Please find responses below to your letter dated 12/1/2017 for the above -referenced
Major Impact Review.
General Application Materials
1. One error was found in the Adjacent Property Owner List. Garfield County Assessor
Records show the mailing address for Mike and Michelle Miller (Parcel No.
217905300002) as 208 County Road 227, Rifle, CO 81650. Please update your
property owner list with this change.

2. The title commitment and County Records show a Subdivision Exemption in 2008
and again in 2010. Please provide additional information on the history of the
property with regards to subdivision exemption. It appears that no plat was ever
recorded finalizing the Exemption. If the applicant is no longer pursuing the
exemption, the applicant should provide a statement that details they no longer
wish to subdivide and the resolution will need to be rescinded.

Section 7-107 Compliance
3. To demonstrate compliance with Section 7-107 the application should be updated
to provide additional details on the existing driveway. Please update the traffic
study to review the existing driveway in comparison to the required traffic
standards in Table 7-107. If the driveway does not meet those standards please
submit a waiver compliant with Policy 01-14 as attached.

4. The application should be updated to provide more details on the proposed access
road, comparing it to County Roadway Standards as detailed in Table 7-107. If the
road will not meet County Roadway Standards as detailed in Table 7-107, a
Roadway Waiver Request shall be included that demonstrates conformance with the
Attached Roadway Waiver Policy.

5. Please provide a copy of the referenced CDOT access permit that has been submitted.

Section 7-203 Protection of Waterbodies
6. The application indicates that there are wetlands located in the area where the
solar development is proposed. The Land Use and Development Code includes
wetlands as waterbodies and requires a setback of 35 feet. Please either amend the
site plan to show demonstration with this setback or provide a waiver request
pursuant to Section 4-118 of the Land use and Development Code. Additional
information may be required for this review.
Microgrid Energy Response: Applicant formally requests a waiver of this
requirement. The wetlands indicated on the site are the result of a breach in an
agricultural diversion ditch, and are not the result of a permanent, fully fledged
wetland (see report from Western Environment and Ecology submitted with
original submittal). Property owner has plans to repair the compromised
diversion ditch this winter which will have the effect of redirecting water along
the site boundaries, and not through and across the site. Nonetheless, applicant
has designed project to limit construction of any structures within the area
designated as wetlands to driven -steel foundation posts with negligible cross
section in contact with the ground. Therefore, there is no increase in the
impervious area of the site, and no fill or dredge activities will occur. The project
does not include any grading, and Applicant is working with the United States
Army Corps of Engineers (USACE) to obtain a "no permit required" status for the
project to proceed as designed.

7. Please provide a copy of the agreement or another confirmation from Xcel Energy
to serve the solar facility.

8. Please provide contact information for any ditches located on the property
Microgrid Energy Response: Cannot find contact info for Lower Cactus Valley
Ditch Company. I reached out to Water Colorado but they were unable to return
contact info. Ditch is entirely north of and above (elevation) project site.
9. Please update the application so that any Waivers of Standards address Section 4-
118 (C) of the Land Use and Development Code. Any requests for the Waiver of
Submission Requirements needs to address Section 4-202 (C).
Microgrid Energy Response: Applicant is requesting a Waiver of Submission
Requirements 4-203 (F) - Landscape Plan, 4-203 (J) Development Agreement,
and 4-203 (K) Improvements Agreement. Applicant believes requests meet the
requirements mentioned in Section 4-202 (C).
Applicant is requesting a Waiver of Standard 7-203 Protection of Waterbodies.
Applicant believes request meets the requirements mentioned in Section 4-
118(C) of the Land Use and Development Code.
