Permanent records of all diversions must be maintained by the well owner (recorded at least annually) and submitted to the Division Engineer upon request. 9) This well shall be constructed not more than 200 feet from the location specified on this permit, and not Tess than 600 feet from any existing well owned by others. 10) The owner shall mark the well in a conspicuous place with well permit number(s), name of the aquifer, and court case number(s) as appropriate. Box 1368, Glenwood Springs, CO 81602, (hereinafter "applicant"), submitted two applications for permits to construct wells. Based on information provided by the applicant and records of the Division of Water Resources, the State Engineer finds as follows: 1. The applications were received complete by the State Engineer on January 10, 1994, 2. The proposed locations are outside the boundaries of a designated ground water basin. 4. The applicant proposes to apply the water diverted from the wells to the following beneficial uses: irrigation and commercial. 5. At the proposed depths, using perforated casing in the intervals indicated in the applications, ground water diverted by the wells would be hydraulically connected to the Colorado River. Diversion of ground water by the wells will influence the rate or direction of movement of water in this natural river and its alluvium. 6. The Colorado River is overappropriated. At some or all times of the year, the water supplies of said stream system is insufficient to satisfy all the decreed water rights senior to an appropriation by the applicant. 7. The proposed diversions from the subject wells would cause depletion to the Colorado River at times when this river is overappropriated. 8. Records show that there are senior vested water rights withdrawing ground water from the alluvium of the Colorado River. Use of the applicant's proposed wells would decrease the amount of ground water in the alluvium of said river. 9. No plan for augmentation to remedy the injury to vested water rights has been approved by the Division 5 Water Court. The proposed use of the wells is not exempt under C.R.S. 37-92-602 and so the applications are evaluated under C.R.S. 37-90-137. 11. A preliminary review of our records indicates that a well constructed under permit no. 170888 and other possible wells are located within 600 feet of applicant's proposed wells. Based on the above, the State Engineer is unable to find that unappropriated water is available for withdrawal by the proposed wells and that the vested water rights of other appropriators will not be materially injured. C. Statement_of__Flan for Augmentation: Regulski Well Nos. 1 and 2 will be utilized for commercial purposes (washing vehicles) continuously for twelve (12) hours each day for 250 working days per year. In,addition, the wells will each be utilized for the irrigation of one-half acre of landscaping. Total annual diversions will total 11.046 acre feet from each well. The effluent from the commercial use will be discharged into a septic tank and leechfield disposal system which will consume. ten percent (10%). The 4.547 acres have been historically irrigated from April 1 to October 31 of each year with 3.6 shares of Grand River Ditch Company water from the Lower Cactus Valley Ditch. According to water commissioner records, said 50 c.f.s. has historically irrigated 1500 acres. The Grand River Ditch Company has a total of 270 shares. . The removal from irrigation of 4.547 acres under the Lower cactus Valley Ditch will result in a consumptive use credit of 7.87 acre feet of water during the irrigation season according to the following schedule and depletions created by the operation of the wells will be as follows: . Therefore, there is an annual consumptive use credit of 0.808 AF from the additional 0.467 acres removed from irrigation by this plan and not needed at this time to augment the subject wells. The Referee does therefore conclude that the above entitled Application should be granted and that 0.044 cubic foot of water per second of time with appropriation date of November 4, 1993, are hereby awarded conditionally to each of Regulski Well Nos. 1 and 2 for those purposes specified in paragraphs 3 E. and 4 E. above , provided always that each of said 0.044 c.f.s. is on the condition that said quantities of water be diverted and applied to beneficial' use within a reasonable time; SUBJECT HOWEVER TO ALL EARLIER PRIORITY RIGHTS OF OTHERS and to the integration and tabulation by the Division Engineer of such. priorities and changes of rights in accordance with law. 94CW3 Page 4 Bo r.r 1 Application for a Finding of Reasona' " D • iligence shall' eQ . filed in the same onth as the decree hereil. is entered every six _..years after the entry of the decree herein so long as applicant _ desires to maintain the conditional water rights herein awarded, or until a determination has been made that such conditional rights are made absolute by .reason of the completion of the appropriations, or are otherwise disposed of. The Plan for Augmentation described above will not injuriously affect the owners of or persons entitled to use water under a vested water right or a decreed conditional water right, and the Plan for Augmentation should be and hereby is approved in accordance with C.R.S. 1973, 37-92-305(3), subject to the following provisions: 1. The Office of the Colorado State Engineer shall issue well permits for Regulski Well Nos. 1 and 2, pursuant to this Ruling, but subject to C.R.$ 37-90-137(2). 2. The requestedplan for augmentation shall be subject to all provisions of the Articles of Incorporation and Bylaws of the Grand River Ditch Company as they presently exist or may hereinafter be amended according to Law. 3. Applicant agrees to continue paying 'assessments upon his shares of stock in the Grand River Ditch Company as from time to time may be levied by the Board of Directors upon all of said stock of which Applicant is of like class and shall, otherwise comply with all other lawful obligations of the shareholders of the Grand River Ditch Company. 4. Based on previous Court cases in said ditch, 2.8 % of applicant's water shall remain in the Lower Cactus Valley Ditch to defray historic conveyance and seepage loss attributable to applicant's interest in said ditch. The amount of water historically utilized to irrigate the 4.547 acres ,shall be bypassed or .diverted and returned to the Colorado River at the discretion of the Division Engineer. The balance of water not accounted for or devoted to this plan for augmentation may continue to be diverted into the Lower Cactus Valley Ditch until subsequent judicial proceedings direct otherwise. It is accordingly ORDERED that this Ruling shall be filed with the Water Clerk subject to audicial review. As I lain r I currently hold two well permits which are due to expire this month. 1 would like to request a year's extension on the permits to construct the wells. Due to some unexpected business expenses this past year, my company experienced a cash flow problem. This problem will be resolved by next summer. Please be advised that pursuant to Colorado Revised Statute 37-90-I37(3)(a)(1), additional extensions cannot be approved. Once the wells are completed and the permanent pumps are installed, well completion and pump Installation reports including well and permanent pump test data must be submitted to this office. After water from the wells has been put to beneficial use and prior to the well permit expiration dates, evidence of beneficial use must be received by this office. The well owner is responsible for submitting the evidence of beneficial use. Statement of Beneficial Use forms were provided to the applicant when the well permits were issued. In order for the perrnit to remain valid, certain actions must be taken and documentation must be received prior to the expiration date of the permit. • 'The permit was approved under Section 37-90-137(2), Colorado Revised Statutes. The well must be constructed, pumping equipment installed and water diverted for beneficial use prior to the expiration date of the permit. In order to affirm that the well was used prior to the expiration date, the well owner must complete and submit a Statement of Beneficial Use, Form No. GWS -10. The completed form must be received by the Division of Water Resources prior to the permit's expiration date. , If the well is not in use, the well owner may request, in writing, a one-time, one year extension of the expiration date. The request must be received with a $60.00 filing fee prior to the expiration date and must provide good cause for extending the permit an additional year. If the expiration date has already been extended for one year, the statute does not allow more than one extension of time. If the well is not used by, and the Statement of Beneficial Use is not received by the expiration date, the permit expires and Is of no force or effect. if the well has been constructed, pumping equipment installed, and water will not be used until after the expiration date of the permit, the permit expires and will be of no force or effect. It will be necessary for you to obtain a new well permit by submitting a completed application for an existing well along with a $60.00 filing fee. If the well has not bean constructed, and you do not wish to pursue construction of a well, please advise us in writing in order that we may formally expire the permit without requiring additional notification.
