GENERAL PROJECT DESCRIPTION The Applicant has recently constructed a barn on their 55 acre property located off of County Road 117 (aka Four Mile Road). They propose to request approval for an accessory dwelling unit (ADU) on the second floor of the barn structure. The ADU request requires an Administrative Land Use Permit pursuant to the Garfield County Land Use and Development Code. The unit will be approximately 756 sq.ft . in size with one bedroom and one bathroom. The barn structure has been constructed with all typical infrastructure including utilities, access driveway, grading and drainage improvements. The Applicant will need to document that legal water, physical water, with acceptable water quality is available to serve the unit as part of the water supply plan. The Applicant will also need to document that the onsite waste water treatment systems have been designed or have capacity to serve the unit or propose additional OWTS options as part of the waste water treatment plan. The proposed unit will need to comply with Land Use Code provisions for ADU 's and ali building code requirements. Location of the structure near Four Mile Creek will need to be addressed as part of the application submittals. II. ACCESSORY DWELLING UNIT A. Maximum Floor Area. The Floor Area of an ADU shall not exceed 1,500 square feet for a lot less than 4 acres. The Floor Area of an ADU shall not exceed 3,000 square feet for any lot 4 acres or greater. B. Ownership Restriction. An ADU is restricted to leasehold interest in the dwelling unit and is for residential or Home Office/Business use only. C. Compliance with Building Code. Construction shall comply with the standards set forth in this Code and with Building Code requirements . D. Minimum Lot Area. The minimum Lot Size for an ADU is either: 1. 2 acres, or 2. For lots in zone districts with a minimum Lot Size of less than 2 acres , the minimum Lot Size is twice the minimum required Lot Size. E. . Entrance to Dwelling Unit. A separate entrance to the Accessory Dwelling Unit is required. III. ADMINISTRATIVE REVIEW PROCESS 2 The Application will follow the Administrative Review Process contained in Sections 4-101, 4-103 and Table 4 -102: 1. Pre-application Conference 2. Submittal of 3 hard copies of the Application along w ith 1 electronic (pdf) copy. 3. Review by staff for technical completeness. 4. If technically complete the Applicant will be notified and the request scheduled for a decision by the Director. 5. If not technically complete the App licant will be advised of the deficiencies and has 60 days to correct them . 6. The complete Application is referred to various agencies for comments. 7. A minimum of 15 days prior to the Director's Decision , the Applicant shall complete the public notice mailing by certified mail to adjacent property owners within 200 ft. and certified mail/retum receipt requested to mineral rights owners on the property. 8. Staff prepares a report including public and referral comments . 9. The Director's Decision is documented by letter as of the noticed date . 10 . The Board of County Commissioners are notified of the decision and have a 10 day call-up period. 11. The Land Use Change Permit is issued after the ten day call-up period has expired and provided no requests for a call-up are received and all conditions of approval have been met. 12. The Applicant has one year to complete all conditions of approval. IV. SUMMARY OF SUBMITTAL REQU IREMENTS -KEY TOPICS The pre-application discussion covered the basic submittal requirements as outlined in the Land Use and Development Code and summarized be low: • General Application Materials (application forms, agreement to pay form, Statement of Authority for Trusts, authorization to represent, payment of fees etc.) • Evidence of ownership such as a deed for the property and title work if available • Narrative description of the proposal • List of property owners within 200 ft. and any mineral rights owners on the property. Information on how mineral rights research was completed should be provided. • Vicinity Map (including the area generally within 3 miles of the site) • Site plan with information on proposed location of the ADU, other existing structures, and significant features on the property including but not limited to easements, utilities , ditches, streams/water bodies, access roads/driveways, wells, proposed OWTS, and topography • Grading and Drainage information • Landscaping Plans are not required for ADU 's. • Impact Analysis 3 • Information to address applicable sections of Article 7 , Division I, II, and III including Standards for ADU's , Comprehensive Plan consistency, information on utilities and geologic hazards such as soils. Application formatting that address each section of Article 7 is recommended • • Information on legal access , physical access , and compliance with Roadway Standards Table 7-107 is required . A roadway waive r may be requested (criteria is attached). Information on the 35 foot setback from 4 Mile Creek is required . Please specifically address Section 7- 203 with a description of how any proposed construction meets these standards. • The property is not mapped for floodplain, however because of the proximity of 4-mile creek please provide any additional floodplain information for the property • Traffic Study • Water supply plan and supporting documenta tion Application Submittal 3 Hard Copies 1 Digital PDF Copy (on CD or USB Slick) Both the paper and the digital copy should be split into individual sections. The LUDC defines "road" as "a County road, State highway, public road, street or alley, or private thoroughfare which affords primary access to abutting property, excluding a driveway accessing a single property." The LUDC defines ''private road" as "a right-of-way constructed, established, owned, and maintained by a private party for access exclusively to private property." Many of the roads in Garfield County are private roads in that they are gated and do not serve the general public and they pre-existed the design current ly required by the County's Road Standards as defmed in Table 7-107. The LUDC allows for the waiver of specific standards provided that the following criteria have been met: 1) an alternative design achieves the intent of the subject standard to the same or better degree and 2) the proposed alternative will impose no greater impacts on adjacent properties than would occur through compliance with the specific standard (Section 4-118). [n applications that include roads that do not meet current County road standards as outlined in Table 7-107, the County has asked that Applicants request a waiver of Section 7-107.F, Design Standards, and include in the Application submittal sufficient information, prepared by a professional qualified in the specific discipline, to demonstrate that they meet the criteria outlined in Section 4-118 for granting a waiver. In doing so, the application must include: A Statement of Adequacy -The eva lu arian of the existing roadway and waiver will need to include a clear statement that finds that the road will be adequate for the proposed use. This statement must be signed by a professional engineer qualified in traffic engineering and licensed by the State of Colorado. To support this evaluarion, the following information will be required to be provided: o Geometry of the road -A description of how the private road does/does not meet the design standards in Table 7-107. This sbould include a chart that compares tbe private road design to tbose standards in Table 7-107, as well as a map that shows the existing road design and highlights those areas that deviate from the standards. A narrative may also be helpful in describing the characteri stics of the road as they compare to Table 7-107 design standards. Unless available, this is not intended to imply construction- level drawings. o Safety/Structural Issues -A description of obvious safety andlor structural issues observed and a statement about how these issues will be addressed. o Maintenance -A descriprion of how the road is and/or will be maintained. This should be supported with the submittal of any existing or proposed maintenance agreements for the road sections. o Travel Demand -An accurate count of the existing peak travel demand as well as the Average Daily Traffic on the road. This should also include the types of vehicles that currently use the road as well as the additional amount and type of traffic that the proposed use will generate through all phases of its development. Other Evidence of Compliance. In addition, Sections 7-107.A, B, C, D , and E are required to be addressed, which includes documentation about legal access. Sufficient evidence will be required to be submitted to demonstrate compliance with these section s of the Code. 8 TO; FROM: DATE: RE: Staff c:Q: Gmj'U1d County MEMORANDUM County Attorney's Office June 24, 2014 Mineral Interest Research Mineral interests may be severed from surface right interests in real property. Colorado revised statute 24·65.5-103 requires notification to mineral owners when a landowner applies for a land use designation by a local government. As such, the landowner must research the current owners ormineral interests for the property. The Garfield County Land Use and Development Code of 2013 ("LUDC") Section 4- JOI(E)(I)(b)(4) requires written notice to owners of mineral interests in the subject property "as such owners can be identified through the records in the office of the Clerk and Recorder or Assessor, or through other means," It is the duty of the applicant to notifY mineral interest owoers. The following is a suggested process to research mineral interests : I. Review the current ownership deed for the property (Le . Warranty Deed, Special Warranty, Quit Claim Deed or Bargain and Sale Deed-NOT a Deed of Trust). The ownership deed is usually one or two pages. Is there a reservation of mineral interests on the ownership deed? AIe there any exceptions to title? A deed may include a list of reservations that reference mineral owoers or oil and gas leases. 2. Review your title insurance policy. AIe there exceptioos to title listed und er Schedule B- II? Ir so, review for mineral interests that were reserved and oil and gas leases. 3. Check with the Assessor's office to determine if a mineral ioterest has been reserved from the subject property. The Assessor's office no longer documents the mineral reservation ownership for its tax roll records unless ownership has been proven. There are only a limited number of mineral owners who have provided such information to the Assessor's office so this may oot provide any informatioo, depending on your property. 9 MEMO June 24, 2014 Page 2 4. Research the legal description of the subject property with the Clerk and Recorder's computer. You can search the Section, Township, and Range of the subject property. You may find deeds for mineral interests for the subject property. 5. Research whether a Notice of Mineral Estate Ownership was filed for the subject property. On the Clerk and Recorder's computer, search under Filter (on the right hand side of the screen), General Recordings, Notice of Mineral Estate Ownership for the subject property. 6. If you find mineral interest owners as reservations on your deed , listed in your title insurance policy, from the Assessor's records or the Clerk and Recorder's computer, you need to determine whether these mineral interests were transferred by deed and recorded in the Clerk and Recorder's office. 7. Enter the name of the mineral interest O\vner as the Grantor in the Clerk and Recorder's computer to see if the mineral interest was transferred. If you find a transfer deed, you need to repeat this process to follow any transfer of the mineral interest to present day. 8. Include a description of your research process in your application and the name(s) and addressees) of the current mineral interest owner(s). Mineral interest research can be a difficult and time consuming process. If you are unable to determine mineral rights o"nership by yourself, consider hiring an attorney or landman. We are requesting a change of land use to incorporate an Accessory Dwelling Unit  (ADU)/Caretaker Unit, within a previously permitted and constructed garage/building on  the aforementioned 55 acre parcel.  The proposed design incorporates a deck/terrace  and required separate entrance to the ADU outside of the existing constructed building,  with secondary access to the existing building through the ADU.  Per Article 3, Sections 401‐403, the proposed use is an Administrative Review Use and  shall be reviewed in accordance with the procedures of Section 4‐103, and per use‐ specific standards in Article 7, Standards (Compatibility, Water, Wastewater, Utilities,  Access, Natural Hazards, and Fire Protection).  Article 7, Section 101 ‐ The land use change complies with Article 3 of the Zoning Code,  including all applicable zone district use restrictions and regulations.  Article 7, Section 102 ‐ The land use change complies is in general conformance with the  Comprehensive plan and applicable intergovernmental agreements.  Article 7, Section 103 ‐ The nature, scale and intensity of the proposed use are  compatible with adjacent land uses.  The deck/terrace is the only structure that will be  outside of the existing permitted and constructed garage structure.  Article 7, Section 104 ‐ There has been an additional well that was permitted by the  Division of Water Sources.  The said well has been installed and is operational  (documentation included within packet).  Article 7, Section 105 ‐ There has been an additional septic system that was permitted  and installed (documentation included within packet).  Article 7, Section 106 ‐ Adequate public utilities were previously available upon the  construction of the original home (2006) and additional garage (2014), and have been requirements and the I.R.C.  In addition to the design guidelines in the I.R.C., there is a  pond feature adjacent to the structure in case of emergency.  Article 7, Section 201 ‐ There will be no adverse affect to any agricultural operations in  the area, as they don't exist.  So, this section is not applicable and we request a waiver.  Article 7, Section 202 ‐ There will be no adverse affect to wildlife habitat areas as the  structure already exists with the exception of the open deck/terrace structure.  So, this  section is not applicable and we request a waiver.  Article 7, Section 203 ‐ The minimum setback of 35' has previously been met with the  existing structure.  The addition of the open deck/terrace is planned with one  supporting post at 30' from the high water mark.  However, the deck/terrace elevation is 15‐25' in width from CR 117 and the property line, and is 15' in length for this distance  and 30' to the property gate.  From the property line, the drive varies between 12 & 15'  in width to the primary residence (asphalt), and to the existing detached garage (gravel).   The drive slope is less than 12% for the entire distance, to all structures and has a cross  slope of less than 2%.  The existing radius and turn around areas meet and exceed the  standard.  The average daily trips are estimated to be 19.14 total for this site per the Based on documents that I researched and purchased through the Clerk and Recorder, John Dunning's last known address listed on the sale of my Client's property was 0828 county road 130, Glenwood Springs, CO 81601. Mr. Dunning purchased this parcel in 1986 and sold to my Client in 1994. You have the information that I previously sent regarding the status of the ditch, and we have no record as to whether Mr. Dunning is deceased or still in the area, or has any further ownership rights in this ditch The Buck Farm Ditch, Moda Enlargement shows the possible contact person as Russell Colodny with an address of 8426 Green Is City Road, Littleton, CO 80124 and a phone number of 303-733-9787. There is also a possible contact person of Roz Colodny, but no available contact information has been located. Again, we have no idea if these people are still alive or if they still have any ownership rights to this ditch. The Division of Water Resources does not keep track of ditch company ownership, and does not guarantee that the information that has been provided is current or correct. The Well Construction Contractor is responsible for notifying the owner of this requirement 6/2006 Information and Standards Conditions of approval of a replacement well permit generally require that Ihe old well be plugged and sealed according to the Water Well Construction Rules . A blank report form is provided to the well owner when a replacement permit is issued. This report is also used to affirm that other types of wells and holes have been plugged and sealed. These reports must be completed and submitted to the D ivisio n of Water Resources, usually within 90 days of plugging and sealing the well/hole. This form may be reproduced by photocopy or word processing means. RULE 16 STANDARDS FOR PLUGGING, SEALING, AND ABANDONING WELLS AND BOREHOLES 16.1 General -The plugging, sealing and abandonment of all wells, monitoring and observation wells, monitoring and observation holes and test holes that are no longer intended for use , and the plugging , sealing, and abandonment of dry holes , collapsed or unusable boreholes, and other incomplete wells or excavations is necessary to prevent contamination of ground waler and the migration of water through the borehole. It is the ultimate responsibility of the well owner to have an existing well properly plugged, sealed and abandoned. The well construction contractor or authorized individual is responsible for notifying the well owner in writing of these plugging requirements. 16.1.1 In the event a borehole(s) is not completed for the intended purpose, the contractor will notify the well owner of the well owner's responsibility for the proper abandonment of the borehole(s) according to Rule 16.1. If the well owner does not agree to allow the contractor to abandon the borehole(s), the contractor shall notify the Board of Examiners , in writing, of the existence of the borehole(s) and the contractor's effort to notify the well owner of the well owner's abandonment responsibilities under Rule 16.1 16.1.2 Persons authorized to install pumping equipment may plug, seal and abandon wells that do not require the removal of casing that penetrates more than one aquifer or the ripping or perforating of casing opposite confining layers. 16.1.3 Materials used for backfilling shall be clean, inert, and free from contaminants. The well casing may be cut off below land surface so that it will not interfere with the anticipated use of the land. If the casing is cut off below land surface, the uppermost five (5) feet of the remaining casing shall be filled with grout or a watertight cover shall be permanently attached to the remaining casing and the excavation shall be filled with materials that are not more permeable than the surrounding soils and adequately compacted to prevent settling. 16.2 Wells or Boreholes in Type II and Type III Aquifers -Wells completed into unconfined aquifers and unconsolidated aquifers shall be plugged, sealed and abandoned by filling the well to the static water level with drill cuttings, clean sand or clean gravel, then with clean native clays, cement or high solid bentonite grout to the ground surface. The uppermost five (5) feet of casing shall be filled with grout or a permanent watertight cover shall be installed at the top of the casing. If casing is removed, the hole shall be filled as described above to within five (5) feet of the ground surface. The top five (5) feet of the hole shall be filled with materials less permeable than the surrounding soils that are adequately compacted to prevent settling. 16.2.1 Dewatering wells, horizontal drains, monitoring and observation holes, percolation holes, piezometer holes, sumps, test holes and dry holes shall be plugged, sealed, and abandoned either pursuant to Rule 16.2 or by removing all casing that was installed and by filling the hole(s) with drill cuttings, clean native clays, cement or high solid bentonite grout to within five (5) feet of the ground surface. The top five (5) feet of the hole shall be filled with materials less permeable than the surrounding soils that are adequately compacted to prevent settling. 16.3 Wells or Boreholes in Type I Aquifers -Wells which were constructed through more than one aquifer shall be plugged and sealed by placing a cement grout plug at the confining layer above each aquifer. If records do not show that the casing opposite each confining layer has been grouted when originally installed, the casing shall be either completely removed from the hole, or perforated or ripped opposite such layer prior to placing the grout plug. Plugs shall be no less than forty (40) feet in length and shall be designed to withstand the maximum potential hydrostatic pressure differential between the aquifers. The well casing, except for the groot plug intervals, shall be completely filled to the land surface with clean native clays, cement or high solid bentonite grout. The conditions and the information on this information sheet must be complied with in order for the permit to remain valid. THE PERMIT EXPIRATION DATE IS TWO YEARS FROM THE DATE ISSUED. The we ll must be constructed and evidence of it's construction must be received by this office in the form of a Well Construction and Test report from the well construction contractor confirming that the well was constructed prior to expiration of the well permit. The well permit number is located in the upper right hand corner of the permit, and the expiration date is located in the lower right hand corner. The expiration date of the permit may be extended one year at a time at the discretion of the State Engineer for good cause shown. If an extension of time is necessary to construct the well, a written request for the extension of time must be received by this office prior to the expiration date of the well permit. In the request, you must provide the well permit number, your name and mailing address and the reasons why the well has not been constructed and approximately when it will be constructed. Water well construction and pump installation contractors are specifically licensed in Colorado to perform these specialized tasks . It is illegal for contractors who do not hold these licenses to construct wells and/or install pumping equipment in or on wells . The well must be constructed and the pump installed by contractors with current license(s) issued by the State of Colorado unless exempted as described on the reverse side. Please ask to see their license(s). Backhoe Operators and Licensed Plumbers mayor may not hold the respective Well Construction and/or Pump Installation licenses. Please be aware of this when you contract to construct the well and install pumping equipment. The well construction report including a test of the well yield must be submitted to the office of the State Engineer within sixty (60) days of completion of the work or within seven days after expiration of the permit, whichever is earlier. The pump installation report including a pumping system test must be submitted within sixty (60) days of completion of the work. The contractor(s) must provide you with a copy of the work report(s) filed with the State Engineer. The Well Construction and Test Report , Form Number GWS-31 and the Pump Installation and Test Report, Form Number GWS-32 are available from the Division of Water Resources offices . Additional information regarding well construction, pump installation, required testing and well plugging and sealing regulations are found on the reverse side of this sheet. You have been provided with at least two copies of the well permit. Keep a copy for your records. There is also a copy for the pump installation contractor. Copies have been sent to the driller if you indicated a driller license number on the application , or two additional copies have been enclosed . You may make additional copies for the well construction contractor if you select one different from the one indicated in your application. Statutes require that any change of mailing address or ownership be reported to the State Engineer. It is your responsibility to complete and submit the Well Construction and Test Report, Form Number GWS-31 and/or the Pump Installation and Test Report, Form Number GWS-32. These forms are available from our offices. The well must be constructed and the pump installed in accordance with the well construction standards of the State Board of Examiners of Water Well Construction and Pump Installation Contractors. The Water Well Construction Rules are available from Division of Water Resources offices for a fee of $5.00. The Rules cover the minimum requirements for well construction, pump installation, disinfection, plugging and sealing and include contractor licensing regulations. If you are constructing your own well or installing pumping equipment, it is recommended that you obtain a copy of these Rules for reference. RULE 12 WELL TESTING 12.1 General-The provisions of this rule establish minimum standards for the testing of water wells. Every well constructed for the purpose of producing ground water shall be tested to determine: a. a stabilized yield for the well; and b. the production rate of the equipment installed when the well is placed into service. 12.2 Well Yield Test -The yield of a well shall be determined as a stabilized production rate where the withdrawal rate and the drawdown do not change by more than 10 % during the last hour of the test. The test shall demonstrate that either: a. the well is capable of producing the permitted pumping rate for the well; or b. that the maximum yield of the well is less than the permitted production rate. 12.3 Responsibility for Well Yield Test -Well construction contractors are responsible for performing the well yield test and submitting the test data to the State Engineer. If the construction contractor also installs the production equipment, the well yield test may be combined with the production equipment test, provided that the test meets the requirements of Rule 12.2. The construction contractor may forgo the well yield test if he can show that a licensed pump installer will perform the well yield test with the permanent production equipment within thirty (30) days of completion of construction of the well. If the pump installation contractor performs the well yield test, he/she shall submit the test information on the Pump Installation and Test Report. 12.4 Production Equipment Test -The production equipment installed in wells shall be tested to ensure it is functioning as designed. The test shall demonstrate the production capacity of the equipment as actually installed in the well. It is the responsibility of the person installing the pumping system to ensure that the production from the well complies with the conditions of the permit. 12.5 Responsibility for Production Equipment Test -Pump installation contractors are responsible for testing the production equipment installed in a well upon completion of their work. If the well construction contractor determined the well yield and submitted a report, the pump installer need not perform another well yield test. If the pump installer does not perform a well yield test with the permanent production equipment, he shall perform a production equipment test and report the data (results) to the State Engineer on the Pump I nstallation and Test Report. • Wells to be plugged and sealed must be plugged in accordance with of the Water Well Construction Rules. A Well Abandonment Report, form number GWS-9 must be submitted to confirm plugging and sealing of the well. This form is available from our offices. First and foremost in maintaining your well permit valid and in good standing is the submittal of the Well Construction and Test Report and the Pump Installation and Test Report (work reports) that licensed contractors (or you, if you constructed the well as a "private driller" or installed the pump as a "private pump installer") are required to submit to the Division of Water Resources. Without the submittal of a work report to show that the well was constructed in conformance with the Water W'ell Construction Rules and' that it is in compliance with the conditions of approval of the well permit, the permit will expire on the expiration date indicated on the permit. Reinstatement of your permit after it has expired or obtaining a new permit for your well may require that you show that the well was constructed by a licensed water well construction contractor (or private driller) and that it meets the required standards of the Water Well Construction Rules. It is much easier and efficient to maintain the valid status of your original well permit than it is to try to have it reinstated after it has expired or to obtain a new permit for the existing structure. Because it is not always easy to confirm that the required reports have been submitted to DWR, this "Owner's Notice of Constructed Well" is provided for your use. Do not give the notice to your contractor to submit. The notice is to be completed by you and mailed or faxed to the Division of Water Resources so that the Division is advised that your well has been constructed. If the required work reports are not then filed within a reasonable period of time, the Board of Examiners can initiate its procedures for obtaining the reports and thereby assist you in keeping your well permit valid. It is your responsibility to complete and submit the Well Construction and Test Report, Form Number GWS-31 and/or the Pump Installation and Test Report, Form Number GWS-32. These forms are available from our offices. The well must be constructed and the pump installed in accordance with the well construction standards of the State Board of Examiners of Water Well Construction and Pump Installation Contractors. The Water Well Construction Rules are available from Division of Water Resources offices for a fee of $5.00. The Rules cover the minimum requirements for well construction, pump installation, disinfection, plugging and sealing and include contractor licensing regulations. If you are constructing your own well or installing pumping equipment, it is recommended that you obtain a copy of these Rules for reference. RULE 12 WELL TESTING 12.1 General -The provisions of this rule establish minimum standards for the testing of water wells. Every well constructed for the purpose of producing ground water shall be tested to determine: a. a stabilized yield for the well; and b. the production rate of the equipment installed when the well is placed into service. 12.2 Well Yield Test -The yield of a well shall be determined as a stabilized production rate where the withdrawal rate and the drawdown do not change by more than 10 % during the last hour of the test. The test shall demonstrate that either: a. the well is capable of producing the permitted pumping rate for the well; or b. that the maximum yield of the well is less than the permitted production rate. 12.3 Responsibility for Well Yield Test -Well construction contractors are responsible for performing the well yield test and submitting the test data to the State Engineer. If the construction contractor also installs the production equipment, the well yield test may be combined with the production equipment test, provided that the test meets the requirements of Rule 12.2. The construction contractor may forgo the well yield test if he can show that a licensed pump installer will perform the well yield test with the permanent production equipment within thirty (30) days of completion of construction of the well. If the pump installation contractor performs the well yield test, he/she shall submit the test information on the Pump Installation and Test Report. 12.4 Production Equipment Test -The production equipment installed in wells shall be tested to ensure it is functioning as designed. The test shall demonstrate the production capacity of the equipment as actually installed in the well. It is the responsibility of the person installing the pumping system to ensure that the production from the well complies with the conditions of the permit. 12.5 Responsibility for Production Equipment Test -Pump installation contractors are responsible for testing the production equipment installed in a well upon completion of their work. If the well construction contractor determined the well yield and submitted a report, the pump installer need not perform another well yield test. If the pump installer does not perform a well yield test with the permanent production equipment, he shall perform a production equipment test and report the data (results) to the State Engineer on the Pump Installation and Test Report. Wells to be plugged and sealed must be plugged in accordance with of the Water Well Construction Rules. A Well Abandonment Report, form number GWS-9 must be submitted to confirm plugging and sealing of the well. This form is available from our offices. The general Rule for plugging and sealing wells is printed below. The specific rules are found on the reverse side of the Well Abandonment Report form. RULE 16 STANDARDS FOR PLUGGING AND SEALING WELLS AND WELL EXCAVATIONS 16.1 General -The plugging, sealing and abandonment of all wells, monitoring and observation wells, monitoring and observation holes and test holes that are no longer intended for use, and the plugging, sealing, and abandonment of dry holes, collapsed or unusable boreholes, and other incomplete wells or excavations is necessary to prevent contamination of ground water and the migration of water through the borehole. It is the ultimate responsibility of the well owner to have an existing well properly plugged, sealed and abandoned. The purpose of our analysis is to assist in the process of obtaining a building permit. We based our analysis on the site survey provided by Bookcliff SUTvey Services. We reviewed the 1986 Federal Emergency Managenlent Agency (FEMA) Flood Insurance Study prepared for unincorporated Garfield County, Colorado. We confirmed that your propeliy is located outside of the detailed area of study. This property is not included in the FEMA Flood Insurance Pl'ogran1. Although your property was not included in the FEMA study area, the study did provide data relative to the Four Mile Creek drainage area and relative to the expected IOO-year flood flow for Four Mile Creek. We used the FEMA data, the site survey, and the cross sectional data to develop a streanl flow n10del for Four Mile Creek through the subject property. We used the US Army Corp of Engineers' HEC-RAS 3.1.3 model to calculate the expected 100-year flood water surface elevations at the various cross sectional stations along the creek. We used the Manning's coefficient for a 1110untain strealTI of 0.05 for the main channel and the coefficient of 0.07 for over-bank areas in the HEC-RAS model. We plotted the calculated water surface elevations on the site survey and connected the water surface elevations at each cross section to delineate the expected creek boundary during at the projected 100-year flood flow boundary, as shown on the attached Figure 2. The FEMA study determined that the FourMile Creek drainage area is 36 square luiles, sq mi, and that the expected IOO-year flood flow at the mouth of Four Mile Creek would be 1400 cubic feet per second, cfs. We reviewed the USGS 7.5 Ininute quadrangle topographic mapping for the Four Mile Creek basin and detennined that approxi111ately 17.7 sq mi or 49% of the basin is located upstream of the subject property. The proportion of the basin located above the subject property relathre to the total Four Mile Creek basin indicates that the entire 1400-cfs flood flow for total basin wo.uld 110t be expected to occur at the subject propeliy. To quantify the propoltion of the 1400~cfs that would be expected at the subject property~ we calculated the estimated IOO-year flood flows for the total 36 sq mi basin and for the upper 17.7 sq mi sub-basin. We used the USGS Water-Resources Report 99-4190 titled "Analysis of the Magnitude and Frequency of Floods in Colorado" and the Colorado Water Conservation Board's "Guidelines for Determining 1 00-Year Flood Flows For Approximate Floodplains in Co lorad,o , Version 6.0'~ to calculate flood flows for typical 36 sq lnile and 17.7 sq mi basins. Copies of these documents are attached in Appendix A. The Report 99-4190 regression formula for the Northwest Colorado region produced the greatest percentage of the total flow expected for the sub-basin at 64.2%, followed by the Report 99-4190 regression formula for the Mountain region at 60.6%. The CWCB guidelines produced the lowest percentage of the total flow expected for the sub-basin at 59.80/0. The Flow Estimates are attached as Table 1. To calculate the expected IOO-year flood flow at the subject property, we conservatively used a value of 65% of the total basin flow. The calculated IOO-year flood flow is 910-cfs (1400-cfs x 650/0). We used the 910-cfs flood flow in the HEC~RAS model to compute the water surface elevations for Four Mile Creek during the 1 DO-year flood event. The estinlated flows produced by the three regression equations were all less than the 910-cfs used in the HEC-RAS lllodel. Printouts of the output from the HEC-RAS lllodel are attached. They show the projected water surface elevations at the cross sectional stations and the profile of the Four Mile Creek through the subject propeliy. We would recomlnend that any structures at the subject propeliy be constructed outside the boundaries and at an elevation of at least I-ft above the flood water surface e1evation delineated on Figure 2. It should be noted that the 100-year flood flow exceeds that capacity of the culvert at the road crossing. We would reco1l1mend that improvements be made to the road crossing to reduce the likelihood of overtopping during high streanl flow conditions. This analysis provides an engineering estimate 100-year flood flows based on standard practices and ll1ethods. There is no guarantee that a flood will not occur that exceeds this estimate. The property owners should be notified that this property is not currently lnapped by FEMA and part of the National Flood Insurance program. The house location and site grading alternatives can be explored to offer additional protection to the stlucture. If you have any questions, please do not hesitate to call 625-4933. No. 17038 Dear Brad: The following letter report summarizes my analysis of the Four Mile Creek’s 100-year flood and its impact to an existing metal building structure located approximately 350 feet up stream from the existing Holmes residence located at 8987 CR 117, Glenwood Springs. The property owner wishes to add an ADU inside the existing metal building and must show the existing building’s location in relationship to the Creek and 100-year flood potential to the existing building. Plus verify the OWTS seepage field is above the 100-year flood plain. Tuttle Surveying Services conducted mid-November, 2017a topographic survey around and approximately 300 feet upstream from the metal building. We based our analysis on Tuttle’s Survey and the 100-year flow established for this location by Colorado River Engineering, Inc. (CRE), as shown in their letter to Giard Homes, dated June 25, 2006. According to CRE’s letter, the 100-year flow at this location of Four Mile Creek was determined to be 910 CFS. Creek Cross sections (shown on attached drawing C.2) were selected and plotted off the topographic survey to calculate flow depth at each section using Manning’s formula for trapezoidal channels. The attached table shows the calculated 100-year flow depths based on the channel cross section parameters for each section. Based on the flow depth calculations, the building appears to be protected from the 100-year flood flow. The survey of the OWTS seepage field indicates that it is more than two feet above the adjacent 100-year flood plain. Also, based on the survey, the two building corners adjacent to the creek complies with the minimum 35 foot distance from the creeks normal high water mark. Please call with any questions. The report summarizes the site and subsurface conditions, and provides design details for the OWTS in accordance with the 2014 Garfield County On site Wastewater Treatment System Regulations and the Colorado Department of Public Health and Environment's Regulation #43. The services were performed as part of our agreement for professional services to D.M. Neuman, dated September 11, 2014. BACKGROUND INFORMATION Hepworth-Pawlak Geotechnical, Inc. (HP Geotech) previously prepared a subsoil study for foundation design for the property and submitted our findings in a report dated September 30, 2014, Job No. 114 393A. PROPOSED CONSTRUCTION The proposed shop building will be a one story, wood frame structure, with a slab-on- grade floor, and designed as an auxiliary dwelling unit with 1 bedroom, a kitchen and, 1 bathroom with a shower, toilet and a sink. The building will be located on the property as shown on Figure 1. The proposed soil treatment area for the septic disposal system is planned to the north of the shop building. If proposed construction is different than described, we should be contacted to re-evaluate our design recommendations. SITE CONDITIONS The site is a residential parcel occupied with a single family residence. The parcel is bordered to the northwest by County Road 117, to the southeast by Four Mile Creek and a steep slope up to the southeast. The western portion of the lot has upper and lower, Job No. 114 393A ~tech -2- relatively flat meadow areas, with the shop building proposed on the lower meadow area. The proposed building area is relatively level with an elevation difference of about 3 feet across the building footprint. An unpaved access drive crosses the north side of the property below County Road 117 from the gravel topped driveway to the area of the proposed shop building. Vegetation on the site consists of grasses, weeds, brush and a moderate coverage of deciduous and conifer trees. EXISTING SOIL TREATMENT AREA The existing soil treatment area for the residence is located approximately 450 feet north of the proposed soil treatment area for the shop building and should not be impacted by the proposed OWTS. SURF ACE WATER AND WETLANDS There is a small pond approximately 65 feet to the north of the proposed soil treatment area and Four Mile Creek flows approximately 75 feet to the east of the proposed soil treatment area. Setbacks for the surface water must be a minimum of 50 feet from the proposed soil treatment area, septic tank, sewer line and effluent line. WELLS The well for the shop building is proposed on the opposite side of the shop building from the planned soil treatment area. An existing well for the residence is located about 350 feet north of the proposed septic disposal area adjacent to the residence. A minimum 100 feet setback is required from the soil treatment area to the well and a 50 feet minimum setback is required from the septic tank, effluent line and sewer line to the well. SUBSURFACE INVESTIGATION The field exploration for the project was conducted on September 17,2014. Two Profile Pits (Profile Pits 1 and 2) and three percolation test holes (P-1, P-2 and P-3) were excavated at the approximate locations shown on Figure 1 to evaluate the subsurface conditions. Logs of the Profile Pits are provided below. The subsoils encountered consisted of about 12 inches of topsoil overlying 3 to 3Y2 feet of weak-granular sandy Job No. 114 393A ~tech - 3 - loam. Beneath the sandy loam, very gravelly sand was encountered to the depth explored, 8 feet. Free water was encountered during the pit excavation at a depth of5lhfeet below grade ground surface. Free water was encountered during the profile pit excavations at depths of 5 V2 to 6 feet below ground surface and reportedly is near the ground surface during spring runoff. Subsoils above the water level were generally moist. The results of gradationlhydrometer analyses performed on bulk samples of the subsoils obtained from the profile pits are attached as Figures 5 and 6. PERCOLATION TESTING Percolation tests were performed in the three test holes by HP Geotech on September 18, 2014. The percolation rates obtained ranged from about 15 to 30 minutes per inch (mpi) with an average percolation rate of about 28 mpi. Percolation test procedures outlined in Regulation #43 were not utilized and the results were only used for comparison of the USDA soil type and structure. Job No. 114 393A ~tech -4- OWTS ANALYSIS Based on the profile pit soils, the infiltrative surface of the soil treatment area (STA) will be located in a Granular Sandy Loam. A Long-Term Acceptance Rate (LTAR) of 0.7 gallons per square foot per was estimated based Table 10-1 of Regulation #43. Based on the shallow depth to groundwater encountered, a mounded sand filter treatment system will be required for the site. A Long-Term Acceptance Rate (LTAR) of 0.7 gallons per square foot per day will be used for sizing of the Sandy Loam soils for the basal area of the mounded sand filter, which assumes Treatment Level 2. Sewage will be collected in the septic tank for primary treatment then gravity flow to a dosing tank where it will be pumped to the mounded soil treatment area (STA) for disposal. Due to the potential for groundwater levels near the ground surface, cuts should be minimized to vegetation removal and scarifying the ground surface only. DESIGN RECOMMENDATIONS The recommendations presented below are based on the site and subsurface conditions encountered and our experience in the area. If soil or site conditions encountered during construction are different than those that are described in this report please contact us and we will re-evaluate our recommendations. SOIL TREATMENT AREA • The soil treatment absorption field will consist of an aggregate bed that is 30 feet long by 10 feet wide constructed over a 2 feet thick mounded sand filter, located as shown on Figure 1. The aggregate area was sized based on an L T AR for concrete sand of 1.0 gallons per square feet per day. • A basal sand area of 450 square feet will be required based on an LTAR of 0.7 gallons per square foot per day. An area of38 feet wide by 18 feet long has been assumed for the mounded soil treatment area. The soil treatment area calculations are presented on Figure 2. • Concrete sand is suitable for construction of the lTIounded sand filter. Job No. 114393A ~tech - 5 - • Absorption area aggregate will be a minimum of 1 foot thick. See Figure 4 for the aggregate specifications. • A minimum of 12 inches and a maximum of36 inches of cover soil should be placed over the soil treatment area aggregate. A layer of 2 ounce/yd2 maximum thickness filter fabric should be placed over aggregate prior to backfill. Hanes Geocomponents ProSilver or equivalent is recommended. • Backfill should be graded to deflect surface water away from the absorption area and should be sloped at 3 Horizonat1: 1 Vertical maximum. • Disturbed soil should be re-vegetated immediately with a native grass mix. No trees, shrubs or other plants with deep roots should be planted on or near the absorption area as this may damage piping. • Four inch diameter inspection ports should be installed at each comer of the aggregate bed. The inspection port piping should extend to the base of aggregate. The portion of the pipe that lies within the aggregate should be perforated. The inspection ports should extent at least 8 inches above the finished ground surface or be protected in a valve box at finished grade. • A plan view of the absorption area is presented as Figure 3 and a cross section of the absorption area is presented as Figure 4. OWTS COMPONENTS Recommended OWTS components were based on our design details and our experience with the specific component manufacturers. Equivalent components may be used if desired; however, they must meet our minimum recommendations and should be approved by the design engineer prior to construction. Septic and Dose Tank • AI, 000 gallon, three chamber Valley Precast septic tank is proposed for primary treatment of sewage effluent from the shop building. A submersible effluent pump will be installed in the third chamber of the tank. Pump specifications are provided in the Effluent Pumping System section of this report. A copy of the tank details are attached to this report. Job No. 114 393A ~tech - 6 - • The tank must be set level. The excavation must be free of large rocks or other objects that could damage the tank during placement. A gravel base course bedding material may be necessary to prevent tank damage during placement and act as a leveling course. • Install tanks with 2 feet minimum cover soil for frost protection. Maximum tank burial depth is 4 feet. • The septic and dose chamber lids must extend to finished grade and be made easy to locate. Sewer Pipe • The sewer line from the shop to the septic tank should not be less than the diameter of the building drain and not less than 4 inches in diameter. • The sewer pipe should have a rating of SDR35 or better. • Sewer pipe should be sloped at 2% minimum from the residence to the septic tank except for the last 10 feet, which should be sloped at 4% maximum (2% minimum) to help limit disturbance of solids in the tank. • A minimum 36 inches of cover soil should be provided over the sewer pipe. Paved areas, patios or other areas without vegetative cover may be more susceptible to frost. We recommend 48 inches of soil cover over the sewer pipe in these areas and the pipe be insulated on top and sides with 2 inch thick blue foam insulation board. If adequate soil cover is not possible, we should be contacted for re-evaluation prior to installation. • The sewer pipe should be bedded in compacted % inch road base or native soils provided that the native soils contain no angular rocks or rocks larger than 2 ~ inches in diameter to help prevent settlement of the pipe. Sags could cause standing effluent to freeze and damage piping. • Install c1eanout pipes within 5 feet of building foundation, where the sewer pipe bends 90 degrees or more and every 100 feet of sewer pipe. • All 90 degree bends should be installed using a 90 degree long-sweep or by using two 45 degree elbows. • The sewer line location shown on Figure 1 is considered conceptual. We assume that there will be only one sewer line exiting the proposed shop. It is the Job No. 114393A ~tech - 7 - responsibility of the owner to locate all sewer line exit locations and connections to the septic tan1e Effluent Transport Piping • The 1.5 inch diameter Schedule 40 effluent transport piping should be sloped at 2% minimum to drain back to the dose tank after each pumping cycle. • The effluent transport pipe should be bedded in compacted % inch road base or native soils provided that the native soils contain no angular rocks or rocks larger than 2 ~ inches in diameter to help prevent settlement of the pipe. Sags could cause standing effluent to freeze and damage piping. • A minimum 18 inches of cover soil should be provided over the effluent transport pipe. Paved areas, patios or other areas without vegetative cover may be more susceptible to frost. We recommend 48 inches of soil cover over the sewer pipe in these areas. If adequate cover soil is not possible the effluent pipe should be insulated on top and sides with 2 inch thick foam insulation board and the design engineer should re-evaluate soil cover prior to installation. • The effluent pipe should be double encased with larger diameter Schedule 40 PVC pipe underneath driveway surfaces and be provided with at least 48 inches of soil cover and be insulated on top and sides with 2 inch thick foam insulation board. • All 90 degree bends should be installed using a 90 degree long-sweep or by using two 45 degree elbows. Effluent Pumping System • An Orenco PF3005, 115 volt, submersible effluent pump with a 1.25 inch diameter discharge assembly, or equivalent, will be required for the effluent pumpIng. • The maximum effluent transport distance from the pump discharge to the treatment area manifold is estimated to be 50 feet. • The elevation difference from pump discharge to the dose tank is estimated to be 10 feet. • The pump should be enclosed in an Orenco Biotube Pump Vault for effluent filtering and protection of the pump from vibration. Job No. 114 393A ~tech - 8 - • An equivalent pump must be capable of operating at 26.3 gallons per minute at 22.1 feet of total dynamic head. A pump performance curve is provided as an attachment to this report. • The floats should be set to provide a dose volume of approximately 45 gallons. To achieve the desired dose volume the upper ("ON") and lower ("OFF") floats should be set approximately 4 inches apart. • The high water alarm float should be placed approximately 3 inches above the "ON" float in the dose tank. • A VB inch diameter weep hole should be drilled in the effluent transport line prior to exiting the dose chamber so the transport line can drain after each pumping cycle. OWTS OPERATION AND MAINTENANCE The OWTS will require periodic inspection and maintenance to function properly. A properly designed, installed and maintained system can greatly increase the lifespan of the OWTS. The level of maintenance will vary with the complexity of the system and water use habits of the residents. We recommend that an Operation and Maintenance (O&M) Manual be developed for the system to ensure that it is properly maintained. Depending on the complexity of the system a contract with an OWTS maintenance provider may also be prudent. Below are some basic recommendations for the O&M. OWTS HOUSEHOLD OPERATION • Use of high efficiency water fixtures is recommended to decrease the hydraulic load on the OWTS. • Fix plumbing leaks immediately as this may cause a hydraulic overload of the soil absorption system. • Do not irrigate the area on top of or directly up gradient of the soil absorption system as this may cause a hydraulic overload. • Do not dispose of household waste down household drains as this may clog or damage OWTS components. Examples of household waste that should not be Job No. 114 393A ~tech - 9 - disposed of in drains include: dental floss, cotton swabs, coffee grounds, paper towels, feminine products and many other kitchen and bath items. • Use of kitchen garbage disposals is not recommended for households served by an OWTS. If a garbage disposal is utilized, kitchen wastewater should be screened thoroughly. Many kitchen solids are not decomposed in the septic tank and may cause increased pumping frequency. • Do not dispose of household chemicals, greases, oils, paints, hot tub water or water softener backwash in household drains. A separate drywell, if feasible, may be necessary for hot tub water or water softener backwash disposal. • Limit the use of bleach as this may harm useful bacteria in the septic tank and soil absorption system. • Liquid dishwasher and clothes washer detergent is recommended for households served by an OWTS. Clay substances used as fillers in powder detergents may result in clogging of the soils absorption system. • The water in septic tanks can freeze during extended periods of non-use. We recommend that second homeowners install a tank heater to help prevent freezing. OWTS MAINTENANCE • Inspect the septic tank, dose chamber, pump vault and soil treatment area at least annually for problems or signs of failure. • The pump vault filter should be cleaned annually by spray washing solids into the first chamber of the septic tank. • Septic tank should be pumped and cleaned every 3 to 5 years depending on use. Longer pumping intervals may increase the amount of solids that reach the soil absorption area, which may shorten its life span. • Pumping should take place when the level of the sludge and scum layers combined take up 25 to 33% of the capacity of the first chamber of the septic tank. OWTS CONSTRUCTION OBSERVATION The Garfield County Environmental Health Department requires that the designer provide an As-Built certification of the OWTS construction. We should be provided with at least Job No. 114 393A ~tech -10- 48 hour notice prior to the installer needing inspection. Prior to issuance of our certification letter, we require observation of all system components prior to backfill. The number of site visits required will be dependent on the installer's construction schedule. LIMITATIONS We have conducted this study in accordance with generally accepted engineering principles and practices in this area at this time. We make no warranty either expressed or implied. The conclusions and recommendations submitted in this report are based upon the site conditions, data obtained from the profilt? pits, percolation test holes, soil texture analysis, the proposed type of construction and our experience in the area. Variations in the subsurface conditions may not become evident until excavation is performed. If conditions encountered during construction appear different from those described in this report, we should be notified so that re-evaluation of the recommendations may be made. This report has been prepared for the exclusive use by our client for design purposes. We are not responsible for technical interpretations by others of our information. As the project evolves, we should provide continued consultation and field services during construction to review and monitor the implementation of our recommendations, and to verify that the recommendations have been appropriately interpreted. Significant design changes may require additional analysis or modifications to the recommendations presented herein. It is our opinion that the designed location of the OWTS does not violate any setback requirements of the current Garfield County Regulations. (c) “Mortgage”: A mortgage, deed of trust, or other security instrument, including one evidenced by electronic means authorized by law. (d) “Policy”: Each contract of title insurance, in a form adopted by the American Land Title Association, issued or to be issued by the Company pursuant to this Commitment. (e) “Proposed Insured”: Each person identified in Schedule A as the Proposed Insured of each Policy to be issued pursuant to this Commitment. (f) “Proposed Policy Amount”: Each dollar amount specified in Schedule A as the Proposed Policy Amount of each Policy to be issued pursuant to this Commitment. (g) “Public Records”: Records established under state statutes at the Commitment Date for the purpose of imparting constructive notice of matters relating to real property to purchasers for value and without Knowledge. (h) “Title”: The estate or interest described in Schedule A. 2. If all of the Schedule B, Part I—Requirements have not been met within the time period specified in the Commitment to Issue Policy, Comitment terminates and the Company’s liability and obligation end. 3. COMPANY’S RIGHT TO AMEND The Company may amend this Commitment at any time. If the Company amends this Commitment to add a defect, lien, encumbrance, adverse claim, or other matter recorded in the Public Records prior to the Commitment Date, any liability of the Company is limited by Commitment Condition 5. The Company shall not be liable for any other amendment to this Commitment. 5. LIMITATIONS OF LIABILITY (a) The Company’s liability under Commitment Condition 4 is limited to the Proposed Insured’s actual expense incurred in the interval between the Company’s delivery to the Proposed Insured of the Commitment and the delivery of the amended Commitment, resulting from the Proposed Insured’s good faith reliance to: (I) comply with the Schedule B, Part I—Requirements; (ii) eliminate, with the Company’s written consent, any Schedule B, Part II—Exceptions; or (iii) acquire the Title or create the Mortgage covered by this Commitment. (b) The Company shall not be liable under Commitment Condition 5(a) if the Proposed Insured requested the amendment or had Knowledge of the matter and did not notify the Company about it in writing. (c) The Company will only have liability under Commitment Condition 4 if the Proposed Insured would not have incurred the expense had the Commitment included the added matter when the Commitment was first delivered to the Proposed Insured. (d) The Company’s liability shall not exceed the lesser of the Proposed Insured’s actual expense incurred in good faith and described in Commitment Conditions 5(a)(i) through 5(a)(iii) or the Proposed Policy Amount. (e) The Company shall not be liable for the content of the Transaction Identification Data, if any. (f) In no event shall the Company be obligated to issue the Policy referred to in this Commitment unless all of the Schedule B, Part I—Requirements have been met to the satisfaction of the Company. (g) In any event, the Company’s liability is limited by the terms and provisions of the Policy. 6. LIABILITY OF THE COMPANY MUST BE BASED ON THIS COMMITMENT (a) Only a Proposed Insured identified in Schedule A, and no other person, may make a claim under this Commitment. (b) Any claim must be based in contract and must be restricted solely to the terms and provisions of this Commitment. (c) Until the Policy is issued, this Commitment, as last revised, is the exclusive and entire agreement between the parties with respect to the subject matter of this Commitment and supersedes all prior commitment negotiations, representations, and proposals of any kind, whether written or oral, express or implied, relating to the subject matter of this Commitment. (d) The deletion or modification of any Schedule B, Part II—Exception does not constitute an agreement or obligation to provide coverage beyond the terms and provisions of this Commitment or the Policy. (e) Any amendment or endorsement to this Commitment must be in writing [and authenticated by a person authorized by the Company].
