HomeMy WebLinkAbout5.00 Mineral RightsPO Box 248 Carbondale, CO 81623 (970) 947-9568 Page 1 December 12,2017 Community Development Department Garfield County 108 8th Street, Suite 401 Glenwood Springs, CO 81601 Re:Fish Bypass Channel of Elk Creek Project –Research of Minerals Rights To whom it may concern, The purpose of this memo is to document research performed in regards to mineral rights on the two properties affected by the proposed Fish Bypass Channel of Elk Creek Project (Project).The two properties are owned by Williams Family Investments Company, RLLP (north bank) and Burning Mountain Land & Cattle, LLC (south bank). The Project is a small fish bypass channel project on the north bank of Elk Creek, designed to provide passage fro aquatic species around the Ware and Hinds Diversion Dam. No land transfers, water rights transfers or mineral rights transfers will be performed as part of this project. Both land owners will sign a maintenance access easement agreement with Colorado Parks and Wildlife (CPW) to allow CPW staff to access the bypass channel for maintenance. RiverRestoration (RRO)staff visited the Garfield County Recorder’s office on the afternoon of December 11, 2017 to research the mineral rights for each of the properties in question. With assistance from Recording Clerk, Chrissy Ziegler- Doran, a review of each property’s deed, water rights, mineral rights information was conducted using the database linked computers located in the Recorder’s office. The Williams Family Land Investments Company search yielded 40 results. The results did not demonstrate any water or mineral rights were present that would be affected by the proposed Project. The Burning Mountain & Cattle search yield 105 results (90 under Burning Mountain Land & Cattle and 15 under Burning Mtn Land & Cattle.) The results yield a number of mineral rights deeds from the mid-1990s, but none of these involved areas adjacent to the Ware and Hinds Diversion Dam. In conclusion, the mineral rights research that was performed for the Fish Bypass Channel of Elk Creek Project did not yield any evidence that mineral rights for the land surrounding the Ware and Hinds Diversion Dam and the Project have been severed from their respective properties.
