PROJECT DESCRIPTION
Existing Use:The Waroand Hinds diversion dam isa channel-spanning low-hoad dam on Elk Creek approximately 0.7 miles upstream
of the confluence with the Colorado River and functions to divert water from Elk Creek into the Ware and Hinds Ditch on the south side of the river.
The Ware and Hinds diversion dam is currently a barrier to fish swimming upstream.

Description of Project:The Project seeks to provide upstream passage for fish to swim around the Ware and Hinds diversion dam.
The Project has been designed to avoid impacting existing water rights and to provide fish passage when possible considering the existing
hydrology and water rights that impact flow rates in Elk Creek.Fish Passage is proposed to be provided by a bypass channel to the north

Re:Grading Permit Application for Fish Bypass Channel of Elk Creek Project
To whom it may concern,
Introduction
The purpose of this memorandum is to request a Floodplain Development Applications approval from the
Garfield County for the Fish Bypass Channel of Elk Creek Project (Project). The Project is sponsored by
Trout Unlimited in coordination with Colorado Parks and Wildlife (CPW), the Ware and Hinds Ditch
Company and local land owners, Eric Williams and Ross Talbott.
Project Description
The proposed Project includes the construction of a fish passage channel on the north bank of Elk Creek
to provide fish passage across the Ware and Hinds diversion dam for rainbow trout, brown trout and other
fish species.The fish passage channel will be constructed primarily of boulder and cobble. Upper sections
of the channel will be treated with seeding, planting and erosion control matting.The proposed channel is
3-4 feet wide. The depth of the cut varies from 2 to 5 feet. The boulder lined channel itself will be 18-
inches deep.Above this low flow channel, the excavation will catch with a 3:1 side slope that is either
rocked or matted.A portion of the existing dam structure will be cut and brackets for installing stop logs
will be added.Two small, low relief rock vanes will be placed into Elk Creek at the downstream and
upstream entrances to the channel.These will create a local scour zone at the entrances to minimize
sediment accumulation that could potentially block the entran ce to the channel, particularly on the
upstream side.
The channel will function by routing a portion of the flow from Elk Creek through the fish passage
channel. The channel has been designed to utilize a series of vertical slots and roughened ramp s created
by the boulder and cobbles to reduce velocities to a level that will provide passage for aquatic species
around the Ware and Hinds diversion dam.
Total permanent change to the landscape has an area of 0.02 acres.Disturbance area of the project during
construction is 0.60 acres,including all staging, access roads and stockpile areas.
The proposed schedule for construction of the Elk Creek Fish Passage Channel Project is as follows:

Please see the details below, the completed application, the attached plan set and the attached hydraulic
modeling results summary for more details.
Engineering
The project was designed hydraulically,using SRH-2D, a 2-dimensional hydraulic model developed by
the US Bureau of Reclamation. The design effort targeted specific velocities (<6 ft/s), depths (>1.0 ft)and
vertical drop (0.0 ft)parameters as specified by Colorado Parks and Wildlife (CPW). These parameters
have been met for the expected range of flows, providing fish passage around the diversion dam for
rainbow trout and brown trout and potentially other fish species.The hydraulic modeling results were also
used to calculate scour potential,size boulders and determine alluvial backfill gradation.See Sheets C01-
C04 and D01-02 for more information.
The project did not require engineered ESC BMPs such as sediment basi ns, diversions, conveyance or
detention/retention facilities.The ESC BMP’s that will be utilized are discussed in more detail below and
show graphically in the attached plan set.
The “No-rise” Certification Letter is included in this submittal as part of a separate memo .The project
results in a net-cut of material in the floodplain of Elk Creek, including an area reduc tion in the cross-
sectional area of the existing diversion dam.
Permitting
From a federal and state regulatory standpoint, t he project was verified by the US Army Corps of
Engineers (USACE) to be constructed under Regional General Permit (RGP) 12 –Aquatic Habitat
Improvement for Stream Channels in Colorado.The verification letter is dated October 25, 2016 and is
valid until October 25, 2018. The project was assigned identification number SPK-2016-00684. A copy of
the verification letter from the USACE is included as an attachment.
The contractor will be responsible developing a SWMP and for acquiring the required NPDES permits for
construction through the State of Colorado.The contractor may use the included Erosion Control Plan
shown in the plan set and discussed in the technical specifications as a guide.The application will be due
10 days prior to start of construction activities.Due to its small size, the project will likely be able to be
permitted under CDPS General Permit, Stormwater Discharges Associated with Construction Activity,
COR-030000.
Erosion and Sediment Control
The majority of the work associated with the project, including cutting the existing dam, grading of the
channel, placement of boulders, installation of matting and revegetation will be performed outside of
Ordinary High Water and will not come in to contact with flowing waters of Elk Creek during the
expected construction window of November-December. Erosion and Sediment Control (ESC) BMPs will

be implemented to minimize impacts to Elk Creek and its riparian area . These BMPs include access
ramps, silt fence, oil booms, turbidity curtains, and dewatering filters.The construction of the
downstream outlet and upstream inlet will require work inside OHW and a high likelihood of contact the
flowing waters of Elk Creek. These two structures are small in scale and are anticipated to only take a few
days each to construct. Erosion and Sediment Control (ESC)BMPs will also be implemented to minimize
impact to Elk Creek during this period, including oil booms, turbidity curtains an d dewatering filters. See
Sheets EC01-EC05 for more details on the ESC plan. Many aspects of the erosion and sediment control
plan are discussed below:
1.Phase Construction –Small site and disturbance area, and short construction window reduces
needs for phasing, but contractor will be required to limit disturbance to areas being worked on.
Erosion and Sediment control BMPs will be in place prior to the start of earth disturbance/moving
activities.
2.Soil Stabilization –Majority of excavated material will be of gravel and cobble nature and will be
reused on site. Fine material will be hauled offsite. Any temporary stockpile of material will be
projected with straw.
3.Permanent Revegetation –Disturbed areas along the proposed fish passage channel will be
seeded with a riparian seed mix provided by Colorado Parks and Wildlife. Willow root balls and
stakes will be harvested from the channel alignment and replanted.Erosion control matting will
be installed on slopes along the proposed channel.See sheet R01 for more information.
4.Cut and Fill Slopes –No fill slopes will be generated as part of this project. Cut slopes will be
less than three feet in height and have a slope of 3:1 or shallower. Seeding, willow stakes and
erosion control matting will be applied to these slopes as shown in the plans.
5.Construction in or Adjacent to a Water Body –See attached plan set for details on stabilization
measures that will be implemented for the proposed fish passage channel. These will include the
use of boulder along the north bank Elk Creek and boulder and coarse cobble in the fish passage
channel to prevent bank and bed erosion.Required work below OHW in Elk Creek will utilize
ESC BMPs, including turbidity curtains, oil booms to prevent increased turbidity in Elk Creek.
The project team has coordinated with CPW and received permission to construct the project in
November and December, outside the standard in water work window.
6.Channel and Ditches –Irrigation return ditch immediately west of the project area will be
protected in place. Construction activities in Elk Creek will be limited to the exit and entrance to
the fish passage channel. All other construction activities, including the diversion dam
modifications will be performed in the dry. ESC BMPs will be utilized to protect the flowing
waters of the creek. See Sheets EC01-06 for more information.
7.Stormwater Runoff –Small Site (<0.25 acres)has been configured to minimize disturbance and
concentration of stormwater runoff.Stormwater runoff and dewatering effluent will be treated
prior to being returned to Elk Creek.See Sheets EC01-06 for more information.
8.Sediment and Mud Control –Specifically located access points and an improved haul road will
prevent sediment and mud from being tracked off of the site.Silt fence will be used on downhill
side of staging area. November-December construction will reduce also reduce potential mud

9.Construction Dewatering –dewatering will be likely required as part of this project, though
construction during low-water/colder month will reduce groundwater infiltration. The contractor
will be required to apply for a Construction Dewatering Discharge Permit with the State of
Colorado and perform dewatering activities in accordance with the permit requirements.
10.Inspection and Maintenance –The contractor will be required to identify an Erosion and
Sediment Control Manager for the project. All Erosion and Sediment Control BMP’s will be
inspected after precipitation events and at a minimum monthly. Repairs will be made as detailed
in the technical specifications. An inspection log will be used to document these inspections and
repairs.
11.Dust Control Plan –project team does not anticipate dust being an area of concern for this
project. The site (<0.25 acres) and disturbance area (<0.1 acres) are small. Haul roads will be
improved with alluvium from Elk Creek prior to the start of significant truck traffic. Construction
will occur in November and December. Disturbed areas will be seeded and planted.As instructed
in the project’s technical specifications, the contractor will be required to water dusty areas if
needed.See Sheets EC01-05 and R01 for more information.

Dear Glenn,
The purpose of this memorandum is to document the floodplain impacts of the proposed
Fish Bypass Channel of Elk Creek.This letter describes how the proposed modifications
comply with the Garfield County Land Use and Development Code and Federal
floodplain development guidelines.
Existing Conditions
The existing diversion dam, which is owned and operated by the Ware and Hinds Ditch
Company,spans Elk Creek approximately 0.7 miles from its confluence with the
Colorado River.It has a height of approximately 5 feet and is composed of a concrete
wall augmented with concrete blocks along the downstream toe of the structure. (See
Figure 1 below) The Ware and Hinds diversion headgate and ditch inlet is on the south
side of the creek (left side of Figure 1).The structure continues into the willows on the
north bank floodplain bench (right side of Figure 1). The extension is composed of two
parallel walls separated by a series of seven buttresses.Ware and Hinds is the senior
water right holder on Elk Creek and typically sweep Elk Creek during low flow periods
in July, August and September.

The project site is in a section of Elk Creek that is not a detailed study area for FEMA,
meaning that a hydraulic model, such as HEC-RAS was not used for delineating the 100-

year floodplain boundary.As such, the 100-year Floodplain is categorized as Zone A and
a Base Flood Elevation has not be established.A copy of the current FIRM is included as
an Attachment A.The 100-year limits were also referenced into the 50%design plans,
which are attached to this letter as Attachment B.
Proposed Conditions
The 150 foot long fish bypass channel around the Ware and Hinds diversion dam is
proposed to be cut through the adjacent flood plain bench on the north bank of Elk Creek.
A small section of the ex isting concrete structure will also be removed.See the 50%
design plans, Attachment B, for more details.When in operation, the project will route a
small percentage of the total flow in Elk Creek through this side channel, providing a
path for rainbow trout, brown trout and other fish species to migrate from downstream to
upstream of the diversion dam and vice versa.During periods when the Ware and Hinds
ditch company is sweeping the creek (i.e. July, August, September), the bypass channel
will be closed with stop logs incorporated into the cut in the existing structure. All other
times of the year, including runoff, the channel will flow.
For design flows, the proposed bypass channel was hydraulic modeled in SRH -2D, which
provided depths and velocities. This information was used to verify fish passage
performance and to estimate needed material sizes and scour depth.See modeling results
of the SRH-2D effort, included as Attachment C.
With no established Base Elevation and a net cut of material on the project,
RiverRestoration asserts that a detailed floodplain analysis is not necessary for this
project. The proposed channel has a net cut of 120 cubic yards compared to existing
conditions and the proposed opening in the existing concrete structure has an cross
sectional area of 18 square feet.These project related reductions in fill and cross section
will provide additional conveyance through the project reach.Admittedly this additional
conveyance will be minimal as compared to the total flow in Elk Creek during the 100 -
year flood event.
In conclusion,the proposed project will not create a rise in water surface elevations
associated with the 100-year floodplain of Elk Creek or change the extents of the 100-
year floodplain boundary.

Longitude -107.545788°, in New Castle, Garfield County, Colorado.
Based on the information you provided to this office, your project involves the
construction of a fish bypass channel, in accordance with the plans provided in the
Notification of Fish Bypass Under RGP 12, dated August 31, 2016. These activities will
result in the permanent loss of approximately 0.05 acre of non-tidal wetland. We have
determined activities in waters of the U.S. associated with the project are authorized by
Regional General Permit (RGP) 12. Your work must comply with the general terms and
conditions listed on the enclosed Regional General Permit information sheets. Please note
that per General Condition 1, you must sign the enclosed Compliance Certification and
return it to this office after completion of the authorized work.
This verification is valid for two years from the date of this letter or until the Regional
General Permit is modified, reissued, or revoked, whichever comes first. Failure to comply
with the General Conditions of this Regional General Permit may result in the suspension
or revocation of your authorization.

redd sites located above the Ware and Hinds diversion due to the barrier presented by the
structure. To address this problem in hopes of increasing natural reproduction and
recruitment of fish to the river, Colorado Parks and Wildlife recruited Trout Unlimited to
construct a bypass channel around the diversion. The bypass will run along a property
boundary between landowners, both of whom have generously volunteered to donate
easements to Parks and Wildlife for construction on a temporary basis and for maintenance in
perpetuity. Also, to accommodate the bypass, the ditch company has been proactive in
voting to allow a notch to be cut in the retaining wall adjacent to the active diversion dam.
Grants have been awarded to fund construction, and the present plan is to select an
excavation contractor and issue notice to proceed in early November so work can be
completed before the middle of December if all goes well. You are cordially invited to visit
the site with me as part of your review of this notification and request. A site visit with
prospective design and construction management bidders is scheduled for September 16th. If

In addition an oblique view bypass schematic by Trout Unlimited staff is provided to help with
visualization. The sketch shows a condition that is not proposed, that being water spilling
over the diversion while the bypass channel is closed. In practice, the bypass will only be
closed when necessary to route water to the ditch when the diversion is not spilling.
Construction drawings are not yet available, however, they will be produced prior to breaking
ground, and updated to provide as-builts.

No wetland delineation is enclosed, as it is assumed that 100 percent of the impacted area
lies within jurisdictional wetland. As shown on the site map, such acreage is estimated to be
about half of the allowable amount without compensatory mitigation under General Condition
3 of the permit, or 0.05 acres. It is possible that the as-built impact area will be slightly
more, though still less than the mitigation threshold.
Per Notification Procedure 3
As stated above, the project purpose is to build a bypass channel to allow fish running up Elk
Creek from the Colorado River to access spawning habitat above the Ware and Hinds Ditch
diversion dam. The constructed bypass will simulate a natural channel by using boulder and
cobble hydraulic roughness elements to provide resistance such that water velocity is reduced
and flow depth increased to levels passable by fish. When open, the bypass will not include
any vertical drop, and thus will require no leap, so as not preclude use by fishes not
accustomed to jumping. The following measurable parameters have been adopted as design
targets tailored to the passage objective, and are expected to prevail during periods of
passage flow. During high peak snowmelt runoff or other flood events, and during times when
the ditch closes the bypass to dewater the creek, these targets will not be met.
Average Bypass Channel Flow Velocity < 6.0 feet per second
Minimum Bypass Channel Flow Depth > 0.5 feet
Maximum Bypass Channel Vertical Drop = 0.0 feet
Achievement of these targets will depend on results of hydraulic roughness element
placement efforts, and cannot be anticipated exactly.
Per Notification Procedure 4
As mentioned above, a notch will be cut in the existing concrete retaining wall adjacent to
the Ware and Hinds Ditch diversion structure. The notch will be about 4 feet deep and have
its bottom about 3.2 feet below the elevation of the active diversion dam crest. It will be
fitted with hardware to accept stop logs for closing the bypass channel. Upstream of the
notch, a channel will be excavated to intersect the active creek channel approximately 65
feet along an arc to the south-southwest transitioning from rectangular at the notch to
trapezoidal cross section with 1 to 1 side slopes and bed width of about 3 feet along most of
its length, subject to refinement during final design. Downstream of the notch a similar
channel with center line length of about 50 feet along an arc to the south-southeast will be
constructed, partially on a low ramp consisting of material excavated from the bypass
channel footprint and or imported boulders, cobbles, gravel and sand as determined by the
quality of the excavated material. A low permeability liner may be incorporated into the
final ramp design. The bypass channel will be armored with large boulders and fitted with
cobbles as bed and side slope hydraulic roughness elements. These materials will be
imported from a local gravel pit. Depending on the quality of the excavated material, the

total volume of all material to be placed or redistributed in the assumed jurisdictional
wetland area could be less than 100 cubic yards or as much as several hundred cubic yards. If
poor material is encountered, greater excavation will be needed to remove it and additional
material will be imported to provide a robust channel with long service life expectancy.
Although it could be more, it is not expected that the volume will exceed 500 cubic yards.
In order to limit introduction of sediment into Elk Creek as a result of construction of the fish
bypass channel, as much of the work as possible will be done in the dry, creek flow may be
bypassed down the Ware and Hinds Ditch if necessary and agreed by the ditch company, the
stop log notch may be kept closed as much as practical until bypass channel armor is in place,
and excavation into the active creek channel will be performed at low flow when little sheer
stress is available to cause sediment movement and entrainment. Further, conditions of any
necessary storm water or grading permit will be met.
Per Notification Procedure 5
The critical stream condition that the planned bypass channel will address is the barrier to
upstream fish passage posed by the diversion dam. It is believed that the grade control
provided by the diversion may be one of the factors that contribute to the existence of good
spawning habitat upstream. Also, due to the senior water rights in the Ware and Hinds Ditch,
the reach upstream of the diversion retains good flow throughout the hot summer months and
provides good brood rearing habitat. Without a bypass channel, spawning fish running up
from the river are denied access to these resources.
Per Notification Procedure 6
The permanent footprint of the bypass is estimated to be about 0.05 acres all within what is
assumed to be jurisdictional wetland area. Once constructed, it may be found to be
somewhat larger, though still well below 0.10 acres. The bypass termini along the left bank
of Elk Creek will span widths totaling approximately 20 linear feet of bank length. These
impacts will benefit fish and the stream ecosystem by providing upstream access to
approximately 3.3 miles of creek channel along Elk Creek and East Elk Creek between the
subject site and the next barriers upstream.
Per Notification Procedure 7
The quantifiable parameters listed above, under Procedure 3 will be measured with a wading
rod and velocity meter during post completion monitoring at several different creek stages
once the bypass channel is put in service. The measured values will be compared to the
design targets and an evaluation of results will be included in the monitoring report
submitted the third year after construction.
The parameters listed above will comprise the entirety of the success criteria necessary for
compliance with Regional General Permit 12. In addition, on a voluntary basis, CPW will
record the long-term effects of the project by monitoring fish density and biomass both

upstream and downstream of the site on the creek and on the river, and will also evaluate
fish passage at various flow stages.
Certification and Requests
The information provided hereby and herewith is accurate and provides a complete
characterization of the planned bypass, both to the greatest degree presently available. It is
the intent of Colorado Parks and Wildlife and its partners in this project to abide by the terms
and Conditions of Regional General Permit 12.
Since this project has been vetted by several levels of staff, including the Area Aquatic
Biologist as documented by the enclosed internal memo and the Senior Aquatic Biologist for
the Northwest Region, Colorado Parks and Wildlife requests that the comment period
associated with our interagency coordination be waived.
Parks and Wildlife also hereby requests that you please verify and acknowledge that the
subject bypass channel plan conforms with the cited permit, state concurrence that it
qualifies with the requirements of the permit, and issue written approval and authorization to
proceed forthwith.

A fish passage structure on Elk Creek at the Ware and Hinds diversion could be beneficial for
rainbow and brown trout, as well as mountain whitefish that utilize the lower portions of Elk
Creek, Main Elk Creek, and East Elk Creek for spawning purposes. Fish from the Colorado
River will seek tributaries in the spring and fall with sufficient flows and suitable habitat to
spawn in. The current Ware and Hinds diversion structure limits fish that have moved into Elk
Creek from the Colorado River in reaching available adult spawning habitat, as well as
recruitment habitat for young fish. Modification of the existing Ware and Hinds diversion
structure could increase reproductive and recruitment success of rainbow and brown trout, as well
as mountain whitefish by increasing connectivity between Elk Creek, Main Elk Creek, East Elk
Creek, and the Colorado River. All three species are heavily sought by anglers for sport fishing
opportunities.
Rainbow and brown trout are currently present in both Main Elk Creek and East Elk Creek, while
cutthroat trout and brook trout can also be found in Main Elk Creek. Sculpin, a native fish
species, has also been collected in both of these creeks. Other native fish species, such as
flannelmouth and bluehead suckers, and potentially roundtail chub, that generally occupy habitat
in the Colorado River, may also utilize the lower portion of Elk Creek on a seasonal basis. CPW
is a signatory on the Rangewide Agreement and Conservation Strategy for these "three species."
Additionally, the roundtail chub is considered by CPW as a Species of Special Concern. Thus,
these native fish species could also benefit from a fish passage structure at the Ware and Hinds
diversion, allowing opportunity for upstream movement to suitable habitat, and increased
connectivity between Elk Creek, Main Elk Creek, East Elk Creek, and the Colorado River.
CPW has been involved with multiple fish passage structures throughout Colorado. We have
quite a bit of knowledge that can be gleaned from others in the Aquatic Section that have worked
on similar projects. Please let me know how I may be of assistance should this proposed fish
passage structure on the Ware and Hinds diversion move forward.
