I. GENERAL PROJECT DESCRIPTION
Caerus Oil and Gas would like to request a permit for the location of a Minor Temporary Employee
Housing Facility for workers related to the drilling of Savage Pad 20F. A Minor Temporary Employee
Housing permit is required for facilities that are 1) completely contained on a COGCC well pad, 2)
that will be located on the site less than 1 year, and 3) have occupancy of 9 to 24 people who are
supporting the drilling operation. Caerus estimates the need for housing trailers on the well pad
starting in approximately July 2018.
II. REGULATORY PROVISIONS APPLICANT IS REQUIRED TO ADDRESS
• Garfield County Comprehensive Plan 2030
• Garfield County Land Use and Development Code, effective July 15, 2013
• Section 4-107 Minor Temporary Employee Housing Facility
• Section 4-301. Minor Temporary Employee Housing Submission Requirements.
• Table 4-102, Common Review Procedures and Required Notice;
Ill. REVIEW PROCESS
• The review process shall follow the steps as contained in Table 4-102 with modifications to
call-up procedures as noted in Section 4-107 (see attached flow chart and below outline).
• Pre -Application meeting;
• Submittal of Application (3 copies and one digital);
• Completeness Review;
• Submittal of additional materials (if needed)
• Setting a date for the Directors Determination;
• Public Notice 15 days prior to the Director's Decision to property owners within 200 feet
and mineral rights owners on the subject property;
• Directors Decision including any conditions;
• A 10 day Call-up Period after Director's Decision is made.
IV. SUBMITTAL REQUIREMENTS
In accordance with Section 4-301, Applications for a Minor Temporary Housing Facility must include
the following:
1. General application materials pursuant to 4-203.8.
2. A Vicinity Map presented on a USGS 7.5 -minute series quadrangle at a scale of
1 inch equals 2,000 feet or equivalent, with a topography depicted at a
minimum of 40 -foot intervals, and that indicates the following:
a. The section, township, and range of the subject parcel and the location
of Minor Facility within the subject parcel and the Permitted Site;
b. General relation to surrounding public roads, private roads, adjacent
utility systems, residential development, other actively permitted
Minor and Major Facilities, natural drainage courses, and municipalities
within 1 mile of the proposed Minor Facility;
C. North arrow and scale; and
d. GPS coordinates and current surface ownership of the subject lot.
3. Site Plan consistent with section 4-203.D. and including the following
information:
a. The proposed location and anticipated layout for the Facility.
b. Site specific, surveyed maps depicting the location of the Facility,
located within the Permitted Site within the subject parcel.
C. The dates of installation and removal for the Facility. The list shall also
include the estimated total cumulative length of time that the Facility is
anticipated to be installed at the proposed location.
d. The sewage and wastewater disposal, trash receptacles, potable water
storage, all other associated infrastructure, and all other equipment
located within the Permitted Site.
e. Identification of the private and public roadways accessing the Facility.
Roadways shall be marked as open, gated, and/or locked (include
combinations). Detailed directions, with mileage, shall be given from
the nearest town within the County, nearest County Sheriff's Office
dispatch location, and responsible fire district headquarters to each
Minor Facility along each roadway.
f. The name, address, and phone number of surface owner of the subject
lot or the Permitted Site if the Permitted Site is within the Resource
Land Zone Districts.
g. The name, address, and phone number, including a 24-hour emergency
response number of at least 2 persons responsible for the Operator's
emergency field operations; contact numbers for local Hospitals,
emergency response, fire protection districts, the County Sheriff's
Office, Life/Care Flight, and applicable regulatory agencies; site
safety/evacuation plan; and any other written response plan for
potential emergencies at the Permitted Site.
4. Sign -offs from the County Sheriff's Office, relevant fire protection district(s),
and Community Development Department consistent with the requirements
of this Code.
5. Use and Occupancy Certification.
a. A legible photo of the State Division of Housing Seal certifying the
housing unit that will be used meets the use and occupancy per Building
Code; or
b. Stamped certification by the State Department of Housing that the use
and occupancy of the housing unit will meet the building and fire code
requirements.
6. A description of infrastructure and services that will be provided at the site.
7. Evidence of the physical and legal water supply and a general description of the
water system planned for potable water, along with details regarding number
and volume of potable water tanks; source of water; name of hauler; hauler's
CDPHE identification number; and copy of hauler's CDPHE certification,
frequency of delivery, calculation of water demand, and demonstration of
adequate capacity.
8. A general description of the system planned for collection and storage of
sewage and wastewater, along with details regarding number and volume of
sewage and wastewater vaults; name of hauler; frequency of pickup;
identification of sewage disposal site; calculation of sewage and wastewater
treatment demand; and demonstration of adequate storage and/or treatment
capacity.
9. A general description of the system planned for collection and disposal of
refuse, including number, type, and volume of collection containers; name of
hauler; frequency of collection; and identification of refuse disposal site.
10. A list of adjacent surface owners, as identified in the records of the County

Assessor or the Clerk and Recorder's Office, located within 200 feet of the
subject parcel or 200 feet from the Permitted Site if the Permitted Site is within
the Resource Land Zone Districts, and a list of separated mineral estate owners
in the subject lot or the Permitted Site if the Permitted Site is within the
Resource Land Zone Districts.
11. The name, title, address, phone number, and email address of the Operator's
Compliance Officer or other authorized representative who is in charge of
ensuring that the Minor Facility is in compliance with the standards outlined in
this Code.
12. A form provided by the Community Development Department and signed by
the Operator's Compliance Officer, indicating that the Minor Facility will be
installed in accordance with all applicable County, relevant fire district, State,
and Federal regulations.
13. A form, provided by the Community Development Department and signed by
the Operator's Compliance Officer, indicating that the Operator submits to the
enforcement provisions identified within this Code
14. A copy of the permit from the State or Federal agency regulating the Permitted
Site, identifying the location, conditions of approval, time period for which the
permit is valid, and the parameters for reclamation, and revegetation of the
Minor Facility once the State or Federal permit for the Permitted Site has
expired or is otherwise terminated

upon determination of completeness.

Caerus provides electricity for lights and heat from the rig generators, potable water
from tanks, and drinking water from bottles, television, and bunks for sleeping. A 10 x
20 trash receptacle will be located south and east of the rig. The waste hauler, Western
Colorado Waste will pick-up daily and take all trash to the Garfield County Landfill.

Scope of Work:
a. Is to provide onsite Housing, Water, Sewer, and Surface Equipment.
b. Water Hauling of Potable/Non Drinking Water. State of Colorado PWSID Permit
#CO00223729 to operate as a potable water delivery system. We purchase our Water
from The Town of Silt, Town of Parachute, and the City of Rifle.
c. We will provide two climate controlled 3000 gallon potable water tanks.
d. Delivery of potable water every four days.
e. The water demand calculation will be 50 gallons per day, per person.
f. Hauling of Gray Water "Sewer". We are permitted to haul and dispose of gray water to
the City of Rifles Water Treatment System (Permit Attached)
g. We will provide six 2000 gallon waste water storage tanks.
h. Pick up of waste water every four days.

qualifications for complying with the conditions of this chapter. Vehicles with a rated capacity in excess of
4,000 gallons Will be approved only upon apeclal authorization of the Superintendent. 113-3-620 (1))

List of Performance Standards for Minor Temporary Employee Housing Facility
A. Federal, State, and Local Laws and Regulations.
Minor Facilities must comply with all applicable Federal, State, and local laws and
regulations.
B. Notification of Facility Installation and Removal.
The Sheriff's Office and relevant fire protection district(s) must be notified at least
24 hours prior to installation and removal of each Minor Facility. The Community
Development Department shall be copied on all such notification, whether hard
copy or electronic.
C. Water Systems.
Water systems shall comply with standards set forth in section 7-705.8. (as
excerpted below):
Water Systems.
9. Water systems must comply with all applicable State and local laws and
regulations.
2. All potable water systems must include a meter and the Operator must
keep a record of the daily usage.
3. For sites to which potable water is hauled, Operators shall:
a. Keep appropriate records, to be provided to the County upon
request, to demonstrate that water supplied to a site is from an
approved source and that wastewater is disposed at an approved
facility.
b. For water facilities not permitted by the CDPHE, the Operator
must conduct monthly tests (or quarterly if an on-site disinfection
system is installed) and maintain records of potable water samples
speck for coli form. Any tests indicating coli form contamination
must be disclosed to the County Public Health Department.
c. Water systems facilities permitted by the CDPHE must obtain all
necessary State permits or demonstrate that applications for any
necessary permits have been submitted prior to a determination by
the County that an application is complete.
d. Maintain compliance with State regulations at all times during
operation.
4. In no case shall unsafe water be used for drinking nor shall raw sewage
or used water be discharged onto the ground surface.

D. Wastewater Systems.
Wastewater systems shall comply with standards set forth in section 7-705.C. (as
excerpted below):
Wastewater Systems.
1. Wastewater systems must comply with all applicable State and local
laws and regulations.
2. Wastewater may be disposed of using either an OWTS or a vault -and -
haul system. A vault -and -haul system must demonstrate the following:
a. Year-round access is available and maintained for safe and
regular access for sewage hauling vehicles;
b. The Operator can demonstrate and guarantee an arrangement
for hauling sewage;
c. The Operator will maintain all records, including but not limited
to, trip logs/reports and landfill receipts;
d. The sewage disposal records will be maintained as public
records to be available to the County upon request;
e. The facility will not exceed a cumulative of 1 year at the
approved location; and
f. The facility has been designed to accommodate 75 gallons of
wastewater per person per day or an amount derived from
engineered calculations taken from metered usage rates at a
similar facility that has been reviewed and approved by the County.
E. Clean, Safe, and Sanitary Condition.
Minor Facilities shall be maintained in a clean, safe, and sanitary condition, free of
weeds and refuse. Any hazardous or noxious materials that must be stored at the
Minor Facility for operational or security reasons must be managed in accordance
with all applicable Federal, State, and local laws and regulations.
F. Trash and Food Storage.
Wildlife -proof refuse containers must be provided for trash. Outdoor food storage
is prohibited unless facilities are provided that prevent the attraction of animals to
the Major Facility site.
G. Fire Protection.
1. Provisions for giving alarm in case of fire and fire suppression must be
installed per fire codes and as required by the fire protection district.
2. Single -station carbon monoxide alarms must be placed in each
Manufactured Home or Recreational Vehicle unit.
H. No Domestic Animals Allowed.
Domestic animals are prohibited.
1. Removal of Facility.
Within 10 days following the expiration or other termination of the Land Use
Change Permit or represented date of removal identified within the Land Use
Change Permit, all housing structures, foundations, and associated infrastructure
shall be completely removed. The Operator shall provide the Director with photos,
dated and signed by the Operator's compliance officer, indicating that all housing
structures, foundations, and associated infrastructure have been removed within
the specified timeframe.

that could occur on this pad. For the proposed 8 wells in 2016, the facilities will consist of 8 separators, 2 water tanks, 1

In addition to the notifications required by COGCC listed in the Northwest Notification
Policy and Rule 316C. COGCC Form 42. FIELD OPERATIONS NOTICE (a. Notice of
Intent to Conduct Hydraulic Fracturing Treatment, b. Notice of Spud; and c. Notice of
Construction or Major Change); operator shall notify the COGCC 48 hours prior to rig
mobilization and pipeline testing (flowlines from wellheads to separators to tanks; and/or
any temporary surface lines used for hydraulic stimulation and/or flowback operations)
using the Form 42 (as described in Rule 316C.m. Notice of Completion of Form 2/2A
Permit Conditions). The appropriate COGCC individuals will automatically be email
notified.
In lieu of standard Form 42 spud notices, submit Form 42 Rulison SAP / Rio Blanco
SAP - Spud Notices, specifying the bottom hole location sector and tier.
Operator shall provide complete well -specific emergency contact information to COGCC
via email prior to spuding wells on this pad. Rulison.Submittal@state.co.us.
The operator shall submit, and receive approval of, a reuse and recycling plan per Rule
907.a.(3), prior to any reuse/recycling of drill cuttings.
The operator shall follow all requirements of the Project Rulison Sampling and Analysis
Plan (SAP), Revision 3.0, dated July 2010.

Operator must ensure secondary containment for any volume of fluids contained at the
well site during drilling and completion operations (as shown on the Construction Layout
Drawings attachment); including, but not limited to, construction of a berm or diversion
dike, diversion/collection trenches within and/or outside of berms/dikes, site grading, or
other comparable measures (i.e., best management practices [BMPsj associated with
fluid containment/control as well as stormwater management for the control of run-on
and run-off) sufficiently protective of nearby surface water. Any berm constructed at the
well pad location will be stabilized, inspected at regular intervals as required by CDPHE
(at least every 14 days and after precipitation events), and maintained in good
condition. The design/build of any perimeter berm shall be sized, constructed, and
compacted sufficiently to contain fluids during drilling operations, as well as all fluids
contained in temporary frac tanks during completion operations.
The access road will be maintained as to not allow any sediment to migrate from the
access road to nearby surface water or any drainages leading to surface water.
Strategically apply fugitive dust control measures, including encouraging established
speed limits on private roads, to reduce fugitive dust and coating of vegetation and
deposition in water sources.
The location is in an area of moderate to high run-on/run-off potential; therefore
standard stormwater BMPs must be implemented; prior to, during, and after
construction, as well as during drilling, completion, and production operations; at this
location to insure compliance with CDPHE and COGCC requirements and to prevent
any stormwater run-on and /or stormwater run-off.
Berms or other containment devices shall be constructed to be sufficiently impervious
(corrugated steel with poly liner or equivalent) to contain any spilled or released material
around permanent crude oil, condensate, and produced water storage tanks.
The moisture content of drill cuttings managed onsite shall be kept as low as practicable
to prevent accumulation of liquids greater than de minimis amounts. After drilling and
completion operations have been completed, the drill cuttings that will remain on the
well pad location (cuttings management area, the cut portion of the pad, cuttings trench,
dry cuttings drilling pit), must meet the applicable standards of Table 910-1. After the
drill cuttings have been amended (if necessary) and placed on the well pad, sampling
frequency of the drill cuttings (to be determined by the operator) shall be representative
of the material left on location. No offsite disposal of cuttings to another oil and gas
location shall occur without prior approval of a Waste Management Plan (submitted via
a Form 4 Sundry Notice) specifying disposal location and waste characterization
method.
Flowback and stimulation fluids must be sent to enclosed tanks, separators, or other
containmentlfiltering equipment before the fluids can be placed into any pipeline or
storage vessel located on the well pad; or into tanker trucks for offsite disposal. No
open top tanks can be used for initial flowback fluids containment. The flowback and
stimulation fluid tanks, separators, or other containment/filtering equipment must be
placed on the well pad in an area constructed to be sufficiently impervious to contain
any spilled or released material. No additional downgradient berming is required if
operator constructs a sufficiently sized perimeter berm.
Potential odors associated with the completions process and/or with long term
production operations must be controlled/mitigated.
Operator shall pressure test pipelines (flowlines from wellheads to separators to tanks;
and any temporary surface lines used for hydraulic stimulation and/or flowback
operations) in accordance with Rule 1101.e.(1) prior to putting into initial service any
temporary surface or permanent buried pipelines and following any reconfiguration of
the pipeline network.

3 1 General Housekeeping
A.) Noise - Sound mitigation will be used around the production equipment if
necessary in order to comply with the nearby cabin per Rule 802. Drilling, completion,
workover, and construction operations will also comply with Rule 802.
B.) Closed Loop Drilling Systems - A closed loop drilling system will be used. No pits
are planned.
C.) Green Completions - Emission Control Systems - Pipelines and production
equipment capable of supporting green completions will be used.
D.) Traffic Plan — This location is accessed via private road. This road is maintained
year round and can accommodate local emergency vehicle access requirements.
E.) Multi -well Pad --The initial drilling phase plans for 8 wells to be drill from this pad.
F.) Leak Detection Plan — Per recent COGCC guidance on Rules 1101 and 1102,
pipelines will be pressure tested prior to use. Wells will be monitored daily via daily
pumper site visits.
G.) Berm Construction - Secondary containment berms with poly liner will be built
around produced
water storage tanks upon completion and will be large enough to contain 150% of the
largest single tank. It will be inspected regularly and maintained in good condition.
H.) Blowout Preventer Equipment (ROPE) - BOPE equipment will consist of a double
ram with blind ram and pipe ram.
I.) BODE Testing for Drilling Operations - BOPE will be pressured tested upon initial rig j
up and on every well thereafter once surface casing is set for each well.
J.) BOPE for Well Servicing Operations - Adequate blowout prevention equipment will
be used on all well servicing operations.
K.) Pit Level Indicators — No pits are planned.
L.) Drill Stem Tests - No drill stem are planned.
M.) Fencing Requirements - Fencing will be placed around all equipment with moving
parts and will be designed and constructed to keep wildlife away from the equipment.

shall be removed a minimum of 25 feet from the wellhead, tanks, and separators.

R.) Tank Specifications - 400 bbl. Tanks —12' OD x 20' tall. Built to API 12F standards.
S.) Access Road — The Access road is already built. This is a private access road
which is maintained for all weather use and able to accommodate local emergency
vehicle access requirements.
T.) Well Site Cleared - Within 90 days after the wells are plugged and abandoned the
well site shall be cleared of all nonessential equipment, trash, and debris.
U.) Identification of Plugged and Abandoned Wells - Upon plugging and abandoning

drilled and completed the second phase of drilling will be determine.
W.) Site Specific Measures - Stormwater is addressed under a field -wide Stormwater
Management Plan (CDPHE Certification #COR039527). Run-on protection and run-off
controls will be installed prior to the beginning of construction activities, as practicable,
with consideration given to worker safety, wildlife, and site access.

authorization from Colorado Parks and Wildlife (CPW) to transfer the Noble Energy,

Once all topsoil has been distributed across the site, the location is then seeded by
drill seeding methods or broadcast seeding. All reclaimed areas except areas needed
for production will comply with any requests the landowner has.
Re -vegetation is accomplished as soon as practical following the preparation of a site
for final stabilization. Seeding will be done when seasonal or weather conditions are
most favorable.
On terrain where drill seeding is appropriate, seed may be planted using a drill
equipped with a depth regulator to ensure proper depth of planting.
Re -contouring: Unless an agreement is made with the landowner to keep the road
and/or pad in place, the disturbed areas surrounding the well location, including the
access road will be re-contoured to blend as nearly possible with the natural
topography. Final grading of back-filled and cut slopes will be done to prevent erosion
and encourage establishment of vegetation. Existing drainages will be re-established.
Re -vegetation: The long term objective is to establish a self-perpetuating plant
community that is compatible with and capable of supporting the identified land use.

(14) - Comply with all DOE Office of Legacy Management requests for sampling and
analysis of natural gas and other materials associated with drilling and production.
(23) - Operator must ensure 150 percent secondary containment for any volume of
fluids contained at well site during drilling and completion operations. If fluids are
conveyed via pipeline, operator must implement best management practices to
contain any unintentional release of fluids.
(25c) - Flowback to tanks only; submit a secondary and tertiary containment plan via'
Form 4 Sundry Notice for the tanks; obtain approval of the plan prior to flowback.
(28) - All materials removed for setting the conductor or for any other excavation on
this site must be screened for gamma emitters; if any gamma emitter detection
above background is encountered, the perator must isolate the materials and
contact COGCC, CDPHE and DOE for further instructions.
(31) - Produced water from this location may not be transported to or re -used at
another location without specific written approval from COGCC and only after
analysis confirms compliance with the Rulison SAP.
(32) - Drill solids and cuttings from this location may not be transported to, disposed
of or re -used at another location without specific written approval from COGCC and
only after analysis confirms compliance with the Rulison SAP.
(33) - A closed loop mud system shall be utilized to ensure containment of all
materials that have been in contact with downhole strata and fluids; all cuttings and
fresh make up water storage pits shall be lined to ensure containment; contour
features, French drains and other stormwater BMPs as necessary shall be
employed to ensure site integrity.
(34) - No individual operator shall utilize more than one rig within one mile of the
Project Rulison blast site at any given time and no individual operator shall utilize
more than two rigs within a three mile radius of the site at any given time; the total
number of rigs allowed by all operators within three miles of the site shall be limited
to five at any given time.
(35) - Operator shall comply with all provisions of the most recent COGCC approved
revision of the Rulison Sampling and Analysis Plan; in addition to the produced
water sampling and analysis outlined in section 5.8 of the plan the operators shall
also obtain and analyze produced water samples on wells described in the plan for
constituents listed in the plan using the specified method where applicable.
(37) - Pit construction shall comply with the Reserve Pit and Liner Design Technical
Specifications, dated July 2008.
(38) - The moisture content of any drill cuttings in a cuttings pit, trench, or pile shall
be as low as practicable to prevent accumulation of liquids greater than de minimis
amounts; at the time of closure, the drill cuttings must also meet the applicable
standards of Table 910-1.
(39) - No portion of any pit that will be used to hold liquids shall be constructed on fill
material, unless the pit and fill slope are designed and certified by a professional
engineer, subject to review and approval by the director prior to construction of the
pit; the construction and lining of the pit shall be supervised by a Professional
Engineer or their agent; the entire base of the pit must be in cut;
(40) -The proposed surface casing is more than 50' below the depth of the deepest
water well within 1 mile of the surface location when corrected for elevation
differences; the deepest water well within 1 mile is 250 feet deep. water wells within
one (1) mile of all locations must be checked. (Rule 321) the operator shall comply
with Rule 321; and it shall be the operator's responsibility to ensure that the wellbore
complies with setback requirements in commission orders or rules prior to producing
the well.

DOW The operator has received authorization from CPW to transfer the previous Noble 10/28/2015
Energy Wildlife Mitigation Plan (WMP) to their existing WMP. Through the utilization 12:17:10 PM
of best management practices, all aspects of both plans will be implemented. CPW
agrees that the measures contained within these WMP agreements are sufficient to
address wildlife concerns associated with the proposed activity.
