information describing proposed operations. B. Waiver request for Section 7-705(C)(2)(e) regarding installation of permanent wastewater system if the facility is onsite for more than a cumulative of one year and reason for waiver. Please respond to criteria in Section 4-118 of the LUDC; C. As vault and haul wastewater system has been in place for a period of time, please provide evidence that the facility has been operating in accordance with the Standards for such a system outlined in Section 7-705(C)(2)(a), (b), (c), (d), and (f). D. Vicinity Map; E. Site Plan; IV. REVIEW PROCESS Though a new application is required, the review of the application may result in an approval, approval with conditions or denial of the amendment only. If the amendment is denied, the Applicant's original approval is still valid. The process to accommodate this request shall require a Land Use Change Permit Application for an "Amendment to an Approved LUCP -Major Impact Review" is a follows: A. Pre-application Conference . B. Application Submittal. C. Determination of Completeness. D. Schedule Public Hearing, provide documentation regarding notice requirements . E. Additional Copies requested and sent to referral agencies. F. Evaluation by Director/Staff resulting in a Staff Report to the Planning Commission. G. Condition #8 of the Land Use Change Permit notes the following: "8. Within 9 months of the issuance of the Trail Ridge Employee Housing Facility Certificate of Occupancy, the Applicant shall install an Onsite Wastewater Treatment System (OWTS) to serve the proposed facility. The installation of the System shall be in accordance with the design and specifications as outlined in the Application. " The Certificate of Occupancy for the employee housing facility was issued on 3/27/17. Please find the Garfield County Certificate of Occupancy and the Freezer/Refrigerator Permit Card attached. Terry Energy Partners is currently evaluating their future drilling schedule in the Trail Ridge area. It is possible that there will not be a need for the Trail Ridge Employee Housing Facility as of the 2nd quarter of2018. The subject property is located within unincorporated Garfield County in the Resource Lands -Plateau zone district, north of the Town ofDeBeque, Colorado accessed by private roads off Rio Blanco Road 5 and BLM Road 1009A. D. Major Temporary Employee Housing and Storage may be permitted in the Resource Land -Plateau zone district with a Limited Impact Review. E. The Board is authorized to approve, deny or approve with conditions a Limited Impact application resulting in issuance of a Land Use Change Permit pursuant to the Garfield County Land Use and Development Code, as amended. F. The Board of County Commissioners opened a public hearing on the 81h day of June, 2015 for consideration of whether the proposed Land Use Change Permit should be granted or denied, during which hearing the public and interested persons were given the opportunity to express their opinions regarding the request. G. The Board of County Commissioners closed the public hearing on the 81h day of June, 2015 to make a final decision. H. The Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following detenninations of fact: 1. That proper public notice was provided as required for the hearing before the Board of County Commissioners. 2. The hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. 3. That for the above stated and other reasons the proposed Land Use Change Permit for the WPX Trail Ridge Temporary Employee Housing and Storage Facility is in the best interest of the health, safety, convenience, order, prosperity and welfare of the citizens of Garfield County. 4 . That with the adoption of conditions, the application is in general conformance with the 2030 Comprehensive Plan, as amended. 5. That with the adoption of waivers for the Storage Facility, from Section 7-lOOl{C)- Concealing and Screening, the proposed facility meets the requirements of the Land Use and Development Code, as amended. 7. That with the adoption of the Conditions of Approval the application has adequately met the requirements of the Garfield County Land Use and Development Code, as amended. RESOLUTION NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that: A. The forgoing Recitals are incorporated by this reference as part of the resolution. B. The Land Use Change Permit for Major Temporary Employee Housing and Storage area, known as the WPX Trail Ridge Employee Housing and Storage Facility is hereby approved subject to compliance with the following conditions: Conditions Prior to Issuance of Permit 1. The Applicant shall improve the access road as proposed to meet Section 7-107, "Semi-Primitive" standards prior to issuance of the Land Use Change Permit. The Applicant shall provide evidence that the roadway has been upgraded and meets the standards set forth in Section 7-107. This evidence shall be reviewed by the Garfield County Community Development Department and the County Contract Engineer. Other Conditions 2. That all representations made by the Applicant in the application shall be conditions of approval, unless specifically altered by the Board of County Commissioners. 3. · That the operation of the WPX Trail Ridge Temporary Employee Housing and Storage Facility shall be done in accordance with all applicable Federal, State, and local regulations governing the operation of this type of facility. 4. The facility shall maintain compliance with Section 7-306 Lighting, with all lighting to be directed inward and doward toward the interior of the site. Facilities and storage tanks shall be painted a non-glare neutral color to lessen any visual impacts. 7. The Applicant shall comply with their Noxious Weed Management Plan including the best management practices. 8 . Within 9 months of the issuance of the Trail Ridge Employee Housing Facility Certificate of Occupancy, the Applicant shall install an Ons ite Wastewater Treatment System (OWTS) to serve the proposed facility. The installation of the System shall be in accordance with the design and specifications as outlined in the Application. 9. All industrial wastes shall be stored in accordance with all State and Federal laws and regulations. 10. .The facility is permitted to operate 7 days per week, 24 hours per day. 11. Exhibit B Conditions of Approval Conditions Prior to Issuance of Permit 1. The Applicant shall improve the access road as proposed to meet Section 7-107, "Semi-Primitive" standards prior to issuance of the Land Use Change Permit. The Applicant shall provide evidence that the roadway has been upgraded and meets the standards set forth in Section 7-107. This evidence shall be reviewed by the Garfield County Community Development Department and the County Contract Engineer. Other Conditions 2. That all representations made by the Applicant in the application shall be conditions of approval, unless specifically altered by the Board of County Commissioners. 3. That the operation of the WPX Trail Ridge Temporary Employee Housing and Storage Facility shall be done in accordance with all applicable Federal, State, and local regulations governing the operation of this type of facility. 4. The facility shall maintain compliance with Storm Water Management Plan, Drainage and Grading Plans and Reclamation for the site. 5. The Applicant shall control fugitive dust during the operation of the site. 6. The facility shall maintain compliance with Section 7-306 Lighting, with all lighting to be directed inward and doward toward the interior of the site. Facilities and storage tanks shall be painted a non-glare neutral color to lessen any visual impacts. 7. The Applicant shall comply with their Noxious Weed Management Plan including the best management practices. 8. Within 9 months of the issuance of the Trail Ridge Employee Housing Facility Certificate of Occupancy, the Applicant shall install an Onsite Wastewater Treatment System (OWTS) to serve the proposed facility. The installation of the System shall be in accordance with the design and specifications as outlined in the Application.
